    SANTA FE, N.M. (AP) — New congressional boundaries approved by Democrats that divided up a politically conservative oil-producing region in New Mexico don’t violate the state constitution, a judge ruled in an order published Friday.

    Judge Fred Van Soelen wrote that the redistricting plan enacted by Democratic state lawmakers in 2021 succeeded in substantially diluting votes of their political opponents, but that the changes fell short of “egregious” gerrymandering.

    “Because ‘entrenchment’ is the touchstone of an egregious partisan gerrymander which the New Mexico Constitution prohibits, the court finds that the congressional redistricting map enacted under Senate Bill 1 does not violate the plaintiff's equal protection rights,” the judge wrote.


    An attorney for the state Republican Party indicated that the decision will be appealed to the New Mexico Supreme Court. A final decision could influence which party represents a congressional swing district along the U.S. border with Mexico where partisan control has flipped three times in three elections.

    Under the map that's being challenged, Democratic U.S. Rep. Gabe Vasquez in 2022 ousted a first-term Republican incumbent by a competitive 0.7% margin of victory. New Mexico’s 2nd District is one of about a dozen that are in the spotlight nationally as Republicans campaign to keep their slim U.S. House majority in 2024.

    Carter Harrison, an attorney for the state GOP, highlighted the judge’s conclusion that the predominant purpose of New Mexico’s redistricting plan was to entrench Democratic Party officials in power by diluting votes.

    “The court ultimately determined that the closeness of the 2022 election in Congressional District 2 — an election where an incumbent Republican and longtime officeholder and candidate in the region lost her election to a Democratic challenger, in a midterm election where Democrats held the White House and lost substantial ground nationally — precludes a finding that this gerrymander rises to unconstitutional levels,” attorney Carter Harrison said in an email Friday. “We respectfully disagree. ... We’re proud of this position, which we believe should be vindicated on appeal.”

    Democrats hold every statewide elected office in New Mexico and its three congressional seats.

    Leading Democratic state senators said they “respect and appreciate” the judge’s decision and that their redistricting plan creates “three competitive urban/rural congressional districts.”

    “We believe and continue to believe that competition in elections is healthy,” said the message from legislators including Senate President Pro Tem Mimi Stewart of Albuquerque and Majority Leader Peter Wirth of Santa Fe.

    During trial last week at a Lovington courthouse in an oil-producing region near the Texas state line, the Republican Party argued that Democrats cut Republican lawmakers out of deliberations as they divvied up a conservative stronghold among three congressional districts that all favor Democrats. An attorney for the Democratic-led Legislature argued that the 2nd District is still competitive.

    Van Soelen ruled against the Republican Party but also rebuffed arguments from Democrats that their map was welcomed in a conservative stronghold. He said the Democratic-led Legislature provided no evidence to back up its assertions that the oil industry would benefit from a map that divvies up the industry in the southeastern corner of the state to provide “multiple voices at the federal level."

    Republican legislators, including a retired oil-pipeline manager, testified at trial that the new congressional map would limit the industry's influence.

    Though Republicans won control of the House from Democrats in the 2022 election, the closely divided chamber more accurately reflects the ratio of Republicans to Democrats among voters nationally than at any time in recent years, according to an Associated Press analysis.

    New Mexico was among several states to use a citizens advisory board with the aim of tempering political inclinations — without taking redistricting powers away from state lawmakers.

    Groups, including Common Cause, said the process resulted in fairer maps. But Republicans in the state's legislative minority argued that they were effectively shut out of the final legislative process amid conversations beyond legislative hearings via email and text messages that were subpoenaed at trial.

    Democrats gained a 12% advantage in voter registrations over Republicans in the newly drawn 2nd District, where major party registration previously was roughly evenly split, Judge Van Soelen noted.

    Democratic Gov. Michelle Lujan Grisham declined at trial to defend the congressional map that she signed into law, citing other pressing demands on her legal team. Her request to delay the trail was denied.

    NEW ORLEANS (AP) — Federal appeals court judges in New Orleans closely questioned voting rights advocates and attorneys for Louisiana Republican officials Friday on whether Louisiana must follow Alabama’s court-ordered path in drawing a new mostly Black congressional district — and how quickly that could and should be done ahead of next year’s elections.

    Louisiana is among multiple states still wrangling over congressional districts after the U.S. Supreme Court decided in June that Alabama had violated the Voting Rights Act when its Republican legislature failed to create a second Black-majority congressional district when it redrew the state’s congressional map after the 2020 census.

    At issue Friday was an injunction by a federal judge that Louisiana Secretary of State Kyle Ardoin and Landry, both Republicans, are fighting. The injunction in 2022 by U.S. District Judge Shelly Dick found that a congressional map drawn up by the Republican-dominated Legislature that year likely violated the Voting Rights Act. The state is about one-third Black but only one of the six congressional districts has a majority Black population. Democratic Gov. John Bel Edwards is among supporters of a second mostly Black district.


    On Friday, Judge Jennifer Walker Elrod, one of three judge's hearing the case at the 5th U.S. Circuit Court of Appeals, raised the possibility that the injunction, which orders a new congressional map for 2024, could be upheld while also allowing a trial on the merits of the case that could alter the map again before the 2026 election. But Elrod also suggested the court might toss the 2022 injunction with orders for an expedited trial process aimed at assuring the issues are settled before next year's elections.

    Elrod and Judge Leslie Southwick both took pains to stress during Friday's hearing that their questions shouldn't be construed as an indication of how they will rule in the Louisiana case.

    Members of the Republican-dominated Legislature have resisted drawing a new minority district, despite the Alabama case.

    Southwick at times seemed skeptical of the state's argument that the injunction should be reversed because the state had too little time to prepare its case.

    “What would another hearing do that you didn’t have an opportunity to deal with, whatever it was, in 2022?” he asked attorney Jason Torchinsky, who represented Attorney General Jeff Landry.

    Abha Khanna, representing voting rights advocates, argued that the injunction must be upheld and that a move toward drawing up new districts must get underway quickly.

    “The plaintiffs should not be forced to play chicken with the election calendar,” she said.

    Members of the Republican-dominated Legislature have resisted drawing a new minority district, essentially ignoring the Alabama case.

    Phillip Strach, an attorney for Ardoin, argued that race cannot be used to “stitch together” distant areas into a single district. He argued that a proposed Black district linking parts of the Baton Rouge to rural north Louisiana's Mississippi Delta country violates court precedents for compact districts.

    Voting rights advocates suing the state argue that the plans they have suggested so far are “on average more compact” than the plan the state is trying to preserve. And they cited evidence that the district linking Baton Rouge and the Delta joins communities of similar social and economic interests.

    The outcome of the cases could have major implications on the makeup of the next Congress if they result in more predominantly Black — likely Democratic Party-leaning — districts.

    Elrod and Southwick were both nominated to the 5th Circuit by former President George W. Bush. Also hearing the case by way of a remote connection was Judge Carolyn Dineen King, nominated to the court by former President Jimmy Carter.

    Delta County Commissioner Don Suppes announced on Tuesday he’ll support Grand Junction attorney Jeff Hurd over Boebert in the Republican congressional race for District 3. Suppes told WesternSlopeNow.com that Boebert’s neglect of vital water and energy issues played a part, but her show-stopping antics at the Buell Theatre in Denver sealed his decision. Boebert was kicked out of the theatre for vaping, being loud, and groping her date. Mesa County Commissioners Cody Davis and Bobbie Daniel also announced they’ll endorse Hurd over Boebert.

    Republicans have won the race to determine the next governor of Louisiana, flipping the state from Democrat control in the first major contest ahead of the 2024 elections.

    Louisiana Attorney General Jeff Landry was declared the clear winner in Saturday's jungle primary, reaching the 50% vote threshold needed to avoid a runoff. The Associated Press called the race.

    Landry and Democrat Shawn Wilson were considered the front-runners in the crowded race to replace term-limited Democrat Gov. John Bel Edwards.

    As the first major test for Republicans and Democrats ahead of the 2024 elections, the outcome could signal momentum for Republicans going into this year's remaining races, as well as the presidential election year.

    Wilson received an endorsement from Bel Edwards early in the race, and told Fox News Digital earlier this week that his experience working across the aisle showed he had the ability to govern over a state made up largely of conservatives despite being a Democrat. Bel Edwards served two terms and maintained an above-water popularity under the same circumstances.

    However, Landry told Fox in an interview early on in the race that it was time to end Democrat rule over the state, and ran on a platform of bringing crime in Louisiana under control, as well as improving Louisiana's standing in areas like education and the economy compared to other Southern states.

    Landry was the favorite to win the race, but a range of recent polls suggested neither candidate would reach the 50% threshold on Saturday and would be forced into a November runoff.

    Rep. Lauren Boebert’s (R-Colo.) naughty night at the theater has produced more intrigue after Politico reported Sunday that she spent spent hundreds of dollars at her date’s bar months earlier.

    Hooch Craft Cocktail Bar in Aspen, Colo., had Boebert’s campaign as guests in late July, according to a recent campaign finance filing cited by the outlet.

    The revelation adds credence to reports that Boebert and the proprietor Quinn Gallagher, who were booted from a “Beetlejuice” performance in September for disruptive antics, were in a longer relationship than a first date, as Boebert had hinted. Hooch is a gay-friendly inn that hosts drag shows, which have been an issue for Boebert and other conservatives.

    A drag queen who worked at a Hooch show early in 2023 scoffed at the notion the two were just getting to know each other at the theater performance and said they had been seeing each other for months.

    Boebert and Gallagher were ejected from the Denver theater after vaping, talking and groping each other.

    Boebert initially denied the accusations but surveillance footage forced her to make apologies and excuses.

    “I was a little too eccentric. I am very known for having an animated personality. Maybe overtly animated personality,” the right-winger told One America News Network.

    The $317.48 campaign expense at Hooch was marked down as “event catering,” Politico said. Hope everyone had fun!

    Boebert said she and Gallagher stopped dating after the incident, with Boebert suggesting it was in part because Gallagher was reportedly a Democrat.

The judge noted that if his only charge was possession of a firearm by an unlawful user of a controlled substance he would have gotten 18 months, not 24 months.

    As House Republicans continue to struggle to elect a new speaker, a new Yahoo News/YouGov poll shows that Americans increasingly blame them more than Democrats for the dysfunction on Capitol Hill.

    The survey of 1,675 U.S. adults, which was conducted from Sept. 12 to 16, found that a full two-thirds (66%) now say conservative Republicans deserve at least “some” blame for “the current gridlock in Washington” (up from 7 points since January), while nearly as many (64%, up 11 points) say the same about moderate Republicans.

    In contrast, there has been no change in the number of Americans who say progressive Democrats deserve at least some blame (57%), while the number who say moderate Democrats deserve at least some blame (52%, up 2 points) has barely budged.

    By the same token, Americans were just 5 points more likely back in January — right after the GOP spent 15 tortured, tumultuous rounds of voting trying (and eventually, just barely managing) to elect former Speaker Kevin McCarthy — to blame Republicans (39%) rather than Democrats (34%) “the most” for D.C.’s ongoing paralysis.

    Today, that gap has doubled to 10 points, with 42% of Americans now blaming Republicans the most versus just 32% for Democrats.

    Republicans lukewarm on potential McCarthy replacements
    Internally, there is little consensus among Republicans and Republican-leaning independents about who should replace the ousted McCarthy.

    Less than half (41%) say Ohio Rep. Jim Jordan, the hard-line co-founder of the ultraconservative House Freedom Caucus who was endorsed by former President Donald Trump. Jordan, who was nominated by his colleagues last week to be the party’s candidate for speaker, lost his first attempt to win the gavel on the House floor Tuesday after 20 Republicans voted for someone else.



    However, even fewer say interim Speaker Patrick McHenry (3%) or Trump himself (14%) should be the next Speaker of the House. If “not sure” (33%) and “none of these” (9%) were a candidate, they would have more support than anyone else.

    Few pay close attention to House Speaker drama
    This indecision stems in part from inattention. Just 19% of Republicans (and 17% of Americans overall) say they have been following the current House speaker election “very closely.”

    Retrospective feelings about McCarthy are also rather lukewarm, with Republicans modestly but not overwhelmingly giving his performance as speaker a thumbs down (29% approve, 35% disapprove, 36% not sure) — and modestly but not overwhelmingly favoring his removal (37% approve, 27% disapprove, 36% not sure).

    Yet there are signs that the GOP’s seemingly endless speaker drama has not been good for its brand. A full 63% of registered voters now say the GOP isn’t “paying enough attention to America’s real problems,” up from 59% in January, while even more say Republicans are more interested in scoring political points (64%) than passing legislation (22%). That 42-point margin is twice as large as the corresponding gap on the Democratic side (55% scoring political points, 34% passing legislation).

    Perhaps as a result, approval of “the way Congress is doing its job” has declined significantly this year, falling to 12% from a previous high of 21% in February.

    Nevertheless, partisan polarization remains the most powerful force in American politics. When asked “who you would vote for in the district where you live” if “an election for U.S. Congress were being held today,” 43% of voters say the Democratic Party candidate — and 43% say the Republican.

    In February, Democrats had a 45% to 42% edge.

    "I will not sit back and watch a complete betrayal of the GOP base with this 'plan' that's being discussed," Boebert wrote in a social media post. "I ran because I was sick and tired of politicians coming up here and cutting deals and releasing 'holier than thou' statements about why we just had to accept it."

    Boebert did not explain how she would follow through with her threat to derail the so-called "plan."

    Rep. Lauren Boebert (R-CO) is officially on notice that her next election won't necessarily be an easy one, with strong challengers on both sides of the aisle.

    Boebert, who recently shouted that Republicans who didn't vote for Jim Jordan — and not those who ousted Kevin McCarthy from the speakership role in the first place — are responsible for the fact that "Congress isn't working right now," barely held onto her seat in the last election cycle.

    Now, it appears she's in for another tough round of voting, based on financial reports flagged by The Seattle Times.


    "U.S. Rep. Lauren Boebert is getting squeezed from both sides of the political aisle in the money race as she faces a growing field of challengers hoping to thwart her reelection next year," the outlet reported Friday. "Third-quarter fundraising totals reported in recent days in Colorado’s 3rd Congressional District show the Republican incumbent was outraised by her most prominent Democratic foe, Adam Frisch, by a factor of 4-to-1. And Jeff Hurd, a Boebert challenger in next year’s GOP primary, posted sizable totals indicating he also might pose trouble for the two-term congresswoman."

    The article further states that "Boebert’s haul for the period from July 1 to Sept. 30 was just shy of $854,000."

    "Earlier this month, before filing his full quarterly report, former Aspen city councilman Frisch, who narrowly lost to Boebert in 2022, touted a nearly $3.4 million haul during the same time frame," the article states. "Hurd, a Grand Junction attorney, collected just over $412,000 despite launching his campaign only in mid-August."

    The piece quotes Paul DeBell, an associate professor of political science at Fort Lewis College in Durango, as saying Boebert's troubles stem partly from her own personal drama.

    Rep. Maxwell Frost (D-FL) accused Rep. Lauren Boebert (R-CO) of calling the U.S. Constitution "junk" after she attacked the separation of church and state.

    At a hearing of the Subcommittee on National Security, the Border, and Foreign Affairs on Wednesday, Frost asked witness Amanda Tyler about the violent role of Christian nationalism in America.

    "It uses the symbols and the language of Christianity to try to justify what is indefensible," Tyler explained. "And it turns, again, their hatred into a religious cause, into something that they believe is ordained by God."

    Frost pointed out that Rep. Marjorie Taylor Greene (R-GA) had called Christian nationalism a "good thing."

    And he added, "My colleague, Rep. Lauren Boebert, said, quote, The church is supposed to direct the government. The government is not supposed to direct the church. I'm tired of this separation of church and state junk, end quote."

    Colorado Republicans turn on Lauren Boebert over 'indefensible' Beetlejuice gropefest

    Rep. Lauren Boebert's groping session with a date that led to her being booted from a performance of the "Beetlejuice" play is casting a major cloud over her re-election prospects in 2024 as GOP heavy-hitters in her home state are lining up behind a primary challenger.

    The controversial Colorado Republican, who barely eked out a victory over her Democratic challenger Adam Frisch by a 546 vote margin, now faces the prospect of not winning the GOP primary as the GOp leadership in Colorado admit they are tired of her act.

    In an interview with Time, Delta County Commissioner Don Suppes admitted, "Just after the congresswoman's issues at the theater, I just decided that we had to do something different. So I started reaching out and trying to make sure that we had the right person in that seat for the next election.”

    That, in turn, led to the emergence of challenger Jeff Hurd who has been the recipient of an endorsement from former Republican Colorado Governor Bill Owens who stated, "I am proud to endorse Jeff Hurd for U.S. Congress for the 3rd district. Jeff is a man of character. He is a hardworking, smart and sincere leader who will deliver for the district.”

    According to Time's Mini Racker, "Owens is the most prominent of a handful of Republican officials who have recently announced their support for Hurd, with several citing Boebert’s Beetlejuice scandal as the moment that pushed them over the edge."

    Mesa County Commissioner Cody Davis expressed the dismay the folks in the district are feeling about Boebert's antics, explaining in an email , "I’ve defended Lauren for [two-and-a-half] years now, hoping that things would improve and she’d become a more effective leader. I think she was about to round that corner, and I was complimentary of that, but what she did at Beetlejuice was altogether indefensible.”

    Add to that, Mesa County Commissioner Bobbie Daniel agreed and pointed out Boebert's struggles with voters aren't new but date back to the last election.

    “In the previous election cycle, I received over [4,000] more votes than the sitting Congressional Representative. This showed that conservatives are voting, and thousands did not vote for the incumbent; that's a problem," Daniel explained before adding, "We have to face the fact we can't keep going on this trajectory and keep this seat."

    'Pray less. Act more," was one of the many harsh responses Rep. Lauren Boebert (R-CO) received on Thursday after she extended her thoughts and prayers to the victims of the Maine mass shooting that claimed 18 lives and more than a dozen wounded from gunshot wounds.

    The controversial Colorado Republican who rose to fame by owning a restaurant and bar called "Shooter's Grill" -- since closed -- that featured waitresses packing heat, is facing a furious backlash over her post on X – with many noting she couldn't even bother getting the town's name right.

    The GOP lawmaker, who is facing a serious primary challenge for her seat in the 2024 primary, wrote, "Sending prayers to Lewistown, Maine tonight. Know that the entire country is praying for you."



    That led more than one Boebert critic to point out the shooting occurred in "Lewiston," not "Lewistown," writing, "C’mon Boebert. The shooter is still on the loose and you can’t ever get the town name right. Lewiston. Not Lewistown."

    In that vein, another wrote: "Lewiston. Should have stayed in school and spent less time on the gun range or in the backseat of a truck."

    Another added, "How unbelievable! Plus, she can't even spell the name of the place correctly" with another X commenter agreeing with, "Boebert couldn’t even be bothered to spell Lewiston right!"

    Frequent GOP critic Russell Drew contributed, "Hey, Lauren Boebert, you can take your hollow prayers and shove them where your hand was that night in the Denver theater.,"
    referring to her Beetlejuice groping scandal in mid-September, with another critic joking, "Groping for hope."

    Marjorie Stoneman Douglas High School shooting survivor David Hogg replied, "But house republicans won’t do a f---ing thing about it."

    Similar criticism piled up in her responses, including, "Lauren Boebert NRA rating = A. She's all-in on slaughtering Americans," followed by, "Oh those prayers are really helping... How about passing some common sense gun laws??? Or would that be too much to ask? Make you actually do some work..." and, "Prayers are even less useful than congress when it comes to ending mass shootings."

    One Boebert critic summed up the responses with, "There it is, folks. The world's most predictable tweet."

    Another added a pithy: "SHUT UP."
