    So the guy walks off his post in a war zone. Gets caught by the bad guys. Costs the US a lot of money and some lives to get him back. AND he expects all of the benefits from the GI bill?

    I don't think that he has yet received all that he has coming to him.

      If it's a dishonorable discharge, he has no claim to it. If his lawyer pushes it his sentence could be changed. The military UCMJ has no rules regarding double jeprady and can retry him at anytime.

    Given what has been released in the public domain, he should be in jail.

    That said, a dishonorable discharge is equivalent to a felony conviction in many cases. It will show up on background checks. Obviously it's not the same but it is an indictment on his character. That will stick with him forever. It will make his life difficult.

    But he should be in jail.

    Military judges are very liberal in such cases. Carter pardoned the deserters. Ford pardoned Nixon. Sometimes it is better to end this soap opera with time served. He is a young man. He can out wait those now in power. Thousands of Vietnam bad paper discharges are still in litigation. He better stay home with mommy and daddy cause someone will off him if he ventures into the world.
