Mollie Tibbetts’ family fights back against anti-immigrant narrative
In his eulogy, Tibbetts' father praised the Hispanic community, while another relative pointed to male entitlement as the real problem.

Mollie Tibbetts was 20 years old when she left to go for a run in Brooklyn, Iowa on the evening of July 18. She never came back.

Weeks after her disappearance, her body was found in a field in Poweshiek County. She was murdered, and law enforcement officials said the man accused of killing her, Cristhian Rivera, 24, was an undocumented immigrant.

Rivera’s lawyers claimed he was in the country legally, but the right immediately jumped on the case. For them, Tibbetts’ death — according to everyone from online, right-wing trolls to the president himself — was proof the country needed to crack down on Mexican immigrants and build a wall.

In the days since Tibbetts’ body was discovered, however, her family has pushed back against that narrative.

In a video posted to Twitter last week, President Trump referenced critics of his administration’s family separation policy — a practice that referred parents detained at the border for prosecution and forced their children into juvenile detention centers with histories of abuse and neglect — comparing the plights of those separated immigrant families with Tibbetts in a racist monologue.

“Mollie Tibbetts, an incredible young woman, is now permanently separated from her family,” he said. “A person came in, from Mexico, illegally, and killed her. We need the wall. We need our immigration laws changed. We have tremendous crime trying to come through the borders. We have the worst laws anywhere in the world.”

The official White House account also tweeted about the case, alluding again to the reprehensible family separation policy.

At Tibbetts’ funeral Sunday, her father, Rob Tibbetts, alluded to the president’s remarks, suggesting Trump was not only wrong, but that hateful commentary was not what his daughter would’ve wanted.

“The Hispanic community are Iowans,” he said. “They have the same values as Iowans…. As far as I’m concerned, they’re Iowans with better food.”

He added, “The person best equipped to help us through this is Mollie. So let’s try to do what Mollie would do. Let’s say what Mollie would say.”

Rob Tibbetts’ comments are the latest in a line of statements from Mollie’s family hitting back at the racist, anti-immigrant narrative pushed by the president and his supporters.

Last week, Tibbetts’ second cousin, Sam Lucas, responded to a tweet from right-wing troll Candace Owens asking what the left would do for Tibbetts’ family.

“Leftists boycotted, screamed, and cried when illegal immigrants were temporarily separated from their parents,” Owens tweeted. “What will they do for Mollie Tibbetts?”

“[W]e are not so fucking small-minded that we generalize a whole population based on some bad individuals,” Lucas responded. “[N]ow stop being a fucking snake and using my cousins [sic] death as political propaganda. [T]ake her name out of your mouth.”

In an interview with CNN, Lucas said that although she hadn’t known Tibbetts well, she knew enough to believe “she would not want this to be used as fuel against undocumented immigrants.”

Another relative, Sandi Tibbetts Murphy, released a similar statement on Facebook over the weekend. “Especially for those of you who did not know her in life, you do not get to usurp Mollie and her legacy for your racist, false narrative now that she is no longer with us,” she wrote. “Yes, [Rivera] is an immigrant to this country, with uncertainty to his legal status. But it matters not.”

Murphy said the real problem, one that may have led to Tibbetts’ death, was male entitlement.

According to the Washington Post, Rivera told police he had seen Tibbetts’ running the night of July 18, and “approached her, and ran alongside or behind her, even relaying to authorities that Tibbetts had grabbed her phone and threatened to call the police.” After pursuing Tibbetts for several minutes, Rivera said he abducted her.

Murphy alluded to that account in her Facebook post, writing, “[Rivera] is a man who felt entitled to impose himself on Mollie’s life, without consequence. He is a man who, because of his sense of male entitlement, refused to allow Mollie the right to reject his advances — the right to her own autonomy. Mollie was murdered because a man denied her right to say no.”

She added, “Our national discussion needs to be about the violence committed in our society, mostly by men […].”

*Murphy is correct: on average, between two and three women are murdered by their domestic partners every day — and that number is likely too low considering how many domestic abuse cases go unreported. Additionally, immigrants are actually significantly less likely to commit crimes than native born Americans.

As the Post noted in 2015, immigration and crime have even had inverse trajectories since the 1990s, as immigration rates have risen while crime as fallen.

This is to say: Mollie Tibbetts was not murdered because undocumented immigrants are dangerous — they aren’t. As Murphy notes, she was murdered because a man did not listen when she said no. And as Tibbetts’ family has argued, the focus on her alleged killer’s immigration status not only erases the reality of immigrant crime, it also taints the space they need to mourn and remember what she would have wanted them to remember.

It made sense for the United States to welcome refugees from Nazi and Communist tyranny. A lot of these refugees were people of substance like Albert Einstein and John Von Neumann, who was instrumental in developing the atomic bomb, and the first workable computer.

Jewish refugees from the Holocaust did not engage in acts of terrorism against their host countries. Muslim refugees do.

Chinese refugees from Communist China and Vietnamese refugees from Communist Vietnam are good people. I have known, dated, and been in love with a few.

The current group of refugees are not fleeing the tyranny of our enemies. They are fleeing the inability of their kind of people to create viable societies.

We are often told that immigrants have lower crime rates than American citizens. I have never seen this claim documented. I would like to see it broken down by demographics. Is it really true that Hispanic immigrants have a lower crime rate than non Hispanic whites who were born in the United States? I have serious doubts.

Yes I certainly think and still believe that Trump and his administration coming up with one of the cruelest possible of separating children and parents, literally child snatching, based on racism more than anything else, should be opposed and protested by everyone. Especially, when the Trump administration did it with no plans beyond separating children and parents. They didn't have proper facilities for holding them, and didn't even have a data base to track the children and parents, and still don't. They deported parents they can't even find and are in violation for court orders. And they systematically blocked legal entry where asylum seekers could claim asylum according to US LAWS.

The Uncertain Fate of Migrant Children Sent to Foster Care
A system designed for abused and neglected kids now must handle thousands who have been forcibly separated from their parents.

In April, President Donald Trump signed a declaration to create the first-ever National Foster Care Month. The month of May, it said, would celebrate those who provide temporary homes to children without parents or guardians. But May would also recognize a darker reality—“the plight of innocent children who are in foster care because their lives have been disrupted by neglect or abuse.”

Today, the American foster care system is bracing for an influx of children whose lives have been disrupted by the Trump administration itself. According to a Monday report from the Washington Examiner, approximately 250 migrant children are being taken from their parents or guardians per day as a result of Trump’s new family separation policy. If that trend continues, as officials expect it to, around 30,000 children would be in the government’s custody by August. That figure doesn’t include the thousands of minors who show up at the border without a guardian every month, a number that has increased significantly in 2018.

The Trump administration insists these kids will be alright. “The children will be taken care of—put into foster care or whatever,” White House chief of staff John Kelly told NPR in May. That’s exactly what’s happening. “As the Trump administration takes more migrant children into custody at the Mexico border,” The Washington Post reported last month, “new statistics show the government is placing a growing number in long-term foster care, sometimes hundreds of miles from their jailed parents.”

But the foster care system is already struggling to provide stable living situations for the 500,000 children who need assistance. The number of kids entering the system has increased every year for the last four years, but there hasn’t been a concomitant increase in social workers to help them and group homes or families willing to take them in. “American foster care,” the Post reported last year, “is in crisis.”

Trump responded to this growing problem in February by signing into law a massive overhaul of the system that redirects funding and resources for foster care services toward programs that keep children with their parents. But what about children whose parents have been jailed or deported by immigration officials? Can a strained system designed for abused and neglected American kids handle an influx of child migrants who are struggling with their own unique problems?

Unlike their parents, children apprehended at the border can only be legally held in immigration detention facilities for three days. After that, they must placed in the custody of the Department of Health and Human Services’ Office of Refugee Resettlement. While ORR employees search for permanent placements, they put the kids in temporary shelters run by outside contractors.

Children forcibly separated from their parents are legally considered Unaccompanied Alien Children, a designation normally reserved for kids who show up at the border by themselves. According to HHS data, these children spend an average of 51 days in temporary shelters. Eighty-five percent eventually ended up in “sponsor homes” with U.S.-based relatives. About 10 percent wind up in foster care.

The White House insists the statistics will be different for the separated children; that they’ll returned to their parents within five to ten days. But that’s not how things are playing out in reality, said Sandy Santana, the executive director of Children’s Rights, one of the organizations suing the Trump administration over its separation policy. “We’ve heard stories of parents being deported and their children being left behind,” he said. “And then kids are being sent all over the country, and that distance makes it less likely that these reunifications are going to take place quickly. So our fear is that many of these children will linger in foster care.”

That may be happening already. A Seattle foster care facility, for example, recently accepted six children who were separated from their families at the border. And Michigan foster care agency Bethany Christian Services has helped place 58 separated migrant children since May 1, a representative said. That’s a major increase from January, when BCS only placed one separated migrant child. Today, children impacted by Trump’s policy make up 75 percent of the agency’s caseload.

Other organizations say they haven’t served any affected children. “We really haven’t been impacted,” said a spokesperson for the U.S. Conference of Catholic Bishops. But that’s because that group only provides resources for more permanent, long-term foster care. “We don’t really have any short-term, transitional sites,” he said.

But some separated migrant children will eventually end up in long-term foster care, former head of U.S. Immigration and Customs Enforcement John Sandweg said in a Tuesday interview with NBC News. “Permanent separation. It happens,” he said, adding that Trump’s policy “could be creating thousands of immigrant orphans in the U.S.” He added that long-term separations normally happen because parents are deported before their children are processed separately.

“Foster care is not a good option for anyone,” Santana told me, citing woeful outcomes for kids that go through it. But it’s an especially bad option for migrant kids, he said, because they’re entering a place for abused and neglected children even though they themselves haven’t been abused or neglected. “You’re imposing trauma on them unnecessarily,” Santana said.

Foster care is supposed to be a last resort for children who face danger in their own homes—the number of whom is rising. After hitting a 25-year low in 2012, the number of kids in foster care increased by 10 percent nationwide from 2012 to 2016; in six states, it has increased by more than 50 percent. That’s largely due to the opioid epidemic, Santana said. “We’re now seeing systems with very high case loads, a lack of foster homes to place kids, and a reliance of group homes, which are not the best settings for kids,” he said. “We are especially worried that these influx of kids from the border are going to further tax the system.”

If 10 percent of the 30,000 kids expected to be under HHS care by August end up in the foster system, that’s another 3,000 children—admittedly a blip in a system that already serves nearly 500,000 kids. But Santana worries that the figure could be higher, because many potential sponsors now fear deportation if they come forward to take in a child. The relatives of migrant children are often undocumented themselves, or live with undocumented people. “There have been cases where the Trump administration has gone after sponsors who choose to take care of kids,” Santana said.

But the number of new kids entering the foster care system is not what worries Santana; it’s the amount of resources and effort it will take to heal their unique wounds. “These are going to be kids who need deep trauma services because of the trauma of being separated from their parents,” he said. “Even more challenging for the system is that close to all of these kids don’t speak English, and finding Spanish-speaking resources is very difficult.”

The bill Trump signed in February intends to ease the growing burden on the foster care system by preventing kids from entering it in the first place. As USA Today reported, the new law “puts more money toward at-home parenting classes, mental health counseling and substance abuse treatment—and puts limits on placing children in institutional settings such as group homes.” Santana’s organization supports the bill, because he says ultimately it will reduce the number of kids in foster care and free up space for kids who really need it. But he noted that migrant children separated from their parents won’t likely see the benefits of this new law since most of its provisions don’t take effect until October of 2019 or later.

In April, Trump hailed the law as a way to create “more desirable family atmospheres,” based on the well-founded belief that children always fare best when they’re able to remain with their parents. *But since then, he’s made clear that his belief in keeping families intact doesn’t extend to those who are in the most desperate circumstances of all.

Trump officials identify 497 migrant children still in custody

Hundreds of children separated from their parents at the U.S.-Mexico border remain separated, according to a court filing on Thursday.

The filing from the Justice Department and American Civil Liberties Union shows that 497 children remain in U.S. government custody, CNN reports.

Twenty-two of those children are under the age of 5, according to the report. The parents of 322 children have been deported, including the parents of six children 4 years old or younger, CNN reported.

Only 14 children were reunited with their parents since last week, according to the government. In total, 1,937 children have been reunited with their parents by the Trump administration.

A federal judge originally set a deadline of July 26 for the government to reunite families it separated at the border, but as of that date 711 children still had not been reunited with their parents.

The family separation crisis was sparked by the Trump administration’s “zero tolerance” policy imposed earlier this year, which referred all adults who crossed the border illegally for criminal prosecution.

That resulted in an increase in adults placed in U.S. custody as they awaited legal proceedings, separating them from their children, who were sent to juvenile facilities.

El Salvador says three migrant children separated from their families were sexually abused at U.S. shelters

Three children from El Salvador who were separated from their families after immigrating to the U.S. were sexually abused in detention centers in Arizona, according to a Salvadoran government official.

The alleged victims — all in their teens — are still in government custody and have not been reunited with their families, Deputy Foreign Relations Minister Liduvina Magarin said.

Magarin, speaking to reporters in El Salvador on Thursday, said U.S. officials should immediately release the children from detention “to shield them … from being abused.”

Accusations of sexual abuse at detention centers have emerged in recent weeks. Former employees at two Arizona shelters run by Southwest Key, a Texas-based nonprofit, are facing criminal charges.

In her news conference, Magarin did not name the shelter or shelters where the young immigrants are being held, and she did not detail the alleged abuse, apart from saying: “They are sexual violations, sexual abuses, that is what this is about.”

An official at the Department of Health and Human Services, which is in charge of caring for immigrant minors who have been separated from their families, said Friday that “without additional details, we are unable to confirm or deny these allegations took place.”

Agency spokeswoman Victoria Palmer said the government acts quickly when abuse is reported, immediately informing authorities, taking corrective action with accused employees and transferring victims to other facilities.

The agency has contracts with 100 immigrant shelters in multiple states, including several in Arizona.

In the last month, two employees at separate Arizona facilities were charged with sexually assaulting immigrant teenagers.

One of them, Fernando Magaz Negrete, 32, was charged with sexual abuse and child molestation after a witness said they saw him fondling and kissing a 14-year-old female detainee in June.

Levian D. Pacheco, 25, is charged with sexually assaulting eight teenage boys over a yearlong period ending in July of last year. His trial in federal court began this week in Phoenix.

The men were employed at two facilities operated by Southwest Key, which is based in Austin and runs 26 migrant child care shelters in three states.

Several weeks ago, a ProPublica investigation found that police had received at least 125 reports of sex offenses at shelters that mostly house migrant children over the last four years.

According to the criminal complaint against Pacheco, he was accused of entering a bathroom at a Southwest Key shelter in Mesa during the early hours of the morning while a 17-year-old boy was washing his hands. The complaint alleges Pacheco began to touch him inappropriately.

Another 17-year-old victim said Pacheco molested him beneath blankets on a bed. A third 17-year-old victim, also reported being touched sexually by Pacheco. The complaint says the acts all occurred in July 2017.

Antar Davidson, who once worked at a Southwest Key facility in Tucson, agreed the background checks were stringent — noting he had his employment delayed by months as he sought to resolve a misdemeanor shoplifting charge that appeared on his record. He said he no longer works for Southwest Key.

Davidson said the system — not just at Southwest Key — is set up in a way that can allow abusers to operate because they hold positions of power over a frightened, disoriented population of children.

“Most of the kids are under a lot of pressure. The kids are always told that things go on their court record,” Davidson said Friday. “They’re very aware and they know they have to keep their head down to get out. It’s the kind of thing where there is opportunity for abusers to work among kids who don’t come from a tradition of self-advocacy. They almost have no incentive to further complicate their situation.”

In early August, after reports of problems at shelters surfaced, Southwest Key issued a statement saying all children at their facilities have the “right to be free from abuse or neglect in this program and this country. This message is repeated to the children throughout the duration of their stay at our shelters.”

The nonprofit added that it is cooperating with authorities, fully complies with background and fingerprint requirements and trains staff to recognize and report abuse.

As for the three children from El Salvador, Magarin said the Salvadoran government has provided attorneys to the families of the alleged victims. It will be up to them to decide whether to take legal action, she said.

The government also plans to provide the alleged victims with psychological assistance, she said.

"The psychological and emotional impact is lifelong, and we are attending to that,” Magarin said.

The allegations of abuse come amid criticism that the Trump administration is taking too long to reunite separated families, despite a federal court order to do so.

While most families have been reunited, hundreds remain apart.

The mass separation of immigrant families was a result of President Trump’s “zero tolerance” immigration policy, which called for the criminal prosecution of all people who illegally enter the United States. When parents were referred for prosecution, their children were place in shelters or in the custody of a sponsor.

Trump halted that policy in June.

El Salvador says three migrant children separated from their families were sexually abused at U.S. shelters

Three children from El Salvador who were separated from their families after immigrating to the U.S. were sexually abused in detention centers in Arizona, according to a Salvadoran government official.

The alleged victims — all in their teens — are still in government custody and have not been reunited with their families, Deputy Foreign Relations Minister Liduvina Magarin said.

Magarin, speaking to reporters in El Salvador on Thursday, said U.S. officials should immediately release the children from detention “to shield them … from being abused.”

Accusations of sexual abuse at detention centers have emerged in recent weeks. Former employees at two Arizona shelters run by Southwest Key, a Texas-based nonprofit, are facing criminal charges.

In her news conference, Magarin did not name the shelter or shelters where the young immigrants are being held, and she did not detail the alleged abuse, apart from saying: “They are sexual violations, sexual abuses, that is what this is about.”

An official at the Department of Health and Human Services, which is in charge of caring for immigrant minors who have been separated from their families, said Friday that “without additional details, we are unable to confirm or deny these allegations took place.”

Agency spokeswoman Victoria Palmer said the government acts quickly when abuse is reported, immediately informing authorities, taking corrective action with accused employees and transferring victims to other facilities.

The agency has contracts with 100 immigrant shelters in multiple states, including several in Arizona.

In the last month, two employees at separate Arizona facilities were charged with sexually assaulting immigrant teenagers.

One of them, Fernando Magaz Negrete, 32, was charged with sexual abuse and child molestation after a witness said they saw him fondling and kissing a 14-year-old female detainee in June.

Levian D. Pacheco, 25, is charged with sexually assaulting eight teenage boys over a yearlong period ending in July of last year. His trial in federal court began this week in Phoenix.

The men were employed at two facilities operated by Southwest Key, which is based in Austin and runs 26 migrant child care shelters in three states.

Several weeks ago, a ProPublica investigation found that police had received at least 125 reports of sex offenses at shelters that mostly house migrant children over the last four years.

According to the criminal complaint against Pacheco, he was accused of entering a bathroom at a Southwest Key shelter in Mesa during the early hours of the morning while a 17-year-old boy was washing his hands. The complaint alleges Pacheco began to touch him inappropriately.

Another 17-year-old victim said Pacheco molested him beneath blankets on a bed. A third 17-year-old victim, also reported being touched sexually by Pacheco. The complaint says the acts all occurred in July 2017.
