Under the microscope of media scrutiny he's under the press would know pretty quickly about the lawsuit. Now granted guilty or not he's already a racist in their eyes just they act of filing of the lawsuit would be the equivalent of an admission of guilt. So a gag order would only delay them finding out at best.

 

i just listened to the recording again and read the transcript of it and not once does he say anything about making them slaves or call them niggers or compare them to animals
he does want a perception of him to be better than it is but he has a right to want to not be associated in public with whomever he chooses

The court of public opinion is the biggest kangaroo court there is. When someone is accused of something it's front page news but should they be innocent of the charges then it's buried in the back if it's even reported. So years later people only remember the accusation not that they were proven innocent. The press only care about selling newspapers and ratings if they destroy someone in the process there sorry but they were just reporting the story. Also just for the record I think he did say what's on the recording and while I support his right to free speech I don't support his views.

 

But he's not accused of breaking any laws, so that hardly matters to him.

I am sure he would rather he was prosecuted under the law. $2.5 million would have bought the judge.

He hasn't broken any law, and his freedom of speech remains just as full as it ever was. No law has been passed to strip him of it.

His freedom to own an NBA franchise, never existed and still doesn't. He is only allowed to own one as long as he complies with NBA policies. He hasn't done, so they kick him out. That's no more surprising, or less lawful, than me booting you out of my house when you say things that I find offensive. Private houses and private clubs are not Congress; they do NOT have to guarantee your rights to free speech in THEIR field of operation.

Not a lot of people could afford $2.5 million to pay for free speech. The law does not have to strip him of it. A group of people got together and decided to do it themselves.
