    You can now get verified on forum.

    The way it's gonna work is that you can send me a PM with a verification picture. The picture has to contain you and forum name on piece of paper or on your body and your username or my username instead of the website name, if you prefer that.

    I need to be able to recognize you in that picture. You need to have some pictures of your self in your gallery so I can compare that picture.

    Please note that verification is completely optional and it won't give you any extra features or access. You will have a check mark (as I have now, if you want to look) and verification will only mean that you are who you say you are.

    Depends where it was hit. Either they carelessly drove out. Or if the vehicle in the lane had ample time to avoid a collision the fault would go to the vehicle on the road. Not 100% just based off of what I've seen.

    You are always supposed to be in control of your vehicle. So its the vehicle in the lane of travel that is at fualt. if somone pulls out in your lane you can't just crash into them.

    I can tell you what the judge told me when I was leaving a driveway and a person coming down the road lost control of his car and hit me.
    It is the fault of the person coming onto the roadway. The law says you should wait until the roadway is clear before entering the road.
    If there is an accident it is because the driver exiting the driveway didn't wait until the roadway was clear.

    Well, according to an Irish taxi driver, right of way is determined by two factors, when driving in Ireland.
    1) Mass
    2) Determination

    The sole exception is if it is a Guinness truck. A Guinness truck always has right of way, no matter what. Even the queens motorcade will yield to the Guinness truck.

    At least, that's what the Irish taxi driver said.

    The car traveling the roadway ALWAYS has the right of way. Even if the car exiting the driveway is fully into the roadway prior to the accident and is rear-ended, the driver failed to yield to oncoming traffic.

    Not in Massachusetts. Here you cant just crash into people. If someones stoped in the road way you have to stop. You can beep and call the person an asshole but you cant hit him. And I also know insurance companies look at where the damage occured if your damage occured in the front they will most likely find you at fualt by stating that you weren't in control of the vehicle

    A car pulling into the roadway is NOT exempted from the need to yield to oncoming traffic by getting all the way in front of it before getting hit. Get a dash cam if you are worried about someone pulling out in front of you.

    As ridiculous as it may sound, when driving the operator is expected to be in control of their vehicle at all times, and that includes driving appropriately for road conditions.

    IOW, if you're driving down a street with a lot of in and out traffic from businesses, homes or whatever, then you are expected to be in enough control of your vehicle that you can avoid mishaps, like someone pulling out in front of you. Furthermore, if the speed limit down that road is 55mph, yet the only way you can avoid all problems is to drive 15mph, if you're driving within the law yet the situation demands that you drive less than, sometimes more than (like during rush hour), then you are expected to drive as the conditions warrant.

    In the end, 99% of the initial ticketing is up to the police officer. Your attitude, demeanor, his bad mood, your level of upset, hell even the dice from your mirror and wheels on your car will affect that decision. Anything beyond that is up to the courts to sort out, though they'll often tell you "he's a policeman, why would he lie?" :rolleyes:

    Which is why I have a dash cam. An impartial witness goes a long way in your favor.
    Case in point: while traveling east on a US highway at a reduced speed in a construction zone a woman pulled onto the highway in front of me. Literally feet in front of me. My truck was damaged and her car totaled. Injuries were slight. At any other time I might have been held at fault as I am a (I know this term bugs the guys in ties, and I don't care) professional driver. Only the evidence of my dash cam showing her pulling out directly in front of me without looking first prevented my being ticketed and sued. Instead her insurance had to pay for my repairs, motel stay, doctors visit and lost income.

    Get a dash cam.
