    From everything I have been seeing the letter might not amount to much and concerns an alleged assault when both the accuser and Kavanaugh were minors.

    But because it involves an alleged crime and has a bearing on Kavanaugh's security clearance Feinstein had no choice but to refer it tho the FBI.

    Then the FBI had no choice but to notify the White House. And they White House had to notify Grassley about it.

    And it does not appear the FBI is going to investigate it.

    But there is a very high probability that since this letter is now in so many hands it will end up being leaked.

    Actually, however, its things like this that are far more important than any letter because the Republicans cannot afford to lose any Republican votes. And the only reason Murkowski is a Senator is because Native Alaskans came out in full force to back her write-in campaign. So it will be very interesting to see if Murkowski is willing to betray them.

    Alaska's largest Native organization said Wednesday it "strongly" opposes the appointment of Judge Brett Kavanaugh to the Supreme Court, calling his views on Indian policy erroneous and a threat to unique policies and laws governing Alaska Native institutions.

    The Alaska Federation of Natives announcement potentially adds pressure to Sen. Lisa Murkowski, R-Alaska, who has not said whether she supports the appointment and who in 2010 benefited from the group's endorsement in her uphill write-in victory against Joe Miller. Groups opposed to Kavanaugh's appointment have pressed Murkowski to vote against him.

    "AFN strongly urges the U.S. Senate to vote against Judge Kavanaugh," the organization said. "The documents that have been released so far in relation to his nomination demonstrate how troubling his confirmation would be for Native peoples, particularly Alaska Natives and Native Hawaiians."

    AFN said Kavanaugh has an "erroneous" position on the Indian Commerce Clause in the U.S. Constitution. The clause gives Congress the power to "regulate commerce" with nations, states and Indian tribes, but Kavanaugh challenges the clause's application to affairs beyond trade, the organization said in a prepared statement.

    "This impacts Alaska Native tribes, corporations, organizations and consortia because their dealings with Congress presently extend to a host of federal programs concerning their members, resources and governments," AFN said.

    AFN also called Kavanaugh's view of the federal government's special trust responsibility with tribes "misguided." Kavanaugh has a limited view of the responsibility, rooted in the U.S. Constitution, treaties and elsewhere, the group said.

    "Specifically, he would only extend the special trust relationship to Indian tribes with his preferred history of federal dealings, including territorial removal and isolation," the group said. "This, too, impacts Alaska, since Alaska Natives have a unique federal experience and few reservations were established in Alaska."

    "This thinking could overturn much, if not all, of the Alaska Native Claims Settlement Act, as well as all other federal legislation and regulations addressing Alaska Natives, tribes, corporations and organizations," the group said.

    Murkowski could not immediately be reached for comment late Wednesday

    Alaska's other senator, Republican Dan Sullivan, had one of the earliest Senate meetings with Kavanaugh and announced immediately after that the judge had won his confirmation vote.

    Murkowski and Sen. Susan Collins, R-Maine, have been targeted as possible "no" votes on because they are both pro-choice Republicans in a Senate with a 51-49 Republican majority. Groups opposed to Kavanaugh have been running ads in Alaska and Maine, largely focused on abortion rights and the Affordable Care Act.

    Senate Democrats know they’re going to be defeated on the Supreme Court nomination of Judge Brett Kavanaugh. The GOP has the votes. They don’t. They can’t block him, partially the reason why the opposition to this nomination, while intense at times, has been lackluster overall. They have little tools to fight with against the Trump White House on judges, which has been pushing through nominees at all levels.

    The Senate Judiciary Committee’s vote on his nomination is set for September 20. As Katie wrote yesterday, there’s been a zero hour attempt to derail Kavanaugh, who has proven to be mainstream, level-headed, and eminently qualified to be our next Supreme Court Justice, with some shoddy secret letter about an alleged incident of sexual misconduct that happened decades ago, though it’s so secret it cannot be shared with Republicans. Sen. Dianne Feinstein (D-CA) has the document, which she sent to the FBI. This isn’t new either; Feinstein knew about thissince July. If there was any hope of muddying this nominee with a possible criminal investigation, the Democrats came up short. The FBI isn’t pursuing one. Maybe it’s because this whole episode is total and utter bullcrap. I mean, it is, folks. The allegation is that Kavanaugh and a friend locked a girl in a room at a party when he was 17-years-old.

    As for the drama, well, The Wall Street Journal has a plausible explanation for this last minute move:

    Some Democrat was bound to have something. Mr. Kavanaugh had come through his confirmation hearing last week without a dent, and Democrats had made themselves look bad by editing his quotes and spreading innuendo unrelated to his judicial views. Meanwhile, the political left is demanding that Democrats do something, anything, to stop the highly qualified jurist from joining the High Court.

    Enter DiFi. “I have received information from an individual concerning the nomination of Brett Kavanaugh to the Supreme Court,” Ms. Feinstein said in a statement. “That individual strongly requested confidentiality, declined to come forward or press the matter further, and I have honored that decision. I have, however, referred the matter to federal investigative authorities.”

    Ms. Feinstein offered no details, and Judiciary Chairman Chuck Grassley said Thursday that she didn’t share the information with him. News reports say the information refers to a letter from a woman concerning possible sexual misconduct when she and Mr. Kavanaugh were both in high school. That would have been sometime in the early 1980s.

    News reports also say that Ms. Feinstein has had the letter since the summer,and that it was first sent to the office of Rep. Anna Eshoo, a Democrat from Silicon Valley. But if the “information” is worrying enough to send to the FBI, why did Sen. Feinstein wait so long? She didn’t bring it up during the summer in the run-up to the hearings, didn’t mention it when she met with Judge Kavanaugh, and didn’t think it was important enough to tell her colleagues.

    The charitable explanation is that she didn’t think the information was credible enough to warrant investigation, but that now under pressure from her colleagues she felt obliged to surface it.

    So here’s what we have: A story floated at the last minute about an accusation whose details are unknown from a woman whose identity is secret. The episode says more about the desperation of Democrats than it does about Mr. Kavanaugh, and the real disgrace would be if Republicans did anything other than move promptly to a confirmation vote.

    Oh, and on top of this super secret letter crap, Democrats sent Kavanaugh over 1,000 additional questions, the most for any nominee combined in U.S. history. The game is over, Democrats. Again, you lost and we won:

    Senate Democrats submitted a record number of written questions to President Trump’s Supreme Court nominee, in a move Republicans said was the latest attempt to delay confirmation of Judge Brett Kavanaugh.

    The 1,278 questions are four times more than the number asked of Justice Neil M. Gorsuch, Mr. Trump’s first high court pick, last year. Indeed, it’s more than the combined total for every justice in U.S. history, said Judiciary Committee Chairman Charles E. Grassley.

    Supreme Court nominee Brett Kavanaugh has publicly denied allegations that he forced himself onto a woman in high school. This comes after Sen. Dianne Feinstein (D-Calif.) allegedly gave a letter containing the claim to the FBI.

    More than six dozen women came forward Friday to defend Supreme Court nominee Judge Brett Kavanaugh against an alleged high school incident, calling President Trump’s pick for the high court “a good person.”



    The 65 women, who claim to have known Kavanaugh for more than 35 years, penned a letter to the Senate Judiciary Committee to vouch for his character.

    “We are women who have known Brett Kavanaugh for more than 35 years and knew him while he attended high school between 1979 and 1983. For the entire time we have known Brett Kavanaugh, he has behaved honorably and treated women with respect,” the letter read. “We strongly believe it is important to convey this information to the Committee at this time.”


    The women wrote that while Kavanaugh attended Georgetown Preparatory School, an all-boys high school in Bethesda, Maryland, they knew him through “social events, sports, church, and various other activities.”

    “Many of us have remained close friends with him and his family over the years. Through the more than 35 years we have known him, Brett has stood out for his friendship, character, and integrity,” they wrote. “In particular, he has always treated women with decency and respect. That was true when he was in high school, and it has remained true to this day.”

    They added: “The signers of this letter hold a broad range of political views. Many of us are not lawyers, but we know Brett Kavanaugh as a person. And he has always been a good person.”


    The letter comes amid a controversy ignited by Senate Judiciary Committee Ranking Member Dianne Feinstein, D-Calif., who released a statement this week saying that she turned information about Kavanaugh over to the FBI. She did not detail the accusation, and Republicans accused her of trying to orchestrate a last-minute smear.

    “I have received information from an individual concerning the nomination of Brett Kavanaugh to the Supreme Court,” Feinstein said in a surprise statement. “That individual strongly requested confidentiality, declined to come forward or press the matter further, and I have honored that decision. I have, however, referred the matter to federal investigative authorities.”

    Fox News confirmed that the letter involved an allegation about Kavanaugh while in high school in the 1980s. A woman who was also in high school at the time, accused Kavanaugh of holding her down and trying to force himself on her during a party, before she got away. The details were first reported by The New Yorker.

    The woman also claimed Kavanaugh was joined at the time by a friend who turned up music to conceal her protests. The unnamed classmate, though, reportedly told the New Yorker, “I have no recollection of that.”

    Kavanaugh denied the allegations Friday.

    “I categorically and unequivocally deny this allegation. I did not do this back in high school or at any time,” Kavanaugh, 53, said in a statement.

    The White House blasted the charges on Thursday.

    “Not until the eve of his confirmation has Sen. Feinstein or anyone raised the specter of new ‘information’ about him,” White House spokesperson Kerri Kupec said in a statement.

    The accusations come after Kavanaugh’s Capitol Hill confirmation grilling, and ahead of the committee vote on sending his nomination to the full Senate.

    The FBI conducts background checks on all major government appointees, including Supreme Court nominees.

    “Upon receipt of the information on the night of September 12, we included it as part of Judge Kavanaugh’s background file, as per the standard process,” the FBI said in a statement.

    Fox News has learned that the White House would need to request that the bureau follow up on the letter for the matter to be investigated further.

    Despite the controversy, Senate Judiciary Committee Chairman Chuck Grassley, R-Iowa, said there is no plan to delay Kavanaugh’s confirmation.

    Grassley set the panel’s vote on Kavanaugh for Sept. 20 and Republicans hope to confirm him by the start of the new court session on Oct. 1.

    That takes time and organization.

    Which makes me think they were ready for this, and knew about it in advance. And in my experience, honourable people do not need to gather crowds to confirm their honour; their actions speak for themselves.

    In either case, it's unfortunate, and poor decisionmaking all 'round, in my view. I don't like how this was handled at all, and my heart goes out to the source of the claim.

      An alleged event that occurred decades ago. Never mentioned during kavanaugh's earlier confirmation and background checks.
      Allegedly known about by feistein since July, and just now coming to light, days before the vote.

    In an act of desperation designed to block Judge Brett Kavanaugh’s nomination to the Supreme Court by smearing his reputation, Sen. Dianne Feinstein, D-Calif., hinted Thursday that someone she would not name has made unspecified accusations about Kavanaugh that possibly might involve criminal conduct.



    Feinstein’s Hail Mary pass came exactly one week before the Senate Judiciary Committee is scheduled to vote on the nomination of the highly qualified judge, who now sits on the U.S. Circuit Court of Appeals for the District of Columbia.

    Feinstein is leaving it to the media to fill in the facts about her vague and unsubstantiated claims about Kavanaugh, who was nominated by President Trump. She clearly is counting on Trump’s many opponents in the media to help her keep the president’s nominee off the Supreme Court – as they would seek to do for anyone nominated by Trump.


    Feinstein said in a statement: “I have received information from an individual concerning the nomination of Brett Kavanaugh to the Supreme Court. That individual strongly requested confidentiality, declined to come forward or press the matter further, and I have honored that decision. I have, however, referred the matter to federal investigative authorities.”

    What the heck does that mean? (Translation: I got nothing).

    OK – Feinstein is claiming she knows something – but she’s not saying what that mystery something is. How on Earth is anyone supposed to evaluate that? How would any of you reading this like someone to make a cryptic charge like the one Feinstein has thrown out about you, without presenting a shred of evidence?

    Fox News reported that two sources said Feinstein got a letter from Rep. Anna Eshoo, D-Calif., in July making the allegations against Kavanaugh – although the senator never spoke about it publicly before Thursday. That’s the way Hail Mary passes work – you don’t throw one until you’re desperate and headed for a loss on the football field.

    The mystery letter wasn’t even concerning enough for Feinstein to show to Senate Judiciary Committee Chairman Chuck Grassley, R-Iowa.

    The Intercept reported the letter was sent by someone associated with Stanford University and involved a woman and Kavanaugh when she and the 53-year-old judge were both in high school.

    The New York Times reported that, according to two sources it did not identify, the letter referenced possible sexual misconduct between Kavanaugh the unidentified woman. Possible, but that is awfully vague for this late stage of a U.S. Supreme Court confirmation.

    With so little information, how is anyone supposed to figure out what is going on?

    If Feinstein knows something, she should say something. If Kavanaugh is being accused of sexual misconduct then we all have a right to know.

    So much about this just smells like a political skunk, not the least of which is the timing of Feinstein’s public non-release of this new information.

    If this is an 11th hour power play by Feinstein – and there’s no “there” there – then the senator is playing politics with an otherwise respectable man’s reputation. Kavanaugh has a wife and two young daughters and as far as we know has been an upstanding member of his community.

    The White House also hit back at Feinstein, questioning the timing of her new claim.

    “Throughout his confirmation process, Judge Kavanaugh has had 65 meetings with senators – including with Senator Feinstein – sat through over 30 hours of testimony, addressed over 2,000 questions in a public setting and additional questions in a confidential session,” White House spokesperson Kerri Kupec said in a statement. “Not until the eve of his confirmation has Sen. Feinstein or anyone raised the specter of new ‘information’ about him."

    If this is all a political game, then shame on you Sen. Feinstein. Unfortunately, that’s exactly what it looks like.

    Washington Post White House reporter Seung Min Kim tweeted Thursday: "New – FBI does not now plan to launch a criminal investigation of the Kavanaugh matter; instead the bureau passed the material to the White House as an update to Kavanaugh's background check, via @mattzap"

    It looks as though Feinstein was saving this “new” allegations for the last minute and then counting on her smear to keep Kavanaugh from being confirmed. But now that the FBI is saying it has no plans to investigate, it seems like her Hail Mary pass may get intercepted.

    That is just one thing that is actually funny about this. The Republicans tried to attack Feinstein for having this letter for more than a month and then turned around and proved they had been sitting on the letter a lot longer than Feinstein which is why they had these "65 women" all set up and ready to go even though there were no girls in Kavanaugh's school.

    But it is all taking a toll.

    Supreme Court nominee Brett Kavanaugh will be confirmed, and it won't be a close vote, Harvard Law professor emeritus Alan Dershowitz predicted Monday, while commenting that he wishes politics could be kept out of the confirmation process.

    "He will get 54 or 55 votes, I think, because the president selected well," Dershowitz told Fox News' "America's Newsroom."

    "If he had picked somebody far less qualified who has strong ideological views it would be a closer vote."

    Kavanaugh, a U.S. Circuit Judge in the U.S. Court of Appeals for the District of Columbia, has "extraordinary experience and taught at Harvard, where "the students loved him," said Dershowitz.

    "Many of the students, both liberals and conservatives, wrote a petition supporting him," said Dershowitz. "I think unless something comes up that we're not aware of, I'm pretty sure he will be confirmed."

    Meanwhile, the country's leaders should be confirming the most qualified people for the higher court without regard to political benefit or gain, said the law professor.

    "That's not the way the framers contemplated justices being nominated and confirmed to the Supreme Court," he said. "They had in mind the very best people."

    But now, the matter of a Supreme Court justice is "completely political," but all senators should keep an open mind, Dershowitz commented.

    "It's all because of Merrick Garland," he said, referring to President Barack Obama's nominee who was blocked in 2016 because of the looming election.

    "It's completely political and all senators should keep an open mind," said Dershowitz. "Interview Kavanaugh. Wait to see what he thinks of the tower of precedent, whether he will start overruling cases, and then cast their vote on the basis of the quality of the candidate, not the political advantage or disadvantage they get from voting one way or the other."

    Meanwhile, Vice President Mike Pence over the weekend praised Kavanaugh as a nominee who will pay attention to the strict construction of the Constitution, but Dershowitz said such phrases have become a cliche.

    "In Bush versus Gore, the conservatives stretched the Constitution to apply equal protection analysis to the way ballots were counted, each side stretches the Constitution when it serves their interest and reads it narrowly when it serves their interest," said Dershowitz.

    Meanwhile, the United States is looking for a person who could potentially be a justice for 20 or 30 years, and nobody knows what the issues will be then, said the professor.

    "Abortion may be off the table and we may have developed technologies to eliminate the need for abortion," said Dershowitz. "Gay rights probably will be an issue of historic interest. We don't know what the issues will be.

    "That's why we need the most qualified, brilliant, academic, serious people serving on the court without regard to what their current political interests are. Justices tend to change over time."

    The story has all the marks of being real. Shooter has no doubt that something happened and kavanaugh was involved. Shooter does not doubt it was traumatic for Mrs. Ford, and her pain should not be trivialized.

    Mrs. Ford's trauma, real, imagined, or weaponized to stop kavanaugh, should not be ignored.

    That said, where is the history of sexual misconduct? Was this single event from over 30 years ago enough to disqualify kavanaugh?

    Does a single alchohol caused blackout make kavanaugh a drunk?

    What this does is raise questions about motivation, about democratic fervor to smear all things trump, all else be damned.

    Where was all of this when kavanaugh was nominated for circuit court judge? Where was it when he got his law license?

    Why weren't the democrats up on their moral high ground before this?

    It's simple.
    Cause .... trump.

    Just the same bullshit ineffective slash and burn democratic tactic we've been subjected to since trump started rising in the polls.

    And it will come back and bite the Democrats right in the ass.
