House Democrats release new report defending Mayorkas against impeachment

Washington — House Democrats released a report on Monday defending Defense Secretary leaving the page." data-wf-tooltip-position="bottom">Alejandro Mayorkas against an impeachment effort they call a "politically motivated sham" aimed at appeasing the far right.

In their 29-page report, which comes ahead of a House Homeland Security Committee vote on a resolution to impeach the cabinet secretary set for Tuesday, Democrats on the committee argued that the impeachment effort is a "total waste of time," stating that it fails to outline any charge that constitutes treason, bribery or other high crimes and misdemeanors — the constitutional basis for impeachment.

"We don't see the high crimes and misdemeanors standard being met," Rep. Bennie Thompson of Mississippi, the top Democrat on the Homeland Security Committee, said in a news conference on Monday. "Democrats are prepared to address the impeachment effort tomorrow with facts. We think history is on our side."

House Republicans released two articles of impeachment against Mayorkas on Sunday, accusing the secretary of "willful and systemic refusal to comply with the law" and a "breach of public trust." But the committee Democrats argue in their report that the impeachment articles fail to provide evidence to support the charges, and they say the effort more broadly has failed to grant due process to Mayorkas and to address "real challenges" at the borders.

"In a process akin to throwing spaghetti at the wall and seeing what sticks, Committee Republicans have cooked up vague, unprecedented grounds to impeach Secretary Mayorkas," the report reads. "The MAGA-led impeachment of Secretary Mayorkas is a baseless sham, and the few rational Republicans left in Congress know that — even if they refuse to admit it."

Congressional Republicans have sought to punish the secretary over the administration's handling of the U.S.-Mexico border, repeatedly accusing Mayorkas of failing to enforce the nation's laws facing a surge of migrants. The committee held two hearings on the impeachment effort this month featuring testimony from attorneys general about the impact of migration on their states, as well as mothers who said their children had died in part because of what they see as failures by Mayorkas to manage the southern border.

Still, Democrats and the Department of Homeland Security have pushed back on the impeachment effort, claiming that it's politically motivated. In a response to the impeachment articles on Sunday, the department said the effort was "a distraction from other vital national security priorities and the work Congress should be doing to actually fix our broken immigration laws."

Nevertheless, House Republicans are moving forward with the impeachment effort, and House Speaker Mike Johnson said last week that the lower chamber will vote on whether to impeach Mayorkas "as soon as possible" after the impeachment articles advance out of committee.

But even if the Republican-controlled House votes to impeach Mayorkas, it remains unlikely that he would be convicted in a Senate trial, where a two-thirds majority of the Democrat-controlled chamber is needed. Still, Mayorkas' impeachment would mark the first of any cabinet official since 1876.

This is what the Democrats are getting much better at than before and it is essential against reality bullies. One of the favorite tactics of treasonous conservative/America Hating/Republicans and one we see around here all the time is instead of arguing what was actually said just make something up and argue that instead. And to defeat that tactic it is essential for people to stand their ground and stick to what they actually said not what some treasonous conservative/America Hating/Republican pretends they said

'Donald Trump was Hitler?' Mayorkas impeachment hearing goes off the rails

Rep. Robert Garcia (D-CA) stood his ground Tuesday after suggesting Donald Trump's rhetoric was like Adolf Hitler.

"Donald Trump speaks about immigrants with the same rhetoric that Hitler did, claiming that immigrants like me and my family, and I quote, pollute the blood of this country," Garcia stated at a House Homeland Security Committee hearing to consider the impeachment of DHS Secretary Alejandro Mayorkas.

Rep. August Pfluger (R-TX) interrupted, but Garcia refused to be stopped.

"I will not yield," he said before noting, "Donald Trump actually has said that he wants to build alligator moats along the border."

After Garcia finished, Pfluger sought to clarify the remarks.

"Can you clarify what you mean by the analogy that you just said that Donald Trump was Hitler?" Pfluger asked.

"Well, when you say that you want to pollute, when immigrants are polluting this country, that to me and the blood of this country, that is absolutely reminiscent of things that Adolf Hitler said," Garcia replied. "And, in fact, his imagery, the way he supports white nationalism, the way he supports white supremacy, and those kinds of comments are completely offensive to immigrants and hopefully to all Americans in this country."

"So just to be clear, you're drawing an analogy between Donald Trump, saying he is like Hitler?" Pfluger pressed.

"I'm drawing an analogy that the rhetoric that Donald Trump uses is very much the rhetoric and the type of rhetoric that Adolf Hitler used," Garcia remarked.

'Go look it up': Dan Goldman schools GOP rep. for distorting Trump impeachments

    David Edwards
    January 30, 2024 4:00PM ET

Rep. Dan Goldman (D-NY) called out his GOP colleagues for misrepresenting Donald Trump's first impeachment.

The remarks came during a House Homeland Security Committee hearing on the possible impeachment of DHS Secretary Alejandro Mayorkas.

In comparing the two impeachments, Rep. Mark Green (R-TN) suggested the so-called Steele dossier prompted the action against Trump.

"I hear you and many of your colleagues completely misrepresenting what that impeachment was about," Goldman asserted. "That impeachment did not include, rely upon, or have anything to do with the Steele dossier."

ALSO READ: It's time Biden sends Trump to Gitmo

Rep. Dan Bishop (R-NC) insisted the Steele dossier — written by a spy and alleging cooperation between Trump and Russia — was used to impeach Trump.

"Go look it up, Mr. Bishop, it did not," Goldman shot back.

"It started with Rudy Giuliani in Ukraine doing Donald Trump's bidding to try to extort the president of Ukraine to open an investigation that would help Donald Trump's political re-election chances," he added.

Ken Buck Says He Opposes Impeaching Alejandro Mayorkas
    Arthur Delaney
Thu, February 1, 2024 at 10:40 AM MST·2 min read
    52

WASHINGTON ― Rep. leaving the page." data-wf-tooltip-position="bottom">Ken Buck (R-Col.) said Thursday that he opposes impeaching Homeland Security Secretary Alejandro Mayorkas.

Republicans are planning an impeachment vote against Mayorkas next week over his alleged deliberate refusal to detain and deport migrants arriving at the southern U.S. border.

Buck said the border chaos doesn’t amount to a high crime or misdemeanor on Mayorkas’ part and that he’s a “solid” no on impeaching him.

“It’s maladministration. He’s terrible, the border is a disaster, but that’s not impeachable,” Buck told reporters outside the House chamber.

Buck’s opposition will make it more difficult for Republicans to push the articles of impeachment through the House. Depending on how many lawmakers might be absent ― two Republicans are currently out for health issues ― it’s theoretically possible that Buck himself could tank the impeachment effort.

As House Speaker Mike Johnson (R-La.) put it on Tuesday, “We have only a tiny, as you know, razor thin, actually a one-vote majority right now in the House.”

It’s possible other Republicans won’t support impeaching Mayorkas. Rep. Tom McClintock (R-Calif.) said Wednesday that he’s undecided. His office did not immediately respond to a request for comment on Thursday.

Buck’s beef with impeachment echoes criticism from many quarters, including from conservative legal scholars, who have said Republicans are bogusly elevating a policy difference into a high crime.

Buck has previously spoken out against the impeachment inquiry against President Joe Biden, saying his colleagues lack evidence. However, he ultimately voted with his party to formally authorize the inquiry last year.

The House Homeland Security Committee voted in favor of the impeachment articles against Mayorkas this week. Buck, who is not a member of the committee, said its chairman, Mark Green (R-Tenn.), visited him at his office to make the case. He said he’s also speaking to people outside of Congress.

“The people that I’m talking to on the outside, constitutional experts, former members, agree that this just isn’t an impeachable offense,” Buck said.

Ken Buck has announced that he is retiring from Congress and is not seeking reelection.
Like a pissed off employee who just quit, he's taking pot shots at everyone as he walks out the door with his pension.

GOP Rep Ken Buck plots scorched-earth exit from Congress (msn.com)
WASHINGTON (AP) — Rep. Ken Buck has had enough.

When the Colorado Republican announced this past week that he would not seek reelection, he began with the type of criticism of Democratic policies that is standard fare for a hard-line conservative. But then Buck turned his ire to fellow Republicans, spending most of the three-minute announcement video accusing them of being “obsessively fixated on retribution and vengeance for contrived injustices of the past.”

Buck’s scorched-earth approach caught few on Capitol Hill by surprise.

With a deadpan demeanor, an independent streak and a background as a federal prosecutor, Buck has gained national prominence as a House Republican fed up with Donald Trump’s lies about the 2020 presidential election he lost to Democrat Joe Biden and the Trump allies in Congress who amplify them. It’s a stand few others in the GOP are taking and is a remarkable turn that shows just how deeply Trump’s once-fringe lies about that race have settled into the Republican mainstream.

Buck regularly appears on networks such as CNN and, with no plans to leave Congress before the end of his term, he probably will be a prominent foil to Republicans during his final months in office. His political heresy extends to the impeachment inquiry into Biden, which Buck has dismissed as baseless.

“Our nation is on a collision course with reality, and a steadfast commitment to truth — even uncomfortable truths — is the only way forward,” Buck said in the video.

Yet under political pressure in Colorado, Buck decided there was no way forward for him in Congress.

Trump celebrated Buck’s impending departure, saying on social media that the congressman “knew long ago he could never win against MAGA, so now he is, like some past and present, auditioning” for a network television job. “MAGA” is short for the 2016 Trump campaign slogan, “Make America Great Again.”

Buck is hardly the first GOP lawmaker to step away from Capitol Hill in frustration in recent years. But unlike other outspoken House Republicans who grew alienated from their colleagues before leaving office, such as former Reps. Liz Cheney of Wyoming or Adam Kinzinger of Illinois, Buck hails from the far-right House Freedom Caucus, putting him at the center of the conservative movement.

Nearly every week, Buck leaves the Capitol complex to attend caucus meetings, where lawmakers strategize about how to disrupt business as usual in Washington. He has proposed drastic budget reductions, strict sanctions against TikTok and cuts for educational material that teaches slavery was central to the nation’s founding.

Buck was also among the eight Republicans who voted to remove Rep. Kevin McCarthy, R-Calif. as speaker and accused him of failing to follow through on his promise to slash spending.

“The critical issue for me is to bend the spending curve and you do that with institutional changes,” Buck told The Associated Press in September. “Nobody has been willing to change this place.”

While Buck in his five House terms has aggressively pushed policy to the right, he has simultaneously resisted what he calls “a populist flavor in the party” that has ascended with Trump.

“Ken is a constitutionalist who tries to make good decisions based on principle,” said Texas Rep. Chip Roy, a fellow caucus member. “I think he’s an important voice, and I’ll certainly miss him.”

Buck has publicly feuded with Rep. Marjorie Taylor Greene, R-Ga., a high-profile Trump ally who calls Buck a “CNN wannabe.” Buck has criticized how Greene and other Republicans have become public advocates for people charged in the Capitol riot on Jan. 6, 2021.

“When I was teaching law school, I learned and taught certain constitutional principles,” Buck told a Denver radio show, referencing his time at the University of Denver. “When Marjorie Taylor Greene was teaching CrossFit, she learned a whole different set of values, evidently, because my idea of what this country should be like is based on the Constitution.” Greene was once a co-owner of CrossFit affiliate gym in Georgia.

Buck’s experience in constitutional law predates his time teaching law school. After completing a bachelor’s degree at Princeton University and a law degree at the University of Wyoming, Buck worked for then-Wyoming Rep. Dick Cheney, who was the top Republican on the committee investigating the Reagan administration for the Iran-Contra affair. Cheney, who is Liz Cheney’s father, eventually issued a minority report that argued that President Ronald Reagan had wide latitude to conduct foreign policy and described the president’s actions as “mistakes in judgment, and nothing more.”

Buck called Iran-Contra a “constitutional crisis” that impressed upon him the importance of Congress not overstepping its powers. He also said a different approach to politics ruled Washington in those days: Democratic and Republican lawmakers were genuinely friends and built trust that led to bipartisan achievements.

Buck later returned to the West and a law career that included directing the criminal division of the U.S. attorney’s office in Colorado. He departed the office after receiving a reprimand for remarks he made about a case to a defense attorney for gun dealers that undermined the prosecution. Buck was later elected as a district attorney in northeast Colorado.

Buck reentered national politics as the tea party gained prominence and he ran seat against Democratic Sen. Michael Bennet in 2010. Buck lost, and Colorado, then a battleground state, has become increasingly dominated by Democrats.

In 2014, Buck made a comeback, winning a House district that spans the entire eastern third of the state, from ranch land to Denver suburbs.

During his five terms in Congress, Buck for a time held a spot on the powerful House Rules Committee, where he sat next to Liz Cheney. He also was the top Republican on the House Judiciary’s antitrust subcommittee. He gained a reputation as a strict conservative who would listen to Democrats and work with them on occasion.

“I’ve always found him to be incredibly straightforward, intellectually curious, willing to disagree without being disagreeable,” said Rep. Joe Neguse, a Colorado Democrat who represents a district adjacent to Buck’s.

Buck formed an unlikely alliance with former Rep. David Cicilline when the Rhode Island Democrat was chairman of the antitrust panel. They managed to advance a series of bills that sought to diminish the power that tech companies such as Amazon, Apple, Meta and Google hold in the online market. Some bills were signed into law by Biden.

Cicilline said Buck defied the will of both Ohio Rep. Jim Jordan, who was the Judiciary Committee’s top Republican and is now the chairman, and McCarthy, who was the House Republican leader before becoming speaker, as Buck worked on the investigations into the tech companies.

“He has demonstrated that he does what he thinks is right, even if it means standing up to his own party leadership,” said Cicilline, who left office in May to head a nonprofit.

In recent weeks, Buck was at the center of moves against both McCarthy and Jordan. He provided a crucial vote to oust McCarthy. Then when hard-line conservatives made Jordan the Republican nominee for speaker, Buck voted against him. Alone among Republicans, Buck said he was opposing Jordan because he had not clearly stated that Biden won the 2020 election.

Buck said opposing Jordan unleashed a wave of vitriol from Republican activists and led to him being evicted from a district office in Colorado.

This past week, Trump called Buck a “weak and ineffective Super RINO,” or Republicans In Name Only. The next day, Buck testified about a legal effort in Colorado to ban Trump from the ballot under the Constitution’s “insurrection clause.” True to form, Buck’s stance defied easy categorization. He testified against banning Trump from the election.

Buck said the events of recent weeks showed him the House no longer allowed for reasonable disagreement.

“This is a real honor to serve here,” he said, “But it’s also a pain in the rear end.”

‘What Changed, Mr. Speaker?’ NBC’s Kristen Welker Confronts Mike Johnson With Brutal Clip Of Him Denouncing ‘Single-Party Impeachment’
    Jennifer Bowers BahneyFeb 4th, 2024, 11:00 am

House Speaker Mike Johnson (R-LA) attempted to explain how the GOP’s impeachment pushes against DHS Secretary Alejandro Mayorkas and President Joe Biden are different than the ones Democrats initiated against Donald Trump when he was president.

Johnson appeared on NBC’s Meet The Press Sunday where anchor Kristen Welker confronted him with his own words on the matters.

“You were, as you just said, part of President Trump’s defense team at his first impeachment,” Welker said. “Here’s what you had to say about impeachment back then.”

Welker then rolled tape of Johnson repeatedly saying that “the founders of this country warned against single-party impeachments.” She included a clip where Johnson concluded, “You know why? Because they feared it would bitterly and perhaps irreparably divide our nation.”

“What changed, Mr. Speaker?” Welker asked.

“Nothing. Nothing’s changed,” Johnson answered. “I would repeat the same refrain over and over because facts are stubborn things that do not change. The Constitution does not change. Impeachment powers, probably the heaviest power that the House of Representatives is given in the Constitution, next to the declaration of war. You can argue it’s the most serious power we have. And it’s not to be used for partisan political purposes. That is exactly what they did for Donald Trump.”

Welker interrupted as the two spoke over each other.

“How is this different? Mr. Speaker, how is this moment different?”

“They telegraphed they were going to impeach Donald Trump before he even took office. It’s very different.”

“If that’s the case, how is this moment different now?” Welker pressed.

“Kristen, in many ways,” Johnson said, continuing:

Let me explain the many ways. For one, the House has methodically, slowly deliberately gone through the impeachment process, impeachment inquiry, on Mayorkas and President Biden himself. We’ve involved three different committees of jurisdiction: Judiciary, Oversight, Ways and Means. We have followed the facts where they have led, not for political purposes, not because we take pleasure in this. It’s again, a heavy thing to look at the impeachment of a president or a cabinet secretary. But these facts require it.

The House of Representatives has the constitutional responsibility of impeachment and it begins with the investigation, and it must be very carefully, methodically done in a non-partisan manner. That is exactly what the House Republican majority has done here. And it is exactly the opposite of what the House Democrats did in the previous administration. That is a fact. and we can follow those facts and understand them for what they are.

Rep. Mark Green (R-T.N.) was busted by his colleague Rep. Joe Neguse (D-C.O.) as he tried to defend the impeachment process against President Joe Biden — using his own words from five years ago when the shoe was on the other foot.

"Chairman Green, I have an editorial here that I want to enter into the record," said Neguse. "The title is, 'Americans are the victims of the impeachment inquiry.' It's an opinion piece. The subtitle is, 'A lot of bipartisan legislation that enjoys widespread support sits gathering dust while Congress focuses on the impeachment inquiry.' I assume you disagree with this?"

    "I do," said Green.

Read Also: The Biden impeachment story is a Trump revenge story

"You do?" said Neguse. "It's interesting. These are your words. This is an editorial that you wrote five years ago, during the debate about the impeachment of former President Trump. It's written by Mark Green, guest columnist in The Tennessean. Local newspaper, I take it, in your state?"

"It is indeed, Nashville," said Green.

"It's fascinating to me that you changed your tune," said Neguse.

The 2019 impeachment of Trump focused on his efforts to threaten the withholding of Ukrainian defense spending to extort that country's president into announcing an investigation of the Biden family. The GOP is currently using its impeachment probe to try to find evidence that Biden laundered international bribes through his son Hunter's business ventures, which even their own witnesses have said they saw no evidence of.

Trump and treasonous conservative/America Hating/Republicans are too stupid, ignorant, and mentally ill to realize they are now like ants under a magnifying glass. Blowing up the border deal they demanded is making most the headlines and so instead of doing anything to help solve the immigration problem they are trying to impeach DHS secretary Alejandro Mayorkas for THEM not doing THEIR jobs. And the American people are clearly seeing that.

Impeachment vote a 'political stunt' to distract from GOP border punt: WaPo reporter

House Republicans are poised to impeach Homeland Security secretary Alejandro Mayorkas over border security, but a congressional reporter said the move was a clearly a "political stunt" to distract from their own legislative inaction.

GOP lawmakers say Mayorkas has “refused to comply” with immigration laws that resulted in a flood of migrants across the U.S.-Mexico border, and Washington Post reporter Jackie Alemany told MSNBC's "Morning Joe" that they appear to have the votes to make him the first sitting Cabinet secretary to be impeached.

"There were a few undecided votes up in the air, but last night, we caught a number of the members, people like congressman Dan Newhouse, who had yet to make a decision, told us last night that he had listened to the hearings, read some of the transcripts over the weekend, and decided he was going to vote for impeaching Mayorkas," Alemany said. "There were a few other undecided people like [Rep.] David Joyce. He also has been reticent in the past to buck party lines. The numbers don't work out for Democrats unless there are unexpected absences. We anticipate this will make it through the House. This is viewed as an easy no-brainer accountability measure, even by vulnerable Republicans who are sitting in those purple Biden districts, who are up for re-election, who are all in support of this and holding Mayorkas accountable."

ALSO READ: Alina Habba is persona non grata at her Pennsylvania law school

At the same time, Senate Republicans appear unlikely to pass a bipartisan border security measure that stands little chance of clearing the House, and Alemany said the impeachment vote was smokescreen.

"It has become a rallying cry," she said. "At the end of the day, especially on a day like today, it's become a distraction measure away from their opposition against a border bill to make it look like Republicans are at least in the House and up to something. But we should be very clear about this: This is completely a political stunt. There is very little support for this in the Senate, it'll likely die in the Senate. After today, I think it's going to continue to be panned by traditionally GOP validators, people like the Wall Street Journal opinion pages, who have already come out against the impeachment of Mayorkas."

    Oh no they didn't.
Yes, yes they did. They're blaming deplorables for the border crisis and for not fixing it.
    Lets get clear on one thing;
The so called border bill, or immigration reform act, or whatever the stupid despicables are calling it, is NOT a solution to the border crisis.
It is a funding bill for Ukraine, Israel, Taiwan and our own Red Sea military.
The bill does shit for securing the border and only a demented despicable would dare claim otherwise.

Their propaganda machine is running at full speed cranking out articles about deplorables being hypocritical of the Mayorkas impeachment, how they wanted funding for Ukraine put in the border bill (a flat out lie, by the way) and diverting attention away from the intent to "legalize" ILLEGAL MIGRANT traffic.

Deplorables are trying to fix the crisis at the border.

For starters, they want to impeach Mayorkas.
That alone solves a good chunk of the problem.

Next they need to impeach brandon.
That will fix a lot of the problem.

Then they need to work out true immigration reform, starting with applications for immigration/asylum be processed ONLY at our overseas offices. All other applications rejected and the applicant deported.

    Well, but didn't you see?
According to the propaganda bullshit coming out of despicable headquarters, the deplorables insisted that the two issues be addressed as one.

That's not what deplorables said, but apparently the distinction is far beyond their ability to comprehend.

What deplorable leaders told despicables was; you need to secure the border before we will talk about more money for Ukraine"
And somehow that became "Ukraine money and a border bill go hand in hand.

See now, why we can't have nice things?

Just too fucking hilarious. First Trump and the treasonous conservative/America Hating/Republicans prove to the whole nation its actually them that want open borders hoping for cheap political points. And then their impeachment scam blows up in their faces.

And I bet this is also why MTG has been freaking out in Congress all day. I bet she knew the had failed.

BREAKING: House Rejects Mayorkas Impeachment Resolution

The House of Representatives voted on Tuesday against impeaching Department of Homeland Security Secretary Alejandro Mayorkas, ending the Republican-led effort to sanction him for what the impeachment resolution called his “willful and systemic refusal to comply with the law.”

However, the failure to impeach may be short-lived.

The vote was 216 against, 214 in favor. Mayorkas would have been just the second cabinet official to be impeached in U.S. history.

Republican lawmakers have been critical of the way Mayorkas and President Joe Biden have handled border security and immigration in general since the beginning of the administration, but not all were on board with the impeachment push.

Last week, Rep. Ken Buck (R-CO) said he would vote against the resolution.

“Well, this is not a high crime or misdemeanor,” Buck stated, referring to the grounds for impeachment in the Constitution. “It’s not an impeachable offense. This is a policy difference.

On Tuesday, Rep. Tom McClintock (R-CA) called the impeachment effort “delusional” and said it fails “to identify an impeachable crime that Mayorkas has committed.”

Rep. Mike Gallagher (R-WI) joined the two in voting “no.” A fourth Republican, Rep. Blake Moore (R-UT) also voted against the measure, but did so for a procedural reason, namely so the vote can be called again at a later date. Republicans would have had the votes necessary to impeach Mayorkas had Rep. Steve Scalise (R-LA), who is having health issues, been present.

GOP lawmakers have been under fire in recent days for seemingly scuttling a Republican-crafted border and immigration bill after former President Donald Trump urged them not to pass it. Trump is aiming to use the issue as a cudgel against Biden on the campaign trail. The gambit, however, undercuts Republicans’ claim that the situation at the border amounts to an emergency and a crisis. Nevertheless, congressional Republicans are heeding Trump’s demand, as Senate Republican leadership appears poised to kill the legislation, with its own author indicating he may vote against it.

McClintock defends vote against Mayorkas impeachment: Greene should ‘read the Constitution’

Rep. Tom McClintock (R-Calif.) on Wednesday defended his decision to vote against the impeachment of Homeland Security Secretary Alejandro Mayorkas after helping sink the move the night before.

Fellow Republican Rep. Marjorie Taylor Greene (Ga.), a leading proponent of Mayorkas’s impeachment, had said McClintock is “clearly” not paying attention to what the American people want. Greene said he is failing his oath of office and urged him to “grow some courage and read the room.”

“Well, instead of reading the room, I’d suggest that maybe she read the Constitution she took an oath to support and defend,” McClintock said on C-SPAN’s “Washington Journal.”

“That Constitution very clearly lays out the grounds for impeachment. This dumbs down those grounds dramatically and would set a precedent that could be turned against the conservatives on the Supreme Court or a future Republican administration the moment the Democrats take control of the Congress,” he continued.

McClintock published a 10-page memo Tuesday that offered criticism of Mayorkas, who has become the face of the Biden administration’s handling of immigration at the southern border. In the memo, he said the Republican Party had failed to identify an impeachable crime.

“Clearly the founders worried that the power of impeachment could be used to settle political disputes and so searched for limiting language to avoid such abuse,” he wrote.

In a stunning vote Tuesday evening, the effort to impeach Mayorkas failed 214-216. McClintock was joined by GOP Reps. Ken Buck (Colo.) and Mike Gallagher (Wis.) in siding with all Democrats to block the move.

A fourth Republican, Rep. Blake Moore (Utah), flipped his vote to “no” seconds before the vote closed as a procedural move that allows the party to bring the legislation back at a later date.

Mia Ehrenberg, a Department of Homeland Security spokesperson, said in a statement: “This baseless impeachment should never have moved forward; it faces bipartisan opposition and legal experts resoundingly say it is unconstitutional.”
