A defamation case against high-profile attorney and Harvard law professor Alan Dershowitz has been settled after two lawyers admitted it was a “mistake” to accuse him of having sex with a minor, their client.

In a statement issued on Friday, Paul G. Cassell and Bradley J. Edwards, lawyers for Virginia Roberts, the woman who alleged she was forced to have sex with Dershowitz and others, said they “acknowledge that it was a mistake to have filed sexual misconduct accusations against Dershowitz.”

“The sexual misconduct accusations made in all public filings...are hereby withdrawn. Dershowitz also withdraws his accusations that Edwards and Cassell acted unethically,” the statement reads,

Last January, Dershowitz filed a sworn statement in which he denied having sex with an underage girl while visiting the island of financier Jeffrey Epstein. Dershowitz was also accused of having sex with a minor on Epstein’s private plane. In that filing, Dershowitz said Jane Doe #3—later identified by Buckingham Palace officials as Roberts—was not on the plane or the island at the same time as him.

In a separate lawsuit, Cassell and Edwards sued Dershowitz for defamation after Dershowitz claimed the two attorneys failed to perform their due diligence when claiming their client, Roberts, was forced to have sex with Dershowitz.

“Edwards and Cassell vigorously denied the contention that they had acted improperly and asserted that it defamed them," said a joint statement from Edwards, Cassell and Dershowitz, issued on Friday. "Dershowitz countersued Edwards and Cassell, alleging they had falsely accused him of sexual contact with Roberts—a claim he vigorously denied and that Dershowitz asserted defamed him.”

“I am pleased that the litigation has concluded,” Dershowitz said in a statement on Friday.

Brad Edwards, Paul Cassell and Alan Dershowitz have today settled their pending defamation claims in which Edwards and Cassell sued Dershowitz and Dershowitz counterclaimed against Edwards and Cassell. The case was about Dershowitz's public claims that Edwards and Cassell, as the attorneys for Virginia Roberts, had failed to perform the necessary due diligence before filing the allegations of their client, not whether the acts of alleged misconduct in fact occurred. Edwards and Cassell vigorously denied the contention that they had acted improperly and asserted that it defamed them. Dershowitz countersued Edwards and Cassell, alleging they had falsely accused him of sexual contact with Roberts—a claim he vigorously denied and that Dershowitz asserted defamed him. Edwards and Cassell maintain that they filed their client's allegations in good faith and performed the necessary due diligence to do so, and have produced documents detailing those efforts. Dershowitz completely denies any such misconduct, while not disputing Roberts's statements that the underlying alleged misconduct may have occurred with someone else. Dershowitz has produced travel and other records for the relevant times which he relies on to establish that he could not have been present when the alleged misconduct occurred. He has also produced other evidence that he relies upon to refute the credibility of the allegations against him.

The parties believe it is time to take advantage of the new information that has come to light on both sides during the litigation and put these matters behind them.

Given the events that have transpired since the filing of the documents in the federal court and in this action in which Dershowitz was accused of sexual misconduct, including the court order striking the allegations in the federal court filings, and the records and other documents produced by the parties, Edwards and Cassell acknowledge that it was a mistake to have filed sexual misconduct accusations against Dershowitz; and the sexual misconduct accusations made in all public filings (including all exhibits) are hereby withdrawn. Dershowitz also withdraws his accusations that Edwards and Cassell acted unethically.

Neither Edwards, Cassell, nor Dershowitz have any intention of repeating the allegations against one another.

Trump ‘won’t survive another week’ if it’s filled with disasters like last week: Fox News’ Judge Napolitano

Conservative Judge Andrew P. Napolitano, known for his commentary on Fox News, hit President Trump supporters with some harsh facts this week via a new syndicated column.

“The president has serious and powerful tormentors whom he cannot overcome by mockery alone,” he wrote. “He needs to do more than demean them with acerbic tweets, because many of those tormentors can legally cause him real harm,” Napolitano continued.

“[Trump] needs to address these issues soberly, directly and maturely…can President Trump survive all this?” the judge asked, then answered with: “Yes — but not if he has another week like the last one.”

The writer and Fox News personality then detailed just how bad Trump’s past few weeks have been, touching first on foreign policy and his failed summit with Kin Jong-Un in Hanoi.

“Mr. Trump’s foreign policy approach is anything but normal,” he wrote. “Mr. Trump knew when he left Washington for Hanoi that there was no agreement between the countries, and he also knew that no agreement was likely…but he believed that the force of his towering personality could produce a meeting of the minds.”

Then the judge hit Trump for his handling of Jared Kushner’s security clearances, which critics say involved Trump inserting himself in the process over the objections of security experts in the FBI who initially denied Kushner a security clearance (for reasons still unknown to the general public).

He called Trump’s alleged behavior regarding over-ruling the FBI and CIA on Kushner’s security status as “extremely dangerous and profoundly unwise.”

Then the judge explained why Trump’s nepotism in this situation was particularly harmful.

“It undermined the intelligence and law enforcement communities, demeaned those who obtained such clearances by hard work and merit, and has exposed the nation’s most carefully guarded secrets to a person who American intelligence believes is naive and susceptible to foreign inducements to reveal what he knows,” he said.

A federal judge in Los Angeles on Thursday dismissed ex-porn star Stormy Daniels’ lawsuit seeking to void a nondisclosure agreement with President Trump about an alleged affair.

“Combined with the attorneys’ fees and sanctions award in the president’s favor totaling $293,000, the president has achieved total victory,” Trump lawyer Charles Harder said, referring to Daniels’ defamation suit. That amount doesn't include the $130,000 payment.

Donald Trump’s inauguration committee accepted $75,000 from mysterious shell companies that disguised the involvement of one foreign contributor and others with foreign ties, The Guardian reports. The three companies allegedly each gave $25,000 to Trump’s inaugural fund. One of the donations was reported to have been made on behalf of London-based Indian financier Cyrus Vandrevala, who appears to not hold U.S. citizenship or residency and could be ineligible to donate. The second was made by a company formed in Georgia by a lobbyist with connections to the Taiwanese government—and one of his daughters was later given an internship in Trump’s White House. The third contribution was made through a company formed anonymously in New York by an Israeli real-estate developer who told the newspaper he held U.S. residency. Federal prosecutors have issued subpoenas to the inaugural committee in recent weeks, demanding information on its contributors and spending.

Trump said big trade deficits proved our leaders were dumb – now he’s got the biggest one in US history

Welcome to another edition of What Fresh Hell?, Raw Story’s roundup of news items that might have become controversies under another regime, but got buried – or were at least under-appreciated – due to the daily firehose of political pratfalls, unhinged tweet storms and other sundry embarrassments coming out of the current White House.

Throughout the 2016 campaign, Donald Trump focused relentlessly on how we needed to reduce our trade deficit, especially with China. It was an odd, even obscure issue to emphasize – some thought that he may have been confusing the trade deficit with the federal budget deficit – but emphasize it he did. For Trump, the trade deficit wasn’t just an economic indicator, its size was also proof of the incompetence – the utter stupidity — of our leadership. It was the feckless politicians who were letting everyone, especially Mexico and “Gina,” rip us off, and only Donald Trump, the master of the Art of the Deal, could fix it.

This, along with the horrors of immigrants coming to the US to pick your produce murder your puppies, were the only truly consistent themes of his 2016 campaign.

As you may have guessed, the Commerce Department announced this week that the US posted an $891.2 billion trade deficit in goods last year, which was, according to WaPo, “the largest in the nation’s 243-year history despite more than two years of President Trump’s ‘America First’ policies.” (The overall deficit, at $621 billion, was somewhat smaller because we had a surplus in services, but it was still the biggest the US has run since 2008.) And as Philip Bump pointed out, while our trade gaps with some countries have narrowed, our deficits with China and Mexico, Trump’s bogeymen on the campaign trail, have actually expanded “dramatically” on his watch.

Oh well — he probably did as well as an intellectually challenged reality TV star could reasonably have been expected to.

This was a busy week for under-the-radar outrages so let’s dig into this week’s roundup.

The Associated Press reported this week that the Pentagon is planning to use $1 billion in funds slated for the troops’ pay and pensions on the stupid border wall that Trump insisted Mexico would pay for. This is unconstitutional on its face but nothing matters anymore.

“Puerto Rico has started cutting benefits paid out by a food stamps program used by more than 1 million of its residents, as federal lawmakers have not provided the island with additional emergency disaster funding amid opposition from the Trump administration,” reported WaPo’s Jeff Stein.

The benefit cut, caused by an impasse among federal lawmakers over aid funding for the U.S. territory, has sparked new fears among Puerto Ricans about a critical lifeline for poorer residents amid an explosion of hunger since the hurricane hit…

The Trump administration had previously dismissed House Democrats’ proposed $600 million plan to extend additional aid as “excessive and unnecessary,” amid a report … that President Trump told top White House officials he did not want a single dollar going to Puerto Rico because he thought the island was not using the money properly and was exploiting the federal government.

The Trump regime’s hostility toward détente in our long Cold War with Cuba has always been kind of inexplicable.

NBC reported that the Trump regime “said Monday it will allow unprecedented lawsuits in American courts against Cuban companies using property seized during the 1959 revolution, as it works to discourage more of the foreign investment in Cuba that provides the island’s economy with a lifeline.”

Vice News dug into Justice Department data and discovered that the Trump regime “is pursuing far fewer civil rights cases — including hate crimes, police bias, and disability rights cases — than the Obama or Bush administration did.” Not exactly shocking news, but good to have on the record.

ICE isn’t the only rogue immigration enforcement agency.

Julia Ainsley reported for NBC that “Customs and Border Protection has compiled a list of 59 mostly American reporters, attorneys and activists who are to be stopped for questioning by border agents when crossing the U.S.-Mexican border at San Diego-area checkpoints, and agents have questioned or arrested at least 21 of them.”

Also, according to NBC, “a federal judge on Friday ruled that the Trump administration is responsible for migrant children separated even before it instituted a ‘zero tolerance’ policy.”

The ruling followed a report from the Department of Health and Human Services Inspector General that found that “potentially thousands” of children were separated from their parents between June 2017 and May 2018, when the Trump administration began prosecuting under the zero tolerance policy all those crossing the border illegally and separating parents from their children in the process.

“For the first time in its history, the U.S. government is detaining more than 50,000 people it says are undocumented immigrants in jails and prisons around the country,” according to The Daily Beast. Most of these people are accused of committing a misdemeanor and could be released pending their hearings. But someone has to keep the private prison business afloat.

And we feel a lot of sympathy for the undocumented workers who have been working for the Trump family for years and are now being unceremoniously fired to obscure the Trump Crime Family’s ubiquitous hypocrisy.

WaPo spoke this week with Juan Quintero, who “lost his golf course job after 18 years of employment — part of a purge of undocumented workers from Trump’s businesses amid revelations that the company relied on illegal labor for years, well into Trump’s presidency. Gone, too, was his side job at the hunting retreat.”

“All of the years you give them, and they just let you go,” Quintero said in a recent interview at his home in Poughkeepsie, N.Y. “They do not say, ‘Let’s do something, let’s try to help you.’ They simply said, ‘Your documents are not valid,’ and that is it.”

Quick follow-up to a story we mentioned last year when The Guardian reported that the Trump regime was moving “to allow marine creatures such as whales and dolphins to be harmed by companies as they search for potential oil and gas reserves off the Atlantic coast.”

Darryl Fears reported for WaPo this week that at a Natural Resources subcommittee hearing, a regime official “testif[ied], over and over, that firing commercial air guns under water every 10 seconds in search of oil and gas deposits over a period of months would have next to no effect on the endangered animals, which use echolocation to communicate, feed, mate and keep track of their babies.” At some point, it seems that Rep. Joe Cunningham (D-SC) had had enough and he pulled out an airhorn and blasted it at the goofball official, who insisted he didn’t find it terribly disruptive.

And finally, in this week’s positive news, a federal judge came down hard on Grifty Commerce Secretary Wilbur Ross for violating the Constitution by inserting a question about citizenship designed to skew the Census results in the GOP’s favor.

Via Law and Crime, Judge Richard Seeborg “awarded a nationwide injunction to the plaintiffs–the State of California and the City of San Jose–in a massive 126-page order, which concluded that the inclusion of the question violated the Administrative Procedure Act (APA) and the Enumeration Clause of the Constitution.”

“In short, the inclusion of the citizenship question on the 2020 Census threatens the very foundation of our democratic system—and does so based on a self-defeating rationale,” he said. “In light of these findings, Defendants do not get another bite at the apple. Defendants are hereby enjoined from including the citizenship question on the 2020 Census, regardless of any technical compliance with the APA.”

REVEALED: Mike Pence cornered as Dick Cheney slams Trump’s foreign policy initiatives

Former Vice President Richard B. Cheney warned Vice President Mike Pence against the dangers of President Donald Trump’s foreign policy, according to a report from The Washington Post.

Cheney said that the rest of the world is losing respect for America as a result of Trump.

“At the closed-door retreat hosted by the American Enterprise Institute on March 9 in Sea Island, Ga., Cheney respectfully but repeatedly and firmly pressed Pence on a number of the president’s foreign policy decisions,” the report said.

“Cheney also worried aloud to Pence that ‘we’re getting into a situation when our friends and allies around the world that we depend upon are going to lack confidence in us,’ and then offered a blunt criticism of the current administration’s response to foreign policy,” the report said.

Trump doesn’t have a functioning White House — and it’s Jared and Ivanka’s fault: MSNBC’s Nicolle Wallace

The panel on MSNBC’s “Deadline: White House” with Nicolle Wallace on Tuesday explained how Jared Kushner and Ivanka Trump are harming Donald Trump’s White House — but can’t leave because Trump’s kids financially reply upon him.

The host introduced the new book, Kushner, Inc. by journalist Vicky Ward, which paints a devasting portrait of Jared and Ivanka, who are both senior White House advisors despite lacking any governmental experience.

“I can’t wait to read it,” noted New York Times editorial board member Maya Gay.

“I think it’s about time that somebody pick a part this narrative that they’ve been so successful at putting out there about themselves, but has no evidence to support it, which is they are a moderating voice on this president or this White House,” she explained. “We know that’s not true.”

“I think there’s something more sinister underneath it for me, which is just the notion that all the ugliness of the president as a human being — and what he’s done to the institution of the presidency — that that could somehow be softened in some way,” she continued. “The images of children in cages, that could be softened by this beautiful young couple who are going to be these voices of reason.”

“I think, because that isn’t the truth behind it, it’s one of most damaging public relations campaign of our time,” Gay concluded.

“The truth is…that Jared and Ivanka are the single, largest repellent of talent inside this West Wing,” Wallace reported. “The reason they can’t recruit a real chief of staff is because Jared and Ivanka run the West Wing.”

“Jared and Ivanka versus whomever, Javanka always wins,” Wallace noted, referring to the portmanteau of the couple’s names.

MSNBC analyst Donny Deutsch said there’s a financial motivation prevent Ivanka or Donald Trump, Jr. from being a moderating factor on their father.

“I interviewed the Trump kids and there was one thing that stood out, the dynamic between the father and the kids. There’s love but it’s employee/employer love,” Deutsch reported. “They can get fired…it’s the same way you have this tremendous affection for a boss, that is affection, but it’s that dynamic.”

“These kids are not independently wealthy. There’s ways that very wealthy set up trusts, by the time they are 35 and 40 they can almost already say screw you dad or mom if they want. Donald Trump is not set up that way.”

“To think in any way Ivanka Trump would be a moderating factor on her father is the same I was saying earlier that the Senate Republicans are not going to be a moderating factor because they want to keep their jobs,” he added.

Trump has been plagued with multiple scandals since he first took office. Trump’s former personal lawyer Michael Cohen sparked several investigations into the president after he testified before Congress.

Deutsche Bank and Investors were subpoenaed by the attorney general office for their relation to the Trump organization.

Trump cried “presidential harassment” on Twitter.
