He may be charged as an adult, but unless she has a really shitty lawyer, there is NO way they can charge her as an adult...though they may TRY, it won't happen...think about it...they would be charging her for a crime involving a minor, whom is herself, but say, oh btw, we are going to TREAT you like an adult, because it is convenient for use to do so...even a half wit lawyer would tear the prosecution a new one in the court.

there was a case about a year ago involving two teens. ( MINORS ),
who decided to take pics of themself(s) and send them to another
person. well, guess what happen in that situation.

the teens ( MINORS ) were charged as ADULTS for committing
CHILD PORNOGRAPHY. the two teens had no idea of there troubling
situation. they both were facing FELONY CHARGES. they were just
fooling around as they told the judge.

the judge residing over the case wasn't buying their story. he allowed
the ruling to stand in place. the parents, friends, families, thought it
was blown way out of line. they were two teens who had no idea
of the consequences, and should be given a warning.

but, having possession of any pic, on your cell phone of an
UNDERAGE person whether female/male in the nude, partially nude,
count as CHILD PORNOGRAPHY. regardless whether or not the pic
had anything of sexual in nature to it.

 

How can you treat someone as an adult and treat the photo of them as child porn? If it is child porn and its of them then they are children. If you treat them as adults then their pictures should be treated the same.

If 13 year old boy or girl is caught masturbating can he/she be charged with molesting a minor? How about rape? or underage sex with a minor? Would he/she have to register as a sex offender. Maybe he/she would not be allow in boy/girl scouts? Or go anywhere near a school!

 

IFF this is in fact true, then the parents didn't even bother to get a lawyer of any kind...because anybody with any type of law degree could have beat this...you can't label a person as a minor and adult at the SAME time...and they could have filed an appeal as well if they weren't smart enough to get a lawyer in the first place.

in my state, if your a MINOR, and commit a serious offense, they can charge
as an ADULT, to the nature of the crime itself. a lot of states have these
types of laws. MIND YOU, the DEPARTMENT OF JUSTICE in
WASHINGTON,D.C. made these guidelines when it re-wrote the punishment
for CHILD PORNOGRAPHY and the different levels of it.

the same way, if a MINOR robbed someone with a weapon of some sort
or possessed a explosive device as well. it sounds crazy, but the laws
have these weird guidelines in what constitutes a FELONY, when it's
committed by a MINOR, for him to be charge as an ADULT.

a lot of your common wealth states have these laws. i know it sounds
dumb, but they manage to do so with LOBBYIST on CAPITAL HILL
and the PROSECUTORS from these states. they are all OUT FOR BLOOD.

it's the same thing, if you showed pictures to your family, of your
children taking their first bath or a bath altogether eventhough, you
and your other half saw it as harmless. they can still charge you for
child endangerment, reckless behavior/endangerment and more.

plus, your exciting the " on looker " who ever that is in seeing the photo's
besides you and your other half. whether it be family, friends,
neighbors, co-workers and so on.

like you said, pics of minors, are PROHIBITED on adult websites
altogether. whether they are fully clothed or not. even a pic of a

on looker might have some sort of fantasy, of being involved with

with that being said, you too can be charged. there have been
parents, who have participated in CHILD PORN with their very own kids

I understand the concept of barely minors being charged as adults in many felony offenses...I realize it happens ALL the time, and agree that it should...Is one really any more mature at 18, then they were at 17 and 364 days 23 hours 59 minutes...NO. My point is that if the pics are of YOURSELF, they are labeling you as a MINOR to call it child porn...they can't then turn the tables and label you as "adult enough" to accept the FULL consequences. It is a complete and utter contradiction and there is not a jury in the world who would buy it...Now as I said in my first post...I know the OP has now said he was joking, and quite honestly he sounds about 13...Anyway, using the OP as and example...HE could be charged as an adult for having pics of his minor g/f on his phone or computer...but you mentioned that SHE could be charged as an adult as well for taking the pic...and that's not the case because that is what causes the contradiction...
