    Accuser can’t dictate confirmation process

    9/20/18

The woman accusing Judge Brett Kavanaugh of sexual abuse while they were in high school is in a special kind of hell.

No matter what happens, her life will never be the same. It will be worse. And all those who are using her (or attacking her) should take a moment to remember this. I am talking in particular to you senators Dianne Feinstein and Mazie Hirono. That is also why, even though her name is now public, I am not going to name her here.

That being said, that does not give her the right to control how the Senate responds to this accusation. It is the Senate that has the final decision on confirmation, not the FBI.

Of course, the Senate could ask the FBI for assistance, but it does not have to. The Senate investigates through committee hearings and she does not have the right, either legally or morally, to set her own preconditions to her testimony.

If she wants to press this accusation, she can do so, but she does not get to pick the forum. It is just the same in the criminal context — many victims of sexual crimes would prefer not to testify in open court, but that is just how it is done.

In any event, an investigation by the FBI is likely to be pointless. Given the decades that have passed, the lack of clarity on some key facts (such as exactly when and where), and the absence of any contemporaneous records, I doubt that even the FBI at its best would come out with much more than her accusation and his denial.

This is not to blame her for any of this, but it is just the reality of this investigation or any other. The more time that passes, the less there is that can be accomplished.
I must also point out that this is also a problem for Judge Kavanaugh. No matter how many people he can identify who didn’t see something, that really does not help since the event could have been somewhere or sometime else. I would have difficulty producing an airtight alibi for last Thursday; I don’t see how anyone other than a Benedictine monk could provide an alibi for an entire summer all these years ago.

As I noted last time, society really hasn’t figured out how to respond to these situations, but life must go on. I suppose if she declines to testify, there will be nothing else to do but proceed to a vote. Otherwise, we create an “accuser’s veto” — any candidate for anything can be terminated just based on an accusation.

Oppose it looks like the Maryland attorney General may open his own investigation.

And there is also speculation that Ford might skip the hearing, gather her witnesses and just hold a press conference instead.

And hey guys why did Kavanaugh delete a crucial statement in a speech he made at his old high school when he turned over to committee?

Booker's push for Kavanaugh vote delay called out over his 1992 column detailing teenage groping

Booker touts 'Spartacus moment' over Kavanaugh documents
Mike Emanuel previews the final round of Kavanaugh hearings.

New Jersey Democratic Sen. Cory Booker is facing accusations of hypocrisy over his calls to delay the confirmation vote of Supreme Court nominee Brett Kavanaugh amid sexual misconduct allegations, as he once admitted groping a friend without her consent in high school.

The senator, who urged the Senate Judiciary Committee to first let the FBI conduct an investigation after California professor Christine Blasey Ford accused the high court nominee of sexual assault over 35 years ago, once wrote an article detailing an instance where he groped a female friend.

“New Year's Eve 1984 I will never forget. I was 15. As the ball dropped, I leaned over to hug a friend and she met me instead with an overwhelming kiss. As we fumbled upon the bed, I remember debating my next 'move' as if it were a chess game,” Booker wrote in the student-run Stanford Daily newspaper in 1992.

“With the 'Top Gun' slogan ringing in my head, I slowly reached for her breast. After having my hand pushed away once, I reached my 'mark,’” he continued, without explaining what he meant by “mark.”

"With the 'Top Gun' slogan ringing in my head, I slowly reached for her breast. After having my hand pushed away once, I reached my 'mark.'"

    - Cory Booker
“Our groping ended soon and while no 'relationship' ensued, a friendship did. You see, the next week in school she told me that she was drunk that night and didn't really know what she was doing,” he added.

Booker’s intent of the column was to detail his transformation from a 15-year-old who was “trotting around the bases and stealing second” to someone who was called a “man-hater” over his pro-women views.

“In retrospect, my soliloquy titled ‘The Oppressive Nature of Male Dominated Society and Its Violent Manifestations Rape, Anorexia, Battered Wives’ may have been a surreptitious attempt to convince her that I was a sensitive man, but more likely I was trying to convince myself that my attitudes had changed,” he wrote.

The now-senator came back to the topic a few months later in 1992, penning another article that mentioned the controversial column, which he said was about “date rape,” and admitted that his actions were at odds with his beliefs.

“But by my second column, as I raised my noble pen to address the issue of date rape, I realized that the person holding it wasn't so noble after all,” he wrote. “With this issue as with so many others, a dash of sincere introspection has revealed to me a dangerous gap — a gap between my beliefs and my actions.”

"With this issue as with so many others, a dash of sincere introspection has revealed to me a dangerous gap — a gap between my beliefs and my actions."

    - Cory Booker
The columns by Booker, a potential 2020 presidential contender, have resurfaced after he became one of the leading voices of the Democratic opposition against Kavanaugh’s confirmation.

Following allegations of sexual misconduct against Kavanaugh, which he vehemently denied, Booker said the accusations are “serious, credible, and deeply troubling.” After the committee vote was delayed and Senate Judiciary Committee Chairman Chuck Grassley invited both Ford and Kavanaugh to testify on Monday, Booker called for an FBI investigation before holding a hearing.

Paul Mulshine, a columnist for the Star-Ledger, the largest newspaper in New Jersey, wrote Thursday that Booker’s columns will put him in an awkward position amid the scandal rocking the confirmation hearings.

“Based on that Stanford Daily column, Booker should be giving Kavanaugh the benefit of the doubt as well. The point of it was that the future senator had ‘a wake-up call’ and decided ‘I will never be the same.’”

    Booker’s office pushed back strongly.

“This disingenuous right-wing attack, which has circulated online and in partisan outlets for the past five years, rings hollow to anyone who reads the entirety of Senator Booker’s Stanford Daily column,” a spokesperson for the senator said in a statement to Fox News.

“The column is in fact a direct criticism of a culture that encourages young men to take advantage of women -- written at a time when so candidly discussing these issues was rare -- and speaks to the impact Senator Booker’s experience working to help rape and sexual assault survivors as a college peer counselor had on him.”

DNC co-chair, Minnesota Rep. Keith Ellison denies abuse allegations from ex-girlfriend
By Robert Gearty | Fox News
    [IMG]
Rep. Keith Ellison has been accused of emotional and physical abuse by a former girlfriend. He said it never happened.

The co-chair of the Democratic National Committee, Rep. Keith Ellison, was accused of emotional and physical abuse by an ex-girlfriend who said: "You know you did that to me."

Ellison responded to the allegations Sunday, issuing a brief statement that said, "I never behaved in this way."

The allegations surfaced Saturday night from Karen Monahan after her son alleged in a Facebook post that he had seen text messages from Ellison threatening her and video of the congressman screaming obscenities at her as he dragged her off a bed by her feet, The Associated Press reported.

"My brother and I watched out mom come out of pure hell after getting out of her relationship with Keith Ellison," 25-year-old Austin Monahan said.

On Sunday, Karen Monahan said that what her son posted was the truth.

"Every statement he made was true. @keithellison, you know you did that to me," she tweeted.

Karen Monahan did not respond to a request from The Associated Press asking for copies of the video or text messages.

"Karen and I were in a long-term relationship which ended in 2016, and I still care deeply for her well-being," Ellison said. "This video does not exist because I never behaved in this way, and any characterization otherwise is false."

The allegations come days before Democratic voters choose between Ellison and other candidates in a Tuesday primary for attorney general.

Ellison posted photos to his Twitter account showing him posing with Monahan.

Earlier on Sunday, Ellison’s rivals in the race for attorney general demanded that he respond to the allegations, WCCO-TV reported.

Matt Pelikan and former Minnesota House Speaker Debra Hilstrom called the allegations troubling, the station reported.

Another candidate in the race, former Ramsey County Attorney Tom Foley, said the allegations were serious, according to the station.

“If there are records and video of his interaction with the victim, those materials also should be turned over to law enforcement for immediate investigation,” he said.

The station reported reaching out to Austin Monahan and left a message on the cell phone believed to be his that was not returned.

Hilstrom said in a tweet that Austin Monahan tagged her with his post. She then shared it with her followers.

One thing that might come out of this sleazy Democratic circus; a national discussion of how to deal with allegations of sexual misconduct that are so old they cannot now be proven or disproven.

We have seen that such allegations are a political tactic, not a cry for justice. They are nothing more than character assassination that forever smears the reputation of not only the accused, but the accuser.

Shooter hopes we can find a way to address the accusation without it being used as a political tactic, to understand the accuser's motivation, their pain (if real) and what they hope to accomplish at this late date. We also need to solidify the idea that the accused is innocent until proven guilty, both legally and socially.

Probably it won't happen, but one can only hope.

The only reason Ford's claims cannot be proven or dispronen is because Trump and the Republicans refuse to let the FBI investigate or let Ford call additional witnesses.

And it is very telling to watch the old videos of Grassley and Hatch demand the FBI investigate Anita Hill's accusations and the videos of them refusing to do that now.

It is an obvious set up they are trying to make Ford walk into.

      Look.
The Democrats started this circus. Making demands now of how it should be played out won't work.
That is, until mid terms. Then, Karma.

Nice try. While Congress does have some oversight regarding the FBI, they can't order the FBI or stop the FBI from doing anything. The FBI is a Executive Branch agency. And Trump is simply "not doing" what Democrats and the alt-left media have, in the past, screamed at him about "not doing."

Anytime he even asked "Why am I being investigated and Dems / Hill da Beast aren't, a torturous tide of tantrums were launched at Trump. "The FBI is an independent agency! You're not supposed to tell them what to do / who to investigate."

ny times trump can't tell fbi what to do.jpg

time mag - pres shouldn't tell fbi who to investigate.jpg

Oh, but now...NOW you want Trump to tell the FBI "what to do and who to investigate." And when he doesn't, you fucking cry again.

Someone is very hysterical. The Republicans sure never had any problem with telling President Obama to order the FBI TO reopen security clearance investigations. Which Obama did.

No this is just a set up all the way by Trump and the Republicans to try and ran this through before the truth can come out.

But the latest is Ford's attorney has informed the committee she is willing to testify next week which probably explains the hysterics.

LOL! Grassley has been bending over backwards even offering to have people fly to CA to interview her. Cuz that's what people do who are hysterical, right?

No. People who are scared and hysterical sit on a letter for nearly two months, hoping to get enough Republicans to vote No, and when at the very last minute, as the final vote is about to take place and they know he'll be confired, then AND ONLY THEN, do they pretend to give a shit about the victim, demanding investigations, etc.
