Boy, 8, accused of intentionally killing 87-year-old woman in Louisiana

An 8-year-old boy intentionally shot and killed an 87-year-old woman at their home in Slaughter, La., authorities said Friday.

Marie Smothers was described only as the boy's "current caregiver." No other information was available on the relationship between the boy and Smothers, who police said was shot in the back of her head late Thursday afternoon as she watched television.

The boy, whose identity wasn't released because he's a juvenile, was released into the custody of his parents pending the investigation, the East Feliciana Parish Sheriff's Office said in a statement. Slaughter is a town of about 1,000 people near Baton Rouge, the state capital.

"Although the juvenile initially told investigators that he accidentally shot the victim while playing with a firearm, the investigation has led investigators to believe that the 8-year-old intentionally shot Mrs. Smothers in the back of the head as she sat in her living room watching television," sheriff's officials said in a statement.

"Although a motive for the shooting is unknown at this time investigators have learned that the juvenile suspect was playing a video game, 'Grand Theft Auto IV,' a realistic game that has been associated with encouraging violence and awards points to players for killing people, just minutes before the homicide occurred," the statement said.

The Baton Rouge Advocate reported that a man who answered the phone number listed for Smothers' address insisted that "it was an accident."

NBC station KPLC of Lake Charles, La., reported that Louisiana law prohibits authorities from charging the child with a crime because of his age.

Armed Man Waiting for Raccoon Accidentally Shoots Self While Sneezing: Police

Police in Connecticut say an 81-year-old man who was lying in wait with a rifle for a pesky raccoon accidentally shot himself after sneezing and falling from a chair.

New Haven police say James Pace Sr. shot himself in the shin at his home Saturday night. The injury wasn't life-threatening.

Pace told authorities that a raccoon had been scratching at his back door for several days and he was waiting for it with a .22-caliber rifle.
Police say he sneezed and fell from his chair, then realized he had accidentally shot himself.

Pace's son drove him to Yale-New Haven Hospital.
Police detectives seized the rifle and are investigating the shooting.

Let's begin this week's installment with an update on one of last week's stories. Remember Terry Dunlap, Sr.? The gun safety instructor who accidentally shot a student in his concealed carry class? Turns out that this wasn't Terry's very first accidental shooting:

Cathy Schmelzer couldn’t believe it when she read in the newspaper that Terry J. Dunlap Sr. — a firearms instructor — had accidentally shot someone.

“Oh no, he’s done it again!” she said she thought to herself. Schmelzer, 50, was Cathy Hessler, a 14-year-old Pickerington girl, when she was accidentally shot in 1977 by Dunlap during a Halloween hayride.

At the time, Dunlap was a Pickerington police department auxiliary lieutenant. According to a Dispatch account back then, Dunlap said he had fired his .38-caliber handgun into the air to create, in his words, a “scary effect” while taking his daughter and her friends for a “haunted hayride” on his rural property in Fairfield County.

Dunlap said he thought the gun was loaded with blanks. But a bullet ricocheted and hit Cathy Hessler in her right leg.

Lots of kid victims this week, averaging out with the low total last week. Ages 2, 3, 3, 4, 12, 12, 14, 15, 15, and 16.

Other especially noteworthy stories: the tragedy in Tennessee, in which a father's accidental discharge of his AR-15 set off an explosion and fire that killed him and his 12-year-old son, and; the day after local hero Antoinette Tuff talked down the would-be school shooter in Atlanta, a security guard at Savannah State University accidentally discharged his weapon into an occupied classroom. Two different approaches to school security, with two very different outcomes.

BRADENTON, FL, 7/27/13: A second person of interest has been identified in the shooting that injured a 4-year-old boy in Bradenton. Detectives are looking to speak with Davian Evans-Dufrene, 21, who may have been in one of two vehicles involved in a shooting at 11:19 a.m. on July 27, according to the Manatee County Sheriff's Office. Authorities initially believed a home had been targeted by a drive-by shooter, but later determined gunfire was exchanged between two vehicles. A stray bullet went through a bedroom window at a home on 26th Street West, striking Davien Martinez. The young boy returned home Saturday after a stint at All Children's Hospital in St. Petersburg. "People in one vehicle were firing at a person in another vehicle and the house was in the background and got hit," said sheriff's spokesman Dave Bristow.

SOLOMON, AZ, 8/11/13: For the third time this year, a report has surfaced of a person accidentally shooting himself. Graham County Sheriff’s Office deputies were dispatched to a residence on the 5000 block of E. Main Street in Solomon at about 11:42 p.m. on Aug. 11 regarding an accidental self-inflicted gunshot wound to the victim’s hand. Upon arrival, a deputy discovered the victim, Ralph Ogas, lying on the living room floor with bloody white towels wrapped around his hand. Ogas allegedly told the deputy that he was unloading his .45 caliber Ruger pistol when he accidentally switched the safety to fire, and a bullet was expelled when he let go of the gun’s slide. The bullet only grazed Ogas’ hand and was described as a “flesh wound” by paramedics from Southwest Ambulance, who treated Ogas at the scene. Ironically, Ogas said he was unloading the weapon to make it safer for his company. He said he keeps his pistol loaded with the slide locked back ready to use for protection but unloads it when he has company over, according to a Sheriff’s Office report. After grazing his hand, the bullet hit a concrete wall, sending shards of concrete onto the couch and other pieces of furniture.

SALISBURY MILLS, NY, 8/16/13: A woman died Friday after she was accidentally shot in Salisbury Mills while handling her boyfriend's pistol, state police said. Kristi Babcock, 30, was holding a gun belonging to Christian Benson at 141 Sycamore St. when it fired.

OPELOUSAS, LA, 8/16/13: A 15-year-old Opelousas teenager has been declared clinically brain dead after a shooting incident on Friday, the first day of school. Opelousas Police Chief Perry Gallow said the teenager didn’t go to school that day, but instead was playing with his brother and two other young men. Exactly what happened is still unknown, but Gallow said it appears the young men had somehow acquired a handgun and were playing with it. For reasons still under investigation, the gun discharged, striking the victim in the head.

DALLAS, TX, 8/16/13: Zackery's misery began last Friday afternoon at the Good Haven Apartments on High Hill Boulevard, not far from the Cedar Crest Golf Course. Dallas police arrived at around 1 p.m. to find the 19-year-old sitting in the front passenger seat of a silver 2007 Honda Civic, blood seeping from a gunshot wound in his leg. What actually happened was that Zackery had accidentally shot himself. She hadn't wanted to say so because he's on probation (he pleaded guilty in March to stealing a car) and, she claimed is a gang member, affiliating himself with the Bloods. She showed officers to a nearby apartment where they recovered the gun -- a Ruger, recently reported stolen in Grand Prairie -- hidden inside Zackery's shoe.

HOWARD CO., IN, 8/17/13: A man was killed Saturday evening in an apparent accidental shooting while he was hunting, police said. Howard County sheriff's deputies were called to the 11300 block of West 100 South, west of Kokomo, just before 6:30 p.m. after dispatchers received a 911 call about the shooting. Witnesses told police the victim, Joseph Steele, 28, had been hunting with family members in a wooded area just south of his home. "Witnesses stated they had split up and at some point had lost sight of the victim. One of the hunters fired at a distance at what he perceived to be a squirrel. Moments later, the victim yelled out that he'd been shot," Howard County sheriff's Capt. Greg Hargrove said in a news release. Steele was shot in the chest, but he was able to talk with witnesses before he lost consciousness.

BROOKLYN, NY, 8/17/13: An NYPD officer is in stable condition after accidentally shooting himself in the leg while holstering his weapon. The NYPD said the incident happened after the officer responded to a domestic dispute in Brooklyn around 8 p.m. on Saturday. The New York Daily News reported that the gun accidentally discharged as the officer was holstering his weapon inside the home in the Bedford-Stuyvesant neighborhood. The officer, who has not been identified, is a rookie, the Daily News reported. The officer was rushed to Kings County Hospital with a gunshot wound to the kneecap.

SUMMERVILLE, SC, 8/17/13: A 77-year-old man accidentally shot himself in the foot at a Summerville gun range, according to the Berkeley County Sheriff's Office. Spokesman Dan Moon says the man was practicing at the firing range at the ATP Gun Shop along College Park Road this morning when the accident occurred. An employee at the ATP Gun Shop told Live 5 that the business has "no comment."

MADISON TOWNSHIP, OH, 8/17/13: A 45-year-old man accidentally shot himself in the hand and left thigh after handling a gun he had just cleaned around 9 p.m. Saturday. The Piper Road area resident told Richland County Sheriff’s deputies he was considering buying a gun from a friend, but it was so dirty he took it home to clean it. The 45-year-old said he cleaned it and put it back in the case. He then pulled it back out to look at it, and pulled the slide back when he hit the decocking lever. “I must have hit the trigger and it went off,” he told deputies, according to sheriff’s reports.

BEATRICE, NE, 8/17/13: A 16-year-old youth was taken to a hospital Saturday, after he was accidentally shot in the leg, about two miles west of Beatrice. Gage County Sheriff Millard “Gus” Gustafson says the 16-year-old was transported to a hospital with a non-life threatening wound to his leg.

BEAUFORT, SC, 8/17/13: A 23-year-old man was hospitalized after he shot himself in the leg early Saturday morning, a Beaufort Police Department spokeswoman said Monday. Beaufort police officers were handling a disturbance at Club Encore on Burton Hill Road caused by a patron who refused to leave at about 2 a.m. Saturday when they heard a single gunshot, Beaufort police spokeswoman Cpl. Hope Able said. Officers found the man injured by a self-inflicted gunshot wound to his leg. He was taken by ambulance to Beaufort Memorial Hospital, Able said.

CHESTERFIELD TOWNSHIP, MI, 8/17/13: A 26-year-old Chesterfield Township man accidentally shot himself in the evening of Aug. 17 while trying to show his girlfriend how to handle and clean a gun, according to police. The man was rushed from his home at the 48300 block of Harbor to a local hospital, where he was treated for a groin wound.

MISSOULA, MT, 8/18/13: A 23-year-old Missoula man died early Sunday morning from a gunshot wound to the chest. Missoula police and emergency responders were called to an apartment complex at 730 Turner St. on the north side of town at 12:05 a.m. by a person who reported an accidental shooting. When police arrived, they found the 23-year-old unresponsive with a gunshot to his chest, said Sgt. Jake Rosling. The alleged shooter is a 21-year-old Missoula man and an acquaintance of the deceased, Rosling said. A third person, who reported the incident, was at the scene at the time of the shooting. Although the incident remains under investigation and details are still emerging, the gun fired was a pistol, Rosling said. UPDATE: The Missoula Police Department has released the name of the Missoula man who was killed by a bullet fired from his own gun early Sunday. Chad Goodman, 23, died after an acquaintance shot him while they were examining and talking about the loaded semi-automatic handgun, police said. The firearm belonged to Goodman, police reported, but Goodman and the other man had exchanged the gun while talking about it.

DUNDEE, MI, 8/18/13: A 3 1/2-year-old boy in southeastern Michigan has died after accidentally shooting himself in the head. Dundee police say Damon Holbrook picked up a loaded gun that belonged to a man who was staying in the home. He was pronounced dead Sunday at a hospital in Ann Arbor. Sgt. Tom Redmond says a man returned from work and left the gun on the floor of a bedroom closet. The man’s name hasn’t been released. He’s in jail on a charge of manslaughter with gross negligence. He’s due in court Monday.

ST. LOUIS, MO, 8/18/13: St. Louis police have released a surveillance image showing two men suspected of firing a gun, and accidentally injuring a 12-year-old girl. Police were called to the 1500 block of Carr around 7:49 p.m. Sunday after two men fired several shots during an altercation in and around Loretta Hall Park near 15th and Cole streets. The suspects ran from the scene north and west, toward O'Fallon Place. A stray bullet hit the hand of a 12-year-old girl playing in the park. She was transported to an area hospital in serious but stable condition.

KESWICK, CA, 8/18/13: A man accidentally shot himself in the leg Sunday evening in Keswick. The shooting occurred at about 12:35 a.m. in the 16000 block of California Street in Keswick, near Sacramento Street, according to dispatchers. Sgt. Steve Grashoff said the man - whose name he did not immediately recall - is a former state prison inmate back in Shasta County through Assembly Bill 109, the state's public safety realignment program. Grashoff said the man slung the shotgun over his shoulder and accidentally shot himself in the back of the knee. He will be charged for possessing the gun, Grashoff said, since offenders on probation aren't allowed to have them.

HURON, TN, 8/18/13: The Tennessee Bureau of Investigation is investigating the deaths of a father and son after a fatal fire reportedly started after the accidental discharge of an AR-15 rifle. According to a TBI spokesperson, the Henderson County Fire and Sheriff’s Departments responded to the fire and explosion in the 2900 block of McCaney Mill Road in Huron, Sunday. Witnesses said that Terry York, 48, who lived at the residence with his family, was showing a friend the AR-15 rifle when it discharged accidentally. The witness told investigators that a fire and possible explosion ensued instantaneously. The person who witnessed the incident was able to escape the engulfed home, but Terry York and his 12 year-old son Luke had to be pulled out of the burning house.

GOLDEN VALLEY, AZ, 8/18/13: A Golden Valley man was wounded in an accidental shooting on Sunday, August 18. The Mohave County Sheriff’s office investigated the incident reported at a swap meet in the 3200 block of N Bacobi Road. Agency spokeswoman Trish Carter said David Allen Matheson, 52, Golden Valley was transported to Kingman Regional Medical Center for treatment of a non-life threatening gunshot wound to his upper left leg. Carter said Matheson told deputies his .45 caliber handgun accidentally discharged when he was loading an ammunition magazine.

JENNINGS, MO, 8/19/13: A man who suffered a gunshot wound and crashed a Jeep into a home in Jennings on Monday night has changed his story to police. At first, the man told police he had been shot at a grocery store in Moline Acres. Now he says he accidentally shot himself. The incident happened at about 8:30 p.m. Monday. The man was bleeding from a gunshot wound to the left calf when he plowed his Jeep into the garage of a home at 8835 Sumter Avenue. The family inside the home was unhurt. The injured man told officers that his friend found a gun a few days ago and he was told to get rid of it, according to St. Louis County Police Officer Randy Vaughn. The man said he was playing with the gun when he pulled the trigger, not knowing there was a bullet in the chamber. He told police he shot himself in the calf.

BROWNWOOD, TX, 8/19/13: Brownwood Police were called to the 1500 block of Durham Avenue regarding a weapons offense/disorderly conduct. According to the report, multiple calls were received reporting gun shots in the area of the 1200 block of Avenue G and Avenue H. The shots were heard by an officer who was in the area on an unrelated call, the report states. After speaking with numerous individuals in the neighborhood, contact was made at a residence in the 1500 block of Durham where several empty casings were found in the driveway, the report states. Officers spoke with 40-year-old Derek Jason Montemayor, who after being read his Miranda rights indicated he had fired shots in the air while he was cleaning his gun, according to the report. Montemayor was placed under arrest for disorderly conduct.

TURNER, ME, 8/19/13: A 57-year-old man was shot to death Monday afternoon by another worker, who was shooting rodents and stray chickens in a barn at the egg farm where they were working. The shooting appears unintentional but investigators are working to determine why the man with the .22-caliber rifle did not make sure there was nobody in his field of fire, said Deputy Attorney General William Stokes. Investigators also want to know what workplace safety procedures are in place to prevent such incidents from happening. "When using a deadly weapon, obviously, there is a higher duty of care," Stokes said. "The person who may have discharged the weapon may not have even known what happened until police started to re-create the sequence of events." The victim was found some distance away from where he was shot, and police followed a trail of blood as they tried to piece together events, Stokes said. The egg barns are vast, almost the size of a football field. It's not clear if the victim heard the gun being fired, but Stokes said the small-caliber rifle does not make a loud noise when discharged and there may have been loud machinery, such as fans, obscuring the noise, he said.

MERSERVEY, IA, 8/19/13: Cerro Gordo County Sheriff Kevin Pals said his department is investigating a shooting accident that wounded a Meservey man. Nicholas Scott Henning, 34, was transported to Iowa Specialty Hospital in Belmond by a private party on Tuesday. Belmond police were notified of the gunshot wound at 9:22 a.m. Tuesday and then contacted the Sheriff’s Department. According to a press release issued by Pals, Henning told authorities he accidentally discharged a firearm Monday night with the bullet striking him in the leg. The type of gun was not disclosed. The incident took place at his home at 429 First St. in Meservey.

BRADENTON, FL, 8/19/13: A 35-year-old man accidently shot himself in the left leg Monday, according to authorities. The incident occurred at 8:15 p.m. in the 3300 block of 36th Avenue East, according to a Manatee County Sheriff’s Office report. The victim was driving a car with his girlfriend seated next to him when he reached over to the glove box and removed his pistol. The pistol was a 1911A1 with its hammer back, its safety off, un-holstered and a live round in the chamber, according to the report. As the victim was handling the gun, it discharged and the round entered his left leg.

NORTH AUGUSTA, SC, 8/20/13: A security guard in the hospital this morning after accidentally shooting himself. North Augusta Department of Public Safety responded to 1100 Dittman Court around 7:30 this morning. They found a security guard with an accidental, self-inflicted gun shot would. Officials say he was putting the gun in the holster when it went off. He was transported by ambulance with a minor gunshot wound to the leg.

LILBURN, GA, 8/20/13: Gwinnett County police are investigating a shooting that killed a 2-year-old boy in Lilburn. A witness told Channel 2’s Steve Gehlbach the shooting took place by the garage door of a home on Stafford Drive in unincorporated Lilburn on Tuesday night. Bullets flew toward the street, and one hit and killed the toddler in the driveway, police said. A witness told Gehlbach that the boy’s father came to the house and got into an argument with the boy’s grandfather. She said the grandfather pulled the trigger, but that she thinks the shooting was an accident. “He didn’t mean to, but he was trying to scare off the guy. The guy shoved him to the ground, so that’s how it started. He shoved him to the ground and he got up and he had the gun and started shooting,” the witness said. Police said they think the man was trying to shoot someone else and the toddler was hit by mistake.

BURR RIDGE, IL, 8/20/13: A Burr Ridge man has been charged with unlawful gun possession after his friend was accidentally shot in the stomach by a gun in the man's home Tuesday night and it was discovered he wasn't a registered gun owner. Mark H. Reinesto, 57, of the 7600 block of South Hamilton Avenue, Burr Ridge, was charged with unlawful possession of a firearm and ammunition without a firearm owner’s identification (FOID) card, according to a release from the Burr Ridge Police Department. “The man said he and Reinesto were looking at a loaded antique gun in Reinesto’s home when he dropped it, and the gun went off, striking him in the stomach,” the police department release reads.

SAVANNAH, GA, 8/21/13: A Savannah State University public safety officer's firearm discharged Wednesday morning, sending a bullet through two windows before it came to a stop in a classroom wall. University spokeswoman Loretta Heyward said the officer's weapon fired during either a training exercise or a demonstration. The bullet went through a window of the C wing of the Hubert Tech Science Building, where the Department of Public Safety is housed, then through the window of an A wing classroom, where it lodged in the wall. There was a class in session in the room where the bullet came to rest, but no injuries were reported, Heyward said.

CHEYENNE, WY, 8/21/13: A 3-year-old boy in Cheyenne found a loaded handgun in a bag and shot himself in the leg. Laramie County Sheriff's officials say the boy was treated at the Cheyenne hospital and released later in the day Wednesday. Sheriff's officials got the report about 7:45 a.m. They say the boy shot himself once in the calf while he was playing with the gun inside a house.

NEW BOSTON, TX, 8/21/13: Authorities say a teenager has died in an apparent accidental shooting while with several other youths at a car wash in Northeast Texas. King says the shooting of the youth does not appear to be intentional and nobody was immediately arrested. More info: A New Boston High School senior is dead after an apparent accidental shooting by the school’s quarterback, officials said late Wednesday. Semaj Williams was fatally shot about 10 p.m. Wednesday at Fawcett Car Wash in downtown New Boston near the T&P Trailhead Park.

SEATTLE, WA, 8/21/13: A 14-year-old boy has non-life threatening injuries after accidentally shooting himself in the leg Wednesday. Police responded to the 7100 block of 38th Avenue South to find a 14-year-old boy who had been shot in the leg, below his knee. The boy lead police to believe he had been shot by a male suspect who had fled the scene in a green SUV. Gang Unit detectives uncovered that the shooting was self-inflicted, and the victim had shot himself while passing around a handgun on a basketball court.

ROMANCE, AR, 8/21/13: The White County Sheriff's Department has ruled that the victim in a deadly Wednesday morning shooting accidentally shot himself. Chief Deputy Phillip Miller said the sheriff's department identified the victim as Donald Fletcher Rouse, 20, of Romance. Rouse was found to have an apparent gunshot wound to the head. Witness interviews, evidence and the preliminary autopsy report led authorities to conclude that Rouse accidentally shot himself. First responders were called to the 100 block of Swink Lane in Romance around 2:30 Wednesday morning in reference to a person with a gunshot wound. Deputies said they found Rouse in the front yard of the home.

REDONDO BEACH, CA, 8/21/13: A Redondo Beach woman was arrested early Wednesday after she fired a bullet that ricocheted into her boyfriend's face. The boyfriend was arrested for getting angry and hitting her, police said. The couple were taken into custody shortly after the 12:50 a.m. shooting at an apartment in the 500 block of The Esplanade. The couple were using a pellet gun to shoot at a target in the apartment, but the woman retrieved a real handgun and fired it. The bullet ricocheted and struck the boyfriend's face. Police said alcohol was involved. Karen Benjestorf, 37, of Rolling Hills Estates was arrested on suspicion of a negligent discharge of a firearm. Ronald Barker, 43, of Redondo Beach was arrested on suspicion of battery.

AUGUSTA, GA, 8/21/13: An Augusta man called Richmond County authorities Thursday after discovering that a bullet had been fired into his home overnight. The 60-year-old said he was outside his home on the 100 block of D Court checking a water valve when he noticed a hole in a window, according to a Richmond County Sheriff’s Office incident report. When a deputy arrived, he went inside the home and followed the bullet’s trajectory. According to his notes, the bullet passed through a TV and struck a wall. It was found underneath a dresser that held the TV.

ST. LOUIS, MO, 8/22/13: A 30-year-old St. Louis cop is currently recovering in the hospital from an accidental, self-inflicted wound, cops say. The officer -- with five years of service -- was training on-duty at a firing range during a weapons exercise with SWAT officers, St. Louis Metropolitan Police officials say. He accidentally fired a shot that struck his left foot just before 2 p.m. The incident happened on the 2100 Gasconade Street, police say.

ST. LOUIS, MO: 8/22/13: A 20-year-old man with mental disabilities apparently accidentally shot and killed his 15-year-old sister Thursday afternoon in St. Louis, police say. The man told police he didn’t know the gun was real, according to authorities. St. Louis Police Lt. John Green said that the man and his family moved into a home in the 4600 block of San Francisco Avenue a few days ago, and that the man had found a shotgun — spray-painted gold — hidden behind a dresser. The gun belonged to a friend of the family and was there when the family moved in, Green said. The shooter’s mother told police she had tried to hide the shotgun.

MEMPHIS, TN, 8/22/13: A Memphis, Tenn., kindergarten student is in police custody after he fired a gun in his elementary school cafeteria Thursday morning. The incident didn't result in any injuries, and school is back in normal operation, school officials said. The Westside Elementary School student, 5, brought the gun to school in his backpack Thursday morning, according to school officials at Westside and at the Shelby County schools superintendent's office. While waiting for the opening bell in the cafeteria, the gun accidentally discharged once inside the boy's backpack at about 7:42 a.m. CT during breakfast and before school started at 8 a.m., school officials said.

READING, OH, 8/22/13: A 2-year-old girl is recovering after she was accidentally shot late Thursday in Reading. Officers responded to a report of a child shot in the “lower extremities” about 7:22 p.m. at 7 Lakeview Drive in the Lakeshore apartment complex, police said in a prepared statement. Police classify the incident as an accidental shooting and say there are no suspects.

WAKE FOREST, NC, 8/22/13: A woman accidentally discharged her gun and shot herself in the hand Thursday night inside the Staples store in Wake Forest. The shooting was reported just after 7 p.m., and the woman was taken to WakeMed in Raleigh. LEHIGH ACRES, FL, 8/22/13: The Lee County Sheriff’s Office has identified the woman shot during a Thursday incident in Lehigh Acres as Ashley Pruitt. Deputies responded to a shooting at 4923 28th St. SW and discovered Pruitt in the bedroom of the residence suffering from a gunshot to the head, according to a sheriff’s office report. Investigators said Pruitt was initially reluctant to discuss the incident, but she later said the shooting was an accident. She said she was in a bedroom and Dukes was “near the doorway playing with an unknown type of firearm when the gun accidentally went off,” according to the report.

CHEROKEE CO., GA, 8/22/13: One suspect was dead and two others on the run after an alleged carjacking led to gunfire and a crash Thursday afternoon, the Cherokee County Sheriff’s Office said. The wreck happened near the 5000 block Ga. 92, just west of Wade Green Road, Lt. Jay Baker told The Atlanta Journal-Constitution. Investigators believe a trio of suspects took a man’s Dodge Charger at a nearby apartment complex, Baker said. The car’s owner was in the backseat with one suspect and the two other suspects were in the front as the car was driving, he said. “According to the victim, one of the suspects was hitting him in the head with a firearm and the gun discharged,” Baker said in an emailed statement. “Moments later, the car left the roadway and struck a tree.” The car ran off the road, down a ditch and struck a tree near Poplar Valley mobile home park, Baker said. The suspect driving the Charger was shot in the back and died at the scene.

I carry pepper spray with me whenever I go outside, even to the mail box or to carry out the trash. I have used it to thwart three mugging attempts. I have done the paper work to get a permit to carry a concealed handgun. Before the verdict came down on the George Zimmerman case I though about buying a shotgun, but I did not.

I dislike guns. I have never owned one. At the same time I am not opposed to allowing people to own them. However, I think gun ownership should be regulated the way automobile ownership is. I think one should be required to get a license to own a gun, and one should be required to register each gun. One should be required to send the results of a ballistics test for each gun to the FBI, or a similar organization.

Criminals would not obey these laws. That would give the government one more opportunity to arrest them and put them into prison.

In addition to more gun regulations, I am in favor of more executions, and more, longer, and harsher prison sentences. I am also in favor of race profiling and encouraging the police to stop and frisk suspicious characters, which is to say young black males. I do not like the way young black males make me feel. I want the police to make them feel that way.

Here in NC I know I had to go buy a permit from the local Sheriff Department to buy my pistols. That was before I got my CCW permit. It's not about new gun laws, it's about enforcing the ones that are already in place.

I can honestly say that the weapons I have are for my safety and the safety of my family from criminals as well as our Government. I am not a paranoid person, just a well prepared person in case the need arises.

My firearms have never killed anyone but if that day ever comes when I have to defend my home or family, they will be readily accessible and they will be used for their intended purposes.

OOPS: Senator Who Advocates Arming Teachers Accidentally Shoots Teacher With Rubber Bullet

A state senator who is advocating for arming teachers in the aftermath of the school shooting in Newtown, Connecticut, accidentally shot a teacher with a rubber bullet during a training course, the Arkansas Democrat-Gazette reports.

Arkansas Sen. Jeremy Hutchinson (R) recently participated in “active shooter” training and mistakenly shot a teacher who was confronting a so-called bad guy. The experience gave Hutchinson “some pause” but failed to shake his confidence in the plan.

“The ideal would be to have a trained resource officer in every school,” Hutchinson told the paper. “The state and school districts can’t afford that.”

In July, Arkansas’ Clarksville School District announced that it would “train and arm 20 staff members who would act as security guards to defend against a gunman” and “applied for a license from the Arkansas Board of Private Investigators and Private Security Agencies to act as a private company with authority to hire private security officers.” Following a legal squabble, however, a state board is scheduled to decide next month if staff members can in fact act as security guards.

Since the Newtown shooting, schools around the country have moved to encourage or require teachers (and sometimes students) to carry firearms.
But serious questions persist about the wisdom of arming teachers. Even trained police have a track record of mistakenly firing on civilians in standoff situations and in Kansas, a school that armed its teachers was denied coverage by major insurers, who deemed the armed teachers too great of a risk.

I particularly love the ones that are against gun ownership spouting off about countries that have gun touting drug lords. basically saying, "look over there at what is happening to that country where none of the citizens have guns! The drug lords control everything!"

No shit! Criminals don't obey gun laws!

So your answer to the problem is to take the guns away from the good and honest citizens here too? From the people who would only use them for the right reasons?

Wouldn't that make us morevulnerable to the gun touting drug lords that wouldn't that wouldn't follow those laws?

Underwear-clad man with gun chasing burglars down his street shot by suspicious neighbor

An Oklahoma man is expected to recover after being shot by a neighbor who became suspicious when he saw him running down the street in his underwear.

Joshua Snow was at his Owasso home early Monday morning when heard someone breaking into his car, according to KOKI. Not even stopping to put on pants, Snow immediately grabbed his gun and began chasing the burglars.

Major Shannon Clark with the Tulsa County Sheriff’s Office told KOKI that investigators aren’t exactly sure what happened next, but something caused Snow to bang on neighbor Jimmy Null’s door at some point during the pursuit.

When Null saw a man with a gun in his underwear standing at the door, he grabbed his 12-guage shotgun instead of asking questions.
“That’s kind of where things get a little gray,” Clark said. “We don’t actually know what took place there.”

“I guess just in the hype of everything taking place, when the guy reached for his own gun, the homeowner at that time fired a shot trying to protect himself and his family.”

Clark warned that chasing burglars was risky, and that homeowners should at least call 911 before taking the law into their own hands.

“Once there is no continuing threat to a person and/or a life or the community, then you can’t use deadly force as an option,” he pointed out.
But neighbor Kayla Brown insisted to KOKI that she would have done the same thing.

“I would grab a gun and, you know, threaten him because he is on my property that I will shoot him if he doesn’t stop,” Brown said.

The Tulsa County Sheriff’s Office did not expect to charge Null for the shooting, and Snow was expected to make a full recovery.

The burglars also managed to escape in the chaos.

I agree with the premise, however, not every teacher wants to become a security guard. Sure they want the children to be safe, but they don't sign up to the job to fend off armed nutcases, they sign up to educate the next generation. Besides it takes a particular mindset to take a life, many wouldn't want that responsibility, even if your own life, or that of the kids were at risk. I predict a lot of 'deer in the headlights' type reactions when faced with looking down the barrel of a gun.

The second problem is there are a lot of nutjob teachers about. People that probably shouldn't be working with people, let alone kids. I remember when I was at school, there were a few loose cannons about. Probably not a great idea to introduce firearms into a stressful classroom. And there are stupid teachers about, people that I wouldn't trust with a breadknife, I predict accidents, accidents with guns can have severe consequences, as stumbler likes to point out.

Maybe what is needed are volunteer teachers that have undergone special training. Real life Kindergarten cops! They do this in Israel, and from what we can tell, it's not a bad system. What's clear is expecting a gun free zone to protect kids from armed nutjobs is foolhardy.

Connecticut man shoots self while biking and claims it was hoodie-wearing ‘gang’

A Connecticut man, who accidentally shot himself while riding a bicycle, was arrested this week after lying to police and saying that a “gang” of men wearing black hoodies had attacked him.

The Connecticut Post reported that Stratford police were notified on Thursday that 22-year-old Wendell Docteur was being treated for a gunshot wound to his right leg. Docteur told officers that he was riding his bike “when he was confronted by a half dozen men, dressed all in black with hooded sweatshirts covering their faces,” according to the paper.

Docteur claimed that the gang had robbed him of his money and then yelled, “North End, North End,” as they fled. The North End is a neighborhood in Bridgeport.

But Docteur finally admitted that the gun in his waistband had gone off and he had shot himself after he was not able to explain why there was only a hole where the bullet exited from his pants. He was also not able to tell police what happened to his handgun after the incident.

Docteur was charged with making a false statement, unlawful discharge of a firearm and failing to report a lost firearm. He was released $10,000 bond. A hearing was scheduled for Superior Court court on Sept. 5.

GunFAIL XXXIII

It's Back-to-School time! Many areas of the country saw their kids back in school during this past week, while elsewhere, students will be returning over the next two weeks. So it's only fitting to note the two particular kinds of GunFAIL that coincide with the season. First, there's the old gun-in-school problem. We had eight of those in primary and secondary schools around the country. Specifically in St. Louis and Ferguson, MO; Griffin, Sandy Springs and Atlanta, GA; Mobile, AL; Winston-Salem, NC, and; Spring Hill, KS. From the post-secondary world, we have the story of the Texas Tech students who thought it would be fun to fire guns off the balcony of their off-campus apartment. Let college kids bring their guns to school? Sure. Why not?

The second kind of seasonal GunFAIL demonstrated this week: the cancellation of classes and/or athletic events due to the shooting death of a local student. We saw that one this week in Drain, OR, and last week in New Boston, TX. It's worth noting, however, that such cancellations don't occur for every accidental shooting. They tend to happen when it's a member of the football team who gets shot. Doubly so when they're accidentally shot by another member of the football team.

In other GunFAIL headlines, there was the now-famous story of the Connecticut man who, while lying in wait for a pesky raccoon, sneezed, fell off his chair, and shot himself in the leg. And the baffling story of the accidental shooting at the "Little Buckaroos Reading Roundup" event, hosted by the Lodi, CA SWAT team. There's just so much to wonder about in that one! The York, SC school resource officer responsible for our second on-campus security guard accidental discharge of the new school year. And of course, the Anchorage, AK GunFAIL two-fer, in which two Responsible Gun OwnersTM shot themselves in the leg, in succession, with the same gun.

The more routine news: three accidents while cleaning loaded guns; two "home invasion" shootings; three GunFAILs involving four cops (in one incident, two drunk cops shot at one another in a fight over loud music at a campground); one gun range accident, and; two "intruders" who turned out to be family members.

The kids of GunFAIL this week were mercifully few, aged 3, 4, 4, 16 and 16. And once again, our count includes a 4-year-old girl accidentally shot by her 6-year-old brother.

INDEPENDENCE, OH, 8/13/13: A 61-year-old woman called a hotel on Rockside Road Monday, August 16 to report she had checked out three days earlier and left a loaded handgun in her room. The woman said she is from out of state and came to Cleveland for a two-day stay, bringing the gun with her for protection. The hotel manager found the gun in a drawer of the nightstand secured in a black box with five rounds in the magazine and one round in the barrel.

COMER, GA, 8/23/13: On Aug. 23, Deputy Darren Sartain was dispatched to Athens Regional Medical Center, where a man said he was at his home on Pine Valley Farm Road, Comer, cleaning his gun when it accidentally discharged. The bullet hit the man in the ankle.

CUDAHY, WI, 8/23/13: A 25-year-old Cudahy man was cited for endangering safety with a weapon, after he accidentally fired his handgun in his apartment in the 2900 block of East Adams Avenue at 11:30 p.m. Aug. 23 sending a bullet through the wall of his own apartment, a small fence, the wall of a garage and into a car two addresses away. The man readied the gun when he thought that a burglar was trying to enter the apartment, but found that it was only his son. He returned to his bedroom to put the gun away and tripped on some shoes, falling to the floor and discharging the gun. The man agreed to pay for any damages caused in the incident.

CHICAGO, IL, 8/24/13: A woman accidentally shot herself when a gun went off during a fight early Saturday in the South Shore neighborhood. The woman was in a fight in the 7800 block of South Constance Avenue about 2:50 a.m. when a gun she was carrying accidentally went off, police News Affairs Officer Hector Alfaro said. She was shot in the chest and taken to Advocate Christ Medical Center in Oak Lawn where she is in “stable” condition early Saturday, Alfaro said.

RICHMOND, VA, 8/24/13: A "very young person" was wounded in an apparent accidental shooting late Saturday and Richmond police said one person has been arrested. The shooting occurred in the 1300 block of Coalter Street, according to Richmond police spokesman James Mercante. The victim's exact age was not immediately available but the injury was described as non-life threatening. UPDATE: A Richmond man now faces a felony charge in the accidental shooting of a 4-year-old girl. Demond Brown is charged with discharging a firearm within a building or dwelling. The child is expected to be okay. Brown's gun went off accidentally Saturday night inside a home in the 1300 block of Coalter Street. UPDATE 2: Brown was in the apartment next door, and accidentally shot four-year-old Canilah Greene through the wall.

BROOKLYN, NY, 8/24/13: The heartless creep accused of shooting a 3-year-old Brooklyn boy in the head asked the tot’s babysitter to hold off on calling 911 to give him time to stash the gun, prosecutors charged Sunday. Akeem Bernard was ordered held on $75,000 bail in the apparently accidental shooting of Tharell Edward in the boy’s second-floor apartment on E. 21st St. in Flatbush on Saturday. Prosecutors said Bernard, 22, who lives in the same building as the boy and was hanging out with the babysitter, stashed a black semiautomatic gun in a shoebox near the boy’s head on Saturday. Bernard had been intoxicated all day, cops said.

NEW HAVEN, CT, 8/24/13: An 81-year-old man accidentally shot himself while trying to combat a raccoon, police said. Officers responded to Yale-New Haven Hospital shortly after 8 p.m. Saturday regarding a shooting, police said. When they arrived, James Pace Sr. told officers he had been having a problem with a large raccoon scratching at his back door. Pace told police he armed himself with a .22 caliber rifle and waited for the raccoon to show, but while waiting, he sneezed and fell out of his chair. Police said it was then he realized he had accidentally shot himself in the shin.

CLINTON TOWNSHIP, MI, 8/24/13: A 41-year-old Harper Woods man accidentally fatally shot himself while helping clean out a house on E. Horseshoe Drive (north of Millar) in Clinton Township, police said Monday. The shooting occurred Saturday afternoon, according to Detective Capt. Richard Maierle of the township police department. An assistant Macomb County prosecutor concurred with police and ruled the shooting accidental. “An employee for the moving company found a M-1 carbine in the closet,” Maierle said. “It accidentally went off when he had the barrel pointed at him and handed it to his step-father.”

MURFREESBORO, TN, 8/24/13: There was an accidental discharge of a weapon on Saturday night that Murfreesboro Police are investigating. A man who is enlisted in the U.S. Army thought he had cleared his .45-caliber handgun but when he inserted the magazine it discharged, according to a police incident report. When the gun discharged the 21-year old was hit in his Femoral Artery and the bullet became lodged next to the femur. Witnesses told police, “He shoved the magazine back into the pistol and it went off.”

LEMONWEIR, WI, 8/24/13: The Juneau Co. Sheriff's Department says 28-year-old Joshua Bader died from an accidental gunshot wound to his upper leg. Deputies say Bader was out with friends on Friday. At some point after he returned to his residence, he was handling a .22 caliber handgun when the gun accidentally discharged, striking him in the upper left leg. A short time later, Bader died from his injury. He was found Sunday morning.

WASHINGTON, LA, 8/24/13: Washington police made a second arrest related to a weekend’s carjacking, but this time it was one of the victims who was shot in the leg during the event. Rochelle Bob, 24, of 715 W. Vine St., was arrested on a charge of filing a false police report after authorities said she confessed she had inflicted a gunshot wound on herself Saturday night. Bob originally told police she sustained the wound as her boyfriend was being car-jacked. Police were called to the area at around 11:30 p.m. Saturday for shots fired and pursued Raekwon Mitchell as he fled from the scene before arresting him on a multitude of charges, including attempted first-degree murder. Bob was the only one treated for injury. Bob later admitted she had accidentally shot herself when she attempted to defend her boyfriend from the carjacking.

LODI, CA, 8/24/13: Lodi police said a young boy caused a SWAT team member’s firearm to discharge during a reading event hosted for children last Saturday. The SWAT member suffered a minor flesh wound and police are continuing to investigate the incident, Lodi Police Capt. Chris Piombo said. During the Little Buckaroos Reading Round-up event, Officer Robert Rench was helping a boy try on pieces of SWAT team gear, when another young boy approached unnoticed. The boy, who witnesses told police was about 6 years old, reached his finger toward the gun and pulled the trigger, Piombo said. Besides Rench, no one was injured. But a woman left with the child who fired the gun, and so far police have been unable to identify him. The Glock handguns that SWAT members carry aren’t equipped with a safety, Piombo said. “There is nothing we could have done differently,” he said. “It was just an accident. It boggles the mind why a child would do that. It’s an unfortunate incident,” he said. “We’re thankful none of the community members were hurt and that Robert was alright. I think we all learned something from it.”

POLAND, ME, 8/24/13: A 71-year-old Poland man brandished a handgun and tried to fight off two men who broke into his mobile home early Saturday morning, police say, but he was overpowered and the intruders took off with the gun, clothes, drugs and other items. Police say two men broke into the 21 Julie Street home of Ronald St. Pierre around 5 a.m., entering through a window while St. Pierre was asleep. St. Pierre woke and ordered the men to leave. Police say the elderly man retrieved his handgun in an attempt to get the men to leave, but the two overpowered him. The gun went off during the struggle, but it appeared no one was shot. The men fled the mobile home with several items, including the loaded, silver .44 Magnum revolver with a long barrel.

KALAMAZOO TOWNSHIP, MI, 8/25/13: Kalamazoo Township Police got a 9-1-1 call very early Sunday morning that a man who had been shot in the 35-hundred block of Market Street was on his way to Borgess Emergency in a private vehicle. They drove up in an F-250 Ford Superduty Pick-up with an extended cab. The victim, who had been shot in the head, was sitting in the back seat. He was pronounced dead shortly after arriving. The four others in the truck say the 24-year-old man from South Carolina had been handling the gun when it went off and the bullet struck him in the head.

JERSEY CITY, NJ, 8/25/13: Port Authority police confirmed this afternoon that a woman, a bystander, and the suspected gunman all sustained gunshot wounds in the shooting that occurred this morning around 5:10 a.m. on a PATH train that was pulling into the Newport PATH Station in Jersey City. Tari Turpin, 34, of East Orange, has been charged in the shooting and was apprehended by the nearby Pep Boys store shortly after the shooting, Port Authority Police spokesman Joe Pentangelo said. Police recovered a 9mm Glock handgun, Pentangelo said. Diamond Drummer, of Hillside, told WABC-TV that a man -- later identified a Turpin -- was sleeping next to her and falling on her. When she politely complained, the man pulled out a gun, Drummer told the station. At that point, her brother intervened, and the man put away the weapon, but when her brother remarked "Who pulls out a gun for something like this?" the man again drew the weapon and started firing, Drummer told the station. Drummer was struck in the ankle, another man -- not her brother -- was struck by a bullet in his hand, and by the time Turpin was apprehended, he had sustained a gun wound in his left leg. Drummer told WABC-TV, the gunman, accidentally shot himself in the leg.

CHARDON TOWNSHIP, OH, 8/25/13: Geauga County Sheriff deputies responded to a Clark Road location about 7:15 p.m. Sunday for a reported accidental shooting. The victim, a female, was transported to the hospital after being hit in the shoulder with pellets from a shotgun. Lt. John Hiscox said the incident was called in as accidental but an investigation is initiated for all shooting events. UPDATE: A Chardon Township woman was shot as a result of a fight between two men involving a gun, according to the Geauga County Sheriff's Office. Gary Schussler and Anthony Molchak engaged in a verbal altercation Sunday evening at the time of a child exchange, according to reports. Schussler pulled a firearm out at one point and eventually set it down. Molchak then picked up the gun and accidentally fired it toward his own wife, shooting her in the back, Geauga County Sheriff's Chief Deputy Scott Hildenbrand said.

CAMAS, WA, 8/25/13: A Camas man was sent to the hospital after accidentally shooting himself late Sunday night. Scott Olson, 53, was using the flashlight mounted on his .40 caliber handgun to unlock a padlock in a dark room when the gun slipped and accidentally fired, Camas police Sgt. David Chaney said. Police and paramedics responded to his residence, 926 N.W. Greeley St., about 11:50 p.m. “He tried to catch it as it fell and it went off,” he said. The bullet went through his finger and lodged into his thigh, Chaney said.

QUEENS, NY, 8/25/13: Sources said the shooting took place because Robert Smalls was irate that Quasaun had been busted for shoplifting over the weekend and released by cops after being issued a desk appearance ticket. According to a criminal court complaint, Quasaun told investigators that he and his father began fighting after the teen returned to their 59th Street home about 4:30 a.m. yesterday. Robert Smalls opened fire after blocking two punches, the complaint says. During an arraignment this morning, Queens prosecutor Robin Kwalbrun said Robert Smalls told cops the shooting was an accident, saying that he was sleeping when his son entered the home and that he mistook his offspring for an intruder. “He heard steps in his home," Kwalbrun said. “He shouted, 'Who is it?' No lights were on. He said 'Police, stop.' He saw the person grab at his waist, he pulled his weapon and fired." Kwalbrun said Robert Smalls told cops: "By the time I realized it was my son, the gun discharged.”

PLAINS TOWNSHIP, PA, 8/25/13: A woman in her 70s is recovering after being shot on school property in Plains Township. Police say a .22 caliber bullet hit the woman Sunday night just outside of Wilkes-Barre at the running track outside the Leo E. Solomon Educational Complex. Dorothy Sarnick of Plains Township was just about to take her nightly walk when a stray bullet hit her in the arm. Police say this is the first incident of its kind here at the school. “It`s very strange, kids are down here all the time. I walk my family down here, my children, kids are playing, the football team practices over here on this field, school property, we`re very concerned about this,” said Plains Township Police Officer Timothy Minnick. Now police are working to piece the puzzle together and figure out exactly where the bullet was shot from and who might have fired the gun. Some are speculating this all might have been an accident. “I have heard of a lot of hunting in the back woods through the years especially quite a few years back, and I hope that it was something like that it was just an error,” said Rigle. With school slated to start later this week police and parents say figuring out exactly what happened here is their top priority.

CHINO, CA, 8/25/13: An apparent booze-fueled dispute over loud music between two groups at a Chino campground over the weekend escalated to the point where men from both sides drew guns and opened fire. No one was hurt, but the two alleged gunmen have plenty to explain. It turns out that the rival gun-toting campers were both Los Angeles County sheriff's deputies. Authorities suspect the off-duty cops learned they were colleagues only after their campground showdown. Chino police officers were called to Prado Regional Park early Sunday morning. They arrested the deputies — Dejay Barber, 44, and Matthew Rincon, 24 — on suspicion of negligent discharge of a firearm.

BRADLEY CO., TN, 8/25/13: Detectives have released additional information concerning a shooting incident which killed a Bradley County man Sunday evening. Cody Tatum, 28, died from a gunshot wound to his chest. Bob Gault, media relations coordinator for the Bradley County Sheriff’s Office, said deputies responded about 10:45 p.m., to a residence at 3248 Spring Place Road where two people had suffered gunshot wounds. Detective Lt. David Shoemaker said Tuesday that initial investigation found that Tatum and his girlfriend, Gaberilia Wendy Gasparian, 33, were sitting together on a couch. Both were reportedly struck by the same .40 caliber bullet. Gasparian was reportedly sitting in the chair with Tatum with her back to his chest when Tatum was alleged to have turned the barrel of the gun back toward them and told her to pull the trigger, according to Shoemaker. At some point, the gun had been reloaded. “She didn’t know it was loaded and reached and pulled the trigger,” Shoemaker explained. The bullet traveled through her chest, exited her back, entered Tatum’s chest and exited his back and lodged in the couch, according to the investigator.

YORK, SC, 8/26/13: A school resource officer's weapon was accidentally fired into a sidewalk outside York Comprehensive High School this morning, the York County Sheriff's Office said. Three other people were nearby, but no one was injured. The deputy involved was placed on administrative leave pending an investigation, the sheriff's office said, and another school resource officer was assigned to the school. UPDATE: He's back on the job.

CHEATHAM CO., TN, 8/26/13: A man was hospitalized after his neighbor and best friend shot him in the eye, and, by all accounts, it was just a terrible accident. Investigators said a man was cleaning his brand new gun at a duplex in Cheatham County when the gun accidentally fired. A .44 caliber bullet traveled through a wall and struck the victim, James Kratz, right in the eye as he sat in his recliner eating breakfast. We're told the man responsible for the accident is so remorseful he is now getting rid of all of his guns, and deputies hope other gun owners learn from his mistake.

TOBYHANNA TOWNSHIP, PA, 8/26/13: Two men who attempted to rob a Tobyhanna Township home are in custody after one of them was accidentally shot in the head by an accomplice. According to police, Jehova Maldonado, 18, and Martin Ranko, 20, were part of a group of four men who broke into a home in the Emerald Lakes community around 9:30 p.m. Monday, looking to rob the residents. Three people were inside the house, one was injured, Pocono Mountain Regional Police said. The victims told police that four men broke into the residence, three armed with handguns and one with a crowbar. The men yelled “where's the money at?” and pointed the guns at them. The would-be burglars fired multiple shots in the house. At one point, one of them accidentally shot one of their accomplices in the head, the victims told police.

COLLINSVILLE, OK, 8/26/13: A Collinsville man is expected to recover after being shot early Monday while chasing a person who had been burglarizing his vehicle. Tulsa County Sheriff’s Office spokesman Shannon Clark said Joshua Snow was shot by a neighbor who was not involved in the burglary. Snow, Clark said, told deputies he awoke in his residence in the 11700 block of North 117th East Avenue just after midnight Sunday night and realized that someone was attempting to burglarize his vehicle. Armed with a handgun, Snow went outside in his boxer shorts and chased the burglar for “quite some distance,” Clark said. “It’s still a little unclear to us, but he said that during the chase, he came into contact with another group of people who began to give chase to him,” Clark said. “During this time he ran to a nearby home asking for help.” Clark said that homeowner, Jimmy Null, saw Snow, clad only in his underwear and armed with a handgun, at his door. Null grabbed a shotgun and “told (Snow) multiple times, “Don’t reach for your gun! Don’t reach for your gun!” Clark said. Snow had placed the gun on the ground as he knocked on the door, Clark said. “I guess in the excitement of the moment, (Snow) goes to reach for the gun, so (Null) fired one shot and struck him.” The person who was burglarizing Snow’s vehicle has not been located.

CHARLESTON, WV, 8/27/13: The victim in an early morning shooting has been identified as 24-year-old Ladaraean Duran Mixon of Detroit. He originally gave police an alias of Omarion Cooper. Police said he had several aliases. It took police more than eight hours to positively identify him because of this. Mixon showed to CAMC with a gunshot wound to the groin early Wednesday morning. Police later determined he accidentally shot himself. Mixon also had heroin on him at the time of the shooting, they said. He has been extradited back to Detroit on unrelated charges. More (too much) info: "Physical evidence tells us [Mixon] accidentally shot his own testicle," said Lt. Steve Cooper, chief of detectives for the Charleston Police Department. "It's not uncommon for criminals to shoot themselves in the groin area."

OCILLA, GA, 8/27/13: G-B-I agents spent the early morning hours investigating a deadly shooting that may have been accidental. Ocilla Police officers were called to a home on the 200 block of Dismuke Avenue around 10:30 last night where they found a man suffering from a gunshot wound to the head. Several witnesses were at the home at the time. The G-B-I was called into assist but investigators right now say it doesn't appear the shooting was intentional. The victim is from Coffee County but his name has not been released.

NORTH FORT MYERS, FL, 8/27/13: A 16-year-old North Fort Myers boy suffered a gunshot wound to the hand yesterday, after allegedly playing with a pistol he had stolen from his grandmother. According to his arrest report, the teen initially lied and told Lee County Sheriff's deputies he had been shot in a drive-by. Soon after giving the account to deputies, the boys' stories began to change. During an interview with a detective at the hospital, the victim came clean, saying he had been playing with the firearm in the bathroom at Farmer Jack's convenience store, located on Laurel Lane, when it discharged. He said he gave the weapon to his friend to hide. The victim's grandmother had reported her pistol as stolen, and told detectives she believed her grandson may have taken it.

SPOKANE VALLEY, WA, 8/29/13: A 22-year-old man is in critical condition after accidentally shooting himself in the head overnight in Spokane Valley, the Spokane County Sheriff’s Office said. Deputies responded to a shooting call at 302 S. Sullivan Road at 12:45 a.m. Thursday, according to a news release from the Sheriff’s Office. At least a dozen witnesses to the incident ran when law enforcement arrived. Investigators interviewed remaining witnesses, and preliminary evidence suggests a man found with a gunshot wound to the head inadvertently fired on himself. The Sheriff’s Office said alcohol played a “major factor” in the incident.

HANAHAN, SC, 8/29/13: A 52-year-old man told Hanahan police that he accidentally shot himself in the hand while cleaning his Glock on Thursday. The man’s right hand was wrapped in a bloody towel when police arrived at his home on Dogwood Court shortly before 5:30 p.m. on Thursday, an incident report states. He told police that he was in his gun room cleaning a 10 mm Glock when the pistol accidentally fired a round into his hand.

GERMANTOWN, TN, 8/29/13: A Collierville police officer accidentally discharged his service revolver while cleaning the weapon inside his Germantown apartment on Thursday.

DRAIN, OR, 8/29/13: A 16-year-old boy was accidentally shot and killed Thursday night in Drain by his 15-year-old friend, the Douglas County Sheriff's Office said. The victim, identified by classmates as Austin Lundeen, was a member of the North Douglas High School Warrior football team. "He was definitely a character and kind of kept things alive on the team," said coach JJ Mast. "So you know, it's still setting in, we're all having a pretty tough time." His best friend, also a member of the football team, accidentally shot him as he passed Lundeen a hunting rifle.

COLUMBUS, OH, 8/29/13: A local man was taken to the hospital after he reportedly shot himself in the leg Thursday evening. Columbus police officers responded to the intersection Aberdeen Avenue and Atwood Terrace on a report of a shooting at about 7:41 p.m. Officers made contact with the victim, 24-year-old Robert McPhail. Through further investigation it was determined that McPhail was at a friend's house and shot himself while mishandling a firearm.

ANCHORAGE, AK, 8/29/13: Anchorage police say two men were shot in the leg during two separate discharges of the same handgun Thursday morning in a Fairview neighborhood. Someone in an apartment complex near East 10th Avenue and Ingra Street reported at 9:13 a.m. that a man had been shot, according to dispatch logs. The first man was holding a handgun inside his apartment when the gun discharged and he was shot in the leg, police said. He dropped the gun and left, headed for the hospital. As the man left the apartment, witnesses told officers, they heard another shot from inside the apartment -- the second man had also been shot in the leg, police said. The circumstances surrounding the second shooting remain under investigation.

ALMA, WI, 8/30/13: A 4 year old Jackson County girl was accidentally shot and wounded by her 6 year old brother. The Sheriff's Department says it happened at 9:30 am Friday morning in the Town of Alma. The boy found a loaded shotgun in their home, it discharged when he pointed it at his sister. The girl suffered non-life threatening injuries to her head.

ASHBURN, VA, 8/30/13: Someone was injured while at the shooting range at Silver Eagle Group on Guilford Drive in Ashburn Friday evening, according to a gun owner who was at the facility preparing to enter the shooting range. The incident, said to have occurred around 5 p.m., has not yet been confirmed by the Loudoun County Sheriff’s Office, and the regular LCSO public information officer is away. The person who reported the incident, who asked not to be identified, said he had been waiting in line for his turn when the incident occurred. “People started shouting, ‘Call 911! Call 911!” he said. Silver Eagle employees quickly took control of the situation and the victim, believed to be female, was thought to have suffered a non-life-threatening injury. The witness at the scene reported seeing blood, but believed the victim to be breathing.

Florida Man’s Defense Invokes ‘Bush Doctrine’ To Justify Shooting Neighbors At BBQ

Attorneys for a Florida man who allegedly killed two people at a Labor Day barbecue filed a motion to have their client's murder charges dismissed under the state's "Stand Your Ground" law, Florida Today reported Wednesday.

Police said William T. Woodward "snuck up" on the barbecue and opened fire on three neighbors, killing two men and injuring one, according to the newspaper. In addition to the state's 'Stand Your Ground' law, Woodward's legal team also argued that the three men posed an imminent threat to Woodward because they had been threatening to "get him" in the hours prior to the shooting.

The motion argued that Woodward could have expected an attack based on those words alone. It cited the "Bush Doctrine" to justify Woodward's response to the perceived threats, referring to George W. Bush's concept of waging pre-emptive war against potential threats before they metastasize into imminent threats.

“I think legally that term has sort of been evolving especially given changes of our government’s definition of ‘imminent,’” Robert Berry, one of the attorneys representing Woodward, told Florida Today. “It’s become more expansive than someone putting a gun right to your head. It’s things that could become, you know, an immediate threat.”

White Dallas man shoots 8-year-old black boy in the face as he plays ‘tag’

An 8-year-old African-American boy in Texas is struggling to recover after being shot in the face by a 46-year-old white man, but authorities have not been able to determine a motive.

Dallas police said that Donald Maiden Jr., who had just celebrated his 8th birthday on Sunday, was playing tag outside his apartment complex on Tuesday. According to his grandmother, Maiden ran inside to get some toys and was shot as came back outside.

Witnesses told police that 46-year-old Brian Cloninger had been seen waiving a handgun at people prior to the shooting, The Dallas Morning News reported.

Police reports said that Cloninger was seen standing beside his pickup truck as the boy was bleeding, and a witness asked him if he shot the boy.

“Yes I shot that kid,” Cloninger reportedly said.
Maiden’s mother, Latamarin Locklin, recalled the aftermath of the shooting to KTVT on Thursday.

“When he ran in I just screamed,” she said. “His mouth was just hanging off and it was just a big hole… I just threw him on the couch and laid him in my arms and put pressure on his mouth with the towel.”

Locklin couldn’t understand why anyone would shoot her child “out of the blue.”

Maiden was in critical but stable condition as of Thursday. He still needed a breathing tube and had a plate in his jaw. He he could wink and nod to communicate, but could not talk. The boy was expected to have more surgeries after swelling from the most-recent surgeries goes down.

Cloninger was charged with injury to a child, and was being held $2.2 million dollar bond.
