Probe of FEMA chief referred to prosecutors: source

A federal probe into whether the head of the Federal Emergency Management Agency, Brock Long, improperly used his government car to commute from Washington to his home in North Carolina has been referred to prosecutors for possible criminal charges, according to a person familiar with the matter.

The person, who spoke anonymously because the investigation is not public, said Long never had authorization to use a government car to drive to his home in Hickory, North Carolina.

Since his home is more than 50 miles (80 km) away from his work station, he also would have needed to get additional permission before using the car on his commute, the person said on Monday. The number of people who generally receive waivers to drive more than 50 miles is very small.

The U.S. Attorney’s Office in the District of Columbia accepted the referral and the prosecutors in the Justice Department’s public integrity section are also involved, the person added. A full investigative report has yet to be completed.

The person said Long was also under investigation for improperly using motorcades during the drives to North Carolina and putting aides up in hotels.

A Justice Department spokeswoman declined to comment, saying the department could neither confirm nor deny the existence of an investigation.

Long, the latest Trump administration appointee to face scrutiny over his use of government resources, said in a statement on Monday: “I am not focused on this investigation. I am fully focused on those impacted by Hurricane Florence.”

He told reporters last week he would never intentionally break government rules, following a report that his use of official vehicles was under scrutiny.

“Doing something unethical is not in my DNA, it is not part of my track record,” he added.

Florence, which hit the North Carolina coast on Thursday, has killed 23 people and displaced thousands before turning into a slow-moving storm that threatens deeper flooding in the Carolinas.

Long said in the statement that he would meet with North Carolina Governor Roy Cooper on Tuesday to discuss how to help in the storm response and recovery.

The Wall Street Journal, which earlier reported about the referral to prosecutors, said Long and two other federal employees may have broken as many as six laws.

With the aftermath of Hurricane Florence causing chaos, it’s already been a difficult week for the Federal Emergency Management Agency—but it could have been much worse. FEMA Chief Brock Long was reportedly brought to the verge of quitting his post over his bitter feud with Homeland Security Secretary Kirstjen Nielsen. Long is the subject of an internal investigation into his use of government vehicles to travel between Washington, D.C. and his home in North Carolina. He was reportedly assured nothing would happen while he coordinated the response to Florence, but is said to have felt betrayed when he learned the DHS Office of Inspector General had referred his case to federal prosecutors for a possible criminal investigation on Monday. “It was FEMA personnel who convinced him not to quit,” one congressional aide briefed on the matter told The Washington Post. At least 37 people are dead from Florence and its record flooding.

Former Trump aide Jason Miller allegedly gave pregnant woman abortion pills without her knowledge: report

According to a court filing, President Donald Trump’s former aide Jason Miller allegedly gave a pregnant stripper an abortion pill without her knowledge.

The court document obtained by Splinter News was filed in Miami-Dade Circuit Court. The stripper’s name was not identified and the report referred to her as Jane Doe.

After engaging in a sexual relationship with Jane Doe, Miller discovered she was pregnant. He then “Unbeknownst to Jane Doe, [gave her a] smoothie [that] contained an abortion pill.”

The pill had traumatic effects on Jane Doe. “The pill-induced an abortion and Jane Doe wound up in a hospital emergency room, bleeding heavily and nearly went into a coma. The unborn child died,” the report stated.

A.J. Delgado, who Miller has a child with is seeking that the courts have Miller “undergo a psychological evaluation” because she “fears” for her child.

Miller also faced allegations of stalking an ex, which he denied.

Bad news for Trump: An emoluments clause lawsuit against him just had a major win

On Friday evening, just as he was dealing with a setback to his Supreme Court nomination, President Donald Trump got a fresh piece of unwelcome news.

According to a report in the Washington Post, federal district court judge Emmet G. Sullivan ruled that a lawsuit filed against the president by 200 congressional Democrats, alleging he is in violation of the Emoluments Clause of the constitution, can proceed:

The lawsuit is based on the Constitution’s emoluments clause, which bars presidents from taking payments from foreign states. Trump’s business, which he still owns, has hosted foreign embassy events and visiting foreign officials at its downtown D.C. hotel.

The decision opens up yet another legal front for the president, who is now facing an array of inquiries into his business, his campaign and his charity.

Trump is already facing a separate emoluments suit filed by the attorneys general of Washington, D.C. and Maryland that is moving forward. In addition, he is contending with the ongoing special counsel investigation into Russian interference, a lawsuit from the New York Attorney General that alleged “persistently illegal conduct” at his charitable foundation and a defamation lawsuit brought by former “Apprentice” contestant Summer Zervos.

In his opinion, Sullivan, an appointee of President Bill Clinton, held that the lawsuit was valid because there was no way for the members of Congress who are party to it to address the dispute through other means, such as legislation.

Trump previously said he would divest from all of his businesses if elected president, a promise he went back on even before he was sworn in. Since then, Trump and members of his inner circle have shown no qualms about using the presidency for the profit of Trump businesses and properties, from touting his country club on the State Department website to charging the Secret Service to rent his golf carts.

But a violation of the Emoluments Clause, a prohibition set forth by the Constitution, could potentially be a bigger deal. Indeed, Congressional Republicans have privately listed Emoluments Clause violations among the things they fear Democrats will investigate if they manage to win back the House of Representatives this year.

The New York Times released a bombshell report on Tuesday based on reviewing hundreds of tax returns from Trump family businesses and trusts.

The paper found that the Trumps had engaged in “dubious tax schemes during the 1990s, including instances of outright fraud.”

Many of the allegations revolve around President Donald Trump’s father, Fred, but also include involvement by his family, including Donald.

The New York Times reviewed 100,000 pages of documents related to Fred Trump’s business empire. “Most notably, the documents include more than 200 tax returns from Fred Trump, his companies and various Trump partnerships and trusts,” the newspaper said.

New York AG raises the stakes in lawsuit over Trump family’s charity scam

President Donald Trump faces a new round of possible tax trouble after the New York Times bombshell report that documented decades worth of shady dealings and fraud by the Trump family, including the president.

But Trump and his children, including Donald Jr. and Ivanka, are also facing a lawsuit over their family foundation. And, on Thursday, the New York Attorney General’s office filed new documents that allege “willful and intentional conduct” that violated the law, including by using the Foundation for his political campaign.

“For more than a decade, the Foundation operated in persistent violation of state and federal law governing charities,” the filings say. “The Board abdicated its fiduciary duties entirely, leaving the Foundation to operate without any oversight, and permitted Mr. Trump to use the Foundation’s assets to satisfy his and his for-profit companies’ legal obligations, to promote Trump hotels, to purchase personal items, and, in 2016 – at the direction of Mr. Trump and his presidential campaign- to promote Mr. Trump’s candidacy for political office.”

The New York attorney general says that the Trumps knew what they were doing was illegal, and did it anyway.

“Mr. Trump was aware of the limitations on political activity by not-for-profits: he signed documents under the penalty of perjury attesting that Foundation assets would not be used for the benefit of any Foundation officer or director or for political purposes, and he even campaigned for the repeal of one prohibition on using charitable assets to intervene in a political campaign,” the document says.

The state of New York is seeking to dissolve the foundation because it “carried on, conducted or transacted its business in a persistently fraudulent or illegal manner, or by the abuse of its powers contrary to public policy of the state has become liable to be dissolved.”

Another interesting aspect is the fact that Trump and his lawyers have sought to claim that he can’t be pursued by a state attorney general because of the Supremacy Clause of the U.S. Constitution. The New York AG is pushing back hard against that, pointing out that there is no precedent for such a claim.

Trump was “unable to cite a single case in which a court has dismissed a civil suit against a sitting U.S. president for unofficial acts on the ground that the court’s jurisdiction would be unconstitutional.”

If the Trump team ends up losing that claim and appealing it, the the subject of whether Trump can be brought into a trial while in office will be settled sooner rather than later.

Majority Leader Kevin McCarthy’s brother-in-law scored millions from government contract based on false claim of Native American ancestry

The Washington swamp may claim another Republican in leadership. A Los Angeles Times report revealed House Republican Majority Leader Kevin McCarthy’s brother-in-law scored a $7 million no-bid contract based on his Native American ancestry. There’s just one problem: he’s not Native.

The investigation by the paper showed prime contracts were awarded through federal programs designed to help disadvantaged minorities. Vortex Construction’s principal owner is William Wages, McCarthy’s wife’s brother. He scored $7.6 million in prime federal contracts since 2000, The Times concluded. While it’s currently owned by Wages, McCarthy’s mother-in-law, father-in-law and sister-in-law are all employed. His wife hasn’t been an executive in the Bakersfield company since the 1990s.

A no-bid contract means there was no competition for other companies that might offer more cost-effective contracts that could have saved American tax dollars.

Wages says he is one-eighth Cherokee, but tribal records call the claim into question. He’s a member of a group called the Northern Cherokee Nation, but it has no legitimate recognition as a tribe and tribal leaders say that it’s considered a fraudulent group.

More than $4 million in minority financing was set aside for projects at China Lake, in McCarthy’s district. The Congressman has also been an advocate for increasing funding for China Lake and expanding the area for the military base there.

It’s prompting questions about whether Wages benefited from McCarthy’s powerful position in Congress or if the claims constitute fraud.

Jared Kushner 'likely' paid little or no income taxes for years: NYTimes

WASHINGTON (Reuters) - Jared Kushner, President Donald Trump’s son-in-law and a senior White House adviser, likely paid little or no federal income taxes between 2009 and 2016, the New York Times reported on Saturday, citing confidential financial documents.

The documents were created with Kushner’s cooperation as part of a review of his finances by an institution that was considering lending him money, the Times reported. The Times said that Kushner’s tax bills reflected the use of a tax benefit known as depreciation that lets real estate investors deduct part of the cost of their properties from their taxable income.

The Times report said that nothing in the documents reviewed “suggests Mr. Kushner or his company broke the law.”

Peter Mirijanian, a spokesman for Kushner’s lawyer Abbe Lowell, told Reuters on Saturday that he would not respond to the newspaper’s assumptions, which he said were “taken from incomplete documents obtained in violation of the law and standard business confidentiality agreements.”

He added, “Always following the advice of numerous attorneys and accountants, Mr. Kushner properly filed and paid all taxes due under the law and regulations.”

The records reviewed by The New York Times did not expressly state how much Kushner paid in taxes, but included estimates for how much he owed called “income taxes payable” — and how much Kushner paid in expectation of forecasted taxes known as “prepaid taxes.” The paper said that for most of the years covered, both were listed as zero, but in 2013 Kushner reported income taxes payable of $1.1 million.

Kushner Cos, the family company for which Kushner previously served as chief executive, has been profitable in recent years, the Times said, citing the analysis. Kushner sold his interests in the company to a family trust last year.

The White House and Kushner Cos did not immediately comment Saturday.

The newspaper noted that the 2017 tax rewrite signed by Trump includes provisions that benefit real estate investors.

Mirijanian said that on tax reform efforts, Kushner “followed his approved ethics agreement and has avoided work that would pose any conflict of interest.”

In December, a group of Democratic lawmakers wrote to Kushner, asking whether in his talks with foreign officials he had ever discussed financing for a deeply indebted property in midtown Manhattan, citing concern he was using his position for financial gain.

Kushner Cos said previously it had more than $2.5 billion in transactions 2017 and has 12 million square feet under development in New York and New Jersey.

Documents released by the White House in June showed Kushner held assets worth at least $181 million, the Associated Press reported. The disclosures also show that Kushner and his wife, Ivanka Trump, received at least $82 million in outside income in 2017.

Damning report shows how the Trump family lies to investors — and then walks away with fistfuls of cash

A massive new investigation by Pro Publica reveals President Donald Trump and his children engage in systematic deceit to lure investors to its building projects — and then still walk away with fistfuls of cash even when the projects collapse.

*(One particularly illustrative example of the Trump family’s business practices is the Trump Ocean Club Panama, which formally evicted the Trump Organization earlier this year and ripped Trump’s name off its sign.

For starters, Pro Publica notes, Ivanka Trump pitched investors on the project by blatantly lying about the number of units that had already been sold. In fact, Ivanka even claimed to have personally sold 40 units herself, although it was unlikely that she had even sold one.

She also told a journalist at one point that 90 percent of the units in the building had already been sold — even though this wasn’t even close to being true.

“Not only were the Panama sales figures inflated, but many ‘purchases’ turned out to be an illusion,” Pro Publica write. “Given that the ‘buyers’ were often shadowy shell companies or other paper entities, it was nearly impossible to discern who the actual purchasers were, let alone why they backed out.”

Even more damning is the way that the family managed to make millions on the Panama project even after it failed. According to Pro Publica, the Trumps often claim to not be deeply involved in many deals such as the Panama hotel, as they claim that they only engage in licensing agreements in which they have little control over how their projects are carried out.

It turns out, however, that the Trump family has deep involvement in these kinds of projects, which is how they manage to make money off them even when they go belly up.

“Trump licensed his name for an initial fee of $1 million… but that was just the beginning of the revenue streams, a lengthy and varied assortment that granted him a piece of everything from sales of apartment units to a cut of minibar sales, and was notable for the myriad ways in which both success and failure triggered payments to him,” the publication writes. “Consider the final accounting: In the wake of the project’s bankruptcy, a 50 percent default rate and his company’s expulsion from managing the hotel, Donald Trump walked away with between $30 million and $55 million.”

One Event at Trump’s D.C. Hotel Includes a $10,000-Per-Person Photo With the President Opportunity
In the old days, if a politician wanted an endorsement from, say, the President of the United States, they would find a way to ask for it. Maybe a phone call, maybe a word with high-level officials in the lawmaker’s party – which the President heads.

In the Trump era, politicians wanting an endorsement from the President apparently have a new way to get it: book an event at the Trump International Hotel in Washington, D.C. That’s sure to get the President’s attention.

“Trump endorsements follow in the wake of candidates spending money at his properties,” a report from Fast Company, shows eight GOP politicians or PACs associated with them have held events or spent money at Trump properties, usually his D.C. hotel – which were followed with endorsements from President Trump.

A PAC run by Vice President Mike Pence and GOP Rep. Kevin McCarthy, who is running to become the next Speaker of the House, has spent over $225,000 at the Trump International Hotel in Washington, D.C., including $7500 at Trump’s Bedminster golf course, which goes to the D.C. hotel.

Trump “signaled his support for Rep. Kevin McCarthy’s (R-Calif.) candidacy for Speaker of the House” at one of the events last month at Trump’s D.C. hotel.

“It raises the specter that the president is essentially enriching himself by virtue of his position,” Noah Bookbinder, the executive director of Citizens for Responsibility and Ethics (CREW) told Fast Company.

“Because if you have other politicians who think they’re more likely to get the president’s support if they spend money at his hotels or his golf courses or his other businesses, they’re more likely to do that and the president makes more money.”

Fast Company notes that Rep. McCarthy’s main competition for Speaker of the House comes from Rep. Jim Jordan. Congressman Jordan is a big Trump supporter – but not financially. Jordan’s campaign has spent just $3000 at a Trump property.

Making it seem all the more possible that Trump properties are in effect acting as money-laundering agents in a pay-for-endorsements scheme, a White House deputy press secretary, the Trump Organization, and the Trump International Hotel Washington, D.C., “did not reply when asked if any employees ever told a campaign that patronizing a Trump business could put the candidate in President Trump’s good graces.”

It would seem like a question about the President’s ethics would garner some sort of response, certainly a denial. But reportedly, nothing.

Fast Company names these politicians: Gov. Scott Walker (R-Wisc.); Reps. Tom Reed (R–NY), Ted Yoho (R-Fla.), Kevin Yoder (R-Kan.), Lee Zeldin (R-NY), and Republican John James, a candidate for U.S. Senate in Michigan, as having received endorsements after spending money at a Trump property.

On Monday, James was forced to apologize after a Nazi swastika was found in footage of his campaign ad. He claims it was a mistake. Some Democratic strategists say that’s impossible. On Tuesday, Trump tweeted out an endorsement for James.

Also on the list is Rep. Andy Barr (R-KY), whose PAC spent a mere $292 at Trump’s D.C. hotel.

But wait, there’s more.

Next week President Trump will headline a fundraiser at the Trump International Hotel in D.C. for New Jersey Republican assemblyman Jay Webber, who is running for Congress. “The October 25 event seeking hard money contributions, includes a $20,000-per-person roundtable with Trump and a photo with the president for $10,000-per-person,” the New Jersey Globe reports today.

MSNBC’s Rachel Maddow explains how a ‘coincidence’ destroyed the Trump admin’s attempt to kill Zinke investigations

MSNBC’s Rachel Maddow on Thursday revealed a previously-overlooked “coincidence” about the Housing and Urban Development employee who the Trump administration tried — and failed to — install as the inspector general at the Interior Department.

Earlier in the week, Interior Department Acting Inspector General Mary Kendall learned via an email that Suzanne Israel Tufts, the Trump-appointed assistant director of HUD, was to replace her. Kendall did not receive the email sent from HUD Secretary Ben Carson herself, but rather learned of its existence from a colleague.

As Maddow pointed out, Tufts — a Queens, New York native with “no relevant experience whatsoever” who worked on the Trump campaign — signed off on Carson’s questionable decision to spend $31,000 in government funds on a dining set for his office.

The host also pointed out that the same woman who found such expenditures acceptable would also have led the four investigations into whether Interior Secretary Ryan Zinke committed ethics violations — including investigations about his use of taxpayer funds.

Democrats on the committee that oversees the Interior Department also noticed Tufts’ startling track record on alleged ethics violations — and as the host noted, they flagged that issue to an association for inspectors general with their concerns.

In this case, Maddow said, “shame made an appearance” Thursday when the Interior Department released a statement saying Carson’s assertion that the IG was being replaced was “false information.”
