    Former special counsel John Durham on Wednesday slammed Rep. Matt Gaetz (R-Fla.) amid a tense exchange during a House Judiciary Committee hearing.

    Durham grew angry with Gaetz after the far-right congressman accused the prosecutor of being involved in a “cover up” to protect those his office was supposed to be investigating.

    Gaetz and Durham sparred over the scope of the special counsel’s investigation into the origins of special counsel Robert Mueller’s investigation of the Trump administration over allegations the former president’s campaign coordinated with Russia in 2016 to damage his political opponent, Hillary Clinton.

    Durham’s report was critical of the FBI and the Department of Justice’s handling of the Russia probe, but Gaetz suggested Durham didn’t go far enough.

    The exchange between Gaetz and Durham got especially testy after the Florida congressman accused the special counsel’s office of failing to investigate Mueller’s team wiping its phones, which Gaetz suggested contained evidence of wrongdoing.

    “That was not something that we were asked to look at,” Durham said.

    Gaetz interrupted, saying “That's not true.”

    “I'm holding a document that authorizes your activity and it specifically says the investigation of Special Counsel Robert Mueller."

    After Durham disputed Gaetz’s characterization of the scope of the special counsel’s investigation, the Florida congressman alleged that Durham was involved in a “cover up.”

    “The FBI did a bunch of wrong and corrupt things. Totally understand. We're trying to deal with that. But when you are part of the cover up, Mr. Durham, and it makes our job harder,” Gaetz said.

    Durham slammed Gaetz, calling his remark “offensive.”

    “Yeah, well if that's your thought, I mean, there's no way of dissuading you from that, I can tell you that it's offensive, and that the people who worked on this investigation have spent their lives trying to protect people in this country and pursue within the law what it is that we can authorize to do.”

    On Wednesday, Republicans on the House Judiciary Committee held a hearing with former special counsel John Durham, who was appointed by Donald Trump's one-time attorney general William Barr to investigate the origins of the FBI's investigation into Russian ties to Trump's 2016 presidential campaign.

    Ultimately, the Durham investigation — long hyped by Trump, Republican House leaders like Judiciary Chairman Jim Jordan (R-OH), and their allies as ironclad proof that the earlier Robert Mueller probe was corrupt and political — was a flop, securing only one plea deal, a couple indictments that led to exoneration, and a recommendation of some minor process changes at the FBI, while failing to find any systemic bias or false conclusions in the Mueller investigation.

    Judiciary Committee ranking member Rep. Jerry Nadler (D-NY) pointed this out in a blistering opening statement before Durham was sworn in.

    "At the end of the day, Mr. Durham never found what he was looking for," said Nadler. "He cannot dispute a single conclusion in the Mueller report. He cannot prove a magnificent 'deep state' conspiracy, he cannot say that the FBI investigation into the Trump campaign's many ties to Russia never should've happened. And again, I can see why this would be disappointing to some. Instead of owning up to his failure, the Durham report doubles down on theories that lost spectacularly before two unanimous juries. The report also references classified material that's been called likely disinformation, played a series of accusations against the former president's perceived enemies. By presenting a so-called finding in this way, swiping a Republican bogeyman and hiding inconvenient truths in footnotes, the Durham report gives Donald Trump one last talking point."

    "It did not have to be this way," Nadler continued. "It may be hard to remember, but at the outset of the Durham investigation, Mr. Durham was a well-respected career prosecutor with a solid reputation. The attorney general is supposed to appoint the special counsel to prevent the appearance of politicization in a criminal investigation. Mr. Durham could well have lived up to that expectation. Instead, what we got is a political exercise that operated with ethical ambiguity and existed to perpetuate Donald Trump's unfounded claims. The investigation fulfilled its political objectives, but did real damage to a department that is still recovering from the excesses of the Trump administration. And despite his best efforts, a reckoning is well underway."

    "Do not be misled," concluded Nadler. "Former President Donald Trump is not a victim. He did this to himself. For all of its flaws, the Durham report does not show that anyone else is responsible for the president's legal woes, past, present, or future. Anyone that tells you otherwise is simply making it up."

    Mention of special counsel John Durham's report on his investigation into the FBI officials who looked into Donald Trump's relationship with the Russians will likely fade away after his disastrous appearance before the House Judiciary Committee this week where he withered under intense questioning by Democratic lawmakers.

    That is the opinion of MSNBC's Hayes Brown who admitted he was startled that Durham appeared to be "shocking unprepared" to justify the time and money invested in his inquiry that led to no criminal convictions.

    Continuing in a long line of "weaponization" committee hearings called by Chair Jim Jordan (R-OH) that have turned up no major revelations and have been widely derided, Brown said Durham and the Republicans on the committee failed to create one sound bite to which Trump or conservative news outlets could point to further their cause.

    As Brown notes, the failure of Durham to score any points during his testimony, combined with his investigation failing to justify itself, means he is of no use to Donald Trump going forward.

    "In the end, Wednesday’s hearing offered little fodder for sound bites to rile up the GOP base," Brown wrote before adding, "Durham even rejected the idea that Republicans should move to defund the Justice Department and the FBI. And his willingness to admit that there was Russian interference in 2016 means that he has likely outlived his usefulness to Trump."

    Add to that, he noted, the fact that MAGA-diehard, Rep. Matt Gaetz (R-FL) expressed his displeasure with Durham while accusing him of being "part of the cover-up" will make him a footnote during any Trump defense.

    "He surely will remain a touchstone for those who never read a word he wrote but are sure that he fully vindicated Trump in the process. For the MAGA movement, John Durham was always more useful as a vessel for whatever conspiracy needed a kernel of truth than as an actual investigator," he concluded.

    Lieu asked Durham if the FBI was obliged to look into Russian interference.

    "The FBI should not have ignored that information," Durham agreed.

    "A bipartisan U.S. Senate report confirmed that the Russians interfered in the 2016 elections and that that interference benefited Donald Trump," Lieu pointed out. "Paul Manafort, Trump's former campaign chairman, also publicly admitted to giving internal Trump campaign data to the Russians, and the U.S. Treasury Department found that this data, which it said was, quote, sensitive information on polling and campaign strategy, was then passed to Russian intelligence services."

    "There is a phrase to describe the facts I just set forth," he added. "It's called Russian collusion."


    Lieu then asked a series of yes/no questions of Durham.

    "Trump's former campaign chairman, Paul Manafort, was convicted, correct?" Lieu asked.

    "Correct," Durham replied.

    "Trump's former deputy campaign manager, Rick Gates, was convicted, correct?" Lieu pressed.

    "That's not in connection with the Russian [investigation]," Durham insisted.

    "Mr. Durham, you can hold yourself out as an objective Department of Justice official or as a partisan hack," Lieu warned. "The more that you try to spin the facts and not answer my questions, you sound like the latter."

    Lieu concluded by questioning the purpose of the hearing.

    "You brought two cases to jury trial based on this investigation, and you lost both," he told Durham. "And so I don't actually know what we're doing here because the author of the Durham report concedes that the FBI had enough information to investigate."

    Special counsel John Durham, who was appointed by former Attorney General Bill Barr to investigate the FBI's probe into the Trump campaign's alleged collusion with Russia during the 2016 election, made false statements while testifying before the House Judiciary Committee Wednesday, legal experts say.

    Durham, who House Republicans have heralded over his widely criticized report, misrepresented key parts of the Russia election scandal, "suggesting he was either unfamiliar with basic facts or was purposefully trying to mislead the committee and the American public," according to Mother Jones.

    Durham's report on the FBI's inquiry was released last month after four years of investigation and notably did not produce any evidence backing former President Donald Trump and his allies' claims that the bureau's investigation was an elaborate hoax concocted by opponents in the Deep State. During his inquiry, Durham lost two jury trials unconnected to the bureau's reasons for launching their investigation and did not prosecute any FBI or Obama administration officials for orchestrating the alleged plot against Trump.


    His only success in the probe was a plea deal with an FBI agent who admitted to modifying an email to back a surveillance warrant for a former campaign advisor to Trump. In the final report, however, Durham concluded there was justification for the bureau to conduct a preliminary investigation, just not a complete one, of Russia's election interference and contacts between the campaign and Russia.

    Rep. Adam Schiff, D-Calif., asked Durham Wednesday about the June 9, 2018, Trump Tower meeting between Donald Trump, Jr., Jared Kushner and Paul Manafort and a Russian emissary, who was said to have dirt on Hillary Clinton. Trump, Jr. received an email from a business colleague that scheduled the meeting and informed him that the session was part of a secret Russian plot to support his father's campaign.


    "People get phone calls all the time from individuals who claim to have information like that," Durham said, dismissing the situation.

    "Are you really trying to diminish the importance of what happened here?" Schiff asked in response, surprised that Durham found the meeting, which indicated to Moscow that Trump's camp was receptive to Russian election intervention, unimportant.

    "The more complete story is that they met, and it was a ruse, and they didn't talk about Mrs. Clinton," Durham answered, repeating a claim from the Trump camp when the meeting was revealed in 2017.


    But the report from special counsel Robert Mueller indicates that the Russian Counsel, lawyer Natalia Veselnitskaya, did discuss Clinton. According to the report, Veselnitskaya had stated the Ziff brothers, owners of an American family investment broke Russian laws and donated profits to the Clinton Campaign or the DNC even though no evidence of wrongdoing was found. She also claimed the firm had participated in tax evasion and money laundering in both the U.S. and Russia.

    The report also notes that Trump, Jr. "asked follow-up questions about how the alleged payments could be tied specifically to the Clinton Campaign, but Veselnitskaya indicated that she could not trace the money once it entered the United States" and quotes a meeting participant who recounted "that Trump Jr. asked what they [the Russians] have on Clinton."





    In a subsequent interaction, Rep. Tom McClintock, R-Calif, noted that the "central charge in the Russia collusion hoax was that Trump campaign operatives were in contact with Russian intelligence sources."

    Durham's response that "there was no such evidence" was also false.

    While chairing Trump's campaign in 2016, Manafort was regularly in contact with a former employee of his in Ukraine who several U.S. government officials — including Mueller — had identified as a Russian agent: Konstantin Kilimnik. Mueller had even indicted him in 2018 on obstruction of justice charges.

    The Senate Intelligence Committee and media reports chronicled the interactions between Manafort and Kilimnik, including a secret meeting in a Manhattan bar, Manafort giving him internal campaign polling data to pass to a close ally of Russian President Vladimir Putin, and Manafort also agreeing to continue passing information through Kilimnik.

    The committee revealed that it discovered publicly withheld information "suggesting Kilimnik may have been connected to the [Russian] hack and leak operation targeting the 2016 U.S. election" and cited "two pieces of information" that "raise the possibility" of Manafort's involvement in the scheme.


    Some legal experts argued that Durham may have violated Title 18 U.S. Code section 1001, which penalizes knowingly and willfully falsifying information known to be a material fact before any branch of the federal government, could come into play.

    "In a just world, Durham would be investigated for the crime of violating 18 U.S.C. § 1001," tweeted Laurence Tribe, a legal scholar and University Professor Emeritus at Harvard

    Trump was indicted on 37 counts related to the classified documents scandal, including charges centered on the alleged mishandling of sensitive information and for obstruction of justice.

    Fox’s Steve Doocy Presses Kevin McCarthy on Whether Biden Broke the Law

    House Speaker Kevin McCarthy (R-CA) struggled to say whether or not the investigations into President Joe Biden’s family have proven that he acted illegally.

    In his Fox & Friends interview where McCarthy threatened to impeach Attorney General Merrick Garland over the Hunter Biden probe, Steve Doocy acknowledged the “suspicious”-looking situation surrounding the Bidens. McCarthy argued, “It’s more than just looks suspicious,” which led Doocy to ask, “Given all the stuff you’ve uncovered so far, have you found Joe Biden broke any rules, any laws, or does it just look fishy?”

    “Well it’s more than just looking fishy,” McCarthy replied. After questioning why the Bidens received money from their foreign dealings, he maintained his stance that “None of it smells right. None of it is right. They talk about the ‘Big Guy.’ I believe firmly, we have to have a constitutional reason of where we go and we wanna follow the facts wherever it takes us.”


    McCarthy’s wishy-washy answer follows appearances his fellow House Republicans made on Fox, where they were pressed on their handling of the investigation and evidence of illegalities from the Bidens. Thrice, House Oversight Committee Chairman James Comer (R-KY) appeared on Fox & Friends to discuss the Biden investigations and, each time, Doocy pressed him for facts and evidence of actual lawbreaking.

    Sen. Markwayne Mullin (R-Okla.) on Monday challenged a labor union president to a physical fight in response to some mean tweets.

    The senator and Teamsters General President Sean O’Brien have been feuding since March, when O’Brien referred to Mullin, a business owner, as a “greedy CEO” during a Senate committee hearing.

    Mullin brought up the exchange during another Senate hearing last Wednesday, prompting O’Brien to respond online, where he called the senator “JohnWayne” and a “moron” in one tweet, and a “clown” and a “fraud” in another.


    “Quit the tough guy act in these senate hearings,” O’Brien wrote in a tweet that mocked Mullin’s height. “You know where to find me. Anyplace, Anytime cowboy.”

    After apparently thinking about it for five days, on Monday, Mullin suggested they set a date and location for a mixed martial arts showdown ― “for charity.”

    “An attention-seeking union Teamster boss is trying to be punchy after our Senate hearing,” Mullin wrote. “Okay, I accept your challenge. MMA fight for charity of our choice. Sept 30th in Tulsa, Oklahoma. I’ll give you 3 days to accept.”


    Mullin fought and won in three mixed martial arts matches in 2006 and 2007, according to Sherdog.com. He was elected to the House in 2012 and won a special Senate election last year.

    In 2018, Mullin Twitter-challenged Democratic lawyer Michael Avenatti to meet him on the mat. The two never fought and Avenatti has since been sentenced to prison for ripping off his clients.

    O’Brien, for this part, has indeed projected a punchy image since winning a 2021 election to lead the Teamsters, having campaigned on a promise of aggressive organization and contract negotiation.

    The Teamsters primarily represent transportation workers, including more than 300,000 UPS employees, who recently voted to authorize a potentially major strike this summer if the company doesn’t meet their demands.
