Somewhere around here I commented when it was happening that I could not fucking believe the White House allowed "Acting AG" Whitaker to testify when Barr would be confirmed as the new AG within days. Because there is world of difference between Whitaker sitting there speaking for the DOJ as opposed to just an employee or guy on the street.

    And that is because the Democrats invited Whitaker to come in there and lie to them and he obliged. Which opened another new scandal for Trump and more legal jeopardy for him and Whitaker. Which is why, even though he was supposed to keep working for the DOJ, Trump and the DOJ now have to cut him loose.

    If I was a Trump supporter I would be wondering why one name seems to be coming up in some of the new stories most dangerous to Trump. Where John Kelly is reported to be involved and/or a witness.

    I would wonder if there are any hard feelings between Kelly and Trump. I would wonder why all Kelly has to do to shoot the stories false is just say so but he doesn't.

    Whitaker was criticized by Democrats during his time as acting Attorney General over his testimony to the House Judiciary Committee, who claimed that his responses were intentionally unclear. Whitaker agreed to return to the House Judiciary Committee to further clarify his testimony, which was deemed as "unsatisfactory, incomplete or contradicted" by Charman Jerrold Nadler.

    BUT....

    That very same committee found Cohens testimony so wholesome and truthful that that very same committee is opening up new investigation pertaining to Trump, even though Cohen is going to prison for a few years for lying under oath.

    Just as well, even as Nadler has claimed, we need to further our investigations into Trump just to make sure the U.S. is not being lead by a dictatorship.

    It befumbles me that the locked step leftists that are still agitated by the sand in their vaginas, that they can't see the trees for the forest and this entire charade is laughable at it's core.

    Several investigations by House Democrats into President Donald Trump have pushed beyond the bounds of the “legitimate function of Congress,” Harvard law professor Alan Dershowitz told Fox News host Sean Hannity on his show Tuesday.

    Democrats, who now control the House, have opened up several wide-ranging investigations into Trump, his family, allies, campaign, finances, and conduct in office. Committees have requested documents and witnesses, and have threatened to use subpoenas to get what they needt.

    “Congress has a legitimate oversight function to perform,” Dershowitz, a frequent Trump defender, told Hannity.

    “But it has to make sure it doesn’t go too far. It can’t use that oversight function, which is really designed to help get legislation through, in order to prevent a president from finishing out his term... They’re interfering with the executive branch if they do so.


    “The framers didn’t intend for Congress to become yet another prosecutorial branch, yet another investigative branch. They’re supposed to pass laws. And so it seems to me these investigations look like they’re going too far.”

    On Monday, the House Judiciary Committee announced it was opening another investigation into Trump, probing alleged corruption and abuses of power.

    The committee sent document requests—a precursor to potential subpoenas if the targets do not comply—to 81 individuals and entities linked to Trump.

    Judiciary Committee Chairman Jerrold Nadler, a New York Democrat, said in a statement that Trump had “evaded accountability for his near-daily attacks on our basic legal, ethical and constitutional rules and norms. Investigating these threats to the rule of law is an obligation of Congress and a core function of the House Judiciary Committee.”

    Nadler said his committee had requested documents that had already been shared with special counsel Robert Mueller’s investigation.

    This is in order to “begin building the public record” amid concerns that Justice Department officials “may conceal the work of the special counsel’s investigation,” Nadler said.

    Dershowitz told Hannity that there was “legal recourse” for targets of document requests and subpoenas if they did not wish to comply.

    “If you go back to the cases in the 1950s, the courts sometimes did say, 'Look, Congress, you’ve gone too far. This is not within your legitimate function,'” Dershowitz said, referring back to the anti-communist McCarthy era.

    “And so if I were one of the people who got a letter or a subpoena, I would at least think about the possibility of bringing a lawsuit and suggesting that Congress is abusing its oversight function.”

    During the discussion, Trump ally Hannity spoke of “criminalizing political differences” and said the current situation is “worse than I’ve ever seen it,” thanks to the Democrats’ investigations into Trump.

    “It’s not worse than I’ve ever seen it,” Dershowitz responded. “I lived through the McCarthy period when Congress misused its oversight function to go after people, some innocent, some guilty.”

    Census question on citizenship ruled illegal by 2nd judge

    A San Francisco-based district court judge in the Ninth Circuit on Wednesday ruled that the Trump administration's decision to add a citizenship question to the 2020 census "threatens the very foundation of our democratic system" because it would cause a significant undercount of immigrants and Latinos that could distort the distribution of congressional seats.

    The ruling by Judge Richard Seeborg, which will head to the Ninth Circuit Court of Appeals if challenged by the government, said the Commerce secretary's decision to add the question was arbitrary and capricious and would violate a constitutional requirement that the census accurately count the U.S. population.

    "The record in this case has clearly established that including the citizenship question on the 2020 census is fundamentally counterproductive to the goal of obtaining accurate citizenship data about the public," Seeborg said.

    Seeborg became the second judge to declare the move illegal, so the effect of his decision is limited. A federal judge in New York had previously blocked the administration from adding the question to the population count that occurs every 10 years, and the U.S. Supreme Court last month agreed to review that decision.

    Legal experts have said the Trump administration has a good chance of prevailing at the Supreme Court, where justices appointed by Republican presidents hold a 5-4 majority -- although Chief Justice John Roberts, who has repeatedly and publicly sought to present the court as nonpartisan, remains something of a wild card.

    "There is no credible argument to be made that asking about citizenship subverts the Constitution and federal law," Chapman University law professor and constitutional law expert John Eastman told Fox News last year.

    Eastman added, "I do not believe it would be illegal or unconstitutional for Congress" to go a step further and explicitly "only count citizens" in the census.

    "Indeed, I have argued in a brief filed in the Supreme Court that the 'excluding Indians not taxed' language in the [Constitution's] apportionment clause requires that only citizens be counted. 'Indians not taxed' was the example at the time of those who were not part of the body politic," Eastman said.
