Obviously the bulk of the evidence is and will remain very closely guarded secretes because the intelligence agencies don't want Putin and other foreign countries and actors to find out about their methods, software, resources, and especially human resources.

But you, all your socks and tenguy purposely ignore the best evidence. Members of congress have seen the classified evidence our intelligence agencies have and not one of them is denying the evidence and many of them in both parties are calling for special investigations.

Here’s The Evidence Russia Hacked The Democratic National Committee

You are probably not on the list of people who have access to the classified evidence regarding the massive influence operation that targeted the 2016 U.S. presidential campaign. Most who have, including President Barack Obama, Republican Senate Majority Leader Mitch McConnell, Republican Senate Armed Services Committee Chairman John McCain, and pretty much every Democrat in Washington D.C., believe the U.S. intelligence community which has concluded with “high confidence” that the operation was directed by Russia. A distinct minority, a handful really, including Donald Trump, say the evidence is inconclusive and the intelligence community is wrong.

If you’re unwilling to trust either camp, or if you want to find out if one side is acting in bad faith, you have little public information on which to form your own opinion. So how can a citizen decide whether Russia just tried to undermine the core exercise of American democracy or even, as the CIA has reportedly concluded, tried to get Donald Trump elected?

Beyond the statements of the public figures above, the only real evidence comes from the analyses of private cybersecurity firms that track and defend against hackers, often in concert with the FBI, NSA and other government agencies.

One, CrowdStrike, was called in by the Democratic National Committee to analyze the hack against their computer system last April. With the DNC’s permission, CrowdStrike then posted details of what it had found. Attribution of hackers, whether by intelligence services or private firms, is a particular discipline. Much of it relies on signature methods used by the hackers, specific pieces of code, and distinguishing behavior.

CrowdStrike’s co-founder, Dmitri Alperovitch, uncovered evidence that two groups of Russian hackers he had named Cozy Bear and Fancy Bear, had been behind the DNC hack. Cozy Bear used a tool called SeaDaddy that allowed it to stealthily exfiltrate information from a victim’s computer. The tool was almost identical to another exfiltration tool previously identified by Symantec as belonging to the group of Russian hackers known to have operated at the behest of Russia’s FSB, a main successor agency to the KGB.

CrowdStrike also found the other group of hackers, Fancy Bear, was sending command and control instructions from a server with an Internet Protocol (IP) address of 176.31.112.10. This was the same IP address that was linked to command and control of an attack against the German parliament in 2015. The DNC attacker also used a special program to open a communication channel with the command and control server that was identical in form and function to the one used in the German hack. Microsoft had previously identified the communication program as belonging to Fancy Bear, which Microsoft had named “Strontium” at the time.

Crowdstrike’s analysis includes other evidence of Russian connections. One of the elements of a truly advanced hack is that it opens, and keeps open, a hidden communication channel with the hacked network, allowing it to continue to avoid detection and to find and steal information in other parts of a hacked computer network. In the DNC hack, the software that opened the hidden communication channel was a piece of software known to have been used by Fancy Bear.

Subsequent analyses by other private firms found other evidence that Russia was behind the hack. And as the attacks broadened over the course of the 2016 campaign to include the DCCC and the email of Hillary Clinton’s campaign chief, John Podesta, private firms found evidence linking the new hacks back to the DNC hack.

The private firms admit their open source evidence is not conclusive, but say in the world of cyber-attribution, this is close to as good as it gets. Those familiar with the classified evidence say there is even more convincing information that has not been released. President Obama has ordered a review of the influence operation, the results of which will be released before he steps down on Jan. 20, 2017.

Majority Wants Monday’s Electoral College Vote Postponed In Wake Of Russia Scandal: New Poll

WASHINGTON ― A majority of American voters favor delaying the Electoral College vote scheduled for Monday until electors can be fully briefed on Russian interference in the election, according to a new poll conducted by YouGov.

The survey, sponsored by the progressive advocacy group Avaaz, found 52 percent of people supportive of stalling the vote.

A surprisingly high number of people ― 46 percent ― were also willing to support so-called “faithless electors,” the name given to members of the Electoral College who spurn the vote of their home state and vote for a different candidate instead.

President-elect Donald Trump’s opponents have been pressuring electors to break with their state’s voters, and a law firm has even offered pro bono, confidential legal advice to any elector curious about his or her options. Avaaz has collected thousands of signatures on a petition calling for the vote to be delayed.

Trump won a fairly wide Electoral College victory on Election Day, but Hillary Clinton is on pace to beat him in the popular vote by some 3 million. In a sign of how divided the country is, however, more than 1 in 4 Republicans believe that Trump in fact bested Clinton in the popular vote. That belief may stem from a false claim Trump himself made on Twitter, when he said that he would have won the popular vote had millions of people not voted illegally. That came after a separate claim from Trump, in which he said he could have won the popular vote if he had wanted to, by campaigning in highly populated states like California and New York.

Some states mandate that electors vote the way their state instructs, but the 10th Circuit Court ruled late on Friday that electors who vote their conscience rather than their state’s preference cannot be removed as electors. The court covers the region of Colorado, Oklahoma, Kansas, Utah and Wyoming.

Only one elector has publicly said he will be breaking from Trump.

Four Ways to Prevent Donald Trump from Becoming President

We are now just barely a month away from Donald Trump being sworn in as the 45th President of the United States. There is a fever pitch of momentum on social media, and among many Democrats (and moderates alike) to do anything possible to prevent Trump from heading to the White House. The reality is that Trump will be taking the oath of office on January 20th, 2017. But, here at LawNewz.com, we love to use our legal skills to go through the “what-if” scenarios. For all the dreamers out there, here are several actual legal scenarios that could (but probably won’t) prevent Donald Trump from becoming President.

1. Electoral College dumps Trump

ADVERTISING
The first scenario is the easiest (but still very unlikely.) On Monday, 538 electors are expected to meet across the country to cast their vote for president. Right now, there are 306 Republicans and 232 Democrat. Trump will obviously win if everyone follows the rules. However, if at least 37 GOP electors break from their respective state’s popular vote and opt for another candidate, they could upend the results.

The National Archives takes us through the process of what happens next:

“If no candidate receives a majority of Electoral votes, the House of Representatives elects the President from the 3 Presidential candidates who received the most Electoral votes. Each state delegation has one vote. The Senate would elect the Vice President from the 2 Vice Presidential candidates with the most Electoral votes. Each Senator would cast one vote for Vice President. If the House of Representatives fails to elect a President by Inauguration Day, the Vice-President Elect serves as acting President until the deadlock is resolved in the House.”

Harvard Law Professor and Constitutional Law expert Lawrence Lessig told LawNewz.com on Friday that he knows of “at least 30” electors who are thinking of voting their conscience (i.e. not voting for Donald Trump.) So, say there are 37 GOP deflectors that all decided to vote for John Kasich. Once the vote went to the House of Representatives, they would decide between Trump, Clinton and Kasich. In that scenario, a Republican would surely win because there are more “red” states. Then the pressure would be on to flip states against Donald Trump if there was an alternative GOP candidate.

Of course, there is also the problem that many states have laws on the books that punish Electors who are faithless. However, some Constitutional experts believe these laws would not stand up in court. The Constitution, experts like Lessig argue, allows electors to vote their conscience in scenarios where the person elected to be President is unfit. Either way, if this happened? Big legal mess!

2. Obama declares Martial law

So here’s the most far fetched one. The 12th Amendment sets the term limits for Presidents. However, if President Obama (or Congress) declares “martial law” and effectively suspends the Constitution, Obama could, at least temporarily stay in office. There is a lot of debate if the President even has the legal authority to do that. But, if he did, military authority would supersede civilian laws during the period of the “Emergency.” I’m not going to elaborate too much further on this one, suffice it to say it is very unlikely.

3. Delayed Electoral College Vote

On Wednesday, Rep. Don Beyer (D-Virginia) called for a delay of the Electoral College vote because of the CIA’s reported determination that Russia meddled with the 2016 election to help Donald Trump win. As we analyzed last week, a delay would be very,very difficult, and literally take an Act of Congress. However, it is not impossible.

There is no date mentioned in the Constitution for when the Electoral College must meet. Instead, the date was set by congressional statute 3 U.S.C. 7 which states:

The electors of President and Vice President of each State shall meet and give their votes on the first Monday after the second Wednesday in December next following their appointment at such place in each State as the legislature of such State shall direct.

The law setting the date was passed in 1948, and there has never been a presidential election in which the vote was postponed, according to our research. The U.S. Constitution requires that the electors in each state meet on the same day. So, in order to change the date, Congress would literally have to intervene and pass a law, which would then have to be signed by President Barack Obama. Even if that did happen, it is still likely the new date would be set before Inauguration Day.

4. Impeachment of Donald Trump

Don’t hold your breathe on this one either, especially because Trump comes into office with both a GOP controlled House and Senate, but there is always the possibility that he could be impeached once he takes over.

Article II of the Constitution states “The President, Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and conviction of, Treason, Bribery, or other High Crimes and Misdemeanors.” The U.S. House of Representatives can impeach, while the Senate must try all impeachments. Two thirds of Senators must vote for a conviction. While most legal experts believe that impeachment is solely reserved for crimes while someone is in office, there is some room for legal debate.

As LawNewz.com’s Elura Nanos discovered, there is precedent for impeachment involving conduct preceding from when a person takes federal office:

The case involved the 2010 impeachment and conviction of District Court for the Eastern District of Louisiana Judge Thomas Porteous. Porteous was removed from the bench after Congress concluded that he had been involved in corruption, committed perjury, accepted bribes from lawyers practicing in his court, and attempted to conceal his sordid past during the confirmation process. During those impeachment proceedings, the timing of Porteous’ wrongdoing never surfaced as any true obstacle.

Let’s say that President Obama does agree to de-classify intelligence briefings, and we figure out that Trump did, in fact, intervene and encourage Vladimir Putin to interfere with the U.S. election. You can bet many will argue that this is grounds to begin an impeachment proceeding, despite the fact the alleged conduct happened before he took office.

First I think any fool, including you, knows full well that an adversary country is always very interested in the internal problems of another country. Because if they can learn about those problems they can exploit them and make those internal problems worse and hopefully cripple their adversary from within.

But that is not what Russia is being accused of doing here. What Russia did was hack into our political institutions, especially the DNC and DCCC in order to interfere in the US Presidential election and try to hurt Hillary Clinton and help Donald Trump because Trump, his campaign, and his political appointees are pro-Putin/Russia.
