‘Rigged Justice’: Scathing new report details rampant ‘free-for-all’ corporate crimes under Trump administration

The Trump administration is letting corporate crime run rampant.

“This country’s government is rigged in favor of the rich and powerful, and the Trump administration has turned this power gap into a chasm.”

That’s the message delivered by a new report (pdf) out Tuesday from Sen. Elizabeth Warren (D-Mass.) and Rep. Pramila Jayapal (D-Wash.).

The report, “Rigged Justice 2.0,” explains how President Donald Trump’s government is allowing corporations to do whatever they want.

“Our justice system’s soft touch with huge corporations and billionaires is not a new phenomenon,” reads the report. “But under President Trump, it is far worse than it has ever been.”

The report is the second in a series. The first edition, “Rigged Justice,” was released by Warren, a Democratic presidential candidate, in January 2016. The report detailed the weakness of the Obama administration on corporate crime—but, as Warren’s office pointed out in a statement announcing “Rigged Justice 2.0,” those were the good old days.

“This new analysis reveals a catastrophic decline in corporate accountability under President Trump,” said Warren’s office, “illustrating the impact of corporate malfeasance on the American public through a dozen case studies in which the government failed to hold companies and white collar criminals accountable for ripping off the American people, hurting workers, or damaging the environment.”

Among the highlights of the new report are a 20-year low in corporate crime enforcement and an abdication of governmental responsibility for workers, consumers, and the environment. The lack of action to hold corporations accountable, the report argues, is because of an unprecedented takeover of the federal government by corporations.

Among the key findings:

A rapid decline in the number of white collar crime enforcement actions pursued by the federal government, bringing enforcement activity to a 20-year low — down 33.5 percent from 2013, and down 41 percent from 1998;

A decline in monetary penalties and enforcement actions across nearly every federal government agency, including drops in penalty amounts of more than 80% during the administration’s first 20 months at the Department of Justice (DOJ), the Environmental Protection Agency, and the Federal Communications Commission;

A failure to punish banks and financial firms that break the law, including a more than 50% decline in the number of cases brought by the Consumer Financial Protection Bureau, Securities and Exchange Commission, and DOJ; and

Massive declines in the number of federal government employees responsible for enforcing federal laws that protect the security of our financial markets, the safety of our workplaces, and the quality of our air and water.

“The Trump administration has treated their billionaire buddies and corporate campaign contributors like the old friends they are,” reads the report, “handing them the keys to government regulatory decisions, and neutering the federal government’s enforcement tools to address and prevent corporate crime.”

In its 16 pages, the new report exhaustively details a litany of corporate crimes across all sectors and notes the Trump administration’s inaction on nearly every issue, including a defunding and defanging of the regulatory state apparatuses put in place to protect the American people.

Trump Made at Least $479 Million Last Year

President Trump made at least $479 million last year, according to his annual financial disclosure report released Thursday. CNN reports that his income includes $40.8 million from his Trump International Hotel in Washington, D.C., and $22.7 million from his Mar-a-Lago resort in Florida. Overall, the president’s income appears to have risen from the year prior—when he reported a total income of at least $450 million. Since taking office, Trump has maintained his interest in his namesake company, the Trump Organization, but passed along its day-to-day management to his two sons.

EPA Watchdog to Scott Pruitt: You Owe Us $124,000

*The Environmental Protection Agency’s top watchdog is recommending the agency try to regain nearly $124,000 spent by former chief Scott Pruitt on “excessive” and improper travel expenses.

The findings were released Tuesday by the EPA’s inspector general. The report comes nearly a year after Pruitt resigned amid controversy over his spending, travel and ties to lobbyists.

Investigators concluded that 40 trips Pruitt either took or scheduled during a 10-month period – between March 1 and Dec. 31, 2017 – cost taxpayers $985,037.

The inspector general’s office identifies a sum of $123,941 for possible recovery. The sum is what taxpayers spent on flying both Pruitt and a security agent in first-class or business class, instead of coach.

Of the more absurd scandals to roil the office included reports that Pruitt made junior staffers pay for his hotels, and then refused to pay them back and even dispatched staffers to fetch his preferred lotion from the Ritz-Carlton hotel.

The new findings effectively end the agency watchdog’s probe into Pruitt, who now works as a consultant to coal companies. The Washington Post reported Pruitt could not be reached for comment.

In November, the inspector general closed two inquiries into his conduct without reaching a conclusion due to Pruitt’s resignation before he could be interviewed.

Deutsche Bank Ignored Potential Illicit Activity in Trump, Kushner Accounts: Report

A former anti-fraud specialist dealing with money laundering for Deutsche Bank told the New York Times that alarm bells went off over certain transactions in accounts under the control of both Donald Trump and his son-in-law Jared Kushner. The former employee Tammy McFadden and five others told the Times that the transactions set off alerts in a computer system designed to spot illegal activity. Staff members then prepared reports that were intended for the Treasury Department arm that polices financial crimes, but executives at the bank rejected the advice and the reports were never filed, according to five employees interviewed by the paper. “You present them with everything, and you give them a recommendation, and nothing happens,” McFadden, who was terminated for questioning the bank’s practices. “It’s the D.B. way. They are prone to discounting everything.” In April, the Trump Organization sued Deutsche Bank and others to prevent them from answering congressional subpoenas.

Secretary of Education Betsy DeVos used four personal email addresses for work-related business and violated government regulations regarding preservation of those documents. DeVos’ spokesperson then blasted the media for reporting the news, as The Hill reports.

“We found a limited number (less than 100) sent or received between January 20, 2017, and April 10, 2018,” the Education Dept.’s Inspector General charges. “Most messages occurred during the first 6 months of 2017 and were from a single writer who was offering advice on potential candidates for Department positions.

The emails “were not always being properly preserved,” to OIG reported. “We did not identify any instances where the secretary forwarded emails from her personal accounts to her department email accounts,” as she should have.

Meanwhile, Education Dept. spokesperson Liz Hill said, “I understand that ‘DeVos + Personal Email’ gets clicks, and attacked “media coverage of the IG report on personal email is the definition of click bait,” which is false.

Trump’s ever-rising golf tab is three times the cost of special counsel Robert Mueller’s Russia investigation — so far

A new report reveals that President Donald Trump has stuck American taxpayers with a $102 million tab as he tees off on his various golf courses.

Since taking office, Trump has forced taxpayers to spend $81 million on his trips to his Mar-a-Lago resort in Florida, according to HuffPost. The revelation about Trump’s expensive golfing habits are noteworthy, given how the current commander-in-chief frequently lambasted his predecessor, former President Barack Obama, over his own golfing hobby.

Trump has also stuck taxpayers with a $17 million tab for his trips to the Trump National Golf Club in Bedminster, New Jersey; at least $3 million for his two days in Scotland last summer, $1.3 million of which was for rental cars for his entourage; and $1 million so he could visit his Trump club in Los Angeles.

Thus far, the amount of taxpayer money Trump has spent on his golf totals equals 255 times the presidential salary that he promised not to take, as well as three times the cost of special counsel Robert Mueller’s investigation. And the president has given no indication he intends to slow down.

This is not the first time Trump’s golf habit has been the source of controversy since the former business mogul assumed the presidency. In addition to draining taxpayer dollars, it also represents a potential conflict of interest as the president’s personal business empire gains at the taxpayer’s expense. The trips to his golf courses also are a source of free publicity for his businesses.

“His top priority with these trips is not the business of the American people — it’s the business of the Trump Organization,” Jordan Libowitz of the Citizens for Responsibility and Ethics in Washington told HuffPost. “The American presidency has become another tool to advertise his golf properties.”

At least one of Trump’s golf clubs also experienced a controversy involving the hiring of undocumented immigrants. Earlier this year, roughly a dozen employees were fired from Trump National Golf Club in Briarcliff Manor, New York, due to their immigration status. All of those employees were from Latin America, and their terminations roughly coincided with a story revealing that undocumented immigrants had been employed at Trump’s Bedminister golf club. As one housekeeping employee explained to the Washington Post, the club had either been extremely negligent in managing employees’ records — or had known about their immigration status and looked the other way until the issue surfaced in the media.

“They said absolutely nothing. They never said, ‘Your Social Security number is bad’ or ‘Something is wrong.’ Nothing. Nothing. Until right now,” the former employee told the Washington Post.

In spite of his frequent golf trips, Trump has not apologized for his comments about Obama’s golfing. These comments included saying in 2014 that “we pay for Obama’s travel, so he can fundraise millions so Democrats can run on lies. Then we pay for his golf.” Later that year, he also tweeted, “Obama has admitted that he spends his mornings watching ESPN. Then he plays golf, fundraises & grants amnesty to illegals.”

During the 2016 presidential election he tweeted, “While our wonderful president was out playing golf all day, the TSA is falling apart, just like our government! Airports a total disaster!” Later he also tweeted, “President Obama should have gone to Louisiana days ago, instead of golfing. Too little, too late!”

Manafort Lender Steve Calk Indicted For Loan Linked To Trump Cabinet Post Hopes

Bank CEO Stephen Calk has been charged with financial institution bribery for the $16 million in loans he extended former Trump campaign chairman Paul Manafort in late 2016 and early 2017, allegedly in the hope that Manafort would secure him a position in Trump’s cabinet.

The indictment, filed in the Southern District of New York and unsealed Thursday, accused Calk of misleading his bank’s primary regulator, including by claiming he never desired a position in the Trump administration.

Many of the details in Thursday’s indictment were made public in Manafort’s financial crimes trial in Virginia over the summer. However, the indictment revealed that — in addition to an email Manafort sent Trump’s son-in-law Jared Kushner flagging Calk’s resume — Manafort also reached out to another unidentified Trump transition figure seeking that Calk be interviewed for Army Secretary. Calk ultimately interviewed for the position of Army under secretary in early January at Trump Tower in Manhattan, according to the indictment, though he was never appointed to Trump’s cabinet.

Manafort first began pursuing the loan from Calk’s bank, Federal Savings Bank, in summer 2016. By August, Calk was named to a campaign economic advisory committee, “consistent” with Calk’s “request” to “participate in the Presidential campaign,” according to prosecutors.

In the months following, Calk assisted Manafort in structuring the loan, with Manafort at one point praising Calk’s “cleverness” and thank him for “fixing” his issue

At the time, Manafort was in severe financial straits, due to other loans he had a secured — some of them fraudulently — and his penchant for a extravagant lifestyle, even as his income from his Ukraine consulting work had dried up.

An initial loan package fell through in October, but in November, shortly after Trump’s election, Calk again began working on getting Manafort a $9.5 million loan, according to prosecutors.

The bank closed on the $9.5 million loan later that month, according to the indictment. Manafort then sought an additional $6.5 million loan. “Concerns about the Borrower’s ability to repay even the first $9.5 [million] loan had already been raised, as noted above, and CALK was further aware of [Manafort’s] dire circumstances at this time,” the indictment said, pointing to Calk’s alleged awareness that Manafort was trying to head of foreclosure proceedings on properties upon which he already had taken out other loans.

The indictment goes on to outline the scrambling internally in the bank as Manafort allegedly pressured Calk get the second loan deal done.

Calk was cc’d on a Manafort email to a bank loan officer, asking for an update on the schedule, that said “the clock is ticking and we are getting pressure on a number of fronts,” according to the indictment. That day, Manafort also emailed Kushner Calk’s resume, while noting Calk’s “preference” for the Army Secretary.

A few days later, Calk allegedly emailed Manafort seeking a meeting with then President-elect Trump.

When Manafort reached out to the second transition official seeking an interview for Calk, he was told that another candidate was already being considered for the Army Secretary position but that Calk could interview for the under secretary position, according to the indictment. That interview happened on January 10, 2017, and was with three transition officials, according to the indictment.

By then, Manafort had been approved for the additional $6.5 million loan, and the transfer of funds happened a week after Calk’s interview with the Trump transition team, according to the indictment.

Trump Wants to Give Border Wall Deal to Fox News Guest’s Firm

President Trump has been pushing for a border wall deal to be granted to the firm of a frequent Fox News guest and GOP donor, according to four administration officials speaking anonymously to The Washington Post. The president has reportedly brought up Fisher Industries, based in North Dakota, to Department of Homeland Security officials and the commanding general of the Army Corps in meetings about the border wall, most recently in the Oval Office on Thursday. Fisher Industries is run by CEO Tommy Fisher, a GOP donor who has been a frequent voice on conservative television and radio shows, where he claims he can build a border wall quickly and cheaply. (He has promised to erect more than 200 miles of barrier on the southern border in less than a year.)

But “the push for a specific company has alarmed military commanders and DHS officials,” the Post reports, noting that the president’s personal interest in the firm “risks the perception of improper influence on decades-old procurement rules that require government agencies to seek competitive bids, free of political interference.” Meanwhile, Fisher Industries is suing the U.S. government over the Army Corps’ previous rejection of its bid to install barriers along the border.

Republicans spend more than $4 million at Trump properties

Republican candidates and campaign committees have spent more than $4 million at hotel, golf and vineyard properties that bear President Trump’s name since he was inaugurated in 2017.

More than three dozen members of Congress have held fundraisers or spent the night at Trump properties, according to a review of filings made with the Federal Election Commission (FEC) over the last two years.

More than a quarter of the money spent has come from Trump’s own campaign, which has paid his businesses nearly $1.5 million over that span, both for rent and for fundraisers.

The Republican National Committee (RNC) has spent more than $1.1 million at Trump-branded properties in both Washington and Florida.

Watchdog groups have raised concerns over the propriety of Trump profiting off businesses as foreign governments and corporate interest groups currying favor in Washington book rooms at Trump hotels — including Trump’s hotel in Washington, D.C.

Attorneys general in Washington, D.C., and Maryland have sued the federal government, alleging the Trump International Hotel in Washington puts the president in violation of the Constitution’s Emoluments Clause.

There is nothing in the Constitution that bans a campaign from spending money at a company that benefits a candidate. But those good-government groups say the mixture of business and politics creates a combustible potion.

“The behavior itself is corrupting, and it’s creating corruption and the appearance of corruption,” said Meredith McGehee, the executive director of Issue One, a group that advocates for ethics in government.

The Trump campaign and the RNC said they did not see anything wrong with hosting events at Trump’s properties. Tim Murtaugh, a Trump campaign spokesman, said the campaign “pays market rates for venues and we report all expenditures as required by law to the FEC.”

RNC spokesman Michael Joyce said the party’s donors “enjoy visiting Trump properties, and have also pointed to the security, convenience, and price as factors” in the decision to hold formal RNC meetings at the hotels.

Republican spending at Trump-owned properties has ballooned since the president took office.

A review by Citizens for Responsibility and Ethics in Washington (CREW), a watchdog organization, found campaigns spent only $468,382 at Trump properties in the dozen years before he announced his run for president in 2015.

“This isn’t a continuation of a trend. It’s not as though Trump properties were a draw for fundraisers in the past,” said Robert Maguire, CREW’s research director.

“Trump came into office presenting an unprecedented set of conflicts of interest stemming from his refusal to divest from his businesses. What this spending shows is that far from being a check on these conflicts of interest, his political allies embraced it and fueled it,” he added. “He’s actively trying to profit off of the presidency.

The chairwoman of the House Financial Services Committee revealed what she is investigating by subpoenaing Donald Trump’s records held by Deutsche Bank.

Rep. Maxine Waters (D-CA) was interviewed on Friday my MSNBC’s Chris Hayes.

“The documents that have been subpoenaed, can you sort of broadly describe them?” Hayes asked. “What is the goal here and what are the categories of documents you are seeking.”

“We are absolutely concerned about money laundering,” Waters replied.

But that is not all her committee is investigating.

“We concerned about illicit funds, we are concerned the loans he has gotten from Deutsche bank,” she continued. “No other bank would lend him money and he sued Deutsche Bank at one point, but Deutsche Bank has been lending him and his family huge sums of money and at the time of his election, he owed them about $300 million.”

“And so we want to understand that relationship, we want to understand his relationship to Russia. We want to understand his finances and financing,” she added.

Trump official flagrantly declares she ‘doesn’t care anymore’ if she is breaking the law

The 1939 Hatch Act prohibits public officials from engaging in partisan activity.

But a top-level Trump era administrator at the Department of Housing and Urban Development does not care — and she’s posting about her flagrant disregard for the law on social media, reports the Huffington Post.

“Just retweeted this amazing tweet from both of my Twitter accounts — professional and personal,” Lynne Patton wrote on Facebook last week. Her message lauded her boss, HUD Secretary Ben Carson, while criticizing Rep. Alexandria Ocasio-Cortez (D-N.Y.). “It may be a Hatch Act violation. It may not be.”

“Either way,” she said, “I honestly don’t care anymore.”

Patton had originally retweeted a message that said, “I find it funny how liberals will laugh at & mock Ben Carson for a simple miscommunication yet praise Ocasio-Cortez as if she’s a genius,” a user called Educating Liberals said.

“One of them is a brain surgeon who separated conjoined twins at the heads & the other just figured out what a garbage disposal is. Case closed.”

Patton confirmed the sentiment, adding a “feeling disgusted” emoji.

$1 Million Donation to Trump’s Inaugural Committee Scrutinized by Feds

A $1 million donation made to President Trump’s inaugural committee by real-estate mogul and prolific political donor Franklin Haney is being probed by federal prosecutors, according to the Associated Press. Authorities are looking into whether donors, like Haney, received benefits after they contributed. In particular, Haney was—at the time of his donation—seeking money and regulatory approval from the government to help acquire Bellefonte Nuclear Power Plant. He still has not closed that deal, but former Trump fixer and personal attorney Michael Cohen allegedly provided prosecutors with information about Haney’s nuclear-plant project.
