Is it against the law to be racist? If so there isn't enough room in jail for all of those guilty.
I have never known anyone who was not racist. I know some that will argue the point but they are usually those who think only white men can be racist.

I didn't ask which law he has broken. I asked under which law people are trying to prosecute him.

 

The claim was that his right to free speech is being assaulted. That claim is ONLY true if he is being prosecuted; the First Amendment guarantees only that Congress shall make no law. It does not absolve anyone of having to deal with people they've ticked off by exercising their free speech.

 

If nobody's trying to prosecute him, that's an irrelevant question.

 

And I'll assure you,, he will be dealing with those people that he has offended.

The man does not believe in inter-racial relatationships,,that does not offend me in the least.

California Wiretapping Law

California's wiretapping law is a "two-party consent" law. California makes it a crime to record or eavesdrop on any confidential communication, including a private conversation or telephone call, without the consent of all parties to the conversation. See Cal. Penal Code § 632. The statute applies to "confidential communications" -- i.e., conversations in which one of the parties has an objectively reasonable expectation that no one is listening in or overhearing the conversation. See Flanagan v. Flanagan, 41 P.3d 575, 576-77, 578-82 (Cal. 2002). A California appellate court has ruled that this statute applies to the use of hidden video cameras to record conversations as well. See California v. Gibbons, 215 Cal. App. 3d 1204 (Cal Ct. App. 1989).

If you are recording someone without their knowledge in a public or semi-public place like a street or restaurant, the person whom you're recording may or may not have "an objectively reasonable expectation that no one is listening in or overhearing the conversation," and the reasonableness of the expectation would depend on the particular factual circumstances. Therefore, you cannot necessarily assume that you are in the clear simply because you are in a public place.

If you are operating in California, you should always get the consent of all parties before recording any conversation that common sense tells you might be "private" or "confidential." In addition to subjecting you to criminal prosecution, violating the California wiretapping law can expose you to a civil lawsuit for damages by an injured party. See Cal. Penal Code § 637.2.

But do we know where the conversation was held?

 

The only problem with him filing a lawsuit against her is he would have to admit it is him on the recording. At this point he can just deny that it is him and say she faked the tape to get payment from the news outlets or to get the current lawsuit against her dropped.

 

He could; but he isn't doing. The one noticeable thing amongst everything he and people representing have said about this tape, is there nowhere does anybody deny it was his voice.

 

They also are not confirming it's his voice either. They have addressed the comments as unexceptionable but they haven't admitted that it's him on the recording.

 

Hey Ace what color is his girlfriend who made the tape? Answer me that and then tell me Sterling doesn't approve of "inter-racial relationships."
