The Supreme Court has had the good sense to ignore the Tenth Amendment. If it overturned popular domestic spending programs on the basis of the Tenth Amendment, the Tenth Amendment would quickly be repealed. Supreme Court justices who ruled on the basis of the Tenth Amendment would be impeached and fired. There might even be a new amendment restricting the power of the Supreme Court. I would certainly welcome that.

It started doing that during the New Deal. American democracy survives.
