    The purpose, Cuomo secretary Melissa DeRosa said, was to shield the Democrat’s administration from federal scrutiny from the Trump administration, the New York Post reported.

    U.S. Rep. Elise Stefanik, R-N.Y., demanded that Cuomo and his "senior team" be "prosecuted immediately" in connection with DeRosa’s revelations.

Andrew Cuomo, attempted to walk back an earlier admission that the state withheld COVID-19 nursing home death data on purpose, insisting Friday that the governor's office was "comprehensive and transparent" in responding to records requests from the Trump administration's Justice Department.

    On a phone call with New York's Democratic lawmakers on Thursday, DeRosa reportedly said that Cuomo's administration feared the data about COVID-19 deaths could "be used against us" by the Justice Department in the midst of its federal probe initiated against four states regarding nursing home deaths, including New York.

    "We were in a position where we weren’t sure if what we were going to give to the Department of Justice, or what we give to you guys, what we start saying, was going to be used against us while we weren’t sure if there was going to be an investigation," DeRosa told the lawmakers, according to the New York Post, which first reported the information.

    The statement did little to quell the anger from Republican lawmakers, some who are now calling for a criminal indictment of Cuomo and top staffers for their mishandling of the coronavirus pandemic.

    Rep. Tom Reed, R-N.Y., told FOX Business' Maria Bartiromo on Friday that he would be filing a criminal complaint with local and federal law enforcement for DeRosa's arrest.

    DeRosa's bombshell admission also fueled fury over an earlier discovery by New York Attorney General Letitia James, who said in late January that an investigation by her office revealed Cuomo's administration had undercounted the COVID-19 death toll linked to nursing homes by as much as 50%.

    On Wednesday, the state revealed the number of deaths was actually 15,049 residents in elder care facilities (nursing homes and assisted living/adult care facilities) -- nearly 10,000 more than the state Health Department was reporting on Jan. 27, 2021 -- according to a letter from the State Health Commissioner Dr. Howard Zucker sent to Senate Democrats.

    A top aide to New York Gov. Andrew Cuomo told leading state Democratic lawmakers that the administration had withheld data on COVID-19 deaths at nursing homes to avoid federal scrutiny, according to a bombshell new report.

    The revelation prompted condemnations and even talk of impeachment in Albany, the state's capital. Rep. Lee Zeldin, R-N.Y., wants the Department of Justice to open an obstruction of justice investigation.

    "The families of thousands of dead New York seniors deserve accountability and justice for the true consequences of Governor Cuomo’s fatally flawed nursing home policy and the continued attempts to cover it up. It’s clear what's happening here is criminal," he said.

    The New York Post first reported that Melissa DeRosa, secretary to the governor, told leading Empire State Democrats that the administration feared the data could "be used against us" by the Justice Department during a video conference call.

    On Friday, DeRosa addressed the call, and the governor's office released a transcript and timeline explaining that officials were worried the Trump administration would politicize the situation to attack Democratic opponents.

    "I was explaining that when we received the DOJ inquiry, we needed to temporarily set aside the Legislature’s request [about data on the nursing home crisis] to deal with the federal request first," she said. "As I said on a call with legislators, we could not fulfill their request as quickly as anyone would have liked. But we are committed to being better partners going forward as we share the same goal of keeping New Yorkers as healthy as possible during the pandemic."



    The DOJ began investigating nursing home coronavirus deaths in four states back in August – and New York was one of them.

    "We were in a position where we weren’t sure if what we were going to give to the Department of Justice, or what we give to you guys, what we start saying, was going to be used against us while we weren’t sure if there was going to be an investigation," DeRosa told the lawmakers, according to the Post report.

    Rich Azzopardi, a senior Cuomo adviser, placed some of the blame on the Trump administration.

    "We explained that the Trump administration was in the midst of a politically motivated effort to blame Democratic states for COVID deaths," he said Thursday evening. "And that we were cooperating with federal document productions -- and that was the priority. And now that it is over, we can address the state Legislature. That said, we were working simultaneously to complete the audit of information they were asking for."



    News of the call sparked outrage among state Republicans and other critics of Cuomo’s conduct already incensed over his March 25 directive that ordered thousands of virus-infected seniors back into assisted-living facilities, nursing homes and other long-term care locations.

    "The second most powerful person in state government and top aide to Gov. Cuomo admitted on video to the premeditated and willful violation of state laws and what clearly amounts to federal obstruction of justice," said state GOP Chairman Nick Langworthy. "Andrew Cuomo has abused his power and destroyed the trust placed in the office of governor. Prosecution and impeachment discussions must begin right away."

    Freedom of information data released Wednesday revealed that the nursing home death toll was far higher than previously reported. And those numbers emerged just two weeks after the state’s attorney general found that numbers released before the end of January were also underreported.

    "It seems every decision coming out of the governor's office is about Team Cuomo protecting its own image and own interests," state Assemblyman William Barclay, the chamber’s Republican leader, told Fox News Thursday. "More than 15,000 seniors died in adult-care facilities, but the governor was clearly more worried about a DOJ investigation and political finger-pointing."

    In response to a separate freedom of information request this week, state health officials told the Associated Press that more than 9,000 virus patients had been sent into nursing homes in the state before Cuomo reversed the directive on May 10.

    "This administration intentionally withheld information from the public, from the press, from lawmakers and from the thousands of families who lost loved ones," Barclay said. "This is why closed-door conversations won't cut it. If this doesn't make it painfully obvious that we need to issue subpoenas and hold public hearings, I don't know what will."



    Even Democratic lawmakers on the call pushed back against the administration’s excuses.

    "In a pandemic, when you want the public to trust the public health officials, and there is this clear feeling that they’re not…being forthcoming with you, that is really hard," state Sen. Rachel May said during the call.

    New York Attorney General Letitia James said that the state Department of Health underreported COVID-19 deaths in nursing homes by as much as 50%, according to a report released Thursday.

    The report holds New York Gov. Andrew Cuomo's feet to the fire for his handling of the coronavirus pandemic in the early months of 2020, after he directed nursing homes in the Empire State to accept patients who had or were suspected of having COVID-19. The decision created an onslaught of COVID-19 cases that infected thousands of elderly patients and resulted in hundreds of deaths among the state's most vulnerable population.




    The state Department of Health reported that as of Jan. 27, 2021 there were 5,957 confirmed deaths due to the coronavirus in nursing homes and an additional 2,783 presumed deaths. In assisted care facilities, there were 160 deaths and 52 presumed deaths.

    Cuomo has defended the nursing home policy as in-line with guidance from the Trump administration at the time. The governor was silent Thursday following the new AG report and did not respond to Fox News' immediate request for comment.

    James' report said that government guidance requiring the admission of COVID-19 patients into nursing homes may have put residents at increased risk of harm in some facilities and may have obscured the data available to assess that risk.

    The Office of the Attorney General (OAG) asked 62 nursing homes to provide data about deaths in their facilities.

    In one example, a facility reported five confirmed and six presumed COVID-19 deaths at the facility as of Aug. 3 to the Department of Health, yet reported to the OAG a total of 27 COVID-19 deaths at the facility and 13 hospital deaths — a discrepancy of 29 deaths.


    The report, which revealed the findings of an investigation into allegations of patient neglect and other "concerning conduct" that jeopardized the health and safety of both patients and employees, said that some facilities failed to comply with health protocols to stop the spread of the virus.

    Nursing homes that had low U.S. Centers for Medicaid and Medicare Services Staffing ratings were found to have higher COVID-19 fatality rates.

    In addition, lack of sufficient personal protective equipment for staff, as well as low availability of testing, could have also increased the patients' risk of contracting the virus, the report said.

    About 70% of the nearly 35,000 COVID deaths in New York were people aged 70 and older, according to state data as of Jan. 28.

    Investigations into more than 20 nursing homes whose reported conduct during the first wave of the pandemic presented particular concern are still ongoing, James added.


    "As the pandemic and our investigations continue, it is imperative that we understand why the residents of nursing homes in New York unnecessarily suffered at such an alarming rate," James said in a statement. "While we cannot bring back the individuals we lost to this crisis, this report seeks to offer transparency that the public deserves and to spur increased action to protect our most vulnerable residents."
