DOJ watchdog sends criminal referral for McCabe to federal prosecutor
    [IMG]
By Brooke Singman | Fox News

Judicial Watch Director of Investigations Chris Farrell on the DOJ inspector general's report that said former FBI Deputy Director Andrew McCabe authorized a leak to the media.

The Justice Department’s internal watchdog has sent a criminal referral for fired FBI official Andrew McCabe to the U.S. attorney’s office in Washington.

The move follows a recent DOJ inspector general report that found McCabe leaked a self-serving story to the press and later lied about it to then-Director James Comey and federal investigators, prompting Attorney General Jeff Sessions to fire him on March 16.

A source confirmed to Fox News that the referral was sent.

The Washington Post reported earlier that the IG referred the finding that McCabe misled investigators "some time ago," asking the top federal prosecutor for D.C. to examine whether he should be charged.

Representatives with the Justice Department, inspector general’s office and U.S. attorney’s office all declined to comment.

Republican Rep. Mark Meadows backed the move in a tweet Thursday afternoon.

"The criminal referral from the IG is the right decision. It's about time we have some accountability for this type of conduct at the Justice Department," he said.

On Wednesday, Comey also publicly acknowledged he was the one who prompted the probe and seemed to back the investigation’s findings.

The fired FBI director addressed his former colleague's controversies during an appearance on ABC’s “The View,” after being pressed on how the public was supposed to have “confidence” in the bureau after revelations that ex-deputy director McCabe lied about the leak.

“It’s not okay. The McCabe case illustrates what an organization committed to the truth looks like,” Comey said. “I ordered that investigation.”

Comey seemed to defend McCabe's character even while backing the DOJ inspector general probe's findings.

“Good people lie. I think I’m a good person, where I have lied,” Comey said. “I still believe Andrew McCabe is a good person but the inspector general found he lied.”

While Comey may not have intentionally launched the investigation gunning for McCabe, it was spurred by a desire to find who leaked to The Wall Street Journal in October 2016 about an FBI probe of the Clinton Foundation. The story said a senior Justice Department official expressed displeasure to McCabe that FBI agents were still looking into the Clinton Foundation, and McCabe had defended agents' authority to pursue the issue.

That leak confirmed the existence of the probe into the Clinton Foundation, which Comey, who led the bureau at the time, refused to do.

Justice Department Inspector General Michael Horowitz sent a criminal referral for Andrew McCabe to the U.S. Attorneys Office in Washington D.C. (AP)

Inspector General Michael Horowitz’s report said McCabe authorized the leak and then misled investigators about it, leaking in a way that did not fall under the “public interest” exception.

Horowitz found that McCabe lacked “candor” when questioned by FBI agents on multiple occasions, and that he told agents he did not authorize the disclosure and did not know who was responsible.

But McCabe’s legal counsel, Michael Bromwich, has blasted the inspector general report and has criticized Comey. The report said Comey and McCabe gave conflicting accounts about a conversation they had on the leak.

“The OIG should credit Mr. McCabe’s account over Director Comey’s,” Bromwich wrote to Horowitz in a letter, complaining that the report “paints Director Comey as a white knight carefully guarding FBI information, while overlooking that Mr. McCabe’s account is more credible…”

He issued a similar statement Wednesday in response to Comey's interview comments:

"In his comments this week about the McCabe matter, former FBI Director James Comey has relied on the accuracy and the soundness of the Office of the Inspector General's (OIG) conclusions in their report on Mr. McCabe. In fact, the report fails to adequately address the evidence (including sworn testimony) and documents that prove that Mr. McCabe advised Director Comey repeatedly that he was working with the Wall Street Journal on the stories in question prior to publication. Neither Mr. Comey nor the OIG is infallible, and in this case neither of them has it right."

On Wednesday, nearly a dozen Republican members of Congress sent their own criminal referral to the Justice Department and FBI seeking an investigation of McCabe, along with Comey, ex-Attorney General Loretta Lynch, Hillary Clinton and others.

The IG referral, however, could represent a more serious problem for McCabe.

Asked how he felt about allegations that McCabe lied to the FBI, Comey said he was “conflicted.”

“I like him very much as a person, but sometimes even good people do things they shouldn’t do,” Comey said, adding that the Justice Department’s “accountability mechanisms are working.”

“It’s a department that is committed to the truth,” Comey said.

Shooter for once bothered to read stumbles spew.

Is shooter the only one disturbed by the very obvious fact that both the department of justice AND the FBI are so politicized?

And that they created the justification to interfere in the election?

The only investigation that counts is Mueller's.

And the vast majority of Americans know the FBI has been using informants to investigate Russian spies since the 1930's and think that's a pretty good deal and they are getting their money's worth.

When the FBI puts spies in a political campaign that isn't to catch Russian spies.
You ought to be scared to death the FBI even thought it up, much less acted on it.

    Yeah...after second thought, you're right.

The more Mueller investigates, the more we find out how a criminal federal fucking government has operated for years.

Yes, you are correct. While most of us have known the leadership in the FBI has been involved in dirty political maneuvering beginning with J Edgar who was the first head of the FBI, most of us had no idea exactly how bad it was. It really is a shame our FBI is having its dirty laundry aired out for the world to see. Actually, it's not a shame it's being aired, the shame being it has "dirty" laundry.

If it doesn't scare people to discover that the FBI and DOJ have been politicized for years, and are covertly trying to impact the presidential election process, we are well and truly fucked.

OK now let's get this straight again. It is not Putin/Russia interfering in our elections and attacking our democracy worse than since World War II. It's not Russian spies recruiting Americans. Surrendering to Russia is not the problem. The problem is the DOJ and FBI who are supposed to protect us from the Russians that are the problem. And I don't think anyone other than a Russian would believe that.

But on the sites and channels I watch and belong to there is much howling and gnashing of teeth right now because it is widely feared Rosenstein is caving to Trump and Nunes to reveal their sources.

Other's, however, say it could also be that Mueller, the DOJ, and FBI are actually far enough by now to start laying down some of their cards. Because they know what they have and there is no stopping this now.

But one way or another something is fixin' to happen.

Comey interviewed by federal prosecutors investigating possible McCabe charges: report

Report: Fired FBI deputy director McCabe gave Mueller secret memo on firing of Comey. Catherine Herridge has the details.

Former FBI Director James Comey was recently questioned by the D.C. U.S. Attorney’s office as part of a probe into whether Andrew McCabe, his former deputy, committed a crime by lying to federal agents, a Thursday report claimed.

The Washington Post report indicated that McCabe, whom Attorney General Jeff Sessions fired earlier this year just days before he would have been eligible for a lifetime pension, could be charged criminally, according to a person familiar with the matter.

McCabe was fired after the Justice Department's watchdog said he lied to investigators reviewing the bureau’s probe of Hillary Clinton’s email server. Justice Department Inspector General Michael Horowitz said McCabe had not been forthcoming in regard to the handling of the FBI’s probe.

Horowitz said McCabe misled both investigators and Comey, multiple times, about a media disclosure authorization. Horowitz then passed those findings to the U.S. attorney’s office to decide if a criminal charge was necessary, although a referral doesn’t mean charges will be filed.

A five-year prison sentence could accompany a charge of lying to federal investigators. McCabe has said he didn’t intentionally mislead anyone.

"This attack on my credibility is one part of a larger effort not just to slander me personally, but to taint the FBI, law enforcement, and intelligence professionals more generally," McCabe said in a statement after he was fired.

"I like [McCabe] very much as a person, but sometimes even good people do things they shouldn’t do," Comey told "The Lead with Jake Tapper" on CNN in April. "I think it is accountability mechanisms working and they should work because it’s not acceptable in the FBI or the Justice Department for people to lack candor. It’s something we take really seriously."

Thursday's report followed a revelation earlier this week that McCabe had written a private memo detailing the circumstances leading to Comey's firing. A detailed report from the IG on the handling of the Clinton investigation, meantime, is expected within days.

Certainly, you don't expect McCabe or for that matter Comey to spend even an hour in jail...that ain't never gonna happen. Why do you think they are hell-bent on getting rid of President Trump? Trump won't go along with "business as usual" politics. You can't possibly think they think Trump is bad for the country. They may not be the sharpest tacks in the box but they aren't that stupid.
