Trump’s voter suppression chief defends use of private email server for government business

Less than a year after then-candidate Donald Trump called for Hillary Clinton to be imprisoned for using a private email server for Secretary of State business, the man leading the president’s “voter fraud” commission is defending his own private email use.

According to the Huffington Post, Kansas Secretary of State and Vice Chairman of Trump’s “election integrity” commission Kris Kobach said he used a private email server to conduct business for the voter fraud commission because he did so as a private citizen.

Last week, news broke that Kobach had been using a private email server to conduct business for the federally-created commission, and some argued him doing so could be a violation of the same laws Clinton was accused of breaking with her private server.

In a response (sent from his official Kansas Secretary of State email), Kobach told ProPublica last week that creating a government email for the commission he co-chairs in a “personal capacity” would be a “waste of state resources.”

Kobach has become infamous since taking the job on the Presidential Advisory Commission on Election Integrity, created in response to Trump’s debunked claims that there was significant voter fraud in the 2016 election. Many have accused him and the commission of enacting voter suppression disguised a way to curb “voter fraud,” a justification for many unconstitutional state voter ID laws.

Trump using campaign, RNC funds to pay legal bills from Russia probe: sources

NEW YORK (Reuters) - U.S. President Donald Trump is using money donated to his re-election campaign and the Republican National Committee to pay for his lawyers in the probe of alleged Russian interference in the U.S. election, two people familiar with the matter told Reuters.

Following Reuters exclusive report on Tuesday, CNN reported that the Republican National Committee paid in August more than $230,000 to cover some of Trump’s legal fees related to the probe.

RNC spokesperson Cassie Smedile confirmed to Reuters that Trump’s lead lawyer, John Dowd, received $100,000 from the RNC and that the RNC also paid $131,250 to the Constitutional Litigation and Advocacy Group, the law firm where Jay Sekulow, another of Trump’s lawyers, is a partner.

The RNC is scheduled to disclose its August spending on Wednesday. The Trump campaign is due for a disclosure on Oct. 15.

The U.S. Federal Election Commission allows the use of private campaign funds to pay legal bills arising from being a candidate or elected official.

While previous presidential campaigns have used these funds to pay for routine legal matters such as ballot access disputes and compliance requirements, Trump would be the first U.S. president in the modern campaign finance era to use such funds to cover the costs of responding to a criminal probe, said election law experts.

Smedile said the RNC payments to Trump’s lawyers were ”from a pre-existing legal proceedings account and do not reduce by a dime the resources we can put towards our political work.”

It was not clear how Trump’s legal costs related to the Russia probe would be allocated between the campaign and the RNC, one of the sources said.

Dowd declined to say how the president’s legal bills were being paid, adding: “That’s none of your business.”

Special counsel Robert Mueller is looking at possible collusion between the Trump campaign and Russia in last year’s election, and whether Trump may have obstructed justice by firing Federal Bureau of Investigation Director James Comey, among other actions.

Moscow has denied meddling in the U.S. election, and Trump has denied any collusion or obstruction.

Reuters could not determine how large a legal bill Trump has incurred to date from his lawyers on the Mueller investigation. Trump hired his longtime New York lawyer Marc Kasowitz to head his defense team in May, but Kasowitz stepped down in July, with Dowd taking over the lead role, according to people familiar with the situation.

Special White House counsel Ty Cobb, who is a salaried staff member, is also working on the matter.

The Trump campaign has paid law firm Jones Day almost $4 million, according to campaign filings, mostly for routine campaign legal expenses like ballot access disputes, vendor contracts, human resources and compliance with state and federal laws. It has also responded to Russia-related inquiries on behalf of the campaign by, for example, providing documents to Congress.

FOLLOWING OBAMA‘S LEAD

The reason Trump is able to tap into his campaign funds for legal expenses is because for the past decade, presidential candidates have abandoned public financing for their campaigns. Instead, they have built networks that collect millions of dollars from private donors, a move that comes with less restrictions on how the money is spent.

Barack Obama in 2008 was the first to eschew public financing for his campaign, and all the major-party candidates followed suit in 2012 and 2016, campaign filings show.

Trump also filed for reelection the day he took office in January, two years earlier than any previous president, ensuring a fund of millions in campaign cash would remain at his disposal.

According to its most recent filing to the Federal Election Commission, Donald J. Trump for President Inc had almost $12 million on hand by the end of June, an increase of over $4 million since January.

Adav Noti, a senior director at the Campaign Legal Center, a watchdog group that describes itself as nonpartisan, said public campaign funds - as opposed to the private funds Trump has raised - cannot generally be used for expenses arising from criminal investigations, or for any expenses that arise after the campaign is over.

President Bill Clinton, who ran two publicly funded campaigns, had supporters start legal defense funds and used his own insurance to help pay legal bills during the Whitewater investigation. He still wound up with millions of dollars in personal debt which he paid off through speaking fees he earned once he left office.

Hillary Clinton, who ran a privately funded campaign, paid millions to campaign lawyers at Perkins Coie to handle routine legal matters, according to campaign filings. Her campaign made no payments to the Washington law firm Williams & Connolly, which represented her in the probes of her use of a private email server when she was U.S. Secretary of State.

Her lawyer, David Kendall of Williams & Connolly, declined to comment on how he was paid.

Campaigns also have discretion to pay legal fees for others besides the president.

According to a July filing, the Trump campaign paid $50,000 to the law firm of Alan Futerfas, who is representing Donald Trump Jr. Futerfas did not respond for requests for comment.

A number of other current and former Trump staffers have also recently hired lawyers.

Trump’s costs to taxpayers continue to mount

As the country’s first CEO president, Donald Trump entered the White House on the back of a pledge to save taxpayers millions of dollars by eliminating whatever he deemed government “waste.” Yet, from regular trips to his golf clubs, Secret Service protection for his family and his administration’s lavish travel budget, the expenses covered by America’s taxpayers are already racking up.

To that bill, an extra sum of almost half a million dollars can now be added: That’s how much it cost taxpayers in Phoenix when Trump held a campaign rally in the Arizona city last month, according to a report Tuesday from The Arizona Republic.

While Trump’s campaign paid for the use of the Phoenix Convention Center and the indoor security, the remainder of the costs were left to the city to cover. By far the largest of those was the $336,887 it reportedly cost the Phoenix Police Department in employee overtime expenses. Trump’s appearance in the city drew the largest police response for any political event in several years, and saw hundreds of officers on duty in the downtown area to control both attendees and protesters.

“We do what it takes to protect the president of the United States when he visits Phoenix,” Mayor Greg Stanton told The Arizona Republic.

It is standard procedure for the city to foot the bill for all costs surrounding such an event, and a spokeswoman for the city confirmed that there had neither been a request for reimbursement nor an offer to do so from the Trump campaign.

Not everyone is happy with this expense to taxpayers.

“It's 2017. He just won in 2016. This shouldn't be something that the city of Phoenix should pay for,” Enrique Gutierrez, spokesman for the Arizona Democratic Party, said.

Despite being less than a year into his presidency, Trump has already been hot on the campaign trail for re-election in 2020. The event in Phoenix was his eighth since entering the White House in January. In addition to the rallies, he has been airing campaign ads and raising funds for his re-election bid.

Those funds are needed for more than just his campaign: Money donated to his campaign and the Republican National Committee will be used by Trump to pay the hefty legal bills incurred as a result of the multiple investigations into his 2016 campaign’s alleged links with Russia, Bloomberg reported Tuesday.

Trump caught giving plum government jobs to unqualified campaign cronies

President Donald Trump has been handing out plum jobs at the United States Department of Agriculture to former campaign workers who have little or no experience in farming.

Politico has done a thorough review of resumes of people hired to work at Trump’s USDA has found that the agency “has been stocked with Trump campaign staff and volunteers who in many cases demonstrated little to no experience with federal policy, let alone deep roots in agriculture.” Among others hired by the agency under Trump are “a long-haul truck driver, a country club cabana attendant and the owner of a scented-candle company,” Politico finds.

The long-haul truck driver, for instance, is making $80,000 a year working at the USDA’s Foreign Agricultural Service despite having no relevant experience in the field. A man who was appointed to work at the Agricultural Marketing Service, meanwhile, had only two jobs prior to being hired by Trump: An attendant at a country club and a Trump campaign worker.

In total, Politico reviewed 42 resumes of Trump USDA political appointees and found that just over half of them cited their experience working on Trump’s 2016 presidential campaign.

A former USDA official said it was “pretty unusual” for an administration to reward campaign cronies with these kinds of high-paying positions that exert significant influence over policy decisions.

“By the time these people are serving in confidential assistant roles, they are sitting on a very thin layer in government bureaucracy,” the official explained.

Jared Kushner used private email account to conduct White House business: report

President Donald Trump’s son-in-law and senior White House aide Jared Kushner has used a private email account that he set up after the 2016 election to conduct official White House business and to communicate with other staffers, said Politico on Sunday.

“Kushner uses his private account alongside his official White House email account, sometimes trading emails with senior White House officials, outside advisers and others about media coverage, event planning and other subjects, according to four people familiar with the correspondence,” Politico reported, adding that reporters have seen and verified about two dozen emails.

This comes after Trump campaigned heavily on “Crooked Hillary” Clinton’s use of a private email server during her time as Secretary of State.

Ivanka Trump conducted government business using personal email account: report

Ivanka Trump, the first daughter and adviser to the president, used a personal email address to communicate with a government official after her father took office, according to documents that the nonprofit American Oversight obtained through the Freedom of Information Act (FOIA) and shared exclusively with Newsweek.

The documents show that on February 28, Trump—identifying herself as Ivanka Kushner—emailed Linda McMahon, the administrator of the United States Small Business Administration, from a personal domain. At the time, Trump was operating inside the White House in a nonofficial capacity. She wrote that she wanted McMahon’s agency and her staff to “explore opportunities to collaborate” on issues related to “women’s entrepreneurship.” She copied on the correspondence the government email addresses of two other federal employees, Dina Powell and Julie Radford.

Trump became an unpaid federal employee in March. But multiple government ethics experts say she likely could have had access to a White House email account in February, given that she is first daughter. Radford, her chief of staff, had a White House email address at the time.

Ivanka Trump was sitting in on White House meetings around the time she sent the email, including one between her father and Canadian Prime Minister Justin Trudeau and a gathering of the business advisory council.

The news that Trump used a personal email address for government work follows the disclosure on Sunday that Jared Kushner—Trump’s husband and a senior adviser to President Donald Trump—also used a personal email address for official work. That disclosure was made by Abbe Lowell, a lawyer for Kushner.

“Yet again we see that there’s one rule for the Trump family and another for everyone else,” Austin Evers, the executive director of American Oversight and a former senior counsel at the Department of State, said in a statement to Newsweek. “It’s simply breathtaking that both Ivanka and Jared Kushner would conduct government [work] on a personal email account after running a campaign centered on that very issue. The fact that they would brazenly ignore rules governing email use raises even more questions about their judgement and fitness to hold positions in the White House.”

Now that Trump is an official employee at the White House, her communications are not subject to FOIA requests—although they are subject to a law that requires them to be preserved.

In a statement to Newsweek, a White House spokesperson pointed out that Trump was not a federal employee at the time she sent the February 28 email. When she became a federal employee in March, “she made clear that one of her reasons for doing so was to ensure that she would have access to government-issued communications devices and receive an official email account to protect government records,” the spokesperson said. The spokesperson added that prior to her obtaining an official account, Trump’s emailing other official accounts “ensured the records were preserved and available under the Federal Records Act.” Trump did not have an official email account as a first daughter at the time, according to the spokesperson.

Politico first reported on Sunday that Kushner had communicated with administration officials via an email address set up during the presidential transition period. He exchanged at least two dozen or so emails that way, according to the outlet. As the report said, there is no evidence that the emails contained classified or sensitive information.

“Mr. Kushner uses his White House email address to conduct White House business,” Lowell, the lawyer, said in a statement on Sunday to several news outlets. “Fewer than 100 emails from January through August were either sent to or returned by Mr. Kushner to colleagues in the White House from his personal email account. These [were] usually forwarded news articles or political commentary, and most often occurred when someone initiated an exchange by sending an email to his personal rather than his White House address.”

During the 2016 presidential election, President Trump and other Republicans made Hillary Clinton’s use of a personal email system while secretary of state a central issue. (That case involved a far greater number of emails and also private servers, not just email addresses.) The FBI investigated her using that system, and Clinton has partly blamed a disclosure that former FBI Director James Comey made about the case 11 days before the election for her loss. Trump supporters would chant “lock her up,” referring to Clinton, and did so as recently as last Friday, at a rally in Alabama for Senator Luther Strange that Trump attended. Trump replied to the chanting, referring to the attorney general: “You’ve got to speak to Jeff Sessions about that.”

Republicans besides Ivanka Trump and Kushner have used personal email accounts while in the White House, too. In January, Newsweek learned that people who were then senior officials, including Kushner, Kellyanne Conway, Sean Spicer and Steve Bannon, had active accounts on a Republican National Committee (RNC) email system. The committee deleted the accounts after Newsweek published an article about them. “There is nothing wrong with having an RNC account if it is not used for any official government business,” RNC spokesman Ryan Mahoney told Newsweek at the time. “In this case, the officials previously employed by the Trump campaign never had functional email accounts with the RNC. The RNC has various distribution lists to communicate with state parties or campaigns, and as a byproduct these contact groups are assigned RNCHQ.org addresses that only forward to external accounts at their respective organizations.”

As Newsweek previously reported, the George W. Bush administration “lost” 22 million emails between 2003 and 2009. The emails at the time were stored on a private email server owned by the RNC.

The Presidential Records Act requires the preservation of certain correspondence by people including the president’s immediate staff and advisers. Federal employees are also required to maintain records under the Federal Records Act.

“Incidental use of a personal email is not that big a deal,” says Andy Wright, an associate professor at Savannah Law School who served as associate counsel to former President Barack Obama and is a founding editor of the online forum Just Security. “But if you’re using it as a separate infrastructure to try and avoid scrutiny, that becomes obviously a lot more problematic. I think we’re still waiting to see how much this was relied on as an alternate means of communication to avoid the system, versus incidental use.” (Newsweek has published articles by Wright.)

HHS Tom Price chartered government-funded jets to places he owns property: report

Donald Trump’s Health and Human Services Secretary Tom Price used a jet paid for by the U.S. government to visit locations where he owns properties, Politico reports.

Price, who once railed against Democrats in Congress using private planes paid for with government funds, took a trip in August to the St. Simons Island resort in Georgia, where he and his wife Betty own land. As Politico notes, his flight landed more than a day before he was scheduled to speak at the Medical Association of Georgia retreat.

That trip followed a June flight to Nashville, TN, where Trump spoke at the Healthy Tennessee Summit, then had lunch with his son.

Both trips were funded by the HHS, which Price advocated to cut $12 billion from earlier this year.

Health Secretary Tom Price and isn’t the only member of the Trump administration in hot water for chartering private jets on the taxpayer’s dime.

According to CBS News, Environmental Protection Agency head Scott Pruitt also chartered a private jet in July.

“Pruitt flew within his home state of Oklahoma on a private plane in July,” the report reads. “That trip cost taxpayers more than $14,000.”

The news came just a day after the New York Times revealed that the EPA paid $25,000 for a soundproof booth for Pruitt’s office. Earlier this year, Pruitt also came under fire for his expensive 18-person security detail, which he said he needed for protection from “the left.”

Scott Pruitt, administrator of the Environmental Protection Agency, has taken at least four military and noncommercial flights since mid-February, at a cost of $58,000 to taxpayers, according to a Washington Post report. The most expensive trip cost $36,068.50, when the administrator took a trip in early June from Andrews Air Force Base to Cincinnati, where President Trump was pitching a plan to revamp U.S. infrastructure. Pruitt and several of his staff members then traveled to Italy to attend an international meeting of environmental ministers. The White House had approved the trip. “When the administrator travels, he takes commercial flights,” agency spokeswoman Liz Bowman told the Post on Wednesday, noting that the four exceptions were due to specific circumstances.

President Donald Trump will kowtow to New York's elites at a private dinner Tuesday, with donors willing to shell out up to $250,000 for an opportunity to sit next to the commander in chief. Some of the most prominent names in finance and real estate are set to attend the event at Manhattan's Le Cirque restaurant to raise money for the Republican National Committee — also known as the president's legal defense fund.

Donors will have the chance to fork up the big bucks for a "private roundtable" with the president, while others could pay $100,000 for "VIP access," Bloomberg reported. The minimum donation was $35,000, with roughly 150 people planning on gathering for the event.

The president was aggressively critical of any indication of pay-to-play politics from his campaign opponents, specifically Democrat Hillary Clinton. Despite his promises to drain the swamp in Washington, Trump seems to have taken pay-to-play politics to a whole new level. For example, many members of the Trump administration, up to 100, according to a USA Today estimate, were ex lobbyists.

Now the president seems eager to accept the money of coastal elites, even though he has masqueraded as a populist looking out for the common man. The Washington Post reported that donors expect to air their grievances with Trump about his stalled agenda on taxes and health care.

A report last week revealed that Trump used donations from both the Republican National Committee and his 2020 reelection campaign to cover the legal costs related to the probe into the Russia scandal. The Republican National Committee paid $131,250 to the law firm employing Jay Sekulow and $100,000 to the law firm employing John Down, according to CNN.

Trump will likely bring up his feud with the NFL, as he did at a private dinner at the White House on Monday, according to CNN.

BUSTED: Interior Sec. Ryan Zinke used taxpayer money to rent private jets to fly to the Caribbean

Interior Secretary Ryan Zinke has been using taxpayer money to fund his own private jets and use of military plans to fly to his home in Whitefish, Montana as well as two two Caribbean islands.

A report from Politico revealed Zinke spent $12,375 on one trip to Whitefish from Las Vegas using a Beechcraft King Air 200.

During that trip to Las Vegas, Zinke spoke at an event for the city’s new professional hockey team. Earlier in the day he flew to Pahrump, Nevada for an announcement about public lands.

He’s now the fourth senior official in President Donald Trump’s cabinet who has been caught using private jets instead of commercial travel for government trips. Others include EPA Administrator Scott Pruitt, who has taken multiple trips back to Oklahoma, where some say he might run for Governor in 2018. Most notably, however, is Secretary of Health and Human Services Secretary Tom Price, who was caught spending $1 million so far on private jets and the use of military planes.

Interior Department spokeswoman Heather Swift explained that the planes were used only when staff was unable to find a commercial flight that would work with the secretary’s schedule. However, Las Vegas is “one of the main connecting airports for commercial flights to Glacier International,” Politico reported.

The trip to Montana was to speak before the Western Governors’ Association’s meeting. He spoke to the governors for 20 minutes and refused to take questions. He then did a photoshoot with GQ Magazine. He also went fishing at Lake McDonald while also doing an interview with Outside Magazine records show. The following day, Zinke and his staff flew back to Washington, D.C. on commercial flights.

The two flights to the Caribbean were to attend the centennial of the Danish government. He flew from St. Croix to St. Thomas in the U.S. Virgin Islands on March 31. There were then two flights chartered returning to St. Croix that night. Commercial flights between the islands generally cost only a few hundred dollars.

Zinke and his wife also used military flights to Norway and from there to Alaska. He also used a military helicopter to fly from Fort Bliss to see the Organ Mountains monument in New Mexico in June. He then used a Bureau of Land Management helicopter to survey the Basin and Range National Monument at the end of July.

Taxpayers spent over $300,000 protecting President Donald Trump’s family for a week-long ski getaway at Aspen in March.

“Records obtained by CBS News through a Freedom of Information Act request show that the Department of Homeland Security (DHS) spent $329,561 for the week-long vacation,” CBS News reported Friday. “Equipment costs were close to $22,000 — to accompany the family on the slopes, the Secret Service had to buy lift tickets and rent skis and boots.”

DHS also shopped at outdoor equipment store REI.

“Pictures posted on Instagram show Ivanka Trump and her husband, Jared Kushner – both senior advisers to the president — along with Eric and Lara Trump atop Aspen Mountain,” CBS News explained. “Eric Trump and his wife also brought along their two dogs.”

As winter is coming, it is important to note this wasn’t the only ski trip by Ivanka and Jared during President Trump’s short time in office.

“When Ivanka Trump and Kushner took their family to a ski resort in Whistler, Canada during Passover in April, U.S. Secret Service went, too, and the cost of their portion of the trip was over $65,000,” CBS News noted.

Tom Price resigned as Secretary of the Department of Homeland Security on Friday after chartering private jets. Three other Trump cabinet secretaries — Treasury Secretary Steven Mnuchin, Interior Secretary Ryan Zinke and EPA Administrator Scott Pruitt — have also been caught up in the private jet scandal.

“I have a great cabinet,” President Trump claimed Friday. “We’ve saving tremendous amounts of money no matter where we go.”
