Trump's handling of classified documents is a crime against American history: Watergate historian

A Watergate historian compared the claims about Joe Biden's mishandling of classified documents to allegations against Donald Trump and found one was a scandal while the other a potential serious crime.

Republicans have unsurprisingly hammered President Biden over the classified files found in his home and post-vice-presidential office, but historian and author Garrett Graff wrote a column for the New York Times explaining that Trump's GOP allies were using bad faith comparisons to distract away from the special counsel investigation of the former president's refusal to return top-secret government documents after the National Archives

"Mr. Biden’s handling of the issue — especially given the more detailed timeline recently released by the White House — shows how an official who finds misfiled or improperly stored classified files should react," wrote Graff, the author of the book, Watergate: A New History. "Mr. Biden’s behavior stands in sharp contrast to that of Mr. Trump, who spent months fighting with the National Archives over the files and repeatedly assured the Justice Department that he had turned over all files, even when he was still — apparently knowingly — holding onto scores of classified files. He failed to comply with a legal subpoena, and only then did the F.B.I. move to search his Mar-a-Lago residence."

Trump's defenders have argued that his status as an ex-president gives him more latitude to hold onto classified records, but Graff argued the law he's accused of breaking -- the Presidential Records Act of 1978 -- was passed in response to Watergate to prevent Richard Nixon from destroying records to cover up his presidency's corruption and mendacity.

IN OTHER NEWS: Trump’s inner circle baffled by his ‘self-defeating’ attacks on evangelicals

"The history that happens inside the White House belongs to the nation — not to the people who work there," he wrote. "It’s a core principle of a country governed by the rule of law, not by men (and women)."

"In keeping documents that reportedly ranged from his letters with foreign leaders to potential nuclear secrets, Mr. Trump is accused of trying to steal America’s history — apparently with forethought," Graff added. "When confronted, he repeatedly resisted returning that history to its rightful owners for future generations ... Mr. Trump’s case isn’t just about classified material. At its core, it is about who controls America’s history."

'Do you have any facts?' CBS host calls out GOPer comparing Trump's document scandal to Biden

    CBS/screen grab

CBS host Margaret Brennan called out Rep. Mike Turner (R-OH) after he suggested that President Joe Biden may have intentionally taken classified documents to bolster "Biden family businesses."

During an interview on Face the Nation, Brennan stopped Turner after he argued that former President Donald Trump's classified document scandal was less serious than Biden's.

"You know, when you reference President Trump, there were 300 classified documents," she noted. "There was a warrant, there was refusal to comply in terms of handing things over, and the White House and president's lawyer are pointing out, in the case of Biden, he granted permission, and this was consensual for the DOJ to come in and search."

"I think this looks more like a cover-up," Turner insisted.

"Do you have any facts to back up your allegation that he was hoarding things in terms of intention to take classified material?" Brennan asked.

"Well, they didn't fly to his home without him," Turner countered. "They went on a train with him from his Senate offices and then in boxes that he was in charge of."

FBI Official Who Investigated Trump for Russian Collusion Gets Arrested for Russian Collusion
    By Bonchie | 1:30 PM on January 23, 2023

In a hilarious and astonishing turn of events, one of the FBI officials who investigated Donald Trump for supposed Russian collusion has now been arrested for Russian collusion.

Former agent Charles McGonigal, who headed up counterintelligence for the FBI’s New York field office during the Trump-Russia saga, was placed under arrest for allegedly taking payments from Russian oligarch Oleg Deripaska. What was he being paid to do? According to CBS News, McGonigal and an interpreter named Sergey Shestakov agreed to investigate another Russian oligarch that Deripaska was targeting.

A former top FBI official in New York has been arrested over his ties to a Russian oligarch, law enforcement sources told ABC News Monday.

Charles McGonigal, who was the special agent in charge of counterintelligence in the FBI’s New York Field Office, is under arrest over his ties to Oleg Deripaska, a Russian billionaire who has been sanctioned by the United States and criminally charged last year with violating those sanctions.

McGonigal retired from the FBI in 2018. He was arrested Saturday afternoon after he arrived at JFK Airport following travel in Sri Lanka, the sources said.

The rot runs deep at the FBI, and this is yet more evidence of that. Even still, the irony here is just a bit thick, is it not? Donald Trump was relentlessly hounded by various investigations into largely non-existent ties to Russia, but here we have one of the highest-ranking FBI officials to ever be charged with a crime getting popped for corrupt ties to Russia. I mean, come on. You can’t script it any better than that.

What this really shows is how manufactured the hysteria around Trump was. Prior to the 2016 election and the subsequent Trump administration, no one at the DOJ cared about things like FARA and “collusion” with foreign actors. They should have cared, but they didn’t. It was only with the arrival of Trump that we saw the enforcement of any number of laws that had sat dormant as Democrats relentlessly violated them.

McGonigal apparently flew a bit too close to the sun, not accepting that the rules had changed. Or maybe he was just arrogant enough to think those new rules didn’t apply to him? There’s no shortage of government officials who would throw someone in jail for the same things they themselves have done.

Still, McGonigal can probably rest easy. Given where this case is taking place, all he has to do is tell the jury he’s a Democrat, and he’ll be acquitted.

As I have said a few times now turning the House over to the treasonous conservative/America Hating/Republican extremists to launch countless sham investigation of President Biden and his administration are going to blow up in their faces. Because the times have changed and the majority of Americans including the press are rejecting extremism.

Treasonous conservative/America Hating/Republicans got away with it during the Benghazi days because the majority the MSM would just sit there like bumps on a log and just let them lie and never challenge those lies. But both the hypocrisy and the lies are just too big to let them go unchallenged now. And a good example of that is Chuck Todd. Back in the Benghazi days he literally said it was not his job to find out who was telling the truth. Todd was king of bothside3rism. But now even Todd fears looking ridiculous in the face of obvious and outrageous lies.

'Biden didn't defy a subpoena!' Chuck Todd schools Jim Jordan on 'raid' of Trump's Mar-a-Lago

NBC host Chuck Todd confronted Rep. Jim Jordan (R-OH) after he suggested there is a two-tier justice system for Republicans and Democrats because a search warrant was used to search former President Donald Trump's Mar-a-Lago estate after he refused to cooperate with the Justice Department.

"You keep talking about this raid on Donald Trump," Todd told Jordan during an interview on Sunday. "There was nine months between the initial action the archives made for a request of documents before they even turned it over to the Justice Department. The subpoena was issued 60 days before they actually executed the subpoena. And more importantly, the only time the public found out about it is because Donald Trump told the public about it."

"It was actually a year and a half of Donald Trump not complying with any of the requests from the National Archives," he noted. "A year and a half! This is not some sort of proof that somehow they've weaponized and are playing politics [at the Justice Department]."

"They raided Trump's home; they haven't raided [President Joe Biden's]," Jordan replied.

"Because Biden didn't defy a subpoena!" Todd shot back.

Jordan argued that Trump's documents were protected by a locked room and the Secret Service while Biden's were not.

"You do not seem to ever see the same conspiratorial problems when it's a Republican," Todd concluded.

‘Much More Agressive’: CNN Says Trump Docs Probe Heating Up As Search Team Trump Was Forced to Hire Testifies To Grand Jury
    By Tommy ChristopherJan 31st, 2023, 1:18 pm
    273 comments

CNN says their scoop about the Trump grand jury shows the investigation into the documents seized at Mar-a-Lago is getting “much more aggressive,” especially compared with the Biden investigation.

CNN’s Kaitlan Collins and Katelyn Polantz reported Monday that two of the people hired by former President Donald Trump’s lawyers to search four Florida properties for classified documents have now testified before the federal grand jury investigating Trump. The search team was hired at the direction of a federal judge.

On Monday night’s edition of CNN’s OutFront, anchor Erin Burnett hosted correspondent Evan Perez to report the scoop, and Perez called the development an indication of “how much more aggressive” the Trump probe is compared to the investigation into President Joe Biden:

BURNETT: Breaking news in the Trump Mar-a-Lago classified documents investigation. CNN just learning that two people hired to search Trump’s properties for the classified documents testified before a federal grand jury. Source tells CNN that two people who found classified material inside of Florida storage facility testified for about three hours each. Evan Perez is OUTFRONT on the breaking news.

And, Evan, what more do you know about these two people? And where the investigation stands right now?

EVAN PEREZ, CNN SENIOR JUSTICE CORRESPONDENT: Well, Erin, the Justice Department and the Trump team have been a little bit — as the prosecutors were trying to get access to due to people. We don’t know they’re names. We do know however, thanks to the reporting from my Kaitlan Collins and Katelyn Polantz, these two people did go into the federal grand jury here in rushing ten, that is working with the team and the special counsel prosecutors are in investigating the former president for his mishandling of classified documents, found at Mar-a- Lago.

Now, the search that these two people did back in October, did turn up additional documents. And it really gives you a sense of how aggressive the prosecutors are being in this case. Simply because this is a more complicated case, this is a case involving potential obstruction of justice. In contrast to the documents that were found at President Biden’s home and off — private office.

    BURNETT: Right.

PEREZ: And the documents found at Mike Pence’s former Vice President Mike Pence’s home. More recently. It gives you a sense of how much more aggressive they are being, because of the issues and the litigation that has been going on between the justice department and the former President Trump.

One other thing that the, that we have learned, is that the prosecutors are also trying to get access to some files on the computer of at least one staff member at the — at Mar-a-Lago. Again, another indication of the aggressiveness behind its investigation.

    Watch above via CNN’s OutFront.

Trump team turns over additional classified records and laptop to federal prosecutors

    CNN —
Former President Donald Trump’s legal team turned over more materials with classified markings and a laptop belonging to an aide to federal prosecutors in recent months, multiple sources familiar with the investigation told CNN.

The Trump attorneys also handed over an empty folder marked “Classified Evening Briefing,” sources said.

The previously undisclosed handovers – from December and January – suggest the protracted effort by the Justice Department to repossess records from Trump’s presidency may not be done.

The Trump attorneys discovered pages with classified markings in December, while searching through boxes at the former president’s Mar-a-Lago residence. The lawyers subsequently handed the materials over to the Justice Department.

    be

A Trump aide had previously copied those same pages onto a thumb drive and laptop, not realizing they were classified, sources said. The laptop, which belonged to an aide, who works for Save America PAC, and the thumb drive were also given to investigators in January.

Special counsel Jack Smith’s investigation, which is pursuing possible criminal charges related to Trump’s handling of national security records and obstruction of justice, had subpoenaed Trump last May for all classified records in his possession.

FBI agents seized classified documents and other presidential records during a search last August. The Trump team also found additional documents in a Florida storage facility and turned them over to the FBI.

The discovery of two documents with classified markings in the storage unit was made after a team hired by Trump’s lawyers searched it along with three other Trump properties: Trump Tower in New York, the Bedminster golf club and an office location in Florida.

Those four searches came amid lingering concerns from the Justice Department that not all of the documents from Trump’s time in the White House had been returned to the federal government.
