The convicted sex offender accused of raping and murdering California high school senior Chelsea King and burying her body in a shallow grave pleaded not guilty to both counts at an arraignment today in San Diego.

John Albert Gardner III was arrested on Sunday, two days before the body of King, 17, was found 10 feet from Lake Hodges in the park where she went missing on Feb. 25 during an afternoon run.
Amid heightened security around the court house, Gardner was flanked by two court officers. His head was shaved and his hands were manacled around the waist of his blue prison jumpsuit.

This thread is populated almost exclusively by people that I am going to assume are redneck hicks.

That way, I don't have to consider the alternative - that such rampant idiocy is more widespread.

 

1) In the case of Gardner, he had served five of six years for raping an 11 year old. He was given this sentence because the DA didn't want the child to be victimized again by having to testify.

2) The US Supreme Court over ruled a Louisiana/Texas/Arkansas law (2007) that would've given death to child rapists. The Supremes felt that only murder warrants the death penalty.

3) California, like most New England states, has very lenient sentences-for serious offenses. They feel that they're more enlightened and progressive than states like Texas, which locks people up for decades on this kind of thing.

4) With that said, even Texas judges will go soft on certain criminals-with connections. In one case, an 11 year old escaped an abduction by a repeat offender. It turns out that the guy started as a peeping tom, moved on to flashing, then to groping, before he actually raped an 8 year old-for which he too received 6 years. On the attempted kidnapping he got 40 years, finally. On his prior offenses, he got probation because he was hispanic, and the hispanic judges in the "valley" (South Texas) feel that hispanic men have certain rights.

 

In cases of death, and when all reasonable doubt is certain, I think the preperator should be put to death. So that means anyone that has killed a child in a molestation case should die. That includes any adult that is murdered by an individual (not accidental death deemed as manslaughter). We shouldn't spend one extra nickel on people who kill other children/or adults. I don't care if they can be rehabilitated... they took another life and should pay the ultimate penalty. I know it is not politically correct these days to carry out a death sentenance but I think about the innocent victim and all the lives that has been sadly impacted by his/her death. The killer should die, it is not a question of whether the execution will have an impact on others committing the same crime, I don't care. They killed someone and should die. Period. Oh and for people who are repeat sex offenders? In the cases of children, death should await them as well.

 

The problem with the modern prison system is it lies somewhere between rehabilitation and punishment, if you don't punish correctly it won't have a lasting effect and if you don't rehabilitate correctly it won't work either.

In medieval times punishments were much more severe and public punishment, such as someone being in the stocks or public hanging had an effect not only on the criminal but on the general public. I mean I wouldn't want to be the guy with the noose round his neck, but thats besides the point.

The prison system needs to adjust to either a programme of pure rehabilitation or pure punishishment, any grey area is a failure. For either programme to work you need to remove the current judicial system which has inherent flaws and human errors. Unless we have a 100% way of confirming guilt I think to implement capital or corporal punishment would be a huge mistake.

As has previously been mentioned in the case of child molesters and sex offenders we need something other than punishment or rehabilitation, we need treatment because they are ill.

I don't know for sure whether the death penalty is an effective deterrent to murder -- I think it most probably isn't.
The problem I see with applying the death penalty to rape, is that rapists will be more likely to kill their victims to avoid the possibility of identification.
