    Mueller team turns over missing Flynn interview document after judge's order


    Special Counsel Robert Mueller on Monday filed a heavily redacted witness report, known as an FD-302, documenting FBI agents' fateful interview with former National Security Adviser Michael Flynn at the White House on January 24, 2017.

    Last Friday, Mueller met Sullivan’s deadline and provided some documents, some of which were heavily redacted. However, the special counsel did not publicly provide the January 302, leading to speculation as to whether one was ever drafted.

    Apart from a new memo from Mueller's team defending the FBI's handling of the interview -- and saying nothing about the way it was conducted “caused the defendant to make false statements to the FBI” -- the filing last Friday included a January 2017 memo on Flynn from then-FBI Deputy Director Andrew McCabe and a separate 302 detailing a July 19, 2017 interview with then-FBI agent Peter Strzok. Strzok, one of two agents who interviewed Flynn, described that meeting in the document, filed Aug. 22 of that year.

    James Trusty, a former senior Justice Department official who now works as a criminal defense attorney at Ifrah Law, predicted Sullivan would notice that the 302 submitted Friday was dated seven months after the Flynn interview took place.

    “Judge Sullivan has a well-established history of taking on discovery issues head-on,” Trusty said. “So providing a seven-month-old FBI 302 is absolutely going to be a red flag for the judge, and I can’t imagine there are not going to be questions tomorrow about whether there are contemporaneous notes, or a contemporaneous report, that is in the FBI’s possession.”

    Speculation about Sullivan's thinking in the Flynn case is widespread considering he threw out the 2008 conviction of the late Sen. Ted Stevens after government misconduct came to light. Sullivan technically has the authority to toss Flynn’s guilty plea and the charge against him if he concludes the FBI interfered with Flynn’s constitutional right to counsel, though he has given no indications that he intends to do so.

    Reporter who broke news of Steele dossier used to surveil ex-Trump aide calls its claims largely 'false'


    The salacious and unverified opposition research dossier cited by the FBI as its main justification to surveil a top Trump aide contains many claims that are "likely false," according to the Yahoo News reporter who was among the first to break the news of the dossier's existence.

    Michael Isikoff's statements on John Ziegler's Free Speech Broadcasting podcast came a day before Michael Cohen adviser Lanny Davis reiterated that Cohen has never been to Prague -- where, according to the dossier, he traveled to arrange a payment to Russian hackers during the 2016 presidential campaign.

    The dossier was created by British ex-spy Christopher Steele and funded by the firm Fusion GPS -- which was retained by the Democratic National Committee (DNC) and the Hillary Clinton presidential campaign.

    "In broad strokes, Christopher Steele was clearly onto something, that there was a major Kremlin effort to interfere in our elections, that they were trying to help Trump's campaign, and that there was multiple contacts between various Russian figures close to the government and various people in Trump's campaign,” Isikoff said

    But he added: “When you actually get into the details of the Steele dossier, the specific allegations, we have not seen the evidence to support them, and, in fact, there's good grounds to think that some of the more sensational allegations will never be proven and are likely false."

    Defiant Comey lashes out at House GOP over ‘frustrating’ hearing

    Former FBI director James Comey blasted House Republicans on Monday after exiting what he described as a “frustrating” closed-door hearing -- his second Capitol Hill appearance this month where he was called to answer questions on the Russia and Hillary Clinton email probes.

    Asked by Fox News' Catherine Herridge if he bears any responsibility for the FBI's reputation taking a hit, he responded, "No."

    Speaking to reporters after the hearing, Comey called it “frustrating to be here.” He dismissed the questions from lawmakers, including over the FBI’s Hillary Clinton email investigation and the anti-Trump dossier authored by Chris Steele, as old news.

    “The questions about Hillary Clinton and Steele dossier strike me as more of the same,” Comey said. “I didn’t learn anything new in there. Maybe they did.”

    Lashing out at Republicans, Comey also called for them to stand up to the “fear of Fox News, fear of their base, fear of mean tweets” and “stand up for the values of this country.”

    Earlier, North Carolina Rep. Mark Meadows told reporters Republicans planned to focus their Comey questioning on a new FBI document that was released Friday in response to a Freedom of Information Act and published by Politico.

    He told reporters he wanted Comey to clarify when he first became aware of the involvement of the Democratic National Committee, law firm Perkins Coie and the opposition research group Fusion GPS in the production of the dossier.

    “I want to give him a chance to clarify all that,” Meadows said.

    That heavily redacted document details the information regarding the bureau’s Russia investigation that Comey, serving as FBI director at the time, briefed Trump about shortly after the Republican was elected president.

    The document, once again, suggests the FBI was vague in the sourcing of the dossier’s origin as being funded by anti-Trump Democrats.

    But Meadows also says he believes it could conflict with previous statements from Comey about what he knew of the dossier’s origins at the time.

    “I can’t imagine how the director of the FBI did not know the connection between Fusion GPS, Perkins Coie, and the DNC, as it related to the infamous dossier,” Meadows told reporters.

    'What Are They Hiding?': Jarrett Blasts Mueller Team After Release of Gen. Flynn's FBI Interview

    Fox News legal analyst Gregg Jarrett said on Hannity that Robert Mueller's prosecutors only care about "getting Trump and winning their cases."


    Jarrett's remarks come after Gen. Michael Flynn's FD-302 interview report was released on Monday, hours before the former national security adviser's sentencing.


    As Fox News reported:


    Flynn pleaded guilty to lying about whether he had talked to former Russian ambassador Sergey Kislyak in December 2016 on limiting the Russian government's response to former President Barack Obama's recently imposed sanctions for election meddling.


    Jarrett told Judge Jeanine Pirro that the 302 report clearly states that FBI agents interviewing Flynn determined he was telling the truth.


    He said that Special Counsel Robert Mueller's prosecutors "deliberately hid" the 302 from U.S. District Judge Emmet Sullivan, which led to him issuing an order Monday to turn over the document.


    "That's a red flag for the judge, it puts him on alert," Jarrett said. "During tomorrow's hearing he may say 'why did you hide that document from me?'"


    Fox News contributor Sara Carter added that she believes Judge Sullivan won't let Mueller's team "walk all over" Flynn.

    Carter said that the interview's raw notes were not turned over, and that those notes could potentially be very different from the 302 report.

    "These are prosecutors who don't care about justice and the truth," Jarrett added. "Mueller's team only cares about getting Trump and winning their cases."

    Carter noted that the 302 document states Flynn was notified of the nature of his interview, which she said was "inaccurate."

    "They asked him not to bring an attorney," she said. "They were looking at him for possible criminal purposes. They were trying -- in a sense -- to entrap him."

    Jarrett also said Deputy Attorney General Rod Rosenstein has not made available who the second FBI agent was that interviewed Flynn.

    The 302 document notes that former agent Peter Strzok was interviewer number one, but the second name was redacted.

    "What are they hiding?" he asked.

    I see the PR hacks working overtime on the spin machine actually defeating their own arguments.

    But here's the real deal. Things just went so bad for Flynn in his sentencing hearing the defense just took the judge up on his offer to delay sentencing because as it stands right now it appears Judge Sullivan is going to slap his ass in jail because he was the National Security Adviser who lied to the FBI inside the White House for Christ's sake and he sold out the United States of America.

    It's funny how you question Strzok, but not a peep from Flynn questioning anything about the man.

    There is a lot of breaking news right now but even though the actual transcript of the hearing is a real bitch to work with, at least the only one I've found so far is, I do want to take the time to shoot down the PR hack spin coming out of it that Comey somehow incriminated himself when he described how and why they interviewed Flynn. And keep in mind. The reasons this interview was different is because Flynn was one of the four individuals in the campaign the FBI was already investigating before the Steele Dossier came along. And this was a National Security Adviser that might be compromised of even working with the Russians.

    So this was an entirely different situation.

    Mr. Gowdy. Why not advise General Flynn of the consequences of making false statements to the FBI?

    Mr. Comey. Two reasons, really. First, the Deputy Director called him, told him what the subject matter was, told him he was welcome to have a representative from White House Counsel there. So he knew what he was going to be asked about. He was an extraordinarily experienced person and so reasonably should be assumed to understand you can't lie to the FBI. Second, it's not protocol. The FBI does not do that in noncustodial interviews. And, third, you want to find out what the witness will say to you before you heat up an interview by raising the prospect that the witness might be lying to you.

    Ok let's knock down another bullshit lie coming out of the Trump PR hacks that Michael Isikoff one of the first reporters to report on the Steele Dossier said the claims in the dossier were likely false. In fact in his book and other interviews he says the opposite. Many things in the dossier are proving true.

    Isikoff was referring to only two things in the dossier. One being the pee pee tapes and the other whether or not Michael Cohen did in fact go to Prague to meet with the Russians. Isikoff does have some doubts about those two things but says again most of the rest of the dossier is holding up well.
