COL. MORRIS DAVIS, FMR. GITMO CHIEF PROSECUTOR: ...In 12 years, we could never charge these guys. We had no evidence to charge them. The Taliban -- clearly, they were affiliated with the Taliban. It would make sense they would ask for them back. Our legal basis to detain them is going to run out at the end of the year with the close of the Afghan war.

OK, now what Col. Morris Davis is saying here is that with the law written as it is the United States would have had to release the five Taliban members pretty soon anyway.

I think the law is badly written, but Davis is a lawyer; I am not.

I also think President Obama could have done a better job of explaining this himself.

The War on Terror is going to last much longer than American involvement in Afghanistan. The Taliban have not surrendered. They have not signed a peace treaty. We need new laws to deal with murky situations like this. According to Col. Morris Davis the laws do not currently exist.

If it would have been a republican president then the democrats would be demanding he be impeached and the republicans would be wanting to make a saint out of him.

I wouldn't be so sure about Democrats, especially those facing a November ballot fight, will be signing the papers nominating him for sainthood. The Obamacare issue alone was enough for many of them to find reasons to be anywhere but where he was if he came to their state. The VA scandal only added to their worry. Now this.

Of course, you can always be sure that Obama's chief sack suckers, like the more-senile-by-the-day Harry Reid, and XNXX's own Stumbelina and magic4589 will attest to the anointed one's infallibility. They can scream "VAST RIGHT-WING CONSPIRACY" all day long. But with each new incident, Americans are coming to grips with the fact that the emperor has no clothes. And, at this point, many Congressional Democrats are more worried about their own long-term survival.

Bergdahl Case Shakes Democrats’ Confidence in Administration

WASHINGTON — President Obama’s handling of the Bergdahl prisoner exchange has renewed frustration among congressional Democrats about the administration’s relations with its allies on Capitol Hill, and prompted criticism that the White House failed to prepare the lawmakers for the politically explosive case.

While Senator Dianne Feinstein, the California Democrat who leads the Intelligence Committee, went public with her dissatisfaction at not being notified in advance about the exchange, other lawmakers and officials said privately that Democrats felt exposed by their lack of knowledge about the circumstances surrounding Sgt. Bowe Bergdahl’s capture and the backgrounds of the five Taliban officials traded for his freedom.

The chain of events, coming after days of contending with a searing scandal at the Department of Veterans Affairs and coupled with some Democratic unrest over new proposed rules on power plant emissions, has some Democrats questioning the effectiveness of the administration’s team and its ability to help them get on the offensive with a midterm election just months away.

Politicians Delete Digital Praise of Bowe Bergdahl Release

Republicans have widely criticized the Obama administration for swapping five high-level Taliban prisoners for Bergdahl, who many believe defected from his base because he was unhappy with the U.S. military’s actions in Afghanistan.

But before those criticisms mounted, some members of the GOP didn't hesitate to welcome Bergdahl's release with open arms.

"A grateful nation welcomes the news of the return of Sgt. Bowe Bergdahl," Rep. Lee Terry (R-NE) said in a statement that's since been removed from his website.
"I have the pleasure of regularly speaking with our nation's active duty military and veterans and I know that there is nothing more solemn than the pledge to never leave one of their own behind on the field of battle," Terry said in the statement, before calling Bergdahl "a national hero."
A tweet sent from the congressman's account still stands, calling Bergdahl's release "wonderful news."

Rep. Mark Amodei (R-NV) seemed excited when he heard the news, too.
"Best news I've heard in a long time!" the Twitter account for the Republican congressman said, including the hashtag "#standwithbowe" and a link to a USA Today story about the soldier's release.

That tweet has since been removed from his account, too.

Joni Ernst, the leading Republican candidate hoping to replace retiring Sen. Tom Harkin in Iowa, tweeted at 3:31 p.m. on May 31, "US Army Sgt. Bowe Bergdahl freed after being reported missing 5 yrs in Afghanistan. Thoughts & prayers go out to Sgt. Bergdahl & his family."
