    As She-Ra already pointed out her, view is of the Irish law, I'm sure there's countries out there where the law protects the man and others where it protects the woman.

    But in Ireland if a woman is drunk and consents it can still be classed as consensual sex. If the man is wreckless as to whether she has or hasn't consented then its rape. She doesn't even have to say no for it to be rape.

    I've served on a jury on such a case and I can tell you as a jury member it's all down to whether the prosecution can prove beyond a reasonable doubt.

    As for her past, if she has a long sexual history the jury will never be told.
    As it has absolutly no bearing on the case.

    Where you live, is the woman's past brought into the case that is before the jury or are you stating that it should be (but is not the actual case) where another motive such as fraud may be a possibility? It seems in europe that on occasion the woman may be asked if she has other motives for bringing the case but that is as far as it can be taken. And rarely at that. The difference may be that here, the accused must take to the stand and be questioned. This may be the reason that a womans past is not permitted to be questioned as the man accused would face the exact same questions. I believe in the USA that the accused does not have to take the stand. Our courts will only take into account the accusations before it for the sake of the jury's decision.

    While no means no, for sure, a general rule is that anything other than yes is no. If they're passed out, that's a no. If they don't say anything, that's a no. If they're not sure, that's a no.

    In the states an accused does not necessarily have to take the stand if his lawyers feel his testimony may damage his case (I don't agree with this) In a case where all the practical evidence points to a woman possibly motivated by something other than the "rape" at hand her past may be investigated but, most lawyers are governed to walk a thin line when accusing the accused? I'm an advocate for woman's rights have a daughter, worked with rape victims teaching them self defense and with Women Organized Against Rape (W.O.A.R.) So in my opinion a women (just like men) should take the responsibility for their actions to know the a difference between rape and regret when putting themselves in a position that opens them up to either? If you plan on partying go with friends that can keep and eye on you, always keep your drink with you, drink responsibly and (personally) don't put yourself in a position if your judgment is obscured when sex can always be postponed till your sober! There's a line that men use that I have never experienced because I drink responsibly,"I've never gone to bed with an ugly woman but, I've woken up to a few!"     I really hope I am misinterpreting you, but what I have read from this seems to be that you think just because a woman is dressed attractively means she is asking to have sex. This is entirely wrong. Your comparison to the animal world? We do not have the same rules as animals do, we also have incredible amounts of reasoning power compared to an animal. Just because a woman wants to look or feel attractive does not mean she is "asking for it." Even if a woman is naked does not mean she is "asking for it." No one has the right to have sex with anyone else without their consent. I sincerely hope this is not what you meant.

    But when a female dog raises her tail to a male suitor, it means she's given him permission to sniff her and potentially mate with her.     That's an interesting point of view, but my point still stands that we are different from animals. We have higher reasoning potential and we also have different mating practices. We don't have a tail to raise to say "I'm ready to mate." The closest thing we have to that is clothing, and that is not a precise signal in the least. Just because someone is scantily clad does not mean they want to have sex/mate. Is a gymnast trying to attract someone while wearing those skintight outfits?

    Human beings are animals and our mating practices are often similar to attract a mate. We can us verbal communication especially when saying 'No' or physical commuication.

    Females will often wear make up and clothes that show off their figure to get the attention they're seeking.

    Males will also go to some lengths to look a certain way such as wearing tight shirts so their muscles are more clear and define, clean shaven.

    Although we don't have a tail, we do have postures that mean 'not interested' such as giving the cold shoulder, turning the back, throwing up the hand. If a gesture, or appearance or other is misunderstood then we verbally communicate so as to make sure the message is clear which is no different than a female dog snapping the neck of the male.

    Non human animals do the same thing.

    Men like all males are programmed to reproduce, the need to mate constantly and are easily stimulated as a result. Unlike in the animal kingdom where the females are visual and often watch intently the physical appearance of a potential suitor, human males are the visual ones.

    Females/males need to be aware that what they wear may attract unwanted attention, also that what they wear may also send out the wrong messages because clothing is what we use to express ourselves. Females/males need to be aware and educated that when under the influence extorts our mind set.

    But we're educated about that from middle school and up yet some people just don't seem to understand or get it. =/

    I didn't brand every man a rapist; I honestly don't even know how you got to that conclusion. Please point out in my post where I state 'every man is a rapist'. Rape is about power, control, dominance. I personally don't believe an actual rape took place in this situation. I personally believe it was a misunderstanding, misscommunication which often happens when one/two isn't wise enough to know their limits when in regards to alcohol.

    Every man who doesn't have a dysfunctional sex organ will get aroused when seeing something that is the slightest bit sexual. Biology programmed them that way.

    The comment in regards to Islam and the burqua. That statement of a women's modesty and men's perversion is justified in the bible, the torah, and quran which are pretty much the same thing. However Christians and Jews have become more reform over the years, but there are Jewish women who still wear wigs and Catholic women as well like my mom. The Islamic religion is also reforming, it's just taking them more time, but it's happening.
