    Time Magazine Calls Michael Avenatti a racist



    Attorney Michael Avenatti argued this week that the Democratic Party's next presidential nominee "better be a white male" -- at least according to Time Magazine, which says it's standing by its reporting as Avenatti calls the publication's claim "complete bulls---" and insists his remarks were taken out of context.



    The dramatic episode comes as Senate Judiciary Committee Chairman Chuck Grassley said he has referred Avenatti and client Julie Swetnick -- who accused Supreme Court Justice Brett Kavanaugh of sexual misconduct -- for criminal investigation regarding a potential “conspiracy” to provide false statements to Congress and obstruct its investigation.


    Avenatti, himself a potential 2020 contender for the White House who has teased an upcoming run against President Trump, was apparently making a broader point about racial injustice and bigotry in his interview with Time.

    The magazine's profile of Avenatti reads: "But when it comes to the party’s presidential nominee in 2020, Avenatti thinks in different terms. 'I think it better be a white male,' he says. He hastens to add that he wishes it weren’t so, but it’s undeniable that people listen to white men more than they do others; it’s why he’s been successful representing Daniels and immigrant mothers, he says."

    The article, written by Molly Ball and Alana Abramson, then purports to provide a direct quote from Avenatti explaining his position: “When you have a white male making the arguments, they carry more weight. .... Should they carry more weight? Absolutely not. But do they? Yes.”

    But in an email to Fox News, Avenatti shot back: "I was misquoted and it is out of context. See my many speeches on the subject." (Avenatti has criticized what he calls racial injustice in the past.)

    In a phone interview with The Daily Caller, Avenatti was more colorful, telling a reporter, "I never said that, that’s complete bulls---. That’s my comment, complete bulls---. ... No, that’s not what I said."

    He also made similar denials to other media organizations, including CNN, in what appeared to be an all-out response to a brewing social media backlash against his remarks. In a Twitter post late Thursday morning, Avenatti reiterated that "sexism and bigotry" are problems that "white males" have a responsibility to address.

    "Let me be clear: I have consistently called on white males like me to step, take responsibility, and be a part of stoping the sexism and bigotry that other white males engage in," Avenatti wrote. "It is especially important for them to call out other white males. I make this pt in my speeches."

    The brouhaha is the latest apparent setback for the prominent California lawyer. Avenatti, who became famous representing porn star Stormy Daniels in her civil litgation against President Trump, was ordered to pay nearly $5 million to an attorney at his former firm, a California judge ruled Monday.

    The judge at the hearing in Los Angeles County Superior Court – which Avenatti did not attend -- said Avenatti must pay $4.85 million because he personally guaranteed a settlement with attorney Jason Frank in a lawsuit over back pay. Frank had alleged the firm misstated its profits and he was owed millions.

    Monday's decision also follows an earlier ruling from a U.S. bankruptcy court judge who ordered Avenatti's former firm to pay $10 million to Frank.


    Avenatti was criticized by Trump last week after a federal judge tossed out a defamation lawsuit brought by Avenatti, saying the president's statements were legally protected opinions that could not form the basis for a lawsuit.

    “I just beat him in a big case. … Beat him badly. In fact, he has to pay me legal fees,” Trump told Fox Business’ Trish Regan. “I don’t think he has any money, but he and [Stormy Daniels] have to pay me a lot of legal fees.”

    A California court orders the eviction of Michael Avenatti's law firm from its offices for skipping four months of rent.

    Michael Avenatti, a presumptive 2020 presidential candidate, is in hot water after being hit an avalanche of legal, political, financial, and personal troubles, raising questions whether this is the beginning of the end for the firebrand lawyer who gained celebrity status thanks to his opposition to President Trump.



    Senate Judiciary Committee Chairman Chuck Grassley announced on Thursday that Avenatti and his client Julie Swetnick, who claimed Supreme Court Justice Brett Kavanaugh engaged in sexual misconduct, were referred for criminal investigation for an alleged “conspiracy” to provide false statements to Congress.


    The Republican lawmaker cited contradictory statements by both Avenatti and Swetnick in media interviews and pointed to an NBC interview on Oct. 1, where Swetnick backtracked on her central claim that she saw Kavanaugh spiking punch at high school parties in the 1980s.


    According to an NBC News report on Thursday, Avenatti’s second Kavanaugh accuser, whose sworn statement was provided to the Senate Judiciary Committee to boost Swetnick’s credibility, also walked back on the allegations even before the lawyer could post her statement on social media.


    While her statement claimed she saw Kavanaugh “spike” the punch at the parties, she said “I didn't ever think it was Brett” in a phone interview with the outlet set up by Avenatti. She also said “no” to a question if she ever witnessed Kavanaugh acting inappropriately towards women.

    Avanatti’s action’s during the Kavanagh confirmation process have damaged him in the eyes of many Democrats who perceived his tactics as counterproductive. The outlandish allegations of “gang” and “train” rapes at parties merely helped cloud the testimony of Christine Blasey Ford who first came forward with the accusations of sexual misconduct.

    Seemingly a permanent fixture on CNN or MSNBC earlier this year only for the appearances to have recently dried up, Avenatti was forced to call a press conference to address Grassley’s referral.

    “Senator Grassley just stepped in it, to be clear,” Avenatti told reporters as he denied the charges. “Thank you, Senator Grassley. It is Christmas in October... It is phenomenal. They want to make this an issue? I say, bring it.”



    But the referral is just one of the problems Avenatti is currently facing. The same day as Grassley’s announcement, Avenatti came under fire for suggesting the 2020 Democratic presidential nominee should “better be a white male.”

    “When you have a white male making the arguments, they carry more weight... Should they carry more weight? Absolutely not. But do they? Yes,” Avenatti said, according to a transcript provided by Time magazine.

    Supporters of Democrats condemned Avenatti’s comments – despite his insistence that the quote was made up – in a number of comments on social media.

    “Let me be unmistakably clear on something. F--- Michael Avenatti,” tweeted progressive activist Shaun King, who compared him to Bob Odenkirk's slimy lawyer in the TV show Breaking Bad. “This man is a clown. He’s Better Call Saul. And now we are learning he’s also a sexist bigot.”

    “Michael Avenatti is the personification of 'progressives' who still traffic in white supremacy and the patriarchy,” wrote Symone Sanders, former spokesperson for Bernie Sanders’ 2016 presidential campaign.

    On top of that, Avenatti was ordered on Monday to fork out nearly $5 million to an attorney at his former firm. In a separate trial the same day, his law firm was evicted from its offices in Orange County, California for unpaid rent.



    The rulings followed a revelation that the lawyer, who boasts of winning over $1 billion in legal cases for his clients, has allegedly been living a luxurious life while owing millions of dollars in unpaid taxes, the Daily Beast reported.

    Lisa Storie-Avenatti, his soon-to-be ex-wife, previously told Fox News that she needs “to be divorced and if [Avenatti] continues to paint the narrative, he can ignore our case!”

    She also asked to read their divorce court records and said: “Tell me where our money and his time has been spent.”

    The divorce records reviewed by Fox News show that Storie-Avenatti branded her husband “emotionally abusive” and “angry and vindictive” after he allegedly verbally ambushed and threatened her in the wake of their messy divorce.

    “[Avenatti] is hot tempered and used to having his way – when he doesn’t he gets extremely loud and verbally aggressive,” she said, according to court documents.

    Avenatti denied his wife’s allegations to Fox News in May. Storie-Avenatti later sent an email – shared with Avenatti – backtracking on her allegations that were made under oath.




    But even the issue that made Avenatti a household name is fizzling out after his legal challenge against Trump on behalf of Stormy Daniels was dismissed on free speech grounds earlier this month.

    Daniels sued the president for defamation in April over a tweet in which he denied her claims of being threatened by a man in a Las Vegas parking lot in 2011.

    Trump teased Avenatti after the case was dismissed and he became entitled to an award of his attorneys’ fees against Stormy Daniels.

    Senate Judiciary Committee Chairman Chuck Grassley on Friday referred lawyer Michael Avenatti to the Justice Department for a second criminal investigation amid reports his accuser recanted her allegations against Supreme Court Justice Brett Kavanaugh even before he submitted her sworn declaration.



    The referral follows the one issued Thursday -- alleging that Avenatti and client Julie Swetnick engaged in a “conspiracy” to provide false statements to Congress about Kavanaugh’s alleged sexual misconduct -- after the accuser backtracked on some allegations.

    The Friday referral concerns the second sworn declaration Avenatti submitted to the committee that supposedly backed up Swetnick’s allegations.


    Grassley cited an NBC News report revealing – nearly three weeks after Kavanaugh's confirmation – that a second, unidentified accuser walked back on her allegations even before the lawyer could post her statement on social media, saying the lawyer “twisted” her words.

    The woman, who remains unidentified, said in a sworn statement posted by Avenatti that she saw Kavanaugh “spike” the punch at the parties.

    But in an interview with NBC News on Sept. 30, prior the release of the statement, she said “I didn't ever think it was Brett” who spiked the drinks and denied ever seeing Kavanaugh acting inappropriately toward women.

    After reviewing her statement posted by Avenatti, she told the outlet that “It is incorrect that I saw Brett spike the punch. I didn't see anyone spike the punch. ... I was very clear with Michael Avenatti from day one.”

    She also said “I would not ever allow anyone to be abusive in my presence. Male or female,” adding that she did not “like that [Avenatti] twisted my words.”


    Grassley said in the letter to Attorney General Jeff Sessions and FBI Director Christopher Wray that the woman’s sworn testimony submitted to the committee Oct. 2 “appears to be an outright fraud.”

    “In light of this new information, I am now referring Mr. Avenatti for investigation of additional potential violations of those same laws, stemming from a second declaration he submitted to the Committee that also appears to contain materially false statements,” he added.

    In response to the referral, Avenatti lashed out on Twitter. “How ignorant is Grassley? He keeps publicly demanding an investigation knowing full well that it will likely never happen - it is all for show. And if it does, he has placed Kavanaugh at risk of being removed from the SCOTUS. This is what happens when you never attend law school,” he wrote in a tweet.

    There is more to it than just that. These leaks are just preludes of things to come. And no I don't think Trump's new AG is going to be able to protect him. There are already too many moves being made against him coming from all sides. Because his appointment is a violation of federal laws and the constitution. So he will be blocked.

    Perhaps a review of this issue is appropriate. First, a timeline;

    According to Daniels, in 2006 she had a brief liaison with Trump. This took place in Lake Tahoe at a celebrity golf tournament. An interesting fact is that this is also reportedly where Trump met playboy bunny Karen McDougal, who he also had a liaison with. At the time, Trump had just turned 60 and was again a father, with his wife Melania having just given birth to Baron Trump. It is curious however what Daniels and McDougal would have been doing at the golf tournament in the first place; at the time, Daniels was not considered a celebrity and neither of them plays golf.

    In any case, by 2009 both liaisons were over and done with, and until 2011, were a non issue. In 2011 the Trump affair with Daniels was revealed on a blog site and the weekly celebrity magazine Life & Style, where Daniels revealed that she had an affair with Trump. She had also been slated to have a story about the affair published in the gossip magazine In Touch Weekly, but in Touch did not publish the story after they were threatened with a law suit by Cohen, Trump's attorney.

    In 2015, after announcing his candidacy, Trump contacted (or was contacted by) David Pecker (now there's an unfortunate name) who is the chairman of America Media, publisher of the National Enquirer. Apparently Trump and Pecker arranged a "capture and kill" deal, whereby the National Enquirer would seek out potential scandal stories involving Trump, pay for exclusive rights to publish them, and then simply not run them. This, by the way, is a fairly common practice at the National Enquirer to assist celebrities David Pecker likes.

    In any case, American Media paid McDougal $150,000 for her story about Trump and then killed it. At about the same time (October, 2016) Stormy Daniels was paid $130,000 in return for a non disclosure agreement negotiated between Cohen, Trump's attorney, and Daniels.

    Now, a non disclosure agreement typically requires all parties to not only not disclose whatever the agreement covers, but to even deny knowledge of whatever the agreement covers. In other words, lying is not only allowed, it is required under some circumstances.

    So Trump wins the presidency, the despicables hyper ventilate, and in January 2018 the New York Times reported the affair between Trump and Daniels, and the payment of $130,000 to Daniels as hush money.

    Initially, all parties (Trump, Daniels and Cohen) denied the affair, but within the month, both Daniels and Cohen conceded that hush money had been paid. Cohen claimed it was all his idea, his money, and that the President was unaware of the issue.

    President Trump continued to deny the affair.

    Then, in March, 2018 Daniels sued Trump to invalidate the non disclosure agreement. Her attorney, Michael Avenatti, claimed that since Trump never signed the agreement, it was null and void.

    In April, the FBI raided Cohens office and home, and eventually, Cohen pleaded guilty to eight charges: five counts of tax evasion, one count of making false statements to a financial institution, one count of willfully causing an unlawful corporate contribution, and one count of making an excessive campaign contribution at the request of a candidate or campaign.[

    From January, 2018 until October, 2018 we've been treated to a front row seat in a sleazy public fist fight between Trump and Daniels, complete with "leaked" stories, public insults, revealing and very embarrassing details, and a lot of bluster.

    So, is this the issue that could bring down the Trump presidency?

    Probably not.

    First, the affair(s) took place long before Trump was even a candidate for president, so the "scandal" part isn't really an issue except for those who claim the high moral ground.
    Second, the fact that Trump denied the affair and the payment of the hush money until it was no loner deniable, isn't a legal issue; Trump has never testified under oath about it, never been questioned by the FBI or the Mueller people, and since he apparently has (had) a non disclosure agreement with Daniels, lying was not the issue. And according to despicables, Trump lies about everything, even when the truth would work better. Lying, even by a President, is not a crime unless one is under oath or talking to the FBI.

    In October, 2018 a Federal judge threw out Daniel's defamation law suit, and prior to that Trump had determined that he would not enforce the Non disclosure Agreement, probably because doing so would cause disclosure of all the sleazy details of their relationship and how the hush money was paid. It would also give Daniel's attorney, Avenatti, a national platform to preach from while doing nothing for Trump's reputation.

    So. The allegation is that the $130,000 came from campaign funds and was therefore a violation of campaign finance laws. A violation of how they were used, that they weren't reported, and that tax laws were violated in the process. Two of the 8 guilty pleas Cohen entered into dealt with the hush money paid to McDougal and Daniels.

    So, lets assume for the moment that it's true; the $130,000 came from campaign funds. How serious a violation of the law is this? Well, it's actually a fairly common occurrence; the Federal Election Commission investigates anywhere from 50 to 200 allegations a year, and imposes penalties from $500,000 to over $1 Million annually.

    Hillary Clinton and the DNC have or are facing FEC complaints, including that the DNC/Clinton failed to disclose that they paid for the Steele Dossier, and that the DNC illegally funneled $84 Million in contributions to the Clinton campaign in 2012 and 2016.

    And yes, President Obama's 2008 campaign ran afoul of the FEC, paying fines totaling $375,000 for violations of reporting requirements.

    So, in the world of politics, campaign finance law violations are not so onerous that a presidency could be toppled. More of a jay walking ticket in fact.
