Punishment for Lying on ATF Form, as Hunter Biden Allegedly Did, Up to 10 Years in Prison

The punishment for lying on a Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF) Form 4473 is “up to 10 years imprisonment and/or up to a $250,000 fine.”

Form 4473 establishes a transaction record containing the information relayed to the FBI during the National Instant Criminal Background Check System (NICS) check, which is performed on every would-be gun buyer at retail.


The first paragraph on Form 4473 says: “WARNING: The information you provide will be used to determine whether you are prohibited by Federal or State law from receiving a firearm. Certain violations of the Gun Control Act, 18 U.S.C. 921 et. seq., are punishable by up to 10 years imprisonment and/or up to a $250,000 fine.” (bold in original)

The form then contains questions such as:

Are you the actual transferee/buyer of the firearm(s) listed on this form and any continuation sheet(s) (ATF Form 5300.9A)? Warning: You are not the actual transferee/buyer if you are acquiring the firearm(s) on behalf of another person. If you are not the actual transferee/buyer, the licensee cannot transfer the firearm(s) to you.

Another question on Form 4473 says:

Are you under indictment or information in any court for a felony, or any other crime for which the judge could imprison you for more than one year, or are you a current member of the military who has been charged with violation(s) of the Uniform Code of Military Justice and whose charge(s) have been referred to a general court-martial?

Question 21(c) is the pertinent one for investigators looking into Hunter Biden’s October 2018 gun purchase. That question says: Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.

On October 6, 2022, Breitbart News pointed to a Washington Post report stating agents believe they have compiled enough evidence against Hunter to bring charges for allegedly providing a false answer on the ATF form.

However, the Post made clear that the bringing of charges ultimately rests with “prosecutors at the Justice Department.”

Pompeo: Biden’s Armageddon Comments ‘Reckless’

Former Secretary of State Mike Pompeo said on this week’s broadcast of “Fox News Sunday” that President Joe Biden’s comments warning of armageddon in response to nuclear threats from Russia were “reckless.”

At a fundraiser last week, Biden said, “We have not faced the prospect of armageddon since Kennedy and the Cuban Missile Crisis.”

Discussing Russian President Vladimir Putin, Biden added, “I know fairly well. He’s not joking when he talks about potential use of tactical nuclear weapons.”

Pompeo said, “First of all, those comments were reckless. Even more importantly, they demonstrate maybe one of the greatest foreign policy failures of the last decades, which was failure to deter Vladamir Putin in the same way the Trump administration did for four years.”

He continued, “When you hear the president talking about armageddon as a random thought, just mussing at a fundraiser, that is a terrible risk for the American people. He ought to be talking to us in a serious way.”

Pompeo added, “More importantly, he should be doing the things necessary to deter Vladamir Putin. We’ve been here in October of ’62 and other times, as well, and America has pushed back by showing enormous resolve, executing quiet diplomacy in the same way we did during our time in office, making clear to Vladamir Putin the cost of him using a nuclear weapon would bring the force of the United States and Europe and the whole world against Vladamir Putin. I hope they are doing this quietly.”

He’s told other unbelievable stories that the Times failed to mention, such as the claim he confronted a gang leader named "Corn Pop" in the 1960s.

Some of Biden’s dishonest statements are political, such as the time he claimed the economy had "zero percent inflation" during July when it was actually 8.5%. Other times, they’re wildly exaggerated tidbits about his personal life. He often botches key details, misremembers dates and sometimes seems to just make up or embellish tales about his past.

He has falsely claimed he was "appointed" to the Naval Academy, dishonestly said he was arrested in South Africa, misleadingly bragged he was arrested during the civil rights movement in the United Stated, inaccurately claimed he was once a professional truck driver and oddly claimed he was "sort of raised in the Puerto Rican community at home."

Biden’s lies are sometimes repeated multiple times, often growing bigger with each exaggerated version of the actual event. He declared this week that "everything was ruined" from the basement to the attic and "we almost lost a couple firefighters" when lightning struck his home 15 years ago.

However, the Associated Press at the time reported that "no one was injured" in the "small fire that was contained to the kitchen" and under control within 20 minutes.

Greg Price, a senior digital strategist for X Strategies, put a spotlight on Biden’s fire falsehood by sharing footage of the apparent exaggeration. He believes "Biden has spent his entire career lying" but regularly gets a pass from the mainstream media.

"He constantly lies with impunity and for no apparent reason. He said he finished at the top of his law school class. He finished near the bottom. He had to drop out of the 1988 presidential race due to plagiarism. He keeps saying he was arrested during civil rights protests. He said he was arrested trying to see Nelson Mandela. He insists inflation is at or near zero percent. He says we’re not in a recession. And he says the border is closed," Concha continued. "Yet, fact-checkers either ignore the lies or try to defend them."
Fox News contributor Deroy Murdoch has seen enough.

"Joe Biden frequently recounts stories about phantom Amtrak conductors, imaginary residential infernos, and baseball glory that he never achieved," Murdoch told Fox News Digital.

"Biden could invent these non-events to make himself look good. In that case, he is a pathological liar. But, even worse, maybe he really believes that these non-events actually took place," he continued. "If so, then he is living a life of total fantasy. Liar or fabulist? The American people need neither in the White House. Joe Biden cannot be replaced as Commander-in-Chief soon enough."
