    New rule attempts to address immigration loopholes; Ray Bogan reports from Washington, D.C.

    A federal judge decided Wednesday to leave in place a Trump administration rule that imposes restrictions on individuals seeking asylum in the United States if they passed through a third country on their way to the border between the U.S. and Mexico, potentially leading to a sharp reduction in Central American migrants entering the country.

    The rule, published in the Federal Register last week, requires people seeking asylum to first apply in one of the countries they pass through on their way to the U.S., with certain exceptions. The rule was quickly met with a legal challenge from advocacy groups, who moved for a temporary restraining order blocking the rule. After a hearing in Washington, D.C. federal court, District Judge Timothy J. Kelly denied the motion. The rule will remain in place for the duration of the case, unless the decision is successfully appealed.


    "We are disappointed in the court's decision today," said Claudia Cubas, litigation direction for the Capital Area Immigrants' Rights Coalition.

    Kelly, who was appointed to the bench by President Trump said the immigrant advocate groups who filed the lawsuit did not show that their work would be irreparably harmed if the policy moved forward.

    With certain exceptions, the rule requires individuals to apply for and be denied asylum in another country in order to apply in the U.S. That means that migrants from Central American nations who travel through Mexico – who make up a significant portion of recent asylum seekers – will not be eligible for asylum in America unless they previously applied for asylum in Mexico or any other country they traversed and were turned down.

    The new rule’s exceptions include certain cases of human trafficking.

    The rule is meant to crack down on asylum seekers coming to the U.S. more for economic reasons than to escape persecution in their home countries. Administration officials say this could help close the gap between the initial asylum screening that most people pass and the final decision on asylum that most people do not win. The goal in part is to allow quicker determinations in these cases.

    The policy follows the Trump administration's Migrant Protection Protocols, commonly referred to as the "remain in Mexico" policy. Under that policy, asylum seekers were often told to go back to Mexico to await hearings, rather than be allowed to remain in the U.S.

    Democrats railed against that policy, with 2020 hopeful Beto O'Rourke calling it "inhumane."

    A reduction in asylum seekers would ease the burden on federal agencies currently overwhelmed by the volume of individuals seeking entry into the U.S.

    Detention facilities have been notoriously stretched for resources, resulting in outcries against the government. The criticism has particularly been strong when it comes to the conditions in which migrant children have been kept.

    The coal industry's slump has hit Texas.

    For the first time since the Electric Reliability Council of Texas began collecting data on the state's fuel mix in 2003, wind surpassed coal as an energy source during the first half of this year, according to data released this month. The ERCOT report shows that 22% of the state's energy was derived from wind, overtaking coal by 1%.

    The slight shift doesn't mean that wind energy is dominant in Texas' fuel mix. The use of wind and coal are both dwarfed by natural gas, which accounts for about 40% of the state's energy.

    The change does, however, illustrate the steady growth of an industry that has been on the rise for years, said Dr. Andrew Swift, a professor at Texas Tech University's National Wind Institute and its associate director of wind energy education.

    'I know a lot about wind,' Trump says: A government FAQ proves he doesn't

    Swift told USA TODAY that while building new coal plants requires a significant investment, wind farms are more of an "incremental investment."

    "There's lots of new wind capacity going in as coal plants are getting older," Swift said. "It's hard to build new [coal plants]; it's risky, it's expensive. You don't know where public policy is going to be."

    He added that wind energy has become a "significant contributor" to the fuel mix in part due to the decreasing cost of harvesting wind energy, the production of more efficient machinery, and the state's support for wind energy development.

    "Texas leads the nation in installed wind capacity by a significant amount," Swift said. "It's been growing since the turn of the century."

    The growth of wind energy is only likely to continue — most of the new energy generation projects being considered for the ERCOT region are utility-scale solar and wind projects.

    A recent report from Rice University concluded that the Lone Star State could easily survive without coal, the Houston Chronicle reported in January.

    “There is no where else in the world better positioned to operate without coal than Texas is,” Dan Cohan, an associate professor of civil and environmental engineering at Rice who co-authored the report with a student, Joanna Slusarewicz, was quoted by the newspaper. “Wind and solar are easily capable of picking up the slack.”

    Coal comeback? Trump plan breathes new life into aging power plants, but critics say climate will suffer

    The shift comes as the coal industry continues to suffer losses in Texas, which, historically, has been among the country's leaders in electricity produced from coal, according to the U.S. Energy Information Administration.

    A 470-megawatt plant near Bryan announced it would shut down by October, the Chronicle reported this month. That follows the closures last year of three Vistra Energy plants with the combined generation capacity to power at least 800,000 homes.

    The news is equally depressing for coal elsewhere. The fourth major coal company since last October filed for bankruptcy earlier this month, jeopardizing some 2,000 jobs across four states.

    The bankruptcy filing from Revelation Energy LLC and its affiliate Blackjewel LLC, the nation's sixth-top coal producing company in 2017, comes amid President Donald Trump's ongoing efforts to boost the struggling industry.

    During his 2016 presidential campaign, Trump promised to revitalize coal and save miners' jobs, despite scientists linking the burning of the fossil fuels to global warming, but the industry has continued to suffer losses.

    Coal’s share of the U.S. electricity mix fell from 48% in 2008 to 27% in 2018 and is projected to be 22% in 2020, according to the Department of Energy.

    President Donald Trump has been given the green light by the Supreme Court to use military funding to build the United States-Mexico border wall along the southern border.

    In what President Trump describes as a “win” for both border security and the rule of law in the United States, the Supreme Court has sided against a lower court and with the administration in their decision to allow military funding to be used to build the famous border wall.

    The Hill reported:

    The administration had asked the justices earlier this month to temporarily pause lower court rulings that blocked officials from tapping some of the diverted Pentagon dollars for border wall construction.



    Solicitor General Noel Francisco argued that the needs of the administration outweighed those of groups like the American Civil Liberties Union and Sierra Club who are challenging the use of the Defense Department funds for the wall. And he said that if the funds remain frozen until the end of the fiscal year, authorities may not be able to use them at all.

    U.S. District Judge Haywood Gilliam in California, an Obama appointee, issued a permanent injunction blocking officials from utilizing $2.5 billion of the roughly $6 billion in diverted military dollars, siding with the groups’ arguments that building the wall would cause “irreparable harm” to their interests at the border.


    Still, four of the court’s liberal judges dissented against the majority’s decision, showing the importance of President Trump’s election. Without Supreme Court Justices Brett Kavanaugh and Neil Gorsuch, it is likely the border wall funding would remain locked behind congressional approval.

Among the reasons is that the Government has made a sufficient showing at this stage that the plaintiffs have no cause of action to obtain review of the Acting Secretary’s compliance with Section 8005. The District Court’s June 28, 2019 order granting a permanent injunction is stayed pending disposition of the Government’s appeal in the United States Court of Appeals for the Ninth Circuit and disposition of the Government’s petition for a writ of certiorari, if such writ is timely sought.Should the petition for a writ of certiorari be denied, this stay shall terminate automatically. In the event the petition for a writ of certiorari is granted, the stay shall terminate when the Court enters its judgment.

    JUSTICE GINSBURG, JUSTICE SOTOMAYOR, and JUSTICE KAGAN would deny the application. JUSTICE BREYER, concurring in part and dissenting inpart from grant of stay.

    Even without congressional approval and with lower courts stymieing progress, President Trump has still managed to build hundreds of miles of border wall. The president said last month that over 400 miles of wall would be completed by 2021.

    While being interviewed by phone on Fox News’ morning show “Fox & Friends”, President Trump revealed that his administration will have completed more than 400 miles of border wall by the end of 2020, despite tremendous opposition from Democrats and obstructionists.

    “So the wall is going up, it’s going up rapidly, we’re going to have over 400 miles of wall built by the end of next year,” said President Trump. “Tbe wall is very important. It’s hard to breach it, it’s high, it’s strong, it’s powerful, and it’s going up at a much lower cost than the wall that was planned prior to me getting there.”

    President Trump also remarked on the state of the previous border barrier the Obama and Bush administrations were building prior to his election.

    At this point it seems as though the completion of the border wall is all but certain

    President Trump on Sunday announced that Texas GOP Rep. John Ratcliffe, a staunch White House ally, will replace Dan Coats as director of national intelligence (DNI), following months of speculation and public spats between the president and the intelligence community.

    The move prompted immediate outrage from many top Democrats who accused the president of seeking to appoint a blindly loyal yes-man to the key post.

    A source close to the matter told Fox News that Coats never saw his 2017 appointment as a long-term proposition. Ratcliffe has been well-versed in the intelligence community after driving key sections of ongoing Republican-led probes into apparent Foreign Intelligence Surveillance Act (FISA) abuses by the FBI and Justice Department, Fox News is told.

    Coats submitted his letter of resignation to President Trump on Sunday. Part of it read: "The Intelligence Community is stronger than ever, and increasingly well prepared to meet new challenges and opportunities. As we have previously discussed, I believe it is time for me to move on to the next chapter of my life."

    WASHINGTON (AP) — The Treasury Department said Monday it expects to borrow $433 billion in the current July-September quarter. That would be the largest quarterly borrowing total since early 2018, as the government replenishes its cash reserves following the expected resolution over raising the debt limit.

    Treasury said the $433 billion in borrowing it expects this quarter, through selling Treasury bonds and bills to the public, would be the largest quarterly total since it borrowed $488 billion in the January-March quarter of 2018.

    Market borrowing for this budget year is projected to total $1.27 trillion, a 6.5% increase from the $1.195 trillion borrowed in the 2018 budget year.

    The rising borrowing needs reflect that the government's deficit is increasing. In its February budget submission, the Trump administration projected the deficit will top $1 trillion this year.

    The Democratic-controlled House last week approved a bipartisan debt and budget deal that the Senate is expected to pass this week. That measure suspends the current $22 trillion debt ceiling for two years until July 31, 2021.

    That will allow the government to borrow as much as it needs to pay its bills until the new deadline without facing the threat of a potentially devastating default on the nation's debt.

    Treasury had initially estimated it would need to borrow $160 billion this July-September quarter but that was before House Democrats struck a budget and debt deal last week with the Trump administration, ahead of a fall deadline for action.

    This is actually right out of the Bernie Sanders campaign when he actually took Americans to Canada this last week so they could buy life saving drugs at prices they could afford. And how about this you Trump supporters. Importing drugs from Canada is socialism. And proves the only reason drugs are cheaper in Canada is because they have universal healthcare.
