Seems to me that all we as writers are asking for is a clear set of guidelines. And, the facts in this case.

1. Was HD's story content at fault, or was there some other game afoot?

2. What is the minimum age for participants in a story?

It would be helpful to hear directly from Lemark on this. As site owner, he can make whatever rules he would like. It's a private company. Those who say he can't censor, he can't do this...you are wrong. With the flip of a switch, he can shut the entire site down, or sections of it, and there is nothing that can be done about it. By using IP content delivery, he could block an entire country from the site, leaving it open to the rest of the world.

I doubt that will happen, but, we do need to keep in mind that there may be reasons beyond what we think as to why certain rules get implemented. This is a business. If a major advertiser said "I need for you to ban these stories in order for you to keep my advertising" the site owner would have to decide what was in his best overall interest. It doesn't necessarily have to be a legal issue, although it could be, but it might be as simple as a financial decision.

Clear cut rules would make for far less stress. And, as someone pointed out, since ALL of HD's stories are gone, it sounds plausible like it could have been a hacked account issue.

Regardless, I for one would like a rules clarification.

 

It looks like the trolls have a new toy to play with, "Instead of voting down stories why not get rid of them altogether".

All they have to do is send a line or two of script, and say they find it offensive. Who here has the confidence to think that the story will be checked to confirm that it really does come from the story the objectors say?

I think self policing is turning out to be a trolls playstation.

 

That's where my personal distain for these stories is defined, kids, real kids, not teenagers.

My interputation of "120 days..." is that the story is more of a horror story centered around political corruption and exploits the dark side of S&M for the shock & horror value rather than the erotic value. Most of the stories here involving children are written for the erotic value.

Maybe it wasn't "the trolls", maybe, just maybe it was another writer wanting to rid his story from the competition because they were jealous or needed to help get their story closer to the top.

I agree - in my opinion, Hardrive's CAW entry was not clearly pedophia. If stories are being report via the button on the front page, then who is reading them to be sure they should be removed, according to the undefined criteria. I hope someone will give us some answers. I am forwarding your ideas, because I don't think anyone could have said it better.

 

I always kind of thought that was a stronger possiblity than non-writers cruising the stories and looking to do harm.

This site is not hosted in the United States, so, U.S. laws probably don't apply.

However, your post of that thread does bring up a very valid point. I thought when I read it, it said "no underage content" but did not have an age (18) posted. It does.

THAT, right there, makes it pretty clear what is acceptable, and what isn't. And, it appears that if something gets reported, it can/will get taken down, but that's about the only way that happens. In other words, there isn't a censor that is scanning as they go up, just if they get reported.

Well, fair/unfair/whatever, that does explain a few things.

Pedophilia is not a legal issue, it is a psychiatric issue and it has a clinical definition and not a legal definition.

When it comes to having sex with underage individuals, the legal issue is age of consent. Age of consent deals with the age at which the law considers a person mentally competent to engage in sexual actives. That includes giving consent to appear in still or motion pictures and that violation of law is called Child Pornography.

With regard to child pornography, Literature is different from photography or cinematography in that the characters portrayed in written stories are not real live flesh and blood people. Therefore there can be no child abuse or criminal violation of child sex laws if there are no actual children involved. XNXX is not in violation of any law by hosting sex stories that depict underage sex as long as they are not directing or inciting readers to commit crimes.

XNXX is privately owned and can control and set standards for the content it will host. However, they allow public access and participation on their site and therefore they must enforce their standards in a clearly fair and equitable fashion. To ban one author’s work for violation of its standards while continuing to host thousands of other authors whose work is just as much or more so in violation, is blatant and deliberate discrimination. Discrimination is a violation of rights and is probably actionable by any party that feels that they have been treated unfairly. If XNXX is concerned about its exposure to being sued, they should consider the risk they are taking by exposing themselves to a discrimination claim. (Not from me, I’m not pissed off enough to seek legal relief.)

Meanwhile, I’m still waiting for a reasonable explanation for their decision to single out my work for deletion. I welcome a discussion and opinions from my fellow XNXX members on this topic. With their intelligence, integrity and capacity to research and investigate until they find the facts, I’m sure the XNXX membership can get to the bottom of this.

God forbid that the "report" button is automatic! Hopefully, if someone reports something, since they ask for specific passages that are offensive, the one receiving the report actually skims the story to see if the report is accurate.

Even if one story by a particular writer is "illegal," that shouldn't mean that everything he wrote should be thrown in the trash. I mean, my God, my latest story involves a mid-thirties man and a late-twenties MILF (all good and proper), but they meet through the woman's seven-year old boy. The boy is NOT a sex object in the story. I don't have my characters blowing the kid or butt-fucking him. He's just there as a sort of catalyst to the reaction of the adults. But, ***gasp*** there IS someone young in the story. Guess I should be banned and reported to Interpol.

I submitted the story to two other sites. It was accepted without question on one, (L*t*r*t*c*.c*m, where they have a strict eighteen-year old rule), but the other site (L*shst*r**s.c*m) rejected it for underage content, because the boy noticed his mother's breasts through her white t-shirt when it got wet! Seriously! What child who understands the concept of modesty wouldn't comment to his Mommy that he could see her boobies?

I re-wrote the thing, removing that content and changed the age of some street kids who talked about the attractiveness of the woman to sixteen, as requested (sixteen is the clearly-stated age limit on that site for "sexual awareness." They still rejected it. Reason? The male protagonist felt himself getting the beginnings of an erection from thinking about the mother when the young boy was present. He didn't pop a monster boner. He didn't whip it out and show it to anyone. The boy was completely clueless about the whole brief incident, but the site still rejected the story. I think it's ridiculous, but the site admins had their opinion. The thing is, they clearly stated their objections to me via pm and invited me to make the necessary changes so I could re-submit.

Is the whole thing bullshit? Of course, but at least it's clearly delineated bullshit. Even though I disagree with their judgment, at least I know what their issue is.

Come on, Lemark! Respond to ejls and to the site as a whole. Give us rules we can understand. They can be arbitrary and draconian -- you run the place, you make the rules. It's no different than requiring gentlemen to wear a tie in a restaurant. We can comply or we can leave.

But don't just do a knee-jerk response to the "report" button.

Also, Lemark, the gentlemanly thing to do would be to respond directly to Mr. Hardrive.
