Florida Gov. Ron DeSantis calls for legislation aimed at cracking down on disorderly protests

Florida Gov. Ron DeSantis introduced proposed legislation that would include new criminal offenses for individuals involved in "violent or disorderly assemblies."

(CNN)Florida Gov. Ron DeSantis released a sweeping set of proposals on Monday that would dramatically crack down on people who attend protests that turn violent or disorderly by threatening them with a mix of felonies and increased jail time.

The proposals, which DeSantis, a Republican, called the "boldest and most comprehensive" piece of legislation on the issues of civil disobedience and protest in the US, were aimed squarely at "those who target law enforcement and participate in violent or disorderly assemblies," he said in a tweet.

Collectively, the proposed legislation represents a dramatic -- if still merely proposed -- escalation in the Florida governor's embrace of President Donald Trump's calls for "law and order."

Those followed a summer of nationwide protests have taken place in cities since the killing of George Floyd on May 25 by Minneapolis police officers.

While the wide majority of the protests remained peaceful -- a report from September 4 found that 93% of racial justice protests since Floyd's death have been peaceful and nondestructive -- a minority were interrupted by violence.

DeSantis said the proposal, which was introduced at a Monday press conference -- called the Combatting Violence, Disorder and Looting and Law Enforcement Protection Act -- would impose stiff criminal penalties for actions such as blocking roadways, disrupting restaurants or toppling monuments.

"You see videos of these innocent people eating dinner and you have these crazed lunatics just screaming at them and intimidating them on a public accommodation," DeSantis said. "You aren't going to do that in state of Florida."

Micah Kubic, executive director of the ACLU of Florida, responded to the proposal in a statement, calling it "undemocratic and hostile to Americans' shared values."
"This effort has one goal: silence, criminalize, and penalize Floridians who want to see justice for Black lives lost to racialized violence and brutality at the hands of law enforcement," Kubic said.

Among the proposals is a measure allowing motorists to be waived of liability should they happen to kill or injure a protester with their vehicles while "fleeing for safety from a mob."

The governor said the legislation also enables the state to use RICO liability against anyone who organizes or funds these kinds of "disorderly assemblies," and he cited the handling of Portland's protest as an example of what not to do.

"What you have to have is clear and predictable penalties," DeSantis said. "I look at what goes on in Portland and they'll have people, they'll arrest them. These are scraggly looking Antifa types. They get their mugshot taken and then they get released. And it's like a carousel and on and on it goes."

Gov. Cuomo criticized for falsely claiming nursing homes weren’t forced to accept COVID patients

New York Governor Andrew Cuomo has come under fire for denying nursing homes were forced to accept COVID positive patients. In a press call Wednesday, he was asked about his March mandate, which ordered nursing homes to accept the readmission of COVID positive patients from hospitals.

According to New York’s Department of Health, more than 6,300 COVID patients were admitted to nursing home facilities. This move likely spiked the death rate in the state.

However, Cuomo has said the state never needed nursing home beds. He has suggested there were always other beds available.

“It just never happened that we needed a nursing home to take a COVID positive person,” he stated. “It never happened.”

An adviser claimed the governor was specifically referencing a shortage of hospital beds when he made the statement.

Cuomo has repeatedly been slammed over the nursing home mandate. He issued an executive order in May to ensure patients tested negative before being sent to nursing homes.

Georgia Republican Marjorie Greene slams House vote to condemn QAnon
House overwhelmingly voted in favor of bipartisan resolution Friday: 371-18

Marjorie Greene, the presumptive next congresswoman from Georgia's 14th congressional district, slammed the House for passing the resolution and said "Congress is failing" for not focusing on condemning Antifa and Black Lives Matter instead.

"There's no reason for a resolution to condemn non-existent violence from folks talking about the VERY REAL Deep State and the attempted coup on President Trump on the internet," Greene told Fox News in a statement about QAnon.

Greene, a controversial candidate who has been previously censored on social media for posts deemed threatening, went on to say the real threats are Antifa, Black Lives Matter and the Democrats who support the groups.

"Republicans should lead strongly by standing up for innocent Americans against this smear and rightfully designate Black Lives Matter and Antifa both domestic terror organizations," Greene said. "The fact that Democrats refuse to condemn the real domestic terrorists BLM and Antifa is what Americans should remember when they go to vote on Nov. 3."

Rochester mayor indicted on fraud, campaign finance violations

A grand jury has indicted the mayor of Rochester, New York on felony fraud charges. A district attorney announced two charges against Mayor Lovely Warren on Friday.

She has been accused of breaking election and campaign finance laws, as well as attempting to defraud another person.

Two associates of the Democrat mayor’s campaign are also facing charges for their hand in defrauding and violating New York’s campaign finance laws.

Warren has since denied the allegation and is calling the charges a political witch hunt. However, the district attorney has pushed back on the claim.

“This is not political,” stated District Attorney Sandra Doorley. “My team presented the case to a grand jury, as we would any other case, and the result is the indictment we’re handing down today.”

The news is the latest blow to the city following the death of Daniel Prude, which recently sparked demonstrations and protests in the area.

Whitmer supports 'spirit' of efforts to 'defund the police'

Gov. Gretchen Whitmer said Tuesday she supported the “spirit” of efforts to defund the police in the wake of George Floyd’s death last month at the hands of Minneapolis police, a statement that her office later clarified did not indicate support for eliminating funding for law enforcement.

The conversation surrounding the “defund the police” movement is really about reprioritizing resources, the Democratic governor told The Root in a Tuesday interview broadcast on Instagram.

“The spirit as you just articulated is really just about reprioritizing and rebuilding communities, not just policing,” Whitmer said.

State budgets are overwhelmingly focused on law enforcement and criminal justice, the governor told the African-American-oriented online publication, but they should be focused on education, health care, skills training, public transit and “leveling the playing field,” she said.

Gov. Whitmer thanks law enforcement amid foiled kidnap plot

Michigan Governor Gretchen Whitmer thanked law enforcement on Thursday amid an alleged plot to kidnap her. Whitmer stated she’s grateful to anyone who puts themselves in harm’s way to keep people safe.

She noted when she took the oath of office nearly two years ago, she knew the job would be hard. However, she added she would have never imagined this.

The governor thanked the “fearless” FBI agents for their work, as well as the “brave” state police troopers who participated in the operation.

“I also want to thank Attorney General Nessel, U.S. attorneys Birge and Schneider, and their teams for pursuing criminal charges that hopefully will lead to convictions, bringing these sick and depraved men to justice,” stated Whitmer.

She went on to say hatred has no place in Michigan. According to the governor, if individuals break laws and conspire to commit violence in her state, they will be brought to justice.

Prop 16 – No Truth in Advertising

One of the most disturbing political ads airing across the state this election season is a television ad urging a “yes” vote on Prop. 16, the ballot initiative that asks voters to overturn Prop. 209, the landmark California law that ended racial preferences in university admissions, government employment and contracting. One scene in the ad shows a night-time procession of young white men carrying torches. The voiceover in the scene states that the people against Prop. 16 are “those who have always opposed equality.” There’s no need to elaborate — the implications are shockingly clear.

But the stark fact is that those who are leading the opposition on Prop. 16 are minorities. African American Ward Connerly, former member of the University of California Board of Regents and whose leadership led to the passage of Prop. 209, heads the coalition group Californians for Equal Rights, which includes well over a dozen Asian American groups. This coalition includes Washington Asians for Equality, the group that led the successful fight against a measure that would have brought back affirmative action to Washington State. Another member of the coalition is Students for Fair Admission, the group of Asian students who brought the lawsuit against Harvard’s admissions policies.

The Prop. 16 ad claims that it will “level the playing field for all of us.” In fact, it will actually tilt the playing field to favor groups that are “under-represented” when compared to the state’s racial composition. Sure to be on the losing side will be Asian Americans who are “over-represented” at California’s public universities under the current system of merit established by Prop. 209.

The real problem African American and Hispanic students are contending with is the poor quality of education they are receiving in our public schools – especially those students living in poor and urban communities. As PRI’s Senior Director of Education Lance Izumi points out: “research shows that K-12 public education, not Prop. 209, is the real obstacle for underrepresented minorities entering higher education . . . . the answer is to allow more school choice options to rescue these kids from failing public schools and switch to either homeschooling or a charter, private, or religious school that will better prepare them for college.”

More than $12 million has been raised by Prop. 16 supporters, which includes Steve Balmer, former CEO of Microsoft, and the powerful California Teachers Association. Compare this to the $950,000 raised by the Coalition for Equal Rights largely coming from hard-working families who want to protect equal opportunity in admissions to California’s universities. If there was “truth in advertising”, the Prop. 16 ad ought to show the real opposition: Working- and middle class families.

The most recent poll from the Public Policy Institute of California found that 47 percent of likely California voters surveyed said they would oppose Prop. 16, while 31 percent said they would vote for it. By now voters are used to exaggerations and spin when it comes to political ads, and Californians should see right through this one.

Mich. governor impeachment resolution introduced as businesses fear new lockdown measures

Michigan Republicans recently introduced articles of impeachment against Democrat Gov. Gretchen Whitmer. State Rep. Beau LaFave formally introduced the articles Thursday along with two other GOP colleagues.

The lawmakers are accusing Whitmer of exceeding her authority by issuing government orders that aren’t in the best interest of constituents and using the pandemic as an opportunity to “reward political allies.”

This came after Whitmer issued another three-week lockdown order, limiting indoor social gatherings amid a spike in COVID-19 cases.



If impeached in the House, a trial will take place in the Senate. A two-thirds vote would be required for Whitmer to be convicted and removed.

The move would be unprecedented in Michigan’s history, but stands a good chance of getting through the state’s Congress as both chambers have a Republican majority. Additionally, it’s a move that could go over well with businesses in the state.

October data shows the state’s unemployment rate is down to 5.5 percent, which is a major drop from September’s rate of 8.6 percent. More than 4.5 million people in Michigan were unemployed in September, marking the highest number since the start of the pandemic.

Whitmer’s new lockdown measures combined with a rising number of virus cases could worsen layoffs. Workers are concerned they won’t be able to stay afloat financially and are looking to Congress to pass more stimulus relief.

 

Suspect in fatal Calif. church stabbings identified as illegal immigrant with extensive criminal history

U.S. Immigration and Customs Enforcement (ICE) officials said a homeless man arrested in connection with a pair of fatal stabbings at a Northern California church is an illegal immigrant with an extensive criminal background.

32-year-old Fernando de Jesus Lopez-Garcia allegedly stabbed five people Sunday, including two who died-at the Grace Baptist Church in San Jose.

Authorities said his criminal history includes convictions for battery of an officer, assault with a deadly weapon and vandalism. He was also previously deported three times, but protected by local sanctuary laws.

The mayor of San Jose, Sam Liccardo, slammed the county’s sanctuary policies by pointing out they allowed Lopez-Garcia to be released despite prior convictions.

“In this case, I’m told the county received an ICE detainer arrest, but did not notify ICE of the defendant’s release,” explained the mayor. “He should have been in jail, in federal custody, in drug treatment or in jail in his own country, but not on the streets in our community.”
