Former Justice Department official and ex-federal prosecutor Harry Litman noted the latest court filing by special counsel Jack Smith on Thanksgiving day. He joined MSNBC's Nicolle Wallace in saying the tone was the part that really made him take notice.

"They made a misrepresentation of what a case stood for," Litman said about Donald Trump's lawyers. "It's the kind of thing, you're new to the case, maybe people would say, 'You know, don't jump in here, Jack. Show that you're prudent. Don't want to look too combative, Jack Smith.' Uh-uh. He came right back with that paragraph that sounded around the world, not just in that court, holding their feet to the fire. And he's got a reputation for being aggressive. This was an aggressive move. They were wrong but he could have thought the court will figure it out, don't come in guns a' blazing. He did, however. And I think it's a real indication of the kind of special counsel he's going to be."

Former Sen. Claire McCaskill (R-MO) agreed, noting that all of the people she spoke to anticipated it would result in legal fireworks.

"I got on the phone after he was appointed and called around to some people who have worked at DOJ," McCaskill revealed. "And I think Harry would agree with me that he has an incredibly strong reputation. And this is a guy who is a slave to the law, period. Just the law. not any of the political machinations that we like to talk about on this show. And he's a real prosecutor. He actually -- I don't mean to besmirch my friends in the feds, but many of them don't have a lot of experience up close and personal with juries. They do a lot on paper but they don't do as much courtroom work. But Jack Smith is the real deal. And I think he's going to do a great job."

Trump has already been in meltdown mode over Smith and has gone on the attack against Smith's wife and her family. Republicans have responded by threatening to defund the special counsel.

On Thursday, the U.S. Court of Appeal for the Eleventh Circuit struck a catastrophic blow to former President Donald Trump, completely ending the special master review of the documents seized by FBI agents in the search of Mar-a-Lago for classified material.

The ruling is a complete repudiation of Trump-appointed District Judge Aileen Cannon, who ordered the review in the first place, said Palm Beach County Attorney Dave Aronberg on MSNBC's "The Beat."

"For folks just catching the news and your view of it, given there was so much back and forth, tell us in plain English what this ruling means to you," said anchor Ari Melber.

"This is a smackdown," said Aronberg. "It says that Judge Cannon should never have exercised jurisdiction over this matter. Remember, Judge Cannon is in a county, two counties away, 68 miles from West Palm Beach. She inserted herself into this case when it was in the hands of Magistrate Judge Bruce Reinhardt. That's what Trump's team wanted. She took jurisdiction and then she gave them everything they wanted including a special master, including a stay of the proceedings and the appellate court said no, no, no. You have no jurisdiction here. You should not have appointed the special master. You should not have delayed the investigation because this sets a bad precedent, and Donald Trump doesn't get special privileges because he's a former president."

The consequence of the ruling, added Aronberg, is that "Donald Trump is going to go through some things" and "this case is game on."

"I think what this [ruling] does is it speeds up the charges," said Aronberg. "I have felt that Trump will be indicted for the documents matter; now that this is out of the way, that's one more obstacle gone. I think charges will be coming at some point after the [Georgia Senate] runoff."

'Beyond nuts': MSNBC panel stunned as Trump lawyers scramble to avoid paying price for his lies

A panel discussion hosted by MSNBC's Chris Hayes on Thursday descended into disbelief at the current state of legal representation on behalf of former President Donald Trump.

Hayes started off by recounting new reporting indicating that the United States Department of Justice has moved to hold Trump's office in contempt for repeatedly providing false assurances that all classified documents requested by the government had been turned over.

Former U.S. Attorney Harry Litman told Hayes he was particularly struck by the fact that none of Trump's attorneys has been willing to become his official custodian of records, as they apparently do not trust him enough to be truthful.

"This is so indicative of who Trump is as a person and a client," he said. "Everybody has a custodian of records. Crime bosses have a custodian of records! There is always someone who can do this!"

He then speculated that recently appointed special counsel Jack Smith pushed for the Trump team to be held in contempt to show that the DOJ is finished getting "diddled around."

"This is beyond nuts," he commented.

Hayes compared being Trump's custodian of records to being a drummer for the legendary parody band Spinal Tap, as whatever musician agreed to play drums for the band was destined to meet a grisly end, often in the form of spontaneous combustion during performances.

I don't know about this. A month isn't much time. And I am sure the DOJ will not charge Trump for his attempted coup and armed violent deadly insurrection within a month. That would be an extremely complex case. But the DOJ does appear to be moving swiftly and decisively on the stolen documents case. We will have to just wait and see if Preet Bharara knows what he is talking about or not.

A former federal prosecutor said that the DOJ has a team of "seasoned" prosecutors who are "on a path" to charging former President Donald Trump.

Preet Bharara said on NBC's "Meet the Press" on Sunday that a team of "very seasoned" federal legal investigators was assigned to investigate Trump in connection with two criminal cases and that Trump may be facing charges within one month. Federal investigators are looking into Trump's actions leading up to the Capitol Riot on January 6, 2021, and his alleged mishandling of classified documents at his Mar-a-Lago home.



"I don't think they would've left their former positions, both in government and private practice, unless there was a serious possibility that the Justice Department was on a path to charge," said Bharara. "And I think it'll happen in a month."

Bharara, a former US Attorney for the Southern District of New York, said the government "generally do not proceed" in charging cases "unless you have a great likelihood of success."

Bharara said he thinks the government could have a good case against Trump.

"I think you want to have an exceptionally strong case," Bharara said on "Meet the Press." "To show not just the jury in the case but the public at large that it was a righteous case, it was a meritorious case and you have the goods."

Special counsel Jack Smith is already 'moving fast' on Trump criminal probes much differently than Robert Mueller: report

According to a report from CNN, newly appointed special counsel Jack Smith has hit the ground running after taking over at least two criminal probes into Donald Trump's links to the Jan. 6 insurrection and his hiding of government documents at Mar-a-Lago.

As the report notes, Smith will not follow in the footsteps of former special counsel Robert Mueller in how he deals with Trump's criminality and will instead conduct in the management style of a U.S. Attorney.

CNN reports, "Smith takes over a staff that’s already nearly twice the size of Robert Mueller’s team of lawyers who worked on the Russia probe. A team of 20 prosecutors investigating January 6 and the effort to overturn the 2020 election is in the process of moving to work under Smith, according to multiple people familiar with the team," before adding, "According to several people familiar with his appointment, Smith will operate more like a US Attorney – managing an existing team of career prosecutors already working on the cases, and signing off on evidence they bring him – rather than as a de facto-department head like Mueller, who tapped several lawyers from outside the Justice Department to pursue parts of the Russia investigation from scratch."

Opinions among Trump lawyers vary on what to expect from the prosecutor who was recalled from Europe by Attorney General Merrick Garland to take over investigating the former president.

According to one Trump insider, some attorneys for the former president think it's a good sign Smith has been working in Europe since the Jan. 6 insurrection.

“The fact that they found a guy who has been in Europe for the past several years, without his brain marinating in the soup of January 6th coverage, that’s a good thing,” they explained.

That runs counter to those surrounding Trump who"are concerned that Smith’s appointment signals a more aggressive stance from Attorney General Merrick Garland, characterizing him as a 'hit man' who is likely to bring a prosecution."

We should all pitch in and help the federal government retrieve classified information from former President Donald Trump in Florida.

I say this in light of the recent news that Trump has kept classified materials not only at Mar-a-Lago, but also in a storage unit nearby in West Palm Beach.

These were among pallets of boxes that were shipped to Florida in September of last year, the Washington Post reported. And the documents in the storage unit were mixed with other Trump keepsakes, including “suits and swords and wrestling belts and all sorts of things.”

Wrestling mementos from Trump not going to be easy
I’ll be the first one to say that we shouldn’t try to separate Trump from any wrestling belts he has collected from his time in the White House. Get all the classified material back. And yes, go beyond that.

While you’re at it, retrieve purloined silverware, duvets from the Lincoln bedroom, and any missing portraits from the White House walls.

But leave the man his fake wrestling treasures.

Trump is in legal jeopardy for failing to turn over classified documents he kept from his tenure in the White House. For more than a year, the National Archives has been asking him to turn over everything. And Trump has yet to fully comply.

His lawyers, fearing charges of perjury against themselves, won’t even attest to the courts that Trump has turned over all the government secrets he took with him.

I sympathize with Trump on this to some extent — particularly when I heard he had a storage unit.

The surest way to forget what you have is to put it in a storage unit. Storage units are air-conditioned garbage cans. They are reassuring purgatories for hoarders, expensive reminders of a personal failure, an inability to throw away stuff that has outlived its usefulness.

I know. I have a storage unit. It’s inside one of those giant mausoleums for useless crap that dot the South Florida landscape. Every once in a while I visit my storage space.

It’s like a prison visit. You pass through a series of coded security portals, and find the cage where your stuff is being held in open-ended detention like a political prisoner in Russia.

Storage units are monuments to personal shortcomings

Mar-a-Lago has 58 bedrooms, 33 bathrooms and three bomb shelters so why would former President Donald Trump need a storage locker in West Palm Beach?
Hello, bad golf clubs, the couch nobody wants, and walls of boxes containing who-knows-what. Push over, ugly old coffee table, here come some more VHS tapes and a hundred pounds of old McDonald’s Happy Meal toys in a plastic bin.

It’s plausible that Trump may have forgotten what’s in his storage unit. It wouldn’t surprise me. Under the penalty of perjury, I would “take the fifth” rather than swear what’s in mine.

Could be almost anything. Although, probably not any wrestling belts or government secrets.

All I know is that I used to have a smaller unit and now I have a bigger one.

That’s because I don’t live in Mar-a-Lago. I live in a four-bedroom house with a one-car garage that is, in itself, a storage space for lots of things — so many that there’s no room for a car in it.

But for Trump to need a storage unit to absorb the overflow from Mar-a-Lago, well, that’s a lot of hoarding. You’d think he’d be able to store all his excess stuff right there at his Florida home.

He lives in a hoarder's paradise. Mar-a-Lago has 58 bedrooms, 33 bathrooms and three bomb shelters.

I’m a big advocate of keeping all the bathroom options in play, but c’mon, Mar-a-Lago ought to provide enough stash spots for anybody, even somebody who thinks everything within his grasp is his.

Trump needs a lifestyle coach, not another lawyer
Or, to put it another way: If you’ve got Mar-a-Lago and still need a storage locker in West Palm Beach, you’ve got a problem.

That’s why I think Trump needs to redirect his energies. Forget focusing on Justice Department special counsel Jack Smith, and start focusing on Marie Kondo.

Kondo is the author of “The Life-Changing Magic of Tidying Up” and an authority on throwing stuff away. She has a five-step method of decluttering your life.

The key is to keep only those things that “spark joy”, Kondo says.

So, for Trump, this would mean, hypothetically, he’d keep the autographed bone saw from the Saudis, but throw out all but one of his fake Time magazine covers with imaginary glowing stories about him.

A good sign for an improvement in Trump's mental health would be the appearance of a big rollaway dumpster in the driveway of Mar-a-Lago.

In the meantime, if you have a storage unit in West Palm Beach, the next time you visit your stuff, look around and see if there are any top-secret government documents sitting in a corner somewhere.

Look underneath the wrestling belts.

During an appearance on MSNBC on Saturday afternoon, a former staffer at the National Counterterrorism Center expressed dismay and alarm at photos published by the New York Times showing guests at Donald Trump's Mar-a-Lago within feet of a storage room containing government documents the former president took with him when he lost the 2022 presidential election.

Speaking with host Alex Witt, Oliva Troye -- who served as an adviser to former Vice President Mike Pence, was stunned by the national security implications and advised the DOJ to dig deeper into the thousands of Mar-a-Lago visitors who might have had access.

Asked by the MSNBC host, "How dangerous is this" Troye replied, "It's completely reckless. and this is a complete slap in the face for every military intelligence officer that has ever served. It is a betrayal of our entire national security committee community to think that former commander-in-chief did this to us and, when I see these images, actually it pains me."

"I get physically ill because I think of the potential damage for people out there on the field, potential damage to things that have been in the works for decades," she continued. "Things that people give their lives for -- Fathers, mothers, daughters, sons. I mean, people who have served. That is what I think about."

"At this point, I would be looking at money trails here," she advised. "Because how did people not know that this was there? Certainly, someone did. Where did those documents go, where does that lead to, why were they there, and who benefited from this?"

Calling the FBI the Gestapo for daring to investigate Trump is one way to measure just how much treasonous conservative/America Hating/Republicans hate the United States of America. The FBI is far from perfect but they are still the best law enforcement organization in world and protect the citizens of the United States of America every hour of every day.

And most legal experts especially former prosecutors are saying this is a very big deal. Because these are the kind of people Trump would not even notice. But their eyes and ears are everywhere every day. And they see and hear a lot. With what I think could be another factor. Trump appears to be a real asshole to work for. So they might welcome the chance to tell Jack Smith what they know.

At least two dozen people – from Mar-a-Lago resort staff to members of Donald Trump’s inner circle at the Florida estate – have been subpoenaed to testify to a federal grand jury that’s investigating the former president’s handling of classified documents, multiple sources familiar with the investigation told CNN.

On Thursday, Trump’s communications aide Margo Martin, who worked in the White House and then moved with Trump to Florida, appeared before the grand jury in Washington, DC. One of special counsel Jack Smith’s senior-most prosecutors was involved in the interview.

Martin, who is among a small group of former White House advisers who have remained employed by Trump after he left office, declined to answer any questions when approached by a CNN reporter.

Smith has sought testimony from a range of people close to Trump – from his own attorneys who represent him in the matter to staffers who work on the grounds of Mar-a-Lago, including a housekeeper and restaurant servers, sources said.







There's a new chief judge in DC who could help determine the fate of Donald Trump

The staffers are of interest to investigators because of what they may have seen or heard while on their daily duties around the estate, including whether they saw boxes or documents in Trump’s office suite or elsewhere.

“They’re casting an extremely wide net – anyone and everyone who might have seen something,” said one source familiar with the Justice Department’s efforts.

For instance, federal investigators have talked to a Mar-a-Lago staff member seen on security camera footage moving boxes from a storage room with Trump aide Walt Nauta, who has already spoken with investigators.

Many of the Mar-a-Lago staffers are being represented by counsel paid for by Trump entities, according to sources and federal elections records.

The Justice Department has been investigating potential mishandling of national security records and possible obstruction for about a year. FBI agents recovered more than 100 classified documents during a search of Mar-a-Lago last summer. Since then, Trump’s legal team has turned over additional classified material.

The federal probe previously subpoenaed top Trump advisers, such as former White House deputy chief of staff Dan Scavino and former Trump adviser and Pentagon official Kash Patel.

Meanwhile, Smith continues to pursue Trump defense lawyer Evan Corcoran. In an earlier appearance before the grand jury, Corcoran declined to answer questions about his conversations with Trump related to the classified documents, citing attorney-client privilege. Prosecutors are asking a judge to find that he must answer because the conversations may have been part of advancing a crime or fraud.

A ruling is expected from the DC District Court on Corcoran as early as this week.
