Ohio Republicans vow to target judiciary over Issue 1 abortion measure

Washington — Republicans in the Ohio state legislature are threatening to strip state courts of their authority to review cases related to Issue 1, the ballot measure approved by voters on Tuesday that established a right to abortion in the state constitution.

A group of four state GOP lawmakers announced their plans in a press release Thursday, which also teased forthcoming legislative action in response to voters' approval of the reproductive rights initiative.

"Issue 1 doesn't repeal a single Ohio law, in fact, it doesn't even mention one," state Rep. Bill Dean said in a statement. "The amendment's language is dangerously vague and unconstrained, and can be weaponized to attack parental rights or defend rapists, pedophiles, and human traffickers."

The Ohio Republicans said state lawmakers "will consider removing jurisdiction from the judiciary over this ambiguous ballot initiative. The Ohio legislature alone will consider what, if any, modifications to make to existing laws based on public hearings and input from legal experts on both sides."

Republicans hold wide majorities in both chambers of the Ohio General Assembly. The state's governor is a Republican, and the seven-seat Ohio Supreme Court has a 4-3 Republican majority.

Ohio state Rep. Jennifer Gross also claimed that the campaign in favor of Issue 1 was funded in part by foreign donations, saying, "this is foreign election interference, and it will not stand."

The GOP lawmakers did not provide details on the legislation they plan to introduce.

Ohio voters on Tuesday passed Issue 1 by a margin of 56.6% to 43.4%, marking the first time a Republican-led state has affirmatively guaranteed the right to abortion in its state constitution. The approval of the measure extended the winning streak by abortion-rights proponents after they were victorious in all six states where abortion-related measures were directly on the ballot last year.

The constitutional amendment, titled "The Right to Reproductive Freedom with Protections for Health and Safety," guarantees that every individual has the right to make their own decisions on abortion, contraception, fertility treatment, miscarriage and continuing their pregnancy. It also allows the state to prohibit abortion after fetal viability, considered between 22 and 24 weeks into pregnancy, except when necessary to protect the life or health of the mother.

Republicans who opposed the measure claimed it would allow parents to be excluded from their children's medical decisions and lead to abortions later in pregnancy. Less than 1% of all abortions performed in 2020 occurred at or after 21 weeks gestation, according to the Centers for Disease Control and Prevention.

Abortion-rights advocates are looking to combat stringent abortion laws and protect abortion access through citizen-initiated ballot measures following the Supreme Court's reversal of Roe v. Wade roughly 17 months ago. In addition to the campaign in Ohio that put the issue directly before voters, abortion-rights groups are mounting similar efforts to land proposals guaranteeing reproductive rights on the ballot in Florida, Arizona, and Nevada in 2024.

Democrats Get Bad News In Governor Race
Story by Andrew Rodriguez • 18h

Republican Gov. Tate Reeves of Mississippi has been re-elected, defeating Democrat Brandon Presley.

Reeves emphasized his standing up to national liberals and Joe Biden in his victory speech, and his endorsement from former President Donald Trump, citing Presley as Biden’s chosen candidate.

“We all now know what it means in a state like Mississippi when you stand up to the national liberals, when you stand up to Joe Biden,” Reeves stated.

“They threw everything they had in Mississippi—$13 million they threw in Mississippi. But guess what? Mississippi did not break. Mississippi did not bend. Mississippi is not for sale.”

“Congratulations to @tatereeves on winning Governor of the Great State of Mississippi. Our big Rally on Friday night moved the numbers from a tie to a big WIN. Great reaction under pressure Tate!” Trump posted.

“Joe Biden’s people are funding Brandon Presley’s campaign,” Trump pressed. “They own him. He’ll do whatever they want him to do. It’s really bad for Mississippi.'”

“I’m asking you to make time to vote. You’ve got to vote for Gov. Tate Reeves, and he has my total and complete endorsement.”

“The radical left maniacs who are attacking me are also after him,” he stated.

“Donald Trump and the people of Mississippi back our campaign, while Brandon Presley is propped up by out of state money,” Reeves said.

Reeves faced strong pressure from Presley, and the race had seemed unlikely to lean Republican.

“Some of my strongest supporters are Republicans who voted for and donated to Tate Reeves four years ago and now have jumped ship and are supporting me,” Presley argued.

“As the 65th Governor of Mississippi, Tate Reeves continues to build on his strong record as a conservative leader who fights to guard taxpayers’ dollars, improve educational opportunity, and grow new careers so that our state’s best and brightest can raise their families and thrive here at home. In his inaugural address, Governor Reeves promised that this would be an administration for all Mississippi. He committed to a mission to create a climate where good careers are plentiful with every Mississippian prepared to pursue them, as he has every single day of his time serving our state,” Reeves official website reads.

“Upon taking office, Governor Reeves inherited a crumbling corrections department and a scandal-plagued human services department. He took immediate action to stem the existing issues and begin the process of rebuilding, shedding light on the issues and installing the best leadership to help him turn the departments around to work for the people of Mississippi. While tackling the inherited issues within government agencies to provide for the safety and human dignity of all Mississippians, Governor Reeves simultaneously led our state through historic flooding and tornadoes and a worldwide pandemic—all within his first 100 days in office.”

Reeves, with a 46% approval rating, has been embroiled in a scandal involving the misappropriation of state welfare funds.

Despite having received fewer contributions, Reeves came out victorious in the election.

This is why the founders wrote God and region out of the Constitution. The first Europeans who came here couldn't even agree on what a "Christian" was. The Colonists couldn't agree either. And by the time the Declaration of Independence was written there were sizable populations of Jews and even Muslims. And many if not most the founders were Diets not Christians. And they knew they couldn't make everyone happy and treat them equally so they very wisely wrote the separation of church and state right into the Constitution.

And leave it to treasonous conservative/America Hating/Republicans to try and fuck that up.

Lawyers for religious leaders challenging Missouri abortion ban say law imposes beliefs on everyone
    JIM SALTER

ST. LOUIS (AP) — Missouri lawmakers intended to “impose their religious beliefs on everyone" in the state when they passed a restrictive abortion ban, lawyers for a group of religious leaders who support abortion rights said at a court hearing Thursday.

But attorneys for the state countered that just because some supporters of the law oppose abortion on religious grounds doesn't mean that the law forces their beliefs on anyone else.

Thirteen Christian, Jewish and Unitarian Universalist leaders filed suit in January seeking a permanent injunction barring Missouri from enforcing its abortion law and a declaration that provisions violate the Missouri Constitution. Thursday's hearing in St. Louis concerned the state's request to dismiss the lawsuit. Judge Jason Sengheiser said he'll likely rule in January.

The Missouri lawsuit is one of 38 filed in 23 states challenging restrictive abortion laws enacted after the Supreme Court overturned Roe v. Wade in June 2022, according to the Brennan Center for Justice. The landmark ruling left abortion rights up to each state to decide.

The lawsuit, filed on behalf of the faith leaders by Americans United for Separation of Church & State and the National Women’s Law Center, said sponsors and supporters of the Missouri measure “repeatedly emphasized their religious intent in enacting the legislation.”

The lawsuit quotes the bill’s sponsor, Republican state Rep. Nick Schroer, as saying that “as a Catholic I do believe life begins at conception and that is built into our legislative findings.” A co-sponsor, Republican state Rep. Barry Hovis, said he was motivated “from the Biblical side of it,” according to the lawsuit.

“We know this has a religious purpose because when the lawmakers passed the law 2019, they told us that,” said K.M. Bell, an attorney for the plaintiffs.

But Maria Lanahan, Missouri's deputy solicitor general, told the judge that lawmakers had varying reasons for supporting the law. She said that while the abortion ban “was in harmony” with the religious beliefs of some members of the Legislature, no one was “compelled to support any system of worship.”

Within minutes of last year’s Supreme Court decision, then-Attorney General Eric Schmitt and Gov. Mike Parson, both Republicans, filed paperwork to immediately enact a 2019 law prohibiting abortions “except in cases of medical emergency.” That law contained a provision making it effective only if Roe v. Wade was overturned.

The law makes it a felony punishable by five to 15 years in prison to perform or induce an abortion. Medical professionals who do so also could lose their licenses. The law says that women who undergo abortions cannot be prosecuted.

Missouri already had some of the nation’s more restrictive abortion laws and had seen a significant decline in the number of abortions performed, with residents instead traveling to clinics just across the state line in Illinois and Kansas.

Lawsuits in other states have taken similar approaches.

In Indiana, lawyers for five anonymous women — who are Jewish, Muslim and spiritual — and advocacy group Hoosier Jews for Choice argued that state’s ban infringes on their beliefs. Their lawsuit specifically highlights the Jewish teaching that a fetus becomes a living person at birth and that Jewish law prioritizes the mother’s life and health. A state appeals court is scheduled to hear arguments Dec. 6.

In Kentucky, three Jewish women sued, claiming the state’s ban violates their religious rights under the state’s constitution and religious freedom law. They allege that Kentucky’s Republican-dominated legislature “imposed sectarian theology” by prohibiting nearly all abortions.
