    A significant percentage of the Republican Party, although not a majority of registered Republicans, has never accepted the basic reforms of the New Deal. Nevertheless, these reforms have broad popular appeal, as does Medicare.

    Trump has been selecting Supreme Court nominees from the Federalist Society. The Federalist Society would like to use the Tenth Amendment against the reforms of the New Deal. The Tenth Amendment states:

    "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."

    This amendment could easily be used by a reactionary Supreme Court, that is to say a Supreme Court with Brett Kavanaugh on it, to overturn much of the economic, civil rights, and environmental legislation passed during the twentieth century.

    This in turn would provoke a Constitutional crises. There could be a demand for a new Constitution. There is no intrinsic reason a Constitution that was thought suitable for an agrarian country of thirteen states and less than three million people is appropriate for computer dominated country of 325.7 million.

    The United States Constitution has lasted as long as it has because the United States Supreme Court has usually had the wisdom to know which parts of it to ignore. In addition, the Supreme Court has invented "Constitutional rights" not found in the Constitution, cush as the right to an abortion.

    All of this becomes uncertain if Kavanaugh joins the Supreme Court.

    Reactionaries who respond to what I have written with, "Good. Let's go for it," should consider that the liberal Warren Court made decisions that contributed to the Republican ascendency.
