Actually it is okay for a 16yo to marry a 20yo in most states, as long as the parents and the justice of the peace agree. What isn't okay is for a 20 yo to have sex with a 16 yo, with or without her permission. If you do it, you are very likely to wind up in the county jail.

Some 13 yo's are capable of making life's decisions, most are not.

 

Pick an age where you know it's 100% certain that every person is capable of making such decisions. Then tell me what kind of a test should be given to determine when the person is capable.
