    You really should send a note to Trump's lawyers about the no victim defense. They should have brought that up before the trial ended.

    As for the "Convicted af sexual abuse based on no evidence at all,..." problem, the only real defense is, "It's not the sort of thing I would do and anyone who knows me, knows that." Trump should have called people to testify about his character and how out of character sexual assault would be. In a "he said, she said" battle, what really matters is what "they said."

    The former FBI informant charged with lying about the Bidens’ dealings in Ukraine told investigators after his arrest that Russian intelligence officials were involved in passing information to him about leaving the page." data-wf-tooltip-position="bottom" data-wf-reset-every="90">Hunter Biden, prosecutors said Tuesday in a new court filing, noting that the information was false.

    Prosecutors also said Alexander Smirnov has been “actively peddling new lies that could impact US elections” after meeting with Russian spies late last year and that the fallout from his previous false bribery accusations about the Bidens “continue to be felt to this day.”

    Smirnov claims to have “extensive and extremely recent” contacts with foreign intelligence officials, prosecutors said in the filing. They said he previously told the FBI that he has longstanding and extensive contacts with Russian spies, including individuals he said were high-level intelligence officers or command Russian assassins abroad.

    Prosecutors with special counsel David Weiss’ team said Tuesday that Smirnov has maintained those ties and noted that, in a post-arrest interview last week, “Smirnov admitted that officials associated with Russian intelligence were involved in passing a story about Businessperson 1,” referring to President Joe Biden’s son, Hunter Biden.

    The revelations about Smirnov’s alleged foreign contacts were disclosed as part of Weiss’ arguments to keep him in jail while he awaits trial. A federal judge, however, ruled later Tuesday that Smirnov be released while he awaits trial. The release was granted with several conditions, including that Smirnov be subject to GPS monitoring and surrender both his American and Israeli passports.

    Smirnov declined to answer questions as he left the courthouse Tuesday evening.

    Prosecutors alleged that Smirnov “claims to have conta
    cts with multiple foreign intelligence agencies,” including in Russia, and that he could use those contacts to flee the United States.

    The explosive revelation comes amid backlash over how Smirnov’s now-debunked allegations played into House Republicans’ impeachment inquiry into the president.

    Smirnov has been charged with lying to the FBI and creating false records. He has not yet entered a formal plea, and his lawyers told CNN in a statement, “Mr. Smirnov is presumed innocent.”

    According to the new court filing, Smirnov told investigators he was in contact with “four different Russian officials,” all of whom are “top officials” and two of whom “are the heads of the entities they represent.” Prosecutors did not independently verify in the filing whether Smirnov’s reported contacts are legitimate, nor whether the Russians provided him with disinformation about the Bidens.


    The false information that Smirnov reported “was not trivial,” prosecutors wrote.

    “It targeted the presumptive nominee of one of the two major political parties in the United States. The effects of Smirnov’s false statements and fabricated information continue to be felt to this day,” prosecutors said, making an apparent reference to the turmoil in Congress over the discredited bribery allegations – which were a key element of the GOP impeachment probe.

    Of particular note is a story Smirnov allegedly told the FBI in September 2023, alleging that Hunter Biden was recorded making phone calls in a Kyiv hotel that is “wired” and “under the control of the Russians.” Federal agents said they knew Smirnov’s story was false because Hunter Biden has “never travelled to Ukraine.”

    Smirnov told investigators Russian intelligence officers would use the hotel to intercept cell phone calls made by “prominent US persons,” prosecutors said, which the Russian government could use as “‘kompromat’ in the 2024 election, depending on who the candidates will be.” Kompromat is a Russian term that refers to compromising information used for blackmail.

    The story, prosecutors noted, matches the story Smirnov told his handler about Hunter Biden being recorded in a foreign hotel.

    “Thus, Smirnov’s efforts to spread misinformation about a candidate of one of the two major parties in the United States continues,” prosecutors wrote.

    And, prosecutors wrote, Smirnov claims to have met with Russian intelligence officials as recently as November and December 2023.

    “What this shows is that the 1misinformation he is spreading is not confined to 2020,” they wrote. “He is actively peddling new lies that could impact U.S. elections after meeting with Russian intelligence officials in November. In light of that fact there is a serious risk he will flee in order to avoid accountability for his actions.”

    CNN legal analyst Elie Honig on Wednesday shoveled dirt on the Republican-led impeachment inquiry into President Joe Biden, which was dealt a lethal blow this week after it was revealed that a key source for the inquiry admitted to having gotten information from people associated with Russian intelligence services.

    At the start of his analysis, Honig explained how longtime FBI informant Alexander Smirnov managed to initially deceive law enforcement officials for so long.

    "The FBI got burned here," he said. "The FBI handles thousands of what we call 'confidential informants' at any given tie. And... a confidential informant is... a person and who's providing information to the FBI, to the Justice Department, but without the expectation of that person ever taking the stand and testifying, It's essentially a secret source of information and one of the challenges with any confidential informant is the FBI and DOJ have to verify that person, have to confirm the things that they're being told, and here they clearly we failed to do that. It is a real embarrassment for the FBI."

    While it may be an embarrassment for the FBI, it could be an even bigger embarrassment to House Republicans who peddled Smirnov's claims as verified facts as they justified an effort to potentially remove Biden from office.

    "Look, the impeachment inquiry, which was officially authorized by the House in December... was already built on a shaky foundation, but this guy was a big part of that foundation," said Honig. "And now it is crumbled altogether. I mean, the primary information that he provided to the FBI on which the house relied is essentially that there was this multi-million-dollar bribe payoff made to Hunter Biden and to Joe Biden. And now the FBI has figured out that that was false, so false, so obviously false... I think the House impeachment inquiry, they had a flimsy basis to begin with, and now they've gotten nothing."

    GOP lawmakers on Wednesday accused James Biden of contradicting himself during testimony about his brother’s supposed business dealings with the family.

    The president’s brother initially said he was not part of a deal with his nephew Hunter Biden and business associates Rob Walker, Tony Bobulinski, and James Gilliar, according to a source familiar with the interview.

    But when presented with an agreement with his signature on it, Biden changed his story, saying he did not recall signing the agreement, the source said.

    Rep. Andy Biggs, R-Ariz., speaking to reporters after the interview said it was “interesting” and that Biden had “contradicted himself.”

    That conclusion was shared by Rep. Matt Gaetz, R-Fla., who told reporters: “Let me say this. So there are a lot of things that Mr. Biden is saying that are directly contradicted by documents.”

    The lawmakers’ comments come after James Biden’s voluntary private interview on Capitol Hill as part of House Republicans’ impeachment inquiry into his brother, President Joe Biden.

    “I have had a 50-year career in a variety of business ventures. Joe Biden has never had any involvement or any direct or indirect financial interest in those activities,” the president’s younger brother said. “None.”

    The interview with both Republican and Democratic staff as well as lawmakers lasted more than eight hours. During several breaks, Republicans came out and told reporters, without citing details, that James Biden’s responses contradicted his opening statement and that he had made efforts to avoid directly answering investigators’ questions.

    The interview with James Biden was the latest in a series that GOP lawmakers have conducted recently as they seek to rebuild momentum for an impeachment process surrounding the Biden family’s overseas finances that has stalled in recent months.

    Wednesday’s testimony comes after a central claim of the GOP investigation was undermined by federal prosecutors, who last week indicted an FBI informant who claimed there was a multimillion-dollar bribery scheme involving the president, his son Hunter and a Ukrainian energy company.

    But Republicans argue that the informant was just one part of their broader investigation and say they intend to push ahead. “It doesn’t change the fundamental facts,” Judiciary Committee Chair Jim Jordan, R-Ohio, said.

    The impeachment inquiry, which began in September under the House Judiciary and Oversight committees, has included the recent depositions of several former Biden family associates

    Rep. Ken Buck (R-Colo.) on Wednesday criticized his Republican colleagues for using a former FBI informant’s claims in their impeachment inquiry even though the statements hadn’t been verified.

    “We were warned at the time that we received the document outlining this witness’s testimony. … We were warned that the credibility of this statement was not known,” Buck said on CNN’s “The Source.”

    “And yet, people, my colleagues went out and talk to the public about how this was credible and how it was damning and how it proved President Biden’s — at the time Vice President Biden’s — complicity in receiving bribes,” he added.

    The informant, Alexander Smirnov, was arrested and charged last week with making false statements to the FBI. He had previously told the FBI that President Biden and his son, leaving the page." data-wf-tooltip-position="bottom" data-wf-reset-every="90">Hunter Biden, received $5 million bribes from the head of Ukrainian energy firm Burisma.

    House Republicans have previously put that claim at the front and center of their investigations into the Bidens. Buck said it is evident now that the information Smirnov relayed was false.

    “It appears to absolutely be false, and to really undercut the nature of the charges. We’ve always been looking for a link between what Hunter Biden received in terms of money and Joe Biden’s activities or Joe Biden receiving money,” Buck explained. “This clearly is not a credible link at this point.”

    On Wednesday, CNN anchor Kaitlan Collins then asked the Colorado Republican if House Oversight and Accountability Committee Chair James Comer (R-Ky.) and House Judiciary Committee Chair Jim Jordan (R-Ohio) used the information “to fuel these investigations, regardless” of them knowing the information was not corroborated.

    “That’s what it appears,” Buck responded. “I certainly didn’t have any evidence outside the statement itself that it was credible. And as a prosecutor for 25 years, Kaitlan, I never went to the public until I could prove the reliability of a statement.”

    But Jordan and Comer, who are leading the impeachment inquiry, have pushed back on the idea that Smirnov’s arrest dealt a blow to the investigation.

    Jordan on Wednesday said it “doesn’t change the fundamental facts” of the Republican case against the president.

    They have also said that while 1023 form that contained the informant’s tip is only used to memorialize — not verify — information, they had been told the source was credible, and U.S. Attorney Scott Brady also told the panel in a transcribed interview that the document warranted further investigation.

    “Chris Wray told us this confidential human source was so important he couldn’t even let us see the 1023, if you remember that fight we had a year ago,” Jordan told reporters Wednesday, referring to the FBI director.

    A spokesman for the House Oversight Committee made the same point on Thursday and slammed Buck’s comments.

    “Representative Buck’s insight would be valuable if he actually attended the FBI briefing on the FD-1023 form, but he didn’t. Representative Buck would have known the FBI informed Chairman Comer and Ranking Member Raskin that the confidential human source who provided information about then-Vice President Biden was deemed credible and paid over six figures since 2010.”

    When asked Wednesday if it was time to shut down the impeachment inquiry, Buck said he did not know.

    “When all the evidence is given — and I don’t want to judge the evidence one way or the other until I have a chance to sit down with the investigators and go through the evidence. But this certainly undermines a lot if the — if the impeachment inquiry was based on this witness, it undermines the credibility of this impeachment,” he said.

    “I will say that it’s suspicious that anybody would pay Hunter Biden as much money as they paid him without any expertise in the oil and gas industry without any expertise in international banking,” he continued. “So those things are suspicious, but again, there’s no link directly to Vice President Biden’s activities.”

    Republicans knew ahead of time that the source of the 1023 report they used as the basis for their investigations into President Joe Biden and his son, Hunter was dubious, yet they charged ahead anyway. Both Democrats and even some Republicans are now railing against the GOP's rush to accept the credibility of the now-debunked report.

    According to the New York Times, the FBI warned Republicans that the confidential source's claims in the 1023 report could not be verified and should be taken with a grain of salt. Chief among those claims was that the Bidens each supposedly solicited a $5 million bribe from Ukrainian energy company Burisma during Biden's time as vice president. However, the indictment of that source, Alexander Smirnov, alleges that he fabricated that charge — possibly with the help of Russian intelligence agencies he was in contact with.

    "The mere existence of such a document would establish little beyond the fact that a confidential human source provided information and the FBI recorded it," FBI acting assistant director Christopher Dunham wrote in a May 2023 letter to Republicans in Congress. "Indeed, the FBI regularly receives information from sources with significant potential biases, motivations and knowledge, including drug traffickers, members of organized crime or even terrorists."

    Despite those warnings, numerous senior Republican elected officials insisted that the 1023 report was rock-solid proof of corruption. As the Times noted, Rep. James Comer (R-Kentucky), who chairs the House Oversight Committee, even chided reporters who called the claims in the 1023 form "unverified," countering that the source was "highly credible." House Republican Conference chair Rep. Elise Stefanik (R-New York) called Smirnov's disproven allegations "the biggest political corruption scandal, not only in my lifetime, but I would say the past 100 years."

    "You have multiple members of the Biden family profiting illegally from foreign governments," Stefanik said in a Fox News interview. "You also have the bombshell reporting, including potential tapes that exist, of while Joe Biden was vice president taking a bribe from Burisma." Sen. Chuck Grassley (R-Iowa) not only endorsed Smirnov's claims, but suggested the FBI may have tried to "sweep it under the rug to protect the candidate Biden."

    But Rep. Ken Buck (R-Colorado), who himself is a former prosecutor, said his fellow Republicans should have known better, adding that it was "premature to go out and tout how significant this was without knowing the reliability of the testimony." And Rep. Dan Goldman (D-New York), also a former federal prosecutor, said that the FBI should share in some of the blame for how they handled the release of the 1023 report to Congress.

    "It is really a dereliction of duty as an investigator to do what they did, and that is also another reason why this investigation should be terminated immediately," Goldman said.
