    Pelosi's impeachment delay opens cracks in Democratic caucus

    Cracks began to appear Wednesday in congressional Democrats' support for Nancy Pelosi’s prolonged delay in sending articles of impeachment to the Senate, with several lawmakers saying it's time for the House speaker to get on with it.

    Rep. Jahana Hayes, D-Conn., said she voted last month to impeach President Trump over urgent concerns about his conduct and argued that handing the case over to the Senate is the right thing to do.

    “I trust the speaker's judgment, but I voted on these articles when they were presented because I felt that we were at a point where it needed to happen,” said Hayes, a freshman member. “So personally, I'd like them to go forward.”


    Across the Capitol, Senate Democrats began to question whether Pelosi’s delay strategy undermines their argument that Trump’s conduct warrants serious and urgent attention.

    “We are reaching a point where the articles of impeachment should be sent,” Sen. Richard Blumenthal, D-Conn., told reporters Wednesday.


    Other senators questioned what kind of leverage Pelosi has over the Senate.

    “I respect the fact that she is concerned about the fact about whether or not there will be a fair trial. But I do think it is time to get on with it,” Sen. Chris Coons, D-Del., told Politico.

    Although House Democrats voted to impeach Trump on Dec. 18, Pelosi declined to promptly send the articles over to the Senate for a trial over concerns that Senate Majority Leader Mitch McConnell was coordinating with the White House and tilting the playing field -- as Democrats sought assurances that the Senate would call certain witnesses. McConnell, R-Ky., has made no such promises, insisting that the trial begin and lawmakers determine how to proceed on potential testimony later.


    Several House Democrats said they are not privy to Pelosi’s strategy that led to this impasse, but they hold out hope that she can still extract concessions to allow witnesses and new evidence in a Senate trial.

    “We're behind the speaker and we think that she will have the best sense of when the Senate will stop their threats of nullifying the whole process,” said Rep. Jamie Raskin, D-Md.

    Rep. Raja Krishnamoorthi, D-Ill., said the delay tactic could shake loose a few GOP senators to join Democrats in allowing new evidence and witnesses.

    "Certainly, I think the president does want this total absolute exoneration, in all caps, to happen, ASAP. And I think that perhaps, Mitch McConnell or four Republican senators would join with Democrats to call for a fair process," he said.


    Rep. Hakeem Jeffries, D-N.Y., said he supports Pelosi’s decision to hold onto the articles for assurances of a fair Senate trial. With the additional disclosure of documents and former National Security Adviser John Bolton stepping forward as a potential witness, the delay has opened the door for Democrats to bolster their case.

    “Additional documents subsequent to the speaker's decision to hold the articles have come out. That's a gain in terms of information to the American people,” Jeffries said.

    House Intelligence Committee Chairman Adam Schiff left open the possibility that Bolton could appear before the House if the Senate does not call him.



    While Hayes holds out hope that senators will keep an open mind, she doesn't think the House should call Bolton back.

    As my RedState colleague Bonchie wrote yesterday, Sen. Chris Murphy (D-CT) became the first Senate Democrat to “fold like a cheap suit” and demand House Speaker Nancy Pelosi (D-CA) finally send over the articles of impeachment that she’s been withholding ever since the vote was taken last month.

    Since Murphy’s call, and since the news broke that Sen. Majority Leader Mitch McConnell (R-KY) had the votes to proceed with the Senate’s impeachment trial on his terms, other Senate Democrats are lining up to wave the white flag as well – with some even telling Pelosi to either send them now or don’t send them at all.


    The Politico reports:

    “The longer it goes on the less urgent it becomes,” said Sen. Dianne Feinstein (D-Calif.). “So if it’s serious and urgent, send them over. If it isn’t, don’t send it over.”

    Several other Senate Democrats also showed their impatience with the Democratic leaders’ current strategy. Sen. Joe Manchin (D-W.Va.) said Wednesday morning that Democrats “should move on” and turn the articles to the Senate and Sen. Jon Tester (D-Mont.) said he’s “ready” for the trial to start.

    “We need to get folks to testify and we need more information … but nonetheless I’m ready,” Tester said. “I don’t know what leverage we have. It looks like the cake is already baked.”

    “I respect the fact that she is concerned about the fact about whether or not there will be a fair trial. But I do think it is time to get on with it,” said Sen. Chris Coons (D-Del.).

    There are also concerns among Senate Democrats that further delays will negatively impact the Democratic senators who are running for president:

    But some lawmakers said privately they are worried this sparring match with McConnell is no longer viable, worried about the political ramifications of dragging it out into the Democratic presidential primaries.

    And several Senate Democrats said publicly that the pressure campaign has outlived its usefulness.

    “We were ready on the day the articles were voted, to conduct the trial,” added Sen. Richard Blumenthal (D-Conn.), who otherwise praised Pelosi for putting a focus on process over the past three weeks. “At some point it’s appropriate to send them and in effect pass the baton to senators who are going to continue to insist on witnesses and documents.”

    Even CNN is noting Pelosi is losing Democratic senators when it comes to her delay tactics on sending the articles of impeachment:

    Speaker of the House Nancy Pelosi just held a press conference where she essentially said she will send the articles of impeachment to Moscow Mitch when she is damn good and ready. And there must have been a lot of phone calls going back and fourth between her and Democrats in the Senate and meetings in the House because most the Democrats that were telling her send the articles yesterday seem to be backing off. And that is probably because Pelosi hinted they have new evidence and she and Schiff need a little more time to document it.

    And she also said that Trump nearly starting a war with Iran that could turn into a world war has now become more critical than impeachment and they have to make their top priority and pass a war powers resolution to make sure Trump cannot start a war without Congressional approval.

    She said they will be putting that on the floor today and allowing quite a bit of time for members of the House to debate the resolution. Which in a way is telling the press and public there will be some great TV today.

    Another thing I really like about Speaker of the House Nancy Pelosi is a lot of people don't get it but she has just a wickedly dry sense of humor that is just funny as fuck.

    And that was also on display during her press conference when she brought up the lie that Democrats don't get anything done and she pointed to the USMCA which she said was passed in the House with overwhelming bipartisan support and is enthusiastically endorsed by Trump. So if they want to get things done why doesn't Moscow Mitch bring that to the floor for a vote and get it passed? She said with a wry smile and a little gleam in her eye.

    And you would have to be really following things to see the humor in that. Because what she is actually eluding to is that behind the scenes Moscow Mitch is up to his ass in alligators with his own caucus who are throwing a fit over the USMCA and threatening to hold it up for months while they hold multiple hearings for multiple committees because Pelosi just rolled Trump on it getting all the Democratic priorities included in it while cutting out the things the Republicans wanted. And not only that but set them up where their biggest donors like the drug makers are screaming you can't fucking pass this after all the millions of dollars we have given you to protect us. We are the ones getting fucked here.

    I literally busted out laughing at that because Pelosi has them by the balls and they know it. Trump is desperate and screaming for that win and no matter how much they hate the USMCA they won't be able to amend it and will either have to pass it or deprive Trump from one of his only wins.

    The House of Representatives just moments ago passed a resolution to inform President Trump that he can not do anything against Iran unless he goes to Congress and gets approval for it first. They might as well have passed a resolution to say Trump can’t get a Big Mac at McDonald’s unless he has a coupon. That is just how meaningless this is.

    The separation of powers enshrined in the Consitution is a VERY important aspect of our republic. This spat between Article I and Article II branches should always be had to keep the people informed and our elected officials honest.


    However, this is not the way to do it. According to Axios

    The House voted 224-194 on Thursday in favor of a symbolic war powers resolution directing President Trump to halt the use of military force against Iran unless he obtains approval from Congress.

    Even if it was passed by the Senate, the House resolution is non-binding and would not go to the president’s desk for a signature. Speaker Nancy Pelosi said at a press conference Thursday, “This is a statement of the Congress of the United States. I will not have that statement diminished by having the president veto it or not.”

    Nancy as of late seems to be all about rush with no substance. She had to rush the Impeachment articles through because the very essence of the republic was at stake yet the Senate awaits her to send those over after three weeks.

    This meaningless resolution is another example of rushing something through to say something is being done. If you are truly worried about the President overstepping his bounds than set up the hearings and let’s roll. The only problem is Nancy has some vulnerable Democrats in Trump districts that can’t afford to sit through all the horror stories of what Solieimani did and say Trump acted inappropriately or outside his role as President.

    Also, the Senate will never pass this so what we had was a dog and pony show with a paper pony and a sick dog.

    Seems that Pelosi will do ANYTHING other than sending the impeachment papers over to the Senate and is just wishing that she goes to sleep one night and wakes up and it is November. While the Speaker can wish for that all she wants, you should know how the old saying goes…

    Wish in one hand and crap in another and see which one fills up first.

    Hopefully, Nancy just chooses to send the impeachment papers to her friend Mitch sooner, rather than later.

    Senate Majority Leader Mitch McConnell could not have delivered a clearer message to House Speaker Nancy Pelosi than he did on Wednesday. Speaking on the Senate floor on Wednesday, he ended the discussion. He said: “There will be no haggling with the House over Senate procedure. We will not cede our authority to try this impeachment. The House Democrats’ turn is over. The Senate has made its decision. This is for the Senate, and the Senate only, to decide.”

    McConnell told his colleagues, “Pelosi wanted leverage — leverage to reach into the Senate and dictate our trial proceedings to us. Now I’ve made clear from the beginning that no such leverage exists. And yesterday we made it clear it will never exist.”


    The Senator from Kentucky added, “Fifty-one senators determine what we do and there will be, I’m sure, intense discussion, once we get past phase one, about the whole witness issue.” McConnell insisted that the Senate first receive the articles from the House.


    McConnell was responding to a letter the Speaker had written to her Democratic colleagues following a meeting with them on Tuesday night. Pelosi wrote, “Sadly, Leader McConnell has made clear that his loyalty is to the President and not the Constitution. It is important that he immediately publish this resolution, so that, as I have said before, we can see the arena in which we will be participating, appoint managers and transmit the articles to the Senate.”

    Rep. Mike Thompson (D-CA) attended the meeting and told Politico, “Pelosi’s message is that McConnell has “taken liberty with the facts.” It was just the process of her proposing [the articles] and how that was different from what happened in the Clinton administration.”

    Rep. Henry Cuellar (D-TX) said, “Her message was it’s not a fair process — which, I agree with her.”

    In other words, she is repeating the same tired talking points hoping that her persistence might make a difference to McConnell. It won’t.

    She doesn’t understand that she no longer has any leverage. In fact, it’s baffling that she acts as though she does. She’s tapped into that “creative visualization” again.

    The House had their turn. They chose not to wait for the legal process to play out regarding their subpoenas for former National Security Advisor John Bolton’s testimony and that of former Deputy National Security Advisor Charles Kupperman.

    Mitch McConnell did not try to involve himself in the House impeachment proceedings because he had no constitutional authority to do so. Likewise, as much as Pelosi hates it, she has no authority over the Senate process.

    On Tuesday, McConnell announced that he has the votes to set the rules for the impeachment trial without Democratic support and that he “does not plan to hold a vote on a resolution setting the procedures until the two articles are formally sent to the Senate.”

    At this point, even some Democratic senators are ready to move on. My colleague, Sister Toldjah, posted about this here. Sen. Chris Murphy (D-CT), Sen. Joe Manchin (D-WV) and Sen. Jon Tester (D-MT) expressed readiness to move on.

    Even Sen. Dianne Feinstein (D-CA) has had enough of Pelosi’s gamesmanship. She said, “The longer it goes on the less urgent it becomes. So if it’s serious and urgent, send them over. If it isn’t, don’t send it over. I don’t see what good delay does.”

    Mitch McConnell has been around the block a time or two. The morning after the House voted to impeach President Trump last month, he delivered a powerful speech in which he described the impeachment case against President Trump as “the thinnest, weakest, and shoddiest” since the outbreak of the Civil War and claimed it was “antithetical to the Constitution. Nothing else comes close.”

    He said, “Speaker Pelosi’s House of Representatives just gave into a temptation that every House in American History has managed to resist” and that the impeachment vote had been about “how Democrats feel about the President rather than about his behavior.”

    The Senator pointed out that their minds had been made up on the day Trump was elected, calling the House’s partisan vote the “predetermined end of a partisan crusade.”

    It’s over, Nancy.

    On Wednesday, a federal appeals court ruled that President Donald Trump can now use military funds for the construction of a wall along the southern border.

    In a 2-1 decision, the New Orleans-based Fifth Circuit Court of Appeals reversed a lower court’s ruling that blocked the spending.

    The judges who ruled in favor of the decision were Trump and Reagan appointees and the judge who opposed it was an Obama appointee, according to a Wall Street Journal report.


    Although the case can still be appealed, this ruling was a solid win for President Trump.

    The case can still be appealed further, but the ruling was a win for Trump’s America First agenda. Trump vigorously campaigned on the promise of building a border wall.

    Trump praised the ruling in a tweet Thursday morning, emphasizing that a border wall is “desperately” needed.

    Back in early 2019, Trump stood firm by refusing to sign a spending bill that did not include border wall funding. In doing so, Trump shut down the federal government for 35 days.

    This is welcome news for America First and should be properly followed up with reforms on chain migration and birthright citizenship.

    Probably before the House forced and scurried along the impatient vote, Pelosi should have directed Pencil neck and humpty dumpty to take Bolton as a witness to solidify the the leftist Articles.

    Now...the Senate will hold a trial on the investigation that the House implemented and will provide...eventually, cuz we all know, the Senate is still waiting the arrival of the Articles...
