  2. Hello,

You can now get verified on forum.

The way it's gonna work is that you can send me a PM with a verification picture. The picture has to contain you and forum name on piece of paper or on your body and your username or my username instead of the website name, if you prefer that.

I need to be able to recognize you in that picture. You need to have some pictures of your self in your gallery so I can compare that picture.

Please note that verification is completely optional and it won't give you any extra features or access. You will have a check mark (as I have now, if you want to look) and verification will only mean that you are who you say you are.

You may not use a fake pictures for verification. If you try to verify your account with a fake picture or someone else picture, or just spam me with fake pictures, you will get Banned!

The pictures that you will send me for verification won't be public

As long as judges tinker with the Constitution to 'do what the people want,' instead of what the document actually commands, politicians who pick and confirm new federal judges will naturally want only those who agree with them politically.

That is the reason both parties want to pick judges that agree with them.
The Constitution does not matter when it comes to politics.

At least the Republicans were able to stop Obama from nominating another left winger. With any luck Ginsberg or Kennedy will keel over and we'll get to put another conservative in there.

Nah JDB, you're a little off base here. While of course I'd like another conservative justice, I would hardly hope one of our sitting justices would keel over. We conservatives are better than that.

There is nothing new in the realization that the Constitution sometimes insulates the criminality of a few in order to protect the privacy of us all.

The virtue of a democratic system with a [constitutionally guaranteed right to free speech] is that it readily enables the people, over time, to be persuaded that what they took for granted is not so, and to change their laws accordingly.

Power tends to corrupt. But the power in Washington resides in Congress, if it wants to use it. It can do anything-it can stop the Vietnam War. It can make its will felt, if it can ever get its act together to do anything.

Politicians never do anything without a very good reason.
That very good reason is always power and money.

The problem with the Constitution is that too few Americans have ever read it and so they don't know what the fuck they are talking about when they say stupid shit about the courts and the constitution. When if they ever bothered to read it they would know better because as incredible and profound as the Constitution is its actually pretty simple to read and understand which is that the founders intended.

    Such as:Article III: Section 2

The real genius of both the founders and the Constitution they wrote is they knew that they did not know everything and things would always change. So one of the checks and balances they included was that there would always be questions about what is and is not allowed under the Constitution and when those questions arise it would be up to the courts to decide and the Supreme Court would have the final say on what is and is not constitutinal. Which really is true genius.

And so I just wish more people would actually read the constitution and stop going around saying stupid shit and learn to love what America really stands for and the true genius of the Constitution of the United States of America It ain't that hard.

The Court's decision reflects the philosophy that judges should endure whatever interpretive distortions it takes in order to correct a supposed flaw in the statutory machinery. That philosophy ignores the American people's decision to give Congress '[a]ll legislative Powers' enumerated in the Constitution. They made Congress, not this Court, responsible for both making laws and mending them.
      I think.

I'm just jumping on the ''quoting stuff I read'' bandwagon because every thing I've been saying are quotes of Antonin Scalia my new but deceased hero of the Constitution and it's intended meaning.
      I think.

That's the argument of flexibility and it goes something like this: The Constitution is over 200 years old and societies change. It has to change with society, like a living organism, or it will become brittle and break. But you would have to be an idiot to believe that. The Constitution is not a living organism, it is a legal document. It says something and doesn't say other things.

It is difficult to maintain the illusion that we are interpreting a Constitution, rather than inventing one.

Lookj I am not going to waste my time on utter nonsense from people who don't have the faintest idea what they are even talking about.

    1. Mayling
Oh on the contrary Justice Scalia had much more than the faintest idea of what he was saying or he wouldn't have said it. If you realize that you just add some of your own words to the stuff you quote and believe what the media says that you agree with, you are the one uttering nonsense. You can debate all you want but I am only repeating , as you do, things that other people said and agree with, as am I, but Antonin Scalia whom I agree with, laid way a path for idiots like you to debate anything, and even affirms some of the things you debate with stumbles. So if you are saying that I haven't the faintest idea of what I'm talking about your right that's why I'm quoting someone who did. And who did it well the words you say will never be studied in law school . Debate that . I think.

@stumbles - Bear in mind that brains and learning, like muscle and physical skill, are articles of commerce. They are bought and sold. You can hire them by the year or by the hour. The only thing in the world not for sale is character. You don't have any, and that being said , I am going to make dinner for my papi. I think

Even though a lot of what is being said here is like hearing fingernails on a chalkboard just because I have had a love affair with the Constitution of the United States of America for close to 40 years now I will go ahead and express that love and point out a few other genius things about the Constitution of the United States of America and how I feel in love with her/him/it.

I walked off a drilling rig and sat down behind a desk with my wife, my partners, and another great publisher and newspaper tycoon (at least in that state) who gave us a grub stake to start our own newspaper. And I didn't really know much about that and had to learn things one at a time as they came along. And it was not long before I thought my freedom of the press was being violated. But the problem was I didn't even know what that right really was. So it was a slow day and I decided maybe I should read the Constitution figure out what my freedom of the press rights really were and look for loopholes. And so I sat down and read the Constitution of the United States of America from the first word to the last word of the last amendment.

And two feelings swept over me that would change my life from that moment on. One, I could not fucking believe how easy it was. I am no scholar and even less of one back then, and every word and sentence just made simple sense, and it didn't take an hour. And then I also realized what I had actually read was a rule book and lots of people were trying to rig the game. And that was the moment I declared war on the lie of conservatism as it is preached and practiced in this nation.

Then a few years later I was a member of the Commission of the Bicentennial of the United Sates Constitution. Which isn't really as big as it sounds. It was a national effort to celebrate the 200th anniversary of the Constitution and they wanted at least one member of every town in the nation. So I got the job. And even though I didn't really do all that much. They sent me what eventually would turn into a cardboard box full of nothing but the history of the constitution. And I already thought the guys who sat down and wrote our Constitution were cool. I didn't know until then what geniuses they were. Because they knew what they did not know. They had no better idea of what freedom and liberty is back then than we have today. But they knew that. And so they knew what freedom and liberty was not. And they knew that powe3r corrupts and absolute power corrupts absolutely. And they decided they had to try and prevent that And that is where they came up with their stroke of genius.

We will just split three ways. Politics will always be politics. But the main thing is the Constitution because that is the rule of our land. So since the president and congress will always be struggling for power we'll throw in a referee, an arbitrator, and try to insulate them from politics as far as humanly possible. So the politicians can squabble all they want but the court system makes the calls and what the Supreme Court says will be the law of the land. And we will appoint judges that will serve for life so they don't hae to be elected by politics and no politician can throw them out. And that is not just how it works. And it has served us amazingly well for more than 23o years.

So how does that work today. Well I will tell you. It is impossible for humans to do anything perfect so there can be political variations in our court system. It can meander to the left or right. But never to the extent that people like to claim. Nobody knows who a judge or justice might decide or vote. But since president's get to appoint judges and especially Supreme court justices thay do get their political stamp. And presidents may come and presidents may go but judges serve for life.

And my side actually had a chance to do that we could have changed the majority on the Supreme Court from conservative to liberal for the first time in more than 30 years. But we didn't. So now Trump is going to get to appoint hundreds of conservative federal judges and maybe even more Supreme Court Justices. And I am sure I am not going to like most of the decisions they come up with.

And what am I going to do about that? Well basically just have to sit there and suck on it. Its not the way I want it. But our constitution only guarantee I will get my say. It does not guarantee I get my way. And whether they know it or not every citizen in this country has agreed to live under our Constitution and if they don't like it they are free to leave. Its not perfect but its probably as close as humans can get. And its well woth the aggravation to be able to live in a country as great as this.

Now please. No more fingernails on the chalkboard.

In the spirit of the question posted in the thread title, I disagree, it is not the best. As for why, I guess that's more a matter of opinion and I suppose in my opinion it's a rather average looking set of tile. Also some dick got his cock in the way.

"Doing what the people want is not such a bad thing." The original Constitution counted people who happened to be slaves as 3/5 of a person, when counting the population to determine how many Representatives each state could send to Congress. That's what the document actually commanded, until the people wanted something else.

In the following years, we've had Federal Judges who declared, based on the Constitution, that a State had to power to imprison a man who was convicted of the crime of sucking another man's cock. I've read the Constitution, and don't remember anything about cock sucking. Maybe someday, the people will want to suck cocks and the Constitution will be tinkered with to allow that.

If the Constitution doesn't do what the people want, there's not much point in keeping it around.

This is what the United States Constitution says about the Supreme Court:

Article III. - The Judicial Branch
    Section 1 - Judicial powers
The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services a Compensation which shall not be diminished during their Continuance in Office.

    --------

Notice that there is no mention of the power to overturn popular legislation. That power was usurped with the Marbury v. Madison Decision of 1803. Since then Supreme Court justices have read their concerns into the often vague wording of the Constitution.

The Fourteenth and Fifteenth Amendments very clearly give full citizenship rights to Negroes. After the presidential election of 1876 the Supreme Court choose to ignore Southern efforts to reduce Negroes to second class citizenship, without the right to vote.

The presumed "Constitutional right to an abortion" was based on a presumed "Constitutional right to privacy." Nevertheless, the Constitution does not mention the words abortion or privacy, so it cannot be said to protect either.

The First Amendment prohibits the creation of an established church, like the Church of England in England. It has been used to prohibit prayer and Bible reading in public schools, and manger scenes on country court houses, even when the voters clearly want those things.
