Trump admin dropped the ball on Pentagon’s offer to deliver thousand of ventilators: report

According to a CNN report this Tuesday, the Defense Department offered two weeks ago to make thousands of ventilators available, but the Trump administration failed to take them up on the offer.

After offering to send 2,000 ventilators to FEMA and HHS, the Pentagon never got the go-ahead to ship them off or any sort of directions on where to send them to.

CNN reports that the Defense Department also made its testing labs available, but still hasn’t heard back from the White House.

More than 1 in 5 ventilators the federal government stockpile is holding for emergencies don’t work

As the coronavirus is raging through the United States, President Donald Trump has begun releasing personal protective equipment from federal stockpiles as well as much-needed ventilators. Unfortunately, however, one in five ventilators from the government don’t work.

The New York Times reported Wednesday that there are 10,000 ventilators that the government is holding back for the next wave of the emergency.

“But what federal officials have neglected to mention is that more than 2,000 of the lifesaving devices are unavailable after the contract to maintain the government’s stockpile lapsed late last summer, and a contracting dispute meant that a new firm did not begin its work until late January. By then, the coronavirus crisis was already underway.”

It became known when the Department of Health and Human Services was hit with questions from stat officials noting that the ventilators are not operational.

“In fact, the contract with a company that was maintaining the machines expired at the end of last summer, and a contract protest delayed handing the job to Agiliti, a Minneapolis-based provider of medical equipment services and maintenance,” said The Times. “Agiliti was not given the $38 million task until late January, when the scope of the global coronavirus crisis was first becoming clear.”

No one knows whether the problems with the equipment happened before or after the contract lapsed but there was no maintenance of the machines after the contract ended.

“We were given a stop-work order before we’d even started,” said Agiliti CEO Tom Leonard. “Between the time of the original and the time of this contract award, I don’t know who was responsible or if anybody was responsible for those devices. But it was not us.”

New evidence shows Trump—who says he knew Covid-19 was ‘going to be horrible’—allowed exports of crucial supplies to continue

While countries in Europe and Asia spent the first several weeks of the year preparing their healthcare systems and populations for the coronavirus outbreak by stockpiling crucial medical supplies, the Trump administration spent that same time sending dozens of medical shipments overseas as President Donald Trump denied the coronavirus would have much of an impact on the United States.

As The Intercept reported Wednesday, while the new coronavirus ravaged countries including China, Italy, and Iran in February and early March, U.S. manufacturers were sending large shipments of respirators, ventilators, and protective medical equipment to Germany, Belgium, and Japan.

A “steady flow of the medical equipment needed to treat the coronavirus [was] being shipped abroad as recently as March 17,” wrote Lee Fang at The Intercept, while Trump first claimed the severity of the coronavirus pandemic was a “hoax” perpetrated by Democrats, then compared it to the seasonal flu and insisting it would likely disappear once spring arrived.

Even though Trump said during a press conference on Tuesday that he knew more than a month ago that the crisis was “going to be horrible,” the new evidence shows that he and his administration did not move swiftly enough at the time to lock down supplies or reconsider the manner in which crucial equipment was being exported.

By March 17, 37 states had closed their public schools, nearly eight million California residents had been told to shelter in place to stop the spread of the virus, and state officials were sounding alarms about medical supply shortages while Trump told governors to acquire supplies themselves without relying on the federal government.

The critical supply shortages now being reported in hospitals across the country “is the result of a combination of factors, including poor planning by the U.S. government,” wrote Fang. “In the absence of early detection and purchasing agreements, crucial medical supplies have been ferried out from American manufacturers for foreign markets.”

The Trump administration’s “unwillingness to read the cards” in January and February while dozens of other countries were anticipating crises and placing moratoriums on medical supply exports is partially to blame for the current state of chaos being faced by healthcare providers, Olivia Webb of the American Economic Liberties Project told The Intercept.

“An ideal policy would demand corporations give the U.S. government and U.S. health care entities the right of first refusal for PPE and related equipment during a national emergency,” Webb said.

The Intercept‘s report is just the latest regarding the administration’s failure to support U.S. hospitals as more than 200,000 people in the country have contracted the virus. As Common Dreams reported Tuesday, the federal government has seized shipments of medical supplies going to several states and has outbid governors as states have tried to procure equipment from manufacturers.

As ProPublica reported Monday, Trump’s Health and Human Services Department has also allowed an American company that was contracted to produce low-cost ventilators to overlook the need for the equipment in the U.S., instead shipping them to European countries at higher prices over the past two months.

Meanwhile, as Politico reported Tuesday, the administration issued a plea to Thailand for a medical supply shipment last week—only to be told that the U.S. had just sent two large shipments of equipment to Bangkok. The mix-up prompted Vice President Mike Pence to put in place a new review process for USAID deliveries of personal protective equipment (PPE) to developing countries—effectively freezing aid packages that were meant for countries including Honduras and Bangladesh.

FEMA told the House Oversight Committee this week that most of the 100,000 ventilators that President Trump promised for the fight against coronavirus won’t be available until June, according to POLITICO.

“FEMA officials, according to a readout of a pair of briefings by the panel’s Democrats, indicated that a shortage of ventilators would worsen by the middle of this month before the coronavirus outbreak peaks,” POLITICO’s Kyle Cheney writes. “FEMA indicated there were just 9,500 ventilators in the national stockpile, with just 3,200 more expected by the week of April 13, the tail end of what Trump described recently as a ‘painful two weeks’ as the outbreak is expected to worsen.”

The shortage of ventilators could make an already bad situation worse when it comes to coronavirus deaths. Trump has shifted the blame for the shortage on state governors, accusing them of having an “insatiable appetite” for equipment they don’t necessarily need.

President Trump has claimed that “we’re going to have plenty” of life-saving ventilators with an additional 100,000 provided to hospitals, but Federal Emergency Management Agency (FEMA) officials told lawmakers this week that they likely won’t be ready until June “at the earliest,” Politico reported on Thursday. The FEMA officials warned the House Oversight Committee that there were only 9,500 ventilators in the emergency federal stockpile of personal protective equipment. They said that 3,200 additional ventilators will be rolled out by the week of April 13, which is when the coronavirus outbreak in the United States is expected to peak.

Virginia, West Virginia, Delaware, Maryland, Pennsylvania, and Washington D.C. only received 10 percent of their requested 5.2 million respirator masks and less than one percent of their requested 194 million pairs of gloves. “The president must act immediately to take all steps within his authority to get personal protective equipment and medical supplies to our nation’s front-line responders who are risking everything to save their fellow Americans,” said Rep. Carolyn Maloney (D-NY), chairwoman of the House Oversight Committee.

The only thing I dislike about this comment is that I did not compose it myself. I would have written it differently, but this is the best explanation of our predicament I have read, and that includes what I have read by professional commentators.

For three years Trump took credit for an economic growth rate (AKA, the "roaring economy" shootersa has been raving about) that began when President Obama prevented George the Lesser's Great Recession from becoming the Republican Party's Second Great Depression. Trump accelerated this growth rate with an irresponsible tax cut that went mainly to the rich and corporations, when they should have been taxed very heavily to pay down the national debt that Republicans only complain about when a Democrat is president.

Now we are looking at the possibility of over a million dead, and an unemployment rate that exceeds the 23% it reached when Herbert Hoover was president. This is a perfect storm Trump cannot solve with his lies, his bluster, and his indifference to expert opinion. The poorly educated whites Trump pretends to love, because up to now they have loved him, are rallying 'round the flag shouting "USA! USA!" That won't help them or us. Millions of good people are suffering because of Trump's incompetence. Thousands are dying.

The startlingly unethical antics of ventilator manufacturers

Earlier this year, the U.S. Attorney’s Office in South Carolina announced that a company called ResMed had agreed to pay more than $37 million to settle allegations under the False Claims Act that it illegally paid kickbacks to promote sales of equipment used to treat sleep apnea.

The case did not receive much attention at the time, but ResMed, which also produces ventilators, is now one of the companies involved in the controversy over the distribution of equipment that hospitals desperately need to save lives during the coronavirus pandemic.

New York Gov. Andrew Cuomo and other state chief executives have been complaining about price-gouging and shipments that fail to materialize, as health systems across the country compete for a woefully inadequate supply of ventilators, some of which have reportedly been exported.

All the big publicly traded companies in the industry have paid millions of dollars in penalties in False Claims Act, kickback and bribery cases.

This apparent profiteering should come as no surprise, given the track record of the ventilator industry, in which ResMed is not the only producer with a history of alleged misconduct. In fact, all the big publicly traded companies in the industry have paid millions of dollars in penalties in False Claims Act, kickback and bribery cases. Along with ResMed, they are Philips, General Electric, Hill-Rom, and Medtronic.

Kickbacks and Payments
*In 2016 a Philips subsidiary called Respironics agreed to pay $34.8 million to settle allegations similar to those faced by ResMed involving the payment of kickbacks to suppliers for the purchase of sleep apnea equipment. In 2013 the Securities and Exchange Commission ordered Philips to pay $4.5 million for violations of the Foreign Corrupt Practices Act stemming from improper payments to healthcare officials in Poland.

In 2011 GE Healthcare agreed to pay $30 million to settle False Claims Act allegations that a subsidiary caused Medicare to overpay for a radiopharmaceutical used in certain cardiac diagnostic imaging procedures by giving the federal government false or misleading information about doses.

False Medicare Claims
Also in 2011 Hill-Rom agreed to pay $41.8 million to settle allegations that for years it knowingly submitted numerous and repeated false claims to the Medicare program for certain specialized medical equipment – bed support surfaces for treatment of pressure ulcers or bed sores – for patients for whom the equipment was not medically necessary.

Since 2006 Medtronic and its subsidiaries have paid more than $160 million in penalties in eight False Claims Act cases. The largest of these was a $75 million settlement agreed to by Medtronic Spine to resolve allegations that its marketing activities caused hospitals to submit false claims for kyphoplasty procedures, minimally-invasive surgeries used to treat compression fractures of the spine caused by osteoporosis, cancer or benign lesions.

Along with the False Claims Act cases, which are civil matters, a Medtronic subsidiary agreed to plead guilty and pay more than $17 million in 2018 to resolve a criminal charge that it promoted a neurovascular device for uses that were not approved by the FDA and were potentially dangerous.

Corporate Criminal
It is true that none of these cases involved mechanical ventilators, but they do suggest something about ethical practices at the five companies. These are corporations accused of putting their own financial interests ahead of those of the federal government and thus the taxpayers. One of them has a subsidiary that is literally a corporate criminal.

The coronavirus crisis is exposing many vulnerabilities of U.S. society. Among them is that the survival of many thousands of people now depends in large part on the behavior of a group of companies that have been something less than model corporate citizens.

This makes it all the more scandalous that the Trump Administration refuses to make full use of the Defense Production Act to end profiteering in the ventilator industry and force it to serve the needs of the country during this national emergency.
