Notorious birther Jerome Corsi expects to be indicted by Robert Mueller: report

Obama “birther” activist Jerome Corsi may have been caught up in a “perjury trap” by special counsel Robert Mueller — and expects to be indicted.

NBC’s Ken Dilanian tweeted Monday evening that Corsi had spoken with Mueller’s investigators a week prior and that they told him he will be indicted for perjury.

Mueller investigating claim Trump associate Roger Stone tried to intimidate a grand jury witness

Special counsel Robert Mueller is reportedly probing whether Trump confidante Roger Stone intimidated a witness who contradicted his story on his contact with WikiLeaks.

The Wall Street Journal reported the turn in the investigation based on sources in contact with Mueller’s team.

The probe reportedly revolves around Stone’s relationship with New York radio host Randy Credico, the man Stone claims was his “backchannel” to WikiLeaks. Credico denied Stone’s claim.

Filmmaker David Lugo, an acquaintance to both men, told the Wall Street Journal that he testified before the special counsel’s grand jury about a “harshly critical” blog post Stone helped him write about Credico.

Progressive activist and businessman Bill Samuels, a friend of Credico’s, told the newspaper that Mueller’s team questioned him about the radio host’s “reaction to allegedly threatening messages” sent by Stone.

Another person familiar with Mueller’s investigation said his team is looking into messages between the two men about Credico invoking the Fifth Amendment before Congress.

Did Robert Mueller Just Hint that the Russia Investigation Will Drag on into 2019?

It’s time to check in on former Paul Manafort associate Rick Gates.

Gates, who played a starring role in the real-life legal drama that ended with Manafort’s conviction on bank and tax fraud charges in the Eastern District of Virginia, faded into the background for a while. Manafort would go on to reach a plea deal with Special Counsel Robert Mueller to avoid a second high-profile trial. That deal included Manafort’s cooperation.

On Wednesday, however, Mueller’s office and Gates’ attorney filed a joint status report to say that, even though not much has changed, Gates is still quite relevant.

The previous status report was filed on Aug. 10, 2018, and the parties were supposed to respond no later than Nov. 10. Well, here we are on Nov. 14 and here the joint status report is.

It is worth noting that although the “status of this matter has not changed substantially” since the last update, Rick Gates is still cooperating “with respect to several ongoing investigations” and sentencing isn’t going to happen just yet, the report says. In fact, the next status report date has been set for no later than Jan. 15, 2019.

Why does this matter? For one, Gates is reportedly useful when it comes to “several” active investigations. Secondly, the Mueller probe is thought to be in the latter stages of the game — and yet, the next status report could come down in the new year.

Manafort and Gates worked for the Trump campaign. Manafort was formerly campaign chairman and Gates was deputy chairman.

All of this brings to mind additional reporting on Gates going back to August 2018: that his continued relevance for Mueller is related to Trump campaign investigations and always has been.

It’s still not clear which “several” investigations Gates is particularly useful for, but if it was true months ago that Mueller “didn’t need [Gates’] cooperation against Manafort … and instead wanted to hear what he knew about contact between the Trump campaign and Russians” then that remains true now.

In closing, we can consider a few facts: Gates was close with Manafort; Manafort was present for the 2016 Trump Tower meeting for “dirt” on Hillary Clinton; this meeting and statements made about it are apparently on Mueller’s radar; the president’s son, Donald Trump Jr., is reportedly worried he may be indicted for making false statements about said meeting; Gates reportedly continued visiting the White House until June 2017 working for Trump advisor Tom Barrack.

As a fact-check, Mueller was approved for his FBI position by the full Senate by a 98 to 0 vote. After that, he was appointed by Rod Rosenstein as the special counsel and Rosenstein was appointed by Trump and approved by the Republican Senate as well.

“The only ‘Collusion’ is that of the Democrats with Russia and many others. Why didn’t the FBI take the Server from the DNC? They still don’t have it. Check out how biased Facebook, Google and Twitter are in favor of the Democrats. That’s the real Collusion!” he continued.

The president reportedly spent 10-15 hours with his lawyers Wednesday with more expected Thursday. He was told by them not to tweet about the Mueller investigation and has followed the instruction somewhat. Thursday that flew out the window.

House Intel Dem wants ‘Donald Trump Jr. — and his phone records’ when Dems take control of Congress

When Democrats take control of the House of Representatives in January, the House Intelligence Committee will seek to obtain the cell phone records of Donald Trump, Jr. that outgoing chairman Devin Nunes (R-CA) refused to subpoena.

Rep. Eric Swalwell (D-CA), a former prosecutor and member of the House Permanent Select Committee on Intelligence, explained the dynamic while appearing on MSNBC’s “Deadline: White House” with Nicolle Wallace on Wednesday.

“Robert Mueller now has an open track, meaning that as he sprints to the finish line now — if he can finish this investigation — there are no more hurdles in the way,” Swalwell noted. “He can be assured that in a Democratic majority, he’s not going to see those types of stunts that would undermine his work.”

“What we’re going to do, and I’m on the Judiciary and Intelligence committees, we’re going to fill in the gaps where they exist right now with what the Republicans didn’t allow us to do,” Swalwell explained. “Whether it was on money laundering that may have gone through the Trump Organization, understanding the full extent of that Trump Tower meeting, understanding Michael Cohen’s relationship with Russian-Americans who were trying to connect Donald Trump and Putin during the primary.”

“And then on the Judiciary Committee, we’re going to seek to immediately protect Bob Mueller, so that no person who comes in like Matt Whitaker or anyone else can shut down the investigation,” he added.

“Can you tell us who you’d like to see back in front of your committee?” Wallace asked.

“Donald Trump Jr. certainly — and his phone records,” Swalwell replied.

“That June 9th meeting almost tells us everything about the intent of the Trump team during the campaign,” he continued. “Within days, they set up that meeting — they moved heaven and earth to make it happen — that showed how willing and eager they were to receive the information.”

“But there is a call after Donald Trump Jr. talks to someone in Moscow — and in between another call with someone in Moscow — he talks to a blocked number,” Swalwell explained. “That’s how it shows up on the Verizon call receipt we have.”

“We’re seeking to unseal that call — to subpoena Verizon — to see if that goes to his father, because we have other evidence from other witnesses that Donald Trump, the candidate, that his phone number was often blocked,” he continued.

“And that would go to Donald Trump’s knowledge,” Swalwell added.

Julian Assange ‘Has Been Charged,’ According to Justice Department Filing
A paperwork slip-up reveals that the U.S. is hiding a federal criminal complaint against the WikiLeaks founder for fear of jeopardizing his extradition.

An obscure sex-crime case may have just revealed a groundbreaking moment for the intersecting worlds of press freedom, espionage, and the Trump-Russia case: sealed federal criminal charges against WikiLeaks’ Julian Assange.

An August filing by the Justice Department in a case involving a Washington, D.C.-area man, Seitu Sulayman Kokayi, accidentally names the founder of the anti-secrecy group in two paragraphs, reporting that a federal criminal complaint has been lodged against him in secrecy—a development long feared by Assange and his allies.

The Justice Department conceded to The Daily Beast and other outlets that Assange’s name was in the document as a result of an error but answered no further questions about the apparent charges against Assange.

The slip-up was first spotted by Seamus Hughes, a terrorism analyst at George Washington University who was closely following the case and flagged the passage on Twitter:

On Aug. 22, Assistant U.S. Attorney Kellen S. Dwyer filed a motion to temporarily seal Kokayi’s charges pending his arrest, which occurred the next day, Aug. 23.

At first, Dwyer’s filing understandably argues that disclosure would jeopardize Kokayi’s arrest. It proceeds to argue that redacting parts of the document would be insufficient to mitigate the potential harm. But then the attorney makes an accidental declaration.

“Another procedure short of sealing will not adequately protect the needs of law enforcement at this time because, due to the sophistication of the defendant and the publicity surrounding the case, no other procedure is likely to keep confidential the fact that Assange has been charged,” Dwyer wrote.

Kokayi is not elsewhere described as a particularly sophisticated defendant, and his case received no publicity. But the description fits Assange’s circumstances perfectly.

A second reference to Assange includes even more details that apply to the fugitive leak master, and not to Kokayi. “The complaint, supporting affidavit, and arrest warrant, as well as this motion and the proposed order, would need to remain sealed until Assange is arrested in connection with the charges in the criminal complaint and can therefore no longer evade or avoid arrest and extradition in this matter.”

Kokayi was arrested in Virginia and did not need be extradited. Assange, in contrast, would have to be extradited from the U.K. to face U.S. charges.

“It seems possible or even likely that someone cut and pasted from a prior motion to seal involving a defendant named Assange,” said Barbara McQuade, the former U.S. Attorney for the Eastern District of Michigan. “I know of only one Assange facing potential charges.”

“It could be a [prosecutor] or support staff member who prepared the document, since a sealing order is sort of a boilerplate filing,” said McQuade.

Dwyer works out of the U.S. Attorney’s Office in Alexandria, Virginia, and is not part of special counsel Robert Mueller’s team.

A Justice Department spokesperson, Joshua Stueve, told The Daily Beast, “The court filing was made in error. That was not the intended name for this filing.” Asked repeatedly if Assange had been indicted and if the slip-up had jeopardized any prosecution of a man who has lived for years in Ecuador’s London embassy, Stueve said he had no further comment.

The Washington Post, citing anonymous sources, reported late Thursday that “what Dwyer was disclosing was true, but unintentional.”

Barry Pollack, an attorney for Assange, told the Post he did not know if his client had been charged. “The only thing more irresponsible than charging a person for publishing truthful information would be to put in a public filing information that clearly was not intended for the public and without any notice to Mr. Assange,” he said.

“The notion that the federal criminal charges could be brought based on the publication of truthful information is an incredibly dangerous precedent to set.”

A spokesman for Mueller declined to comment.

The Wall Street Journal first reported Thursday that the Justice Department was preparing to indict Assange.

In an interview with the Journal, John Demers, who runs the Justice Department’s national-security division, said about possibly prosecuting Assange: “On that, I’ll just say, ‘We’ll see.’”

An indictment of Assange, whom Mueller has portrayed in his own indictments as a cat’s paw of Russian intelligence, would immediately draw worldwide attention.

Since Assange disclosed hundreds of thousands of tactical military reports from Iraq and Afghanistan and cables from U.S. diplomats worldwide in 2010, press-freedom advocates have warned that a U.S. government move against him for fundamentally journalistic activity—publishing documents in the public interest—would be illegitimate and set a fearsome precedent.

Yet Assange’s irascible personal behavior and accusations of sexual assault by two women in Sweden wore away his store of goodwill from many advocates‚ even before WikiLeaks published embarrassing information from leading Democrats purloined by Russian intelligence and surreptitiously cultivated ties to the Trump campaign that had nothing to do with its ostensible anti-secrecy mandate.

Still, for eight years, no government effort at investigating Assange has yielded any charges. Numerous reports over the years have claimed that Justice Department attorneys have found no evidence or legal theory sufficient to indict WikiLeaks but narrow enough to avoid the specter of criminalizing legitimate journalism or other First Amendment-protected activity.

Should that have recently changed and Assange been indicted, Dwyer’s ominous reference gave no indication as to the pivotal question of what Assange is accused of doing. No one at the Justice Department or FBI responded to The Daily Beast’s repeated inquiries on the subject.

“Any prosecution of Mr. Assange for WikiLeaks’ publishing operations would be unprecedented and unconstitutional, and would open the door to criminal investigations of other news organizations,” said Ben Wizner, a senior attorney with the ACLU, who also represents the National Security Agency whistleblower Edward Snowden.

“Moreover, prosecuting a foreign publisher for violating U.S. secrecy laws would set an especially dangerous precedent for U.S. journalists, who routinely violate foreign secrecy laws to deliver information vital to the public’s interest.”

They have had the questions for nearly a year and they amount to a take home open book test. So it should be easy for them but even though they said they were going to submit them earlier this week they still haven't done it. So what's the problem?

And most reporters and legal experts I am seeing are saying the most logical reason is Trump's legal team doesn't really know what Mueller already has from other witnesses and evidence and they are fearful Trump is lying to them which would amount to written perjury.

‘Secret litigation’ rocketing through courts could mean Mueller has already subpoenaed Trump: Legal expert

Special counsel Robert Mueller may have already subpoenaed President Donald Trump to compel testimony about collusion with Russia and obstruction of justice, a top legal expert explained on MSNBC on Saturday.

Nelson Cunningham served as general counsel of the Senate Judiciary Committee and as a federal prosecutor in the Southern District of New York.

“There is some sealed litigation in the D.C. courts, that’s bounced back from the district court to the court of appeals, back to district court, back to the court of appeals — in rapid-fire fashion,” Cunningham explained.

“The action was filed on Aug. 16,” he noted. “If you’ll remember, Rudy Giuliani said on Aug. 15 ‘We’re almost done with our opposition to a subpoena motion.’ The very next day, this mystery litigation began.”

“Only one judge has recused himself — from what we can tell from the public records — from consideration of the case, and that’s the one judge that Donald Trump appointed to this court,” he continued.

“You put the pieces together and it could well be the president, who is litigating with Robert Mueller, over a piece of secret litigation, perhaps a subpoena that Mueller has given to Trump and which is lawyers are fighting,” he concluded.

“It certainty would be a good way for him to use the period the before the midterms to make significant progress on the case,” he added.

Special counsel Robert Mueller just filed a new 3,000-word sealed motion in secret subpoena case

Special counsel Robert Mueller just filed a new and extensive motion that is being kept under seal for the grand jury, according to Politico reporter Darren Samuelsohn.

The reporter posted a screen capture from the update showing Mueller made the November update as part of “Case Name: In re: Grand Jury Subpoena.” It explained, “The following transaction was entered on 11/20/2018 3:49:22 PM EST and filed on 11/20/2018.”

Politico has been following the secret subpoena as Mueller was locked in some kind of dispute with a witness, who is refusing to give up information requested by the investigators.

The information is all under seal, so it makes it difficult for the public to track any specific information other than, the filings and procedures entered into the public record. Because the witness is refusing to cooperate, a process of elimination can likely gather who the witness is not, but that still leaves a number of possibilities.

“This can get a step or two weirder than it already is,” said one attorney working for a senior staffer of President Donald Trump for the Russia inquiry. The lawyer recalled a case from a previous investigation where he couldn’t even get to see a judge’s opinion because it was under seal.

“It could be anyone who’s been subpoenaed by the special counsel for anything,” he added.

‘Birther King’ Jerome Corsi is now trying to hammer out a plea deal with Mueller: report

Right conspiracy theorist Jerome Corsi, who for years was notorious for spreading false information about former President Barack Obama’s birth certificate, is now reportedly trying to hammer out a plea deal with special counsel Robert Mueller.

The Washington Post reports that Corsi and his legal team are back in negotiations with Mueller just one week after talks between the parties broke down completely — and Corsi said publicly that he expected to be indicted within a matter of days.

The Post cautions, however, that “the deal is not yet complete and could still be derailed” by assorted hangups. According to the paper’s sources, a plea deal with Mueller could involve Corsi admitting to committing a crime in exchange for leniency in his sentencing.

However, the fact that Mueller seems receptive to cutting a plea deal with Corsi indicates that he has some piece of information that could be useful to the investigation.

With all these new revelations coming in just the past short couple of weeks.

One would think an impeachment hearing and a prison bed was in the horizon for the POTUS.

But, I suspect the more rational minds might think differently.

A new court ruling is set to destroy the main Republican talking point about Russian ‘collusion’

One of the most common defenses of President Donald Trump and his associates as Special Counsel Robert Mueller’s investigation has heated up is that “collusion” is not a crime, even if Mueller can prove that it took place. It’s a favorite claim of Trump and Rudy Giuliani.

To some degree, this is just wordplay. There is no federal statute that explicitly defines “collusion” or makes it a crime, so of course that would not be literally spelled out on any of the Mueller team’s dozens of indictments, convictions, and plea agreements with U.S. and Russian suspects.

But insofar as “collusion” — if that is taken to mean Russian actors working together to break U.S. laws — is in fact a crime, Mueller is absolutely hot on its trail. And a federal court decision last week reveals just how close the investigation is to actually proving such a thing took place.

In the decision, D.C. District Judge Dabney Friedrich, a Trump appointee, ruled Mueller can proceed with indictments against Concord Management and Consulting, a Russian company accused of helping manage a “troll farm” that used social media to broadcast election propaganda to the United States.

Specifically, Mueller sought to charge Concord, and several other Russian individuals, with 18 U.S.C. § 371, or conspiracy to defraud the United States. Prosecutors say that by secretly funding and promoting targeted messages to influence the election outside of any proper channel, the defendants conspired to stop the Federal Election Commission from enforcing campaign finance law, the Justice Department from registering them as foreign agents, and the State Department because they lied on visa applications to travel to the United States.

At issue in this ruling was whether Mueller could bring these charges alone, since the indictment did not charge any of the Russian companies or individuals with the underlying violations of the laws they allegedly conspired to defeat (failure to register as a foreign agent, for example, or failure to report campaign activity to the FEC). Concord argued to Friedrich that the conspiracy charge could not stand on its own, because “there is no such crime as interfering with an election.”

Friedrich did not agree. She denied Concord’s request to dismiss the charges, noting that established law does not require prosecutors to prove any underlying crime to bring a charge of conspiracy. In other words, she held that a conspiracy to interfere with U.S. elections can itself be a crime — and effectively laid out a way for Mueller to prosecute Russian actors over “collusion.”

Between this ruling and the fact that there are clear lines of evidence of involvement between Russia and the Trump campaign, it is getting untenable to claim that collusion isn’t a crime — or that the effort to uncover it will not take members of Trump’s inner circle down with it.
