Fox News’ Andrew Napolitano reveals Trump is in legal jeopardy over Cohen tapes: ‘There is indication of a fraud’

Fox News judicial analyst Andrew Napolitano, a former judge, told Fox News on Wednesday that a tape of President Donald Trump talking about paying hush money to a former Playboy model appears to be like evidence of a crime.

While speaking to Napolitano on Wednesday, Fox News host Bill Hemmer noted that Trump attorney Rudy Giuliani claimed that the tape of Trump talking about paying off Karen McDougal is “no indication of any crime.”

“There doesn’t appear to be any indication of any crime but I think that’s the wrong analysis,” Napolitano said. “There is an indication of a fraud. And the significance of that is, if the client and the lawyer discuss the commission of a crime or discuss the commission of a fraud, there is no attorney-client privilege in that conversation, meaning the tape can be used by anybody.”

According to the former judge, McDougal or special counsel Robert Mueller’s investigation could use the tape against Trump in court.

“What’s the fraud?” Napolitano continued. “The discussion is about paying National Enquirer to pay McDougal $150,000 to buy her story and to lead her to believe that the National Enquirer is going to publish her story. But the real aim here is to bury the story by duping her into selling to them and then not publish it.”

“That failure to be truthful to her and the involvement of Donald Trump and Michael Cohen in that decision is the fraud,” he added.

Napolitano explained that in his scenario, it looks like Trump committed civil fraud, not criminal fraud.

“Civil fraud is when you dupe somebody out of cash for some other purpose” than personal enriching oneself, he remarked. “The other purpose here was to keep the story from being put in the press by lying to her and telling her, ‘We’ll pay you $150,000, you don’t talk to anybody else and we’ll publish your story’ — when they never intended to publish it.”

Napolitano also said that campaign finance laws may have been broken “but that is up to Mueller.”

“[Trump attorney] Rudy Giuliani is right in the fact that there is not a criminal violation,” he observed. “He is incorrect by not addressing the fact this is a fraud because he knows that crimes and fraud both vitiate the attorney-client privilege.”

“There is no crime. It hurts the president in that there is fraud,” Napolitano concluded.

Fox News President Declares ‘Strong Solidarity with CNN’ After WH Bars Kaitlan Collins from Event

Fox News President Jay Wallace has put out a statement expressing support for CNN after the White House barred reporter Kaitlan Collins from the Trump Rose Garden event this afternoon.

Collins was informed by the White House she was being blocked because they didn’t like her shouted questions to President Donald Trump at the pool spray earlier.

The rest of the media came to Collins’ defense, notably including Fox News. After Bret Baier said Fox stands with CNN, Wallace issued this statement:

Report: Kimberly Guilfoyle Left Fox News After Misconduct Probe

When Kimberly Guilfoyle quit Fox News last week, it was billed as her own decision in order to help her partner, Donald Trump Jr., campaign for Republicans in the 2018 midterms. However, multiple unnamed sources have now told HuffPost that Guilfoyle’s exit from the network came after her alleged inappropriate workplace behavior could no longer be tolerated. Six sources said Guilfoyle’s alleged behavior included "showing personal photographs of male genitalia to colleagues (and identifying whose genitals they were), regularly discussing sexual matters at work and engaging in emotionally abusive behavior toward hair and makeup artists and support staff." HuffPost reports that Guilfoyle was subject to a human resources investigation that started last year, and was warned by Kevin Lord, head of Fox News HR, about her behavior in the fall of 2017. Guilfoyle was not formally terminated, but the sources told HuffPost that Fox prefers problematic employees resign to avoid controversy. Guilfoyle's attorney said: “Any accusations of Kimberly engaging in inappropriate work-place conduct are unequivocally baseless and have been viciously made by disgruntled and self-interested employees."

WATCH: Fox’s Shep Smith rolls supercut of Giuliani’s latest ‘deceptive straw man argument’ for Trump

During his Monday afternoon show, Fox News host Shep Smith slammed Donald Trump’s attorney Rudy Giuliani for repeatedly making the “straw man” argument that collusion with Russia is not a crime.

The host ran a supercut of Giuliani during his twin appearances on Fox & Friends and CNN in which he repeatedly tried to assert that “collusion is not a crime” — a doubling-down on his claim that Trump did not collude, but if he did, it wouldn’t be against the law anyway.

“I’m sitting here looking at the federal code trying to find collusion as a crime,” Giuliani told the hosts of Fox & Friends Monday morning in the clip Smith played on the network that afternoon.

“Giuliani is making a straw man argument,” the host said, “and it’s deceptive.”

“While the U.S. Criminal code does not criminalize collusion,” Smith continued, “it is against the law to influence or undermine our election or any other action.”

Fox News’ Shep Smith does a point-by-point tear down of the White House’s ‘patently false’ claims about Mueller probe

On Fox News Wednesday, host Shepard Smith tore apart the White House’s increasingly bizarre official narrative about Special Counsel Robert Mueller’s probe.

Reporting from the north lawn, Fox News White House correspondent John Roberts described the contradictions in the White House’s story.

“You have the president saying the attorney general, Jeff Sessions should shut down the Mueller investigation, but at the same time, the president and the White House have on many occasions said that the Mueller investigation should continue to its logical conclusion,” Roberts noted.

“The president tried to have it both ways today sending out that tweet, but then, at the briefing, Sarah Huckabee Sanders saying this afternoon ‘We think the investigation should continue, though the President does think that it’s been going on too long and as you said at the top of the hour what he said today in the tweet was not official policy. It was an opinion.”

Smith then went on to point to inconsistencies and outright lies in the administration’s public statements.

“The White House today echoed President Trump’s false tweets claiming that the dossier is the foundation of the Special Counsel Robert Mueller’s Russia investigation,” Smith said.

“We’ll play the sound, show you the tweets, and then explain the facts,” Smith declared.

Smith rolled footage of Sarah Huckabee Sanders claiming that the Mueller investigation originated with the Steele dossier. In fact, the FBI inquiry was sparked after the agency received a tip from an Australian diplomat that Trump campaign advisor George Papadopoulos bragged that the Russians had dirt on Hillary Clinton.

“In the main and in its parts, that statement is patently false,” Smith said.

Donald Trump, Jr. spoke out on Monday about his controversial Trump Tower meeting on Monday, after his father’s weekend tweet appeared to throw his namesake son under the bus.

The Executive VP of development and acquisitions at The Trump Organization addressed his legal predicament from the friendly confines of the Laura Ingraham radio show.

After playing criticism of the shifting story, Ingraham said, “you want any comments on that Donnie, because they’re hitting you on that for contradictions. I mean, they’re calling it worse than contradictions, obviously.”

“Hello?” the president’s son asks.

“Donnie, what is your reaction to all that?” Ingraham asked.

There was a seven second pause following the question.

“Hey Donnie, you there?” Ingraham asked.

MSNBC reported on the interview, noting that Trump Jr. eventually came back on Ingraham’s radio show to blame the media.

“What’s the story?” MSNBC anchor Chris Jansing asked. “Drama just minutes ago when Donald Trump Jr. was asked about the infamous Trump Tower meeting.”

“When he — asked about it on the radio – the line went dead,” Jansing reported. “And then blamed the press and the Democrats. And the story of what led to the meeting, the story keeps changing.”

“Let’s start with a double dose of Donald Trump. Just moments ago, Donald Trump, Jr. making first comments after his father appeared to put him in even more legal peril with a tweet on Sunday. This is what Donald Trump, Jr. said to conservative commentator Laura Ingraham on her radio show.

“Basically, he says his story has been consistent from day one,” she explained.

Fox News host Shepard Smith is sad to report that Donald Trump’s proposed Space Force will not include anything from the Star Wars franchise.

“There will be no Millennium Falcon, no Jedis or Wookiees we are sad to report,” the Fox News host said. “But if the White House gets its way, in this special case, there will be a Space Force.”

“A sixth branch of the United States military to support America’s objectives in orbit.”

Vice President Mike Pence on Thursday announced plans for the creation of a Space Force, saying the Trump administration planned for it to be established by 2020.

“As President Trump has said, in his words, it is not enough to merely have an American presence in space — we must have American dominance in space. And so we will,” Pence said. “Space is, in his words, a war-fighting domain just like land and air and sea.”

‘That’s a deceptive headline’: NFL icon blasts Fox News for spinning his words during interview about kneeling

Fox News used NFL legend Tony Dungy as a “prop” to pin black people against each other, according to Robert Littal of Black Sports Online. While doing an interview with Fox and Friends, Dungy was asked if he would kneel during the national anthem.

He answered by saying that he would personally not kneel, but would support players personal decisions. However, the headline that Fox News decided to use did not capture Dungy’s full statement.

Littal called out the networks news judgment on Twitter.

“Here is your media lesson of the day. Tony Dungy I’m sure had good intentions and said several things in favor of players, but if you look at the Fox News tag lines they say ‘National Anthem Outrage’ and their tweet says ‘I would stand says, Tony Dungy,'” he tweeted.

“As I have mentioned several times, if you are a black person in media, Fox News will put you on, not because they want your opinion, but because they can flip your opinion to their MAGA audience. See this nice black gentleman said he’d stand, NFL Players are wrong,” he tweeted.

The Post Game was able to interview Dungy about the twisted headline and asked him to clarify exactly what he meant.

“My headline would be, ‘The Dungys support the players’ right to be out-front for social change,'” Dungy said. “We support any way they want to do it, but the idea is to try to make the situation better. I thought that was a very deceptive headline. I would personally stand, but I support those who don’t stand.”

“I think it’s because I really think I try to represent God’s point of view and try to talk about things biblically and I think people appreciate that. I’m not taking one side or another or anti-this. I try to give them good sound advice,” he said.

Fox & Friends gives Trump administration credit for “cracking down on Russia” after it belatedly implements legally required sanctions

New sanctions were mandated by US and international law for Russia’s nerve agent assassination attempt in the UK

Fox & Friends is, yet again, pointing to congressionally-mandated sanctions the Trump administration is (belatedly) implementing to claim the president is “cracking down on Russia.”

On August 8, the State Department announced a new round of sanctions against the Russian government and affiliated entities in response to the use of a Soviet-era nerve agent in the attempted assassination of a former Russian spy and his daughter on British soil in March. Months later, in July, two British civilians also came into contact with the nerve agent, killing one.

Now, Fox & Friends is pointing to the newest round of sanctions to claim the president is “holding Russia accountable” and “screwing this collusion thing up,” even though the sanctions are mandated by Congress and international law, and the administration has been late in implementing them.

AINSLEY EARHARDT (CO-HOST): The Trump administration holding Russia accountable.

BRIAN KILMEADE (CO-HOST): Again. The U.S. is issuing brand new sanctions, and this, after the attempted assassination of a former Russian spy and his daughter. They've been investigating since, and they don't like what they've found.

STEVE DOOCY (CO-HOST): Griff Jenkins live in Washington, D.C. with the details on how the U.S. of A is cracking down on Russia.

DOOCY: It looks as if the president is screwing this collusion thing up because I've been watching on the other channels, "He's been colluding with Russia." And yet, once again, they're cracking down on Russia.

KILMEADE: Every step of the way the president's done this, but he doesn't trumpet it. He doesn't say, "Hey, I've got a press conference, here are the sanctions." He just puts them on, and the next thing you know, they're mounting and I think they are significant. Especially they still focus on the Maginsky (sic) Act, and what he did to certain oligarchs surrounding Vladimir Putin, because it's really throttled their individual banking ability and investment ability.

‘Do you feel disoriented?’ Fox News host asks Rudy Giuliani why he seems confused all the time

During an interview with Trump attorney Rudy Giuliani, Fox News host Howard Kurtz touched on the former New York mayor’s mental health.

Kurtz noted that MSNBC hosts Joe Scarborough and Nicole Wallace had both suggested that Giuliani’s mental health is failing.

“Joe Scarborough, a onetime Republican congressman, said while criticizing some of your comments, ‘His eyes are bulging while he’s talking and he looks disoriented,'” Kurtz explained. “Do you feel disoriented, Mr. Mayor?”

“Absolutely, I’m completely disoriented,” Giuliani replied flatly. “I’m sure I sound that way. Is there something wrong? Doesn’t this give you an indication, Howie, of how completely disoriented the press is and how out of control they are, not only criticizing the president, but everybody around him.”

“You can disagree with me,” he added. “But I’m hardly disoriented. I know where I am. I know who I am. I don’t even think it’s worth commenting except for the fact that, aren’t they way out of control as journalists, accusing you of some kind of mental illness?”

“It’s another thing to say that a person is disoriented, who’s not,” Giuliani said. “Scarborough has got some deep animus towards the president. All of MSNBC does.”

On Wednesday, Brian Kilmeade said President Trump got played by Omarosa Manigault-Newman since she successfully goaded him into a new controversial squabble.

Kilmeade was speaking to his Fox & Friends colleagues when he said that Trump is probably helping his former Apprentice protégé sell her book – Unhinged: An Insider’s Account of the Trump White House – by going after her the way he has in the last few days. He compared the situation to how the White House inadvertently elevated Michael Wolff when they attacked his gossip-filled piece, Fire and Fury: Inside the Trump White House.

“She has come out with a series of tapes,” Kilmeade said, “and in many ways, [she] seems to have outsmarted the president who has taken the bait and gone out and tweeted directly after her.”

The curvy couch made note of how Sarah Huckabee Sanders faced a lot of questions about Manigault-Newman yesterday, though they neglected to highlight the part where the press secretary said she couldn’t “guarantee” that her former colleague lied by saying there’s a tape of Trump saying the N-word. Kilmeade reacted to this by saying Trump would’ve done better tweeting about the issues instead of getting baited into fights with people.

Fox News Mistakes Patti LaBelle for Aretha Franklin

Fox News apparently mistook singer Patti LaBelle for Aretha Franklin on Thursday, including a photo of LaBelle as part of the network’s obituary image for Franklin, who passed away earlier this morning after a battle with pancreatic cancer.

At the end of an America’s Newsroom segment memorializing the late singer-songwriter, Fox News cut to a still image of Franklin, captioned “Aretha Franklin, Singer, 1942-2018,” inexplicably featuring a background photograph of LaBelle—who is not Franklin—singing for PBS in 2014. The flub was made all-the-more ironic by the fact that Franklin and LaBelle reportedly had a longstanding feud that only ended on Thursday morning when the 76-year-old legendary diva passed away.

“We sincerely apologize to Aretha Franklin’s family and friends. Our intention was to honor the icon using a secondary image of her performing with Patti LaBelle in the full screen graphic, but the image of Ms. Franklin was obscured in that process, which we deeply regret,” said Jessica Santostefano, Fox News’s VP of media desk, in a statement.

Contrary to Fox’s claim, however, Franklin was not on-stage with LaBelle during that performance. According to the same AP photograph used by Fox News, the only Franklin connection is that her name appears in the caption because she separately performed at the same Obama White House event.

Fox & Friends host Ainsley Earhardt: America is great because ‘we defeated communist Japan’

Fox & Friends host Ainsley Earhardt asserted on Thursday that America is “great” because it “defeated communist Japan.”

On Thursday’s edition of Fox & Friends, the three co-hosts complained about a recent statement by New York Gov. Andrew Cuomo (D).
“We’re not going to Make America Great Again,” Cuomo said on Wednesday. “It was never that great. We have not reached greatness. We will reach greatness when every American is fully engaged.”

On Thursday, Earhardt encouraged Fox News viewers to email the network with comments about Cuomo.

“We want to know what you think,” Earhardt said. “We defeated communist Japan, radical Islamists. We ask our men and our women to go overseas to fight for our country and sacrifice so much for this great country so that we can be the land of the free, the land of the brave.”

“We’re the most generous country in all of the world,” she continued. “Yes, we have our faults. But because of this country, our world is definitely a better place. We are great.”

Co-host Steve Doocy stepped in to correct Earhardt.

“Communism and Japan and so many other things,” Doocy stated.

In fact, Japan was ruled by emperors, not communism, before being defeated in World War II.

It’s been a rough day for Donald Trump supporters, as the president’s former campaign manager and personal attorney both became felons within minutes of each other.

Fox News has spent the whole day spinning the situation, while also focusing attention on a tragic murder case in Iowa.

It got to be too much for host Brett Baer, who ended his Tuesday night segment with a video featuring frolicking puppies.

“After an intense day of news—multiple breaking stories—intense, serious,” Baer said. “Puppies, just puppies.”

Baer then aired the footage of puppies.
