Have you discussed this with her and have her permission to use her when she's past out? Because it is boarderline rape. Granted some tolerence should be gained in that it is your wife who shares a bed and sleeps naked with you, obviously there is always that possible "expectance" of some sort of sexual activity. But from my personal moral standpoint...this is just what I think if it was me in the situation, not that I feel it should be this way for everyone...I have A LOT more respect for women that I am involved with than that, so would never do it without having a general discussion about it and having that permission to use her body as I please when she is sleeping; and even then, I probably could still never bring myself to actually doing it. Unless you have some type of agreement in place, it is rape. No gray area. If you're in the US and she chooses to take it to the authorities you could easily be prosecuted.

I suggest talking with her about it while she's sober and see how she feels. What if she really doesn't know? She might consider your activities a serious breach of trust.

Not exactly, the wonderful thing about the US is almost anything is legal if you (can) pay enough for the lawyer. And a case like this, unless she flat out lies about not having drank that night, and even then, it's her word against his as to whether she consumed alcohol, as I'm sure it'd be out of her system by the time any testing is done. But basically if she admits to drinking, even occasionally, then a good lawyer will get the case thrown out in that she could have just been too drunk to remember agreeing to sex.
