There are other writers on these forums who write as well as I do, if not better, about the same subject. Some even disgust me with what they write!

Maybe it's because you get a kick out reading what I write. Perhaps it turns you on and you are ashamed of what my words do you? Maybe my stories are so interesting to you because secretly you longed for your daddy/brother/uncle/ other family member to notice you and take ANY kind of interest in you? If it was abusive, so what, just so long as someone was paying you attention, right?

Too late, it's out there, you've bismirched Lollylover's character as this forum is public to not only members but non members also. Does the term 'libel' mean anything to you? Don't think it wouldn't be an easy enough task for any lawyer worth his or her salt to track you down and call you to book over these accusations. And, to be honest - if I was Lolls, that is the exact route I would take with you. And please, don't think that just because this is the internet that there are not laws protecting users. There are, as there should be. The difference between posting an insult and libellous material is that insults are borne from frustration, this thread however was planned and posted in a totally malicious fashion and could be classed as libellous!! Also the fact that in your OP you posted totally false information (a post by Lolylover was linked and copy/pasted instead of Lollylover) then it shows a definite lack of intellect in your approach to the matter. You posted slanderous and libellous material from one member while directly accusing another.

There actually is a member on the site who posted not only a thread in stories but also something in sexuality about abusing his young daughter. Funny then that you should 'research' Lolls so thoroughly and totally pass this other guy over - it was one of the longest non-story threads in the stories section I think. Here it is. From what I remember about it, reading through the thread, a lot of the replies received were from people actually applauding the OP!! Our moderator, Piggit also provided links to posts the OP had made in the sexuality section of the forum saying that he had/has sex with his underage daughter. Ergo, it would not be libel to call the OP out as a molester and abuser of children, he did that himself. What is it about Lollylover that gets you so hot? Because he's a more 'well known' member on the site?

If you are honest and you are on a vendetta regarding the laws on posting stories involving monors, then you would do well to hold your counsel until such time as you have garnered enough evidence to support the your crusade.

 

Damn I'm glad someone called my attention to this thread and I'm glad I finally found it.

This is one hateful, butt ugly, shameless, slanderous, hurtful, thoughtless, mean spirited thread. Which are all forms of protected free speech especially on this forum.

But what I think is most important about it is the people who posted on it, especially in Lolly's defense did such excellent work. Logic, reason, courage and fighting spirit prevailed. That in and of itself proves the value of allowing even something as offensive as this to take place. That's one reason I'm opposed to banning people in most instances.

In the this instance, however, where the person resorted to impersonation and fraud I don't have a problem with that.

My compliments guys and gals on a brave and intelligent effort.

PS Just a side note and not to argue with the most intelligent and well informed Smaacphd but while I am not well versed in libel laws in the UK from everything I know about US libel laws even something as outrageous as this would not rise to the level of actionable liable in the US.

I have cautioned about this before but for all of us, our participation in this forum essentially negates our claim to being libeled. There are two basic reasons for that.

The first reason is (in the US at least) for libel to be actionable (in other words sue the dog shit out of someone for it) it has to meet ALL THREE of the following tests. 1. The person writing it either knew or should have known that what they were writing was false. 2. The person writing it wrote it with malicious intent. 3. The false and malicious statements were published without giving the subject of the written material a chance to respond.

The second reason is probably less well known but much more important as far as our individual participation on this forum. Even if something written meets all three tests for actionable libel there are two separate categories of protection; private citizens and public figures. Private citizens have much more protection from libel, or it would be more accurate to say that public figures have almost no protection from libel.

Believe it or not we on this forum fall under the category of "public figures" because we have willing agreed to participate in a public forum. It is also nearly impossible to libel a persona which is what we are because we have screen names instead of using our real name. Also Lolly would fall under the category of a public figure almost anywhere because he has chosen to write and publish stories (the same is true for any writer).

Just thought I would throw that out there again because some of us may think we have protections that we don't.

 

And this bit here shows why no-one that anyone says on this forum can be used in court as evidence of libel or slander:

It's an open forum, the victim ALWAYS has time to respond. And if it's accusations being passed around PMs, then it's not slander/libel, it's gossip, and it's no different from the real world.

 

Stumbler and Stargazer - the advent of the internet meant that new laws regarding libel had to be written. This site gives an overview of internet law around the world.

This site on the other hand, goes into the issues of the responsibility and liability of sites hosting message boards and other media where libel can occur.

One cannot assume that due to the anonymity of the internet that one is free from the constraints of the law. The laws of internet libel are not as well founded as the laws of printed media, being as this is a relatively new media available to the masses, but it is being defined and refined daily and one should always be aware that they are responsible for what they type - publicly or privately!!

 

Enough posting on this thread pls. It has left an ugly taste on XNXX's mouth. Let it fad into the abyss of forgotten threads and hopefully never arise again.

Thanks Smcaaphd, I must admit I was not familiar with the precise definitions and precedences of the internet. It is far more complex.

But from reading the information you provided what I said would still hold true. This forum would be considered a common carrier, not a distributor and therefore would not be held liable. Those of us posting on it would meet the definition of public figures, and the anonymity issue would pertain not to the person writing the defamatory information, but to the persona they were writing about. In other words to libel someone on this forum you would have to use their real name not just a screen name.

And the last thing I want to do is defend the OP, which I don't in anyway, but what was written, as despicable as that might be, would be classified as opinion not fact.

The one really dangerous area the OP entered is in the creation of an identical persona and using that persona to make false and malicious statements. But even then it would fall under the definition of parody, which might be enough to get you banned but could not get you sued.
