Report: Chaos and confusion after 'zero tolerance' policy on immigration

Washington (CNN)A report from the US Government Accountability Office released Wednesday describes chaos and confusion among federal agencies this past summer over efforts to reunify undocumented children separated from their parents at the US-Mexico border.

According to the report, officials at the department of Homeland Security and Health and Human Services "did not plan for the potential increase in the number of children separated from their parent or legal guardian as a result of the Attorney General's (Jeff Sessions) April 2018 'zero tolerance' memo."

A similar report from the DHS Inspector General released earlier this month found that the agency was not fully prepared for the zero-tolerance memo.

The officials interviewed by the GAO also said they "were unaware of the memo in advance of its public release."

The Justice Department memo called for the prosecution of all individuals caught coming into the United States illegally. It led to more migrant children being separated from their parents when children entering the country with their parents were placed into custody with a sponsor, in foster care, or held in a shelter as their parents were detained separately.

News of migrant family separations by American immigration authorities reached a fever pitch this summer following the issuance of the zero-tolerance memo.

The policy was essentially put on hold in
June.
According to the new GAO report, which included interviews with staff during visits to Office of Refugee Resettlement shelters in Arizona and Texas, the departments did not take specific steps to prepare for the increase in children referred to shelters.

According to DHS and HHS officials, once the families were separated, staff faced challenges coordinating communication between family members.

"DHS and HHS officials told us that they facilitated telephone conversations between parents and their children. However, even though a call had been scheduled, DHS and HHS officials said there were instances when either the parent or the child was unavailable to talk," the report states. "In addition, ORR shelter staff told us it was difficult contacting (Immigration and Customs Enforcement) detention centers and reaching the detained parents, especially when trying to establish the first contact."

One refugee resettlement field staff person told the GAO "that ICE personnel monitoring the phone calls between parents and children began terminating calls when they heard her speaking, explaining that the call was supposed to be between the child and the parent only."

"She said this was problematic because it inhibited her ability to determine if there were questions regarding parentage, parental fitness, or any possible danger to the child. According to ICE officials, they were concerned that ORR staff were consuming too much of the 10 minutes allotted for parents and children to speak and were also going over the allotted time. As a result, there was less time available for other parents to speak with their children in ORR custody," the report relays.

The report also details challenges HHS faced with family reunification, "including children having to wait for parents for unreasonably long amounts of time and parents transported to the wrong facilities."

"Shelter staff we interviewed also told us there were times when the parent was not available because the parent was in transit, resulting in long waits for the children and the accompanying shelter staff. In one case, staff at one shelter told us that they had to stay two nights in a hotel with the child before reunification could occur," the report states.

Refugee resettlement officials said that HHS leadership advised them not to plan for continued increases "since DHS officials told them that DHS did not have an official policy of separating parents and children."

The report investigated the process to coordinate data systems from DHS and HHS, which "did not systematically collect and maintain information to indicate when a child was separated from his or her parents" prior to the zero-tolerance memo.

Between April and August 2018, the report states, the agencies updated their data systems "to help notate in their records when children are separated from parents." Within DHS, the agency "made changes to their data systems to allow them to better indicate cases in which children were separated from their parents."

Despite making those changes, "ORR officials stated, as of early September 2018, they were unaware that DHS made these systems changes."

The report indicated that though data systems were updated this year to better indicate whether a migrant child has been separated from their parent, "it is too soon to know the extent to which these changes, if fully implemented, will consistently indicate when children have been separated from their parents, or will help reunify families, if appropriate."

Number of Unaccompanied Immigrant Children in U.S. Custody Tops 14,000

The number of unaccompanied immigrant minors in the United States topped 14,000 for the first time, The San Francisco Chronicle reports. The number of unaccompanied immigrant children in the custody of Health and Human Services reportedly reached 14,056 as of Friday, breaking a record that was set just two months ago. The newspaper reports that the rise can be attributed to children spending a longer time in holding facilities. Children reportedly have to wait longer periods of time while background checks process for adults who are claiming custody of them.

U.S. Immigration and Customs Enforcement also confirmed in September that the agency was using information from background checks to arrest undocumented people who came forward to claim the children, leaving the minors in government care for an even longer period of time. While the Trump administration’s family-separation policy brought attention to unaccompanied immigrant minors, many of the children who were forcibly separated from their families this summer are now reunited or are out of the government system. Department of Health and Human Services spokeswoman, Evelyn Stauffer, told the Chronicle the growing number of children in government care was due to a “broken immigration system” and a “crisis at the border.”

U.S. Troops to Leave U.S.-Mexico Border Just as Migrant Caravan Arrives

The Pentagon announced all active-duty troops sent to the U.S. southern border ahead of a migrant caravan’s arrival will begin to drawdown, just as that caravan of asylum-seeking refugees began to arrive at a port of entry in Tijuana, Mexico.

Army Lt. Gen. Jeffrey Buchanan, who runs the mission out of Texas, told Politico that the troops sent by President Trump to back up existing border enforcement “should be home by Christmas.” He also said troop numbers would rapidly fall after “engineer and logistics troops” finish fortifying entry ports and base camps along the U.S.-Mexico border.

Buchanan also confirmed that the Pentagon rejected a Department of Homeland Security request for “armed force to back up Border Patrol agents in the event of a violent confrontation,” describing the request as a “law enforcement task.” Migrants started arriving in Tijuana by the hundreds late last week, with Mexican officials worrying about how to house the influx of migrants.

Trump Personally Employs Undocumented Immigrants? That May Be a Federal Crime

President Donald Trump has long employed undocumented immigrants at the Trump National Golf Club in Bedminster, New Jersey, according to a New York Times report. This arrangement may run afoul of federal law.

A mid-afternoon Thursday exposé identified two of the undocumented women by name.

Victorina Morales, the report notes, has made Trump’s bed, “cleaned his toilet and dusted his crystal golf trophies.” The second woman, Sandra Diaz, no longer works at the golf club but had similar duties during her three-plus years there.

Per the Times:

[Diaz] said she washed and ironed Mr. Trump’s white boxers, golf shirts and khaki trousers, as well as his sheets and towels. Everything belonging to Mr. Trump, his wife, Melania, and their son, Barron, was washed with special detergent in a smaller, separate washing machine, she said.

Substantial media attention has focused on the stark divide between Trump’s personal employment of undocumented immigrants compared to his campaign rhetoric and governing priorities. Morales herself noted that disconnect.

“We are tired of the abuse, the insults, the way he talks about us when he knows that we are here helping him make money,” she told the Times. “We sweat it out to attend to his every need and have to put up with his humiliation.”

Aside from the disconnect between the Trump administration’s approach to illegal immigration and the apparent reality at his club, there could be a federal crime afoot here, too.

Let’s take a look at federal law. The statute on point here is contained at 8 U.S.C. § 1324(a)(3)(a) and reads, in relevant part:

Any person who, during any 12-month period, knowingly hires for employment at least 10 individuals with actual knowledge that the individuals are aliens…shall be fined under title 18 or imprisoned for not more than 5 years, or both.

One relevant inquiry here would be how many undocumented immigrants were–or are–employed by Trump at Bedminster during the above time period.

The more pressing–and arguably more interesting–concern here is whether Trump or his underlings could be shown to have had “actual knowledge” of the maids’ (or other employees’) undocumented status. The report suggests that at least a few people at the golf course knew.

Again, the Times:

“There are many people without papers,” said Ms. Diaz, who said she witnessed several people being hired whom she knew to be undocumented…

Ms. Morales expects she will have to leave her job as soon as her name and work status are made public. She understands she could be deported. But she also says she is certain that her employers — perhaps even Mr. Trump — knew of her unlawful status all along.

“I ask myself, is it possible that this señor thinks we have papers? He knows we don’t speak English,” Ms. Morales said. “Why wouldn’t he figure it out?”

Other parts of the Times report allege that higher-ups at Bedminster were absolutely aware of their employees’ undocumented status. Morales explicitly claims that some of those higher-ups conspired to help certain employees obtain forged immigration and work documentation–including herself.

These facts could support an extended inquiry into the knowledge of Bedminster officials–if not the 45th president himself. With an emboldened Democratic House majority dedicated to investigating anything that smells like corruption emanating from the Trump White House, this report may be just another source of ammunition for the Congressional subpoena mill.

Since at least 2005 every trump owned or managed business uses e-verify. It is a management policy not to hire anyone who does not have the legal right to work in the US.
Shooter knows this because a company he worked for was contracted by the trump organization to provide guidance and training to hiring managers on how best to use e-verify. Trump management made clear to HR departments and managers that hiring illegals was unacceptable and would be dealt with promptly and severely.

Under US law, once someone crosses into US territory from Mexico, they have a right to ask for asylum, but the federal fucking government doesn’t have to grant them asylum.

A 7-year-old Guatemalan girl died of “dehydration and shock” hours after she was taken into Border Patrol custody last week, U.S. Customs and Border Protection revealed Thursday. The child, who has not been identified, reportedly arrived in the U.S. with her father and a group of 163 migrants, and the two were taken into custody in New Mexico on Dec. 6. A CBP statement said she had “not eaten or consumed water for several days.” She was reportedly taken by helicopter to an El Paso hospital, where she died “less than 24 hours after being transported,” CBP said. The Washington Post reports that food and water are typically given to migrants taken into Border Patrol custody, but it was not clear if the girl got provisions or received a medical exam before she experienced seizures. “Our sincerest condolences go out to the family of the child,” CBP spokesman Andrew Meehan said in a statement. “Border Patrol agents took every possible step to save the child’s life under the most trying of circumstances… As fathers and mothers, brothers and sisters, we empathize with the loss of any child.”
