    The Georgia Court of Appeals has suspended a case against a
    Donald Trump co-defendant, dealing a setback to Fulton County District Attorney (DA) Fani Willis, pending Trump's appeal to remove her from the case.

    Former Coffee County elections director Misty Hampton is one of 19, including Trump,
    accused of conspiring to overturn the result of the 2020 U.S. presidential election in Georgia. All co-defendants deny the charges, apart from four who have taken a plea deal.

    On Wednesday, the Appeals Court overturned Judge Scott McAfee's ruling from earlier this month in which
    he rejected Hampton's request to have the case against her suspended, pending the outcome of other appeals.

    Her request came after an Appeals Court order on June 5 to
    indefinitely pause trial proceedings against Trump and other co-defendants during their appeal against Judge McAfee's March decision to allow Willis to stay on the case.



    Previously, in an attempt to get Willis and her team disqualified and the charges against them thrown out, some of the defendants, including Trump, had argued that a personal relationship between Willis and her lead prosecutor Nathan Wade created a conflict of interest. While Willis and Wade confirmed that they had been in a relationship, they said that neither had personally benefited from it.

    Trump and nine co-defendants appealed the ruling that allowed Willis to stay on.

    Hampton was not part of the motion to remove Willis, but after the Appeals Court paused proceedings against the co-defendants who were party to the motion, she requested that her case be put on hold too.

    Wednesday's order stated "Based upon Misty Hampton's request that this Court stay her case pending this Court's resolution of the outcome of the appeal in [The State of Georgia v. Donald J. Trump, et al], this Court hereby stays all underlying proceedings against her in the Superior Court of Fulton County pending the outcome of the appeal.

    The Appeal's Court ruling in Hampton's favor comes as a blow to Willis, who, following the earlier June 5 order,
    intended to proceed prosecutions against six of the co-defendants, including Hampton, who were not party to the motion to remove her.

    The order gives a legal avenue for the remaining five co-defendants to request the cases be paused pending appeal, meaning that the DA's cases against all 15 remaining co-defendants will likely be entrenched in a legal quagmire of pretrial proceedings, further extending the timeline before any trial can take place.

    A tentative date of October 4 has been set for an
    appeals panel to consider Willis' disqualification. Once it rules, the losing side could ask the Georgia Supreme Court to consider an appeal, making it all but
    certain that Trump will not stand trial before the November 5 election.

    Trump Lawyers: Willis 'Disqualified' by Race Rhetoric

    As Republican presidential nominee Donald Trump continues his bid to remove Fulton County District Attorney Fani Willis from the racketeering case against him, the former president’s legal team filed a brief in the Georgia Court of Appeals, arguing that Willis should be taken off the case due to her “racial rhetoric.”

    Steve Sadow, Trump’s legal counsel, told the Washington Examiner that the reply brief filed Monday “persuasively” rebutted the arguments the state made.

    In the court filing, the former president’s attorneys argue that Willis should be “disqualified” over her “proven false, incendiary racial rhetoric” in a church speech they say “was calculated to heighten public condemnation of, and thereby prejudice, the defendants in eyes of potential jurors.”

    They noted that the speech Willis made at an Atlanta church on Martin Luther King Jr. Day weekend “violated the Georgia Rules of Professional Conduct.”

    Fulton County prosecutors have said Willis’ speech was “vague” and did not identify whom she was referring to when she spoke about “weapons” being formed against her.

    “The Scripture they keep sending me is ‘No weapon formed against you shall prosper,'" Willis said in February. “I need y’all to hear me, though. They did not say the weapons will not form.”

    While Judge Scott McAfee, who presided over the case at the trial level, said the speech was “improper,” he did not consider it to be disqualifying.

    In his 22-page reply brief, Sadow argued that the state’s “interpretation” of Willis’ speech is “disingenuous at best.”

    "Willis’s purpose was plain: To obscure her misconduct by falsely accusing the defense of racism,” Sadow wrote. “Willis’s strategic use of pronouns was neither innocuous nor vague — Willis repeatedly used 'them,' 'they,' and linked these terms to her antagonist: 'White male republicans.’”

    The defense cited an opinion from former Georgia Supreme Court Justice Harold Nelson Hill, which suggests that a state attorney should be disqualified if their involvement in a case could cause reasonable potential for prejudice against the defendant.

    Given the “extensive media coverage” of the case, Sadow said there is a high probability of Trump receiving unfair treatment.

    While Willis has not yet responded to the defense’s latest filing, her office previously said that she did not express any personal opinion about Trump’s guilt and would not discuss the details of the case publicly.

    Trump’s effort to have Willis removed from the case was prompted by Republican operative Mike Roman, a co-defendant known for conducting opposition research. Roman’s attorney filed a motion to disqualify Willis in January over an affair she was having with then-special prosecutor Nathan Wade.

    During lengthy hearings, Willis and Wade claimed the case was not tainted due to their relationship and that Wade’s expenses for lavish trips the pair took were reimbursed by undocumented cash payments Willis made.

    Wade resigned from the case after the judge ordered that either he or Willis must step aside for it to move forward.

    According to the Examiner, the appeals court is scheduled to hear Trump’s motion to disqualify Willis on Dec. 5.

    The youngest daughter of anti-Trump DA Fani Willis was just arrested in Tyrone, Georgia, late last month and is now facing criminal charges.

    25-year-old Kinaya Imani Willis was booked into Fayette County Jail, about half an hour south of Atlanta, on August 24 for driving with a suspended license.

    Local law enforcement pulled over the prosecutor's pregnant daughter after spotting the young woman on a cell phone while driving her 2010 Nissan Altima allegedly in violation of the Georgia Hands-Free Act, which prohibits all drivers from using a hand-held electronic device, even to talk over the phone, while operating a vehicle.

    She "stated that the reason for her using her cell phone while operating the vehicle was due to her mother calling her related to her pregnancy," the police report obtained by Daily Mail says.

    Willis, who's reportedly heading to law school, told a Tyrone Police Department officer she was "unaware" her license was suspended as of May 13 for the same offense: driving on a suspended license.

    FIRST ON FOX: Former Georgia Sen. Kelly Loeffler's conservative advocacy group has launched a six-figure ad campaign that the group said is aimed at exposing the "failures" of Fulton County District Attorney Fani Willis ahead of the election in November.

    The $100,000 ad campaign, launched by the Greater Georgia 501(c)(4) on Thursday, will include digital ads, direct mail and text messages – all of which will run over the next nine weeks, reaching Atlanta-area voters ahead of the election on Nov. 5, the group said.

    The ad titled, "Failed," will run on streaming services and programmatic media including Fox News, CNN, WSB-TV, Hulu, Roku and Fubo.

    Fulton County DA Fani Willis sent a scathing letter to the GOP-led House Judiciary Committee demanding that her lover, Nathan Wade, whom she had hired to spearhead the prosecution of former President Donald Trump on Georgia RICO charges, should not have to answer questions before Congress, because the proceedings could compel Wade to "improperly divulge confidential information."

    Willis contacted the committee's chairman, Rep. Jim Jordan (R-OH), ahead of Wade's deposition slated to take place Tuesday, arguing that it could interfere with the Trump case.

    On X, the House Judiciary GOP posted a copy of the Democrat DA's letter addressed to Jordan as well as a separate directive she sent Wade, ordering him not to speak about the particulars of the Trump prosecution.

    Willis indicated that Wade has "knowledge of highly sensitive and confidential information regarding this ongoing criminal matter." She insisted that this information "still belongs" to her prosecutorial team. In the three-page memo to Jordan, she said, "I am concerned that your demand for Mr. Wade's testimony would force him to improperly divulge confidential information that is protected by privileges held by the Fulton County District Attorney's Office..."

    "The disclosure of such evidence may also interfere with ongoing proceedings, [and] this is considered legally privileged and not subject to disclosure," Willis wrote.

    In May, Jordan sought Wade's closed-door testimony after asking him for records related to his employment under Willis and the undisclosed affair the two had engaged in during the Trump investigation. Wade is scheduled this week to tell investigators in Washington all he knows about the Georgia election interference case against Trump and his allies.

    Last month, the judiciary panel reportedly asked the U.S. Marshals to help locate Wade and serve him a summons to testify following his failure to appear for a previous hearing. Wade ultimately agreed to appear.

    Willis is now moving to place certain restrictions on what Wade can disclose on Capitol Hill and said he was already "instructed not to answer any questions that seek to solicit information about his role or underlying evidence" in the Trump case.
