Gowdy also pushed Comey on comments he had made in a New York forum earlier this month, in which he told a moderator his decision to send two FBI agents to the White House without notifying the White House counsel's office was something he "probably wouldn't have done or maybe gotten away with in a more organized administration."
"I'm just kind of hung up on the phrase 'gotten away with,' " Gowdy told Comey on Monday in the private Capitol Hill interview, according to the transcript.
"In an administration where the rhythm of the context between the FBI and the White House was more established, there would've been a strong expectation that we coordinate it through White House counsel instead of calling the national security adviser directly. That's what I meant by it," Comey replied.
The timing of the interview thrust Comey back into the spotlight over the Russia investigation, as he was quizzed on the Flynn interview the same week that Flynn was supposed to be sentenced by a federal judge, although that sentencing was delayed Tuesday. But memos detailing how the FBI had arranged the interview and the assessment afterward were released ahead of the sentencing date, raising new questions for Comey from Republicans.

All they wanted to know is why? The FBI was not investigating a crime when they went to talk to Flynn. There was nothing illegal about Flynn talking to the Russian ambassador. And even if he discussed sanctions that is not illegal with the possible exception of violating the obscure and never used Logan Act. What they wanted to know was why was VP Mike Pence going on TV saying things they knew were not true.

And the crime was committed right in front of them when Flynn deliberately and repeatedly lied to them.

Fine. In order for Miranda to apply, the suspect must be detained or under arrest. Shooter was trained that when an individual is a suspect, they must be advised of their rights, whether they are under arrest or detained or not. Shooter should have done further research before he posted the standards he was trained under.

One police practice is to not tell the suspect that they are in any way in custody. The reality however is that law enforcement has determined that the suspect will be arrested, but they want a statement from the suspect first. This tactic worked until 2004 when the Supreme court restricted the practice, noting that if an investigation leads law enforcement to conclude that their suspect has committed a crime, they cannot avoid giving the "Miranda warning" simply by avoiding use of the term "arrest" or "detained".

Because the ensuing discussion took place after petitioner had been indicted, outside the presence of counsel, and in the absence of any waiver of petitioner’s Sixth Amendment rights, the Court of Appeals erred in holding that the officers’ actions did not violate the Sixth Amendment standards established in Massiah, supra, and its progeny.

Second, because of its erroneous determination that petitioner was not questioned in violation of Sixth Amendment standards, the Court of Appeals improperly conducted its “fruits” analysis under the Fifth Amendment. Specifically, it applied Elstad, supra, to hold that the admissibility of the jailhouse statements turns solely on whether the statements were “ ‘knowingly and voluntarily made.’ ” 285 F.3d, at 724 (quoting Elstad, supra, at 309). The Court of Appeals did not reach the question whether the Sixth Amendment requires suppression of petitioner’s jailhouse statements on the ground that they were the fruits of previous questioning conducted in violation of the Sixth Amendment deliberate-elicitation standard. In the context of Miranda, interrogation has a broad meaning. It includes any direct questioning of a suspect about a crime under investigation. It also includes various forms of indirect or subtle questioning that are considered the “functional equivalent” of direct questioning.

What is the “functional equivalent” of direct questioning? This is any words or actions by an officer that the officer should have known were reasonably likely to elicit an incriminating response. According to the United States Supreme Court, this is “a practice that the police should know is reasonably likely to evoke an incriminating response from a suspect amounts to interrogation.”

In determining whether an officer’s words or actions constituted the functional equivalent of direct questioning, it is helpful to keep the following principles in mind:

Reasonably likely: Interrogation does not result merely because there was a “possibility” the suspect would incriminate himself, or because officers “hoped” he would. Instead, interrogation occurs only if officers should have known an incriminating response was reasonably likely.

Officer's intent: Interrogation will probably result if the officer actually intended that his words or conduct would elicit an incriminating response because it indicates the officer was aware that an incriminating response was reasonably likely.

So the general and Anon can puff out their chests and proclaim that they were right and Shooter was wrong. Shooter agrees; current case law says a suspect must be "in custody" before Miranda applies, but "in custody" can also mean that the police have determined that a suspect has committed a crime and they are interrogating the suspect, if their intent is to obtain incriminating statements.

So going forward, you can freely talk with the cops until they slap the cuffs on you. Until then, you can confess to your crimes, cause, you know, being truthful is a given and no one should need to be reminded not to lie to the cops.

And just total bullshit on you ever being a cop or trained as one. Detaining and questioning suspects that MIGHT be involved in criminal activity without giving a "Miranda warning" is called a Terry Stop and was ruled constitutional in 1968. No one would have ever trained you otherwise.

Terry Stop / Stop and Frisk

A terry stop is another name for stop and frisk; the name was generated from the U.S Supreme Court case Terry v. Ohio. When a police officer has a reasonable suspicion that an individual is armed, engaged, or about to be engaged, in criminal conduct, the officer may briefly stop and detain an individual for a pat-down search of outer clothing. A Terry stop is a seizure within the meaning of Fourth Amendment.

In a traffic stop setting, the Terry condition of a lawful investigatory stop is met whenever it is lawful for the police to detain an automobile and its occupants pending inquiry into a vehicular violation. The police do not need to believe that any occupant of the vehicle is involved in criminal activity.

In a recent case, Floyd v. City of New York 813 F. Supp.2d 417 (2011), the court held the New York stop-and-frisk policy violated the Fourth Amendment because it rendered stop and frisks more frequent for blacks and Hispanics.

Note that "reasonable suspicion" is a much lower legal standard than having "probable cause" to suspect a crime has been committed. And if police can claim just reasonable suspicion the stop is legal and they do not have to advise you of your rights.

And as I said in an earlier post the magic words are "officer am I under arrest." And if the officer says no then you either turn your back and start walking away or if you are in a car ask if you are free to go. And if the officer stops you from leaving then he has technically placed you under arrest whether they actually say you are under arrest or not.

And at that point it is time for you to follow three simple rules. Shut up, SHUT UP, and SHUT THE FUCK UP!!! Because anything you say can and will be used against you in a court of law whether warned you or not.

Former FBI counterintelligence boss reveals why Mueller appears ready to make indictments involving Russian collusion

Another tumultuous week of the Trump presidency ended with the federal government shuttered under one-party rule with no end in sight.

On Saturday’s MSNBC anchor Richard Lui hosted a panel featuring Danny Cevallos and Frank Figliuzzi, the former Assistant Director for Counterintelligence at the Federal Bureau of Investigation. Both said they expect things only to get worse as the Mueller investigation reaches its end, reportedly as soon as mid-February.

Figliuzzi pointed to reports that Trump lashed out at acting AG Matt Whitaker for not protecting him from damaging revelations made during Michael Cohen’s plea deal, in the form of documents that basically called Trump a felon as proof things were about to get worse.

“It’s a devastating week for the president and his team,” said Figliuzzi. “Let’s add something… the revelation that the president has angrily lashed out at [acting AG Matt] Whitaker, he called Whittaker angrily at least twice, angry with what he’s seeing in the [Southern District of New York] filings. Let’s combine that with the NBC reporting that maybe Mueller is going to wrap up as early as February: What does this mean? It means this is going to come right back to Whitaker… if Mueller wraps up by February, the report goes to Whitaker. Whitaker’s being lashed out by the president, between a proverbial rock and hard place.”

Figliuzzi said these reports suggested to him that new indictments were about to drop, and that they would contain evidence of Russian collusion.

“If I’m Mueller after this week of developments, here’s what I do: I’m going to stay on course with the strategy of making the report to Whitaker secondary to telling the full story through speaking indictments,” he said. “If we’re talking about a February wrap up, the next shoes to fall, I predict, will be Roger Stone and Jerome Corsi. And look for those indictments to tell us a story that includes Russian collusion.”

Cevallos agreed new indictments are looming but thinks Mueller will steer around Whitaker.

“There is a real possibility that we may never get to read the Mueller report, at least in its full incarnation, complete expression,” said Cevallos. “We may get a summary of that through another avenue. It may never see the light of day. Mueller has been speaking to us the entire time, through his indictments filled with detail, the kind of detail that you don’t normally see in an indictment… which can be a bare bones, bare minimum pleading designed just to get over the threshold, so Mueller’s report we may never see but in a sense, we have all seen a lot of it already.”

“Well, I tell you what: If I’m Roger Stone, I’m spending the holidays with my family, I’m getting my affairs in order because I’m anticipating either cooperating fully or being indicted,” Figliuzzi said. “Everything he said so far indicates he is not going to cooperate, so I think that’s next up.”

A cell phone signal obtained by Eastern European intelligence suggests that former Trump attorney Michael Cohen was near Prague during the summer of 2016.

The cell phone records were first reported by McClatchy on Thursday.

According to the report, “Michael Cohen briefly sent signals ricocheting off cell towers in the Prague area in late summer 2016, at the height of the presidential campaign, leaving an electronic record to support claims that Cohen met secretly there with Russian officials, four people with knowledge of the matter say.”

During the same period of late August or early September, electronic eavesdropping by an Eastern European intelligence agency picked up a conversation among Russians, one of whom remarked that Cohen was in Prague, two people familiar with the incident said.

The phone and surveillance data, which have not previously been disclosed, lend new credence to a key part of a former British spy’s dossier of Kremlin intelligence describing purported coordination between Trump’s campaign and Russia’s election meddling operation.

Although President Donald Trump has referred to the dossier as a “pile of garbage,” much of it has been authenticated by news and intelligence services.

The cell phone signal intelligence has reportedly been shared with special counsel Robert Mueller’s Russia investigation.

Cohen, 52, has vehemently denied the dossier’s allegations ever since BuzzFeed published the salacious document on Jan. 10, 2017. He has denied ever visiting Prague. In an attempt to prove that, he provided BuzzFeed with his passport, which did not show any stamps from the Czech Republic.

Mueller’s probe is sending waves of panic over DC lobbyists now vulnerable to being prosecuted: report

A new report from The Hill claims that special counsel Robert Mueller’s investigation into Russian interference in the 2016 presidential election is generating anxiety among many Washington DC lobbyists who may now find themselves vulnerable to criminal charges.

According to The Hill, “Mueller has uncovered a web of alleged criminality linked to violations of a World War II-era law enacted amid concerns over foreign propaganda” that could also be used to nail a number of other DC lobbyists who have been breaking the law for years.

Mueller has already referred lobbyist-related cases to other prosecutors, including cases involving former associates of one-time Trump campaign chairman Paul Manafort and former national security adviser Michael Flynn.

However, one lobbyist tells The Hill that others in the industry fear this could be just the tip of the iceberg.

“When you become ground zero for what America is angry about. anything can happen,” the source said. “All it takes is a couple of scandals.”

But one thing for sure the smell of fear is in the air. And what is interesting to me is Corsi has been all over the news and TV swearing up and down he has refused to cooperate with Mueller. According to the Washington Examiner, Stone’s anger comes from the fact that Corsi stated in recent interviews he had told Stone and “many” others about the Russia-linked theft of emails from Hillary Clinton campaign chair John Podesta before they had been published to WikiLeaks.

Stone hinted he had advance knowledge of the document dump in 2016, tweeting that it would soon be Podesta’s “time in the barrel” weeks before the first of his emails were released on the vigilante intelligence group’s website. He has since tried to claim he was not involved in the operation and only heard about it from comedian Randy Credico — who vehemently denies it. Mueller has opened an investigation into the full extent of Stone’s involvement, and if it turned out that Stone lied to investigators or to Congress, he could be in serious trouble.

But the fact that Stone is now turning on Corsi is especially notable, as Corsi has — at least publicly — been one of Stone’s most steadfast and loyal allies.

Corsi was offered a plea bargain by Mueller in exchange for cooperation, but he refused, telling MSNBC that he “might die in jail” for helping Trump get elected but that he has no regrets. To help him defend against Mueller’s investigation, he retained Larry Klayman, a far-right legal activist who once tried to make a citizen’s arrest of former President Barack Obama and claimed the Florida pipe bomber was a false flag paid for by Democrats. Klayman proceeded to send a fake “criminal complaint” to the Justice Department and the D.C. Bar accusing Mueller of false statements, extortion, and racketeering, and then filed a lawsuit accusing Mueller of blackmail.

It would not be altogether surprising if Corsi ultimately abandoned this bizarre strategy — when people have refused to cooperate with Mueller’s investigation, it has tended to not end well. But while there is no outward sign Corsi is ready to give up, Stone clearly seems to think he could blow up everything.

And this has been a very consistent pattern ever since the Trump/Russia investigations started. whenever there is a new development, another guilty plea, or news that someone has agreed to cooperate Trump starts rage tweeting WITCH HUNT and trying to attack Mueller and his team. And one thing we know for sure is Trump lies all the time which would indicate he is also lying about Mueller and his investigations. But there is also just sheer panic in his tweets and they become the Tell Tale Heart. Where is responding to his own guilty consciousness.
