    House Republicans, led by Oversight Chair James Comer (R-KY), are now threatening to hold FBI Director Christopher Wray — himself an appointee of former President Donald Trump — in contempt of Congress, over his move to limit public availability of a document they have claimed, without any public evidence, implicates President Joe Biden and his family in crimes from when he was serving as vice president.

    But this entire thing is nonsense, said Rep. Dan Goldman (D-NY) on CNN Tuesday evening.

    "Of course, you've dealt with a lot of the Hunter Biden allegations back when you were working on the 2019 impeachment," said anchor Kaitlan Collins. "With this happening now, do you view this as legitimate oversight? Do you understand why Republicans want to hold the FBI director in contempt?"

    "No, I don't at all," said Goldman. "And I don't both for procedural reasons and for substantive reasons. First, on the procedural side, the FBI director has substantially complied by providing the chairman and ranking member access to this document, which, if disseminated to the rest of the committee, might impede on the confidentiality of sources."

    "But more importantly is that the substance of this document has been debunked over and over and over again," said Goldman. "You don't have to just take my word for it, or the 17 witnesses in the first impeachment investigation who said unequivocally that Vice President Joe Biden executed official U.S. policy by encouraging Ukraine to fire its prosecutor general because he was not prosecuting corruption, including against Burisma, but you should take the word of the Trump Department of Justice, which received this information in this document that Chairman Comber and Ranking Member Raskin looked at, they evaluated it, and they determined that it did not warrant further investigation."

    "This is just an effort for the House Republicans to rehash debunked allegations and launder them through an official committee of the Congress, in order to hurt Joe Biden and help the Republican nominee for president," Goldman added.

    So, first of all, Wray would be held in contempt for refusing to comply with a congressional subpoena, not because of a "debunked conspiracy theory".
    Second, neither the contents of the memo, or what Wray has done with it matters.
    Not at all.
    The congressional subpoena says "you will produce this document and give it to the committee."
    Now, Wray has options;
    Wray can run to court and argue that he can't/shouldn't/won't comply and hope the court gives him it's blessing.
    Or, he can produce the memo and comply with the subpeona.
    Or, he can refuse and accept the consequences.

    Pretty simple isn't it?
    All the rest is just political bloviation, and everyone knows it, eh stumbler?

    James Comer (R-KY) moved to hold FBI Director Christopher A. Wray in contempt of Congress Wednesday for not fully complying with a subpoena to produce a document that he says contains allegations from a confidential informant about President Joe Biden and his family, The Washington Post reported.

    “To date, the FBI has refused to comply with our lawfully issued subpoena and even refused to admit the record’s existence up until a week ago,” Comer said in a statement Wednesday as he released the contempt resolution. “The FBI created this record based on information from a credible informant who has worked with the FBI for over a decade and paid six figures.”

    According to Comer, who is the House Oversight Committee Chairman, the informant has firsthand information regarding a foreign national who claimed to have bribed Biden while he was vice president.

    Comer said the committee will vote on the resolution this Thursday.

    House Republicans are scrapping a high-profile vote to hold FBI Director Christopher Wray in contempt, ending a weeks-long standoff with the bureau.

    The Oversight Committee had been scheduled to meet Thursday on a resolution holding Wray in contempt of Congress as it ramped up a GOP investigation into President Joe Biden. But Chair James Comer (R-Ky.) announced Wednesday night that he was calling off the vote after the FBI offered to let all committee members review a 2020 document at the center of the standoff.

    In addition to letting the full panel review the document, known as an FD-1023, describing an interview the FBI had with a confidential informant, Rep. Jamie Raskin (D-Md.), the top Democrat on the panel, and Comer will also be able to review two additional documents.

    “Allowing all Oversight Committee members to review this record is an important step toward conducting oversight of the FBI and holding it accountable to the American people,” Comer said in a statement announcing his decision.


    Comer quickly characterized the deal as a win, saying that the FBI had “caved.” But the Kentucky Republican had previously pledged to hold the contempt vote in his committee unless the FBI physically turned a copy of the document over to the panel. He had announced the Thursday vote on Monday after he and Raskin were able to see the document and got a briefing, but were not given the document.

    But people familiar with the offer told POLITICO earlier Wednesday that the FBI was now offering to let the full committee review the document in an apparent bid to find an off-ramp to prevent the committee vote. Comer, in a joint Fox News interview with Sen. Chuck Grassley (R-Iowa) just hours before the agreement was announced, confirmed the bureau had put new potential deals on the table and was actively negotiating.

    The deal is in line with a bar set by Speaker Kevin McCarthy, who said repeatedly that if Wray let the whole panel see the document, there would not be a need to hold a vote on holding the FBI director in contempt. Speaking with reporters earlier Wednesday, McCarthy pointed to Comer as deserving the credit for any agreement.

    “If [Wray] changes his position and provides it for everybody, I want to thank Chairman Comer for being strong,” he said.

    Some conservatives had voiced confidence that they would have the support among Republicans on the House floor to hold Wray in contempt. But it would also be a historic vote and with only a five-seat majority, it would likely put some of their more pragmatic members in a tough spot.

    At the center of the standoff is a document that Republicans allege ties then-Vice President Joe Biden to a “bribery scheme.” The forms themselves, regardless of their content, do not independently amount to evidence of wrongdoing and the FBI has warned that they contain unverified information.

    The document has ties to a Trump-era inquiry led by then-U.S. Attorney Scott Brady, who was tasked with investigating claims made by Rudy Giuliani, who was at the time Trump’s personal attorney. Though Democrats and Republicans have spent the days since Monday’s briefing sparring over what was said behind closed doors, they are in agreement that the document was created when the bureau, searching for information that could be related to the Brady inquiry, re-interviewed an informant in June 2020.

    The informant, Comer noted, was viewed by the FBI as credible, and had been paid six figures by the bureau dating back to the Obama years.

    The broader Brady inquiry, the FBI told Raskin and Comer this week, was closed in August 2020. But Republicans have highlighted that the document was reportedly handed over to DOJ prosecutors in Delaware, who have been conducting a years-long investigation into Hunter Biden, the president's son.

    Both Comer and Raskin have confirmed that the allegation is related to Ukraine — as were many of the claims Trump’s then-lawyer was circulating during the 2020 election. GOP Oversight aides have stressed that there is nothing in the 2020 document that shows a direct link to Giuliani, and that his name is not mentioned, but Democrats have characterized the allegation as similar to those he had previously passed along to the Trump-era Justice Department.

    Raskin, in a statement after Comer’s decision, praised the FBI for operating “in a spirit of good faith” and accused Republicans on the panel of trying to “ignore the facts that undermine their false narratives.”

    “Holding someone in contempt of Congress is among the most serious actions our Committee can take and it should not be weaponized to undermine the FBI,” Raskin said. “As Republicans’ investigation into President Biden has uncovered no evidence of wrongdoing, they continue to attempt to discredit and dismantle the FBI to help prop up Donald Trump’s poll numbers.”

    Reacting to a Donald Trump screed about his impending indictment by the Department of Justice, MSNBC political analysts scoffed at the former president's belief that GOP lawmakers can intercede on his behalf to keep him from being indicted.

    After the former president's lawyers received a DOJ notice memorializing that their client is the target of an investigation into his handling of classified materials after leaving office, Trump took to his Truth Social platform to rage, "No one has told me I’m being indicted, and I shouldn’t be because I’ve done NOTHING wrong.”

    He then added, "REPUBLICANS IN CONGRESS MUST MAKE THIS THEIR # 1 ISSUE!!!”

    As MSNBC's Steve Benen noted, Trump-supporting lawmakers can make threats but they have no power over stopping special counsel Jack Smith's endeavors.

    Pointing out "Trump genuinely seems to believe that congressional Republicans have a role to play in his intensifying legal troubles," he recalled a previous letter sent by GOP lawmakers in April, who demanded a "'legislative solution," to be approved by Congress, is 'required' to prevent federal prosecutors from pursuing the case further."

    That, he notes, never came to pass.

    As for the former president's latest demands that GOP lawmakers stand between him and the DOJ, Benen wrote, "I honestly don’t know what he expects congressional Republicans to do. Congress has no control over who is or isn’t indicted. It’s possible that Trump has imagined a scenario in which lawmakers pass a bill to defund the special counsel’s office, thereby derailing the investigation, but even if the GOP-led House were to take up such a measure, it obviously couldn’t pass the Democratic-led Senate or receive President Joe Biden’s signature."

    "What we’re seeing, in other words, is a desperate criminal suspect scrambling to find someone, anyone, who can help rescue him from a crisis of his own making," he added. "Whether Trump understands this or not, his pleas won’t work."

    House Judiciary Chair Jim Jordan (R-Ohio) on Sunday sparred with CNN’s Dana Bash over former President Trump’s indictment in the Justice Department’s probe into his handling of classified documents.

    Jordan, who firmly defended Trump during the segment, stressed his stance that “the president’s ability to classify and control access to national security information flows from the Constitution” and that “he can put it wherever he wants, he can handle it however he wants.”

    But Bash pushed back, noting a recording of Trump that revealed he acknowledged he couldn’t declassify documents once he was no longer in the White House.

    “He says point blank on tape, ‘As president, I could have declassified it. Now I can’t.’ … It’s on tape as part of this indictment that he did not declassify the material,” Bash said of Trump, referring to a transcript of an audio recording obtained by CNN.



    “Saying he could have is not the same as saying he did it,” Jordan said.

    “He said, ‘Now I can’t,'” Bash said.

    “Now he can’t — right, because he’s not president now. But when he was president he did declassify,” Jordan said.

    “Which means that it’s classified. Which means that what he was holding was classified,” Bash said as the two talked over each other.

    “Not if he declassified it when he was president of the United States, for goodness sake,” Jordan said.

    “But he’s saying point blank in this audio tape that he did not declassify it. What you’re saying just doesn’t make sense on its face,” Bash said.

    Trump was indicted last week on 37 counts in connection to the mishandling of records as well as his efforts to prevent the government from recovering the documents after the end of his White House term, according to the unsealed indictment.

    Bash repeatedly pressed Jordan over Trump appearing to admit he did not declassify documents, some of which had to do with the country’s military and foreign defense capabilities, U.S. nuclear programs and potential vulnerabilities of the U.S. and it’s allied.

    “Do you have evidence that the president — when he was president, now former president — actually declassified these documents before he took them?” Bash asked.


    “I go on the president’s word and he said he did,” responded Jordan, who has consistently been one of Trump’s closest allies in Congress.

    Wray caved in and let all of the committee members see the document(s) subpoenaed in a SCIF room. A SCIF room that doesn't make a lot of sense, since the documents at issue are not secret. Not at all. Apparently Wray thought it might give the propaganda peddlers some more fake ammunition. Now, to be clear, that didn't meet the precise terms of the subpoena, but it was apparently close enough that Comer and the committee decided to save the fight with the FBI for another day. It wasn't that they caved into Wray's arrogant refusal, rather Wray found a path that kept the issue out of the courts.

    Big difference. And once again why, before swallowing despicable propaganda one has to research for the facts.
