Accused Paul Pelosi attacker was caught up in conspiracies: Defense attorney

The defense attorney for a man accused of attacking former Speaker Nancy Pelosi’s (D-Calif.) husband, Paul Pelosi, in October, 2022, said on Thursday that David DePape was caught up in conspiracy theories.

Jodi Linker, who represents DePape in a trial that began earlier this week in San Francisco, said that she isn’t disputing DePape’s attack on Paul Pelosi, 82. She added that she will argue DePape believed “with every ounce of his being” he was trying to end government corruption and child abuse from politicians and actors.

“This is not a ‘whodunit.’ But what the government fails to acknowledge is the ‘whydunit,’ and the why matters in this case,” Linken said, according to The Associated Press.

DePape has pleaded not guilty to attempted kidnapping of a federal official and assault on the immediate family member of a federal official with intent to retaliate against the official for performance of their duties. Linker’s central piece of her argument is that DePape wasn’t targeting the former Speaker in an attempt to stop her from her official work.

“These beliefs matter because both charges require that the government prove that Mr. DePape acted because of her performance of her official duties as a member of Congress,” Linker said, according to the AP.

Laura Vartain Horn, a federal prosecutor, told jurors that DePape began planning his attack in August, 2022, and that evidence and testimony from the FBI will show he researched his alleged targets online, worked on collecting phone numbers and addresses and went so far as to pay a public records service for information on Nancy Pelosi, among others.

During her opening statement, Vartain Horn showed a picture of Paul Pelosi in a pool of blood, and played a call by DePape to a television station in which he repeated conspiracy theories.

“The evidence in this case is going show that when the defendant used this hammer to break into the Pelosi’s home he intended to kidnap Nancy Pelosi,” Vartain Horn said, holding a hammer in an evidence bag, according to the AP.

Muslim student run down in a crosswalk for wearing a shirt with Arabic script: police

The Santa Clara County Sheriff's Office is seeking a suspect who allegedly attacked a Muslim student at Stanford University with his car and drove away, reported Bay City News.

"The collision is being investigated as a hate crime, because the suspect reportedly yelled 'F--- you and your people' out the window of his vehicle after making eye contact with the man, accelerating, and striking him as he crossed the intersection of Campus Drive and Ayrshire Farm Lane," said the report.

The victim was taken to the hospital after the suspect fled. He has survived the injuries sustained in the alleged attack.

The victim identified the suspect as a "white, unshaven adult male in his mid-20s" wearing glasses and a gray top, and driving a "black Toyota SUV with a tire mounted on the rear," which likely now has passenger-side bumper damage from striking the victim.

The brutal terrorist attack against Israel by Hamas and the subsequent war in Gaza has resulted in a flaring of rage around the United States, accompanied by both antisemitic and Islamophobic assaults and other incidents.

In Illinois, a landlord faces hate crime charges after allegedly stabbing a 6-year-old Palestinian Muslim boy to death with a military knife, and then stabbing his mother, causing her severe injuries. Meanwhile, in Indianapolis, a woman carried out a vehicle-ramming terrorist attack on what she thought was a Jewish school, but which turned out to actually be a headquarters for the Radical Hebrew Israelites, an antisemitic hate group.

Capitol riot defendant planned to kill FBI agents who investigated him, unsealed filing alleges
Edward Kelley, 33, of Tennessee is accused of planning to kill the federal agents who worked on his investigation and attack the FBI’s field office in Knoxville.

    Zoë Richards and Michael Kosnar

A Tennessee man who was previously charged in connection with the Capitol riot is now facing conspiracy and other charges after allegedly obtaining a copy of a list of law enforcement personnel who played a role in his criminal investigation and discussing plans to kill them, according to a court filing unsealed Friday.

The criminal complaint against Edward Kelley, 33, of Maryville says he obtained the names of law enforcement personnel involved in the probe that led to his initial arrest, and discussed plans to kill them and attack the FBI's field office in Knoxville. Austin Carter, 26, of Knoxville is listed as a co-defendant.

The pair was charged with conspiracy, retaliating against a federal official, interstate communication of a threat, and solicitation to commit a crime of violence.

Kelley and Carter made their initial appearance in federal court in Knoxville on Friday.

Kelley was already facing charges in U.S. District Court for the District of Columbia after he was arrested in Knoxville on May 5 on allegations that he assaulted a law enforcement officer during the Jan. 6 riot at the Capitol. He was released a week later on a personal recognizance bond.

According to the new court filing, the FBI's Knoxville office had opened an investigation and assigned agents to Kelley's case after receiving information about his potential involvement at the Capitol on Jan. 6.

A cooperating witness earlier this week presented authorities with a printed document including about 37 names, positions and in some cases phone numbers of law enforcement personnel involved in the criminal investigation, the filing states. The list also identified which officers were present when Kelley was arrested in May, according to the filing.

The witness allegedly told investigators that Kelley discussed collecting intelligence on law enforcement involved in the case and shared plans to kill personnel on the list, saying, “With us being such a small group, we will mainly conduct recon missions and assassination missions.”

Both Kelley and Carter have been detained. Carter has a detention hearing scheduled for Wednesday.

Marina Medvin, who has been representing Kelley in the Jan. 6 charges, did not immediately respond to a request for comment. Medvin on Friday filed a motion seeking to withdraw as Kelley's attorney.

More than 850 defendants have been arrested on Jan. 6 charges ranging from misdemeanor parading to felony seditious conspiracy.

‘Actual incitement’: Former DOJ official warns on Trump’s latest post

David Badash, The New Civil Rights Movement
    November 14, 2023 12:28PM ET

Former President Donald Trump (Gage Skidmore/Creative Commons)

A former top U.S. Dept. of Justice official issued a warning on one of Donald Trump's latest social media posts, saying it is an "actual incitement to break the law," and "it greatly endangers" the judge and attorney general in his New York State civil business fraud case.

On his Truth Social platform, Trump reposted another user's post that reads, in all-caps: "My fantasy," and then: "I would like to see Lititia [sic] James and Judge Engoron placed under citizens arrest for blatant election interference and harassment."

Harry Litman, who also served as a U.S. Attorney, and teaches law, wrote Tuesday morning: "Sometimes [Trump] says incendiary things that his followers act on, as in 'will be wild.' This is an actual incitement to break the law and it greatly endangers the judge and AG."

Citing MSNBC legal analyst Lisa Rubin, MSNBC executive producer Kyle Griffin added: "New York law only allows for a citizen's arrest when a person has 'in fact' committed a felony in the presence of that citizen."

READ MORE: ‘Inflation Was Literally Zero’: Economists Thrilled With Latest Report

The Messenger's senior legal correspondent, Adam Klasfeld, commenting on the post wrote:

"1) Engoron said his 'chambers have been inundated with hundreds of harassing and threatening phone calls, voicemails, emails, letters and packages' since trial began. 2) His gag order currently doesn't prevent Trump from attacking him anyway."

Attorney Jonathan Turley declares the call for a citizen's arrest, "a dangerous (and uninformed) suggestion that some could easily take seriously. That is particularly the case after the reckless attacks of Trump on critics as 'vermin' and pledging to go after them if reelected."

"Just in case anyone is taking such a statement as more than a fantasy," Turley adds, "there is no basis for a citizen’s arrest and such an effort to physically hold either the judge or the attorney general would most certainly constitute a criminal act."

And of course it again proves the adage that
What a deplorable does is criminal.
What a despicable does is politics.

How many times do we have to show Pelosi offering to punch out Trump, or Biden wanting to take him "out behind the woodshed" or Maxine Waters calling for violence on deplorables, in particular anyone supporting Trump.

Or how about Hillary saying there was no need for people to be civil to deplorables until the despicables had won back Washington?
Or how about Eric Holder saying when they go low, to hell with going high, we kick them.

But they've gotten violent, these despicables have.
In 2017 one of Bernie Sanders supporters blasted away at a practice for deplorable congressional baseball players, injuring representative Steve Scalise and three other people.
During the Kavanaugh debacle Senator Susan Collins had an envelope with deadly Ricin mailed to her.
And in Laramie Wyoming the deplorable campaign office was torched.

How Trump’s 'fascination' with violence led to 'unhinged Republican behavior': expert

    Carl Gibson, AlterNet
    November 16, 2023 2:32PM ET

    (Photo via AFP)

A former federal prosecutor is arguing that the recent spate of violent and aggressive behavior seen in the halls of Congress is a byproduct of former President Donald Trump's belligerent brand of politics.

Writing for The Bulwark, Dennis Aftergut — a former assistant US Attorney for the Northern District of California — made the case that journalists shouldn't be afraid to link Trump's bellicose rhetoric to Republicans' increasingly hostile demeanor. Aftergut pointed to former Speaker Kevin McCarthy's (R-CA) "sucker-elbow" of Rep. Tim Burchett (R-TN) in a U.S. Capitol hallway and Sen. Markwayne Mullin (R-OK) attempting to fight International Brotherhood of Teamsters president Sean O'Brien in a Senate hearing as examples.

"Before Tuesday’s unhinged Republican behavior recedes from memory, it’s worth emphasizing one aspect of it that has been underappreciated in the press coverage: that it didn’t happen in a void, but rather fits into larger patterns in the world of Donald Trump," Aftergut wrote.

"Time and again, Trump has issued permission slips to those who practice violence. His fascination with the use of force, including by violent militias like the Oath Keepers and Proud Boys, is well documented. Tuesday’s events can only really be understood in that larger context of Trump and violence."

Aftergut wrote that Trump has made political violence a part of his brand. He underscored this by pointing to Trump encouraging his supporters to carry out acts of violence against protesters at his rallies, referring to violent white supremacists in Charlottesville, Virginia as "very fine people" in his first year as president, and his "three hours of diddling" while a crowd of his supporters ransacked the US Capitol on January 6, 2021, attacked police officers, and chanted "hang Mike Pence."

"ALL OF THESE TRUMPIAN MOMENTS — and countless others one could name — create an environment in which political violence becomes acceptable, and in which it’s okay to coldcock someone you don’t like in a Capitol hallway or to challenge an adversary to put up his dukes in a hearing room of what was once known as the world’s 'greatest deliberative body,'" Aftergut wrote.

"There is no reason to think we won’t see more such political pugnacity on the right as the 2024 campaign continues. Journalists should not be shy about connecting the dots between the vile words of Trump and the violent actions of his Republican followers."

In his essay, Aftergut made the observation that Congress hasn't seen such acts of violence among its members since a pro-slavery senator's brutal caning attack on an abolitionist colleague in the years leading up to the Civil War. Aftergut pointed out that Mullin appeared to endorse the caning attack in a candid interview following his outburst in the Senate. He also warned that "normalizing small acts of political violence can create the climate for big ones."

    Read Aftergut's full essay here.

‘Epidemic of violence’ targets transgender community, with at least 33 deaths cited in report

The Human Rights Campaign (HRC), the nation’s largest LGBTQ civil rights group, on Monday released its annual report on fatal violence against transgender and gender-nonconforming people in the U.S., describing the past year as an “epidemic of violence” targeting the community.

At least 33 transgender and gender-nonconforming people were killed in the past 12 months, according to Monday’s report, released on Transgender Day of Remembrance. An overwhelming majority were young people of color, with Black transgender women disproportionately impacted.

Most victims were killed by a friend, family member or romantic partner, the report said, and guns were involved in most cases. A 2022 report from Everytown for Gun Safety, a national gun control organization, found that known transgender homicides jumped 93 percent over four years — from 29 killings in 2017 to 56 in 2021 — and 73 percent involved a firearm.

“The epidemic of violence against transgender and gender-nonconforming people is a national tragedy and a national embarrassment,” HRC President Kelly Robinson said in a Monday statement. “Each of the lives taken is the result of a society that demeans and devalues anyone who dares challenge the gender binary.”

According to the group’s report, more than two-thirds — 69 percent — of all transgender and gender-nonconforming victims of fatal violence this year were Black, and 51 percent were Black transgender women.

People of color have made up the largest share of victims since 2013, when HRC began tracking such data and the FBI started reporting on hate crimes motivated by anti-transgender bias.

Since last year’s Transgender Day of Remembrance, Hispanic victims accounted for 21 percent of all deaths, according to Monday’s report, and white victims accounted for just more than 9 percent.

At least 335 transgender and gender-nonconforming people have been killed over the past decade, the HRC said Monday. The actual tally, however, is likely much higher, the group said, because “data collection is often incomplete or unreliable when it comes to violent and fatal crimes against trans and gender-nonconforming people.”

The FBI recorded 21 fatal hate crimes committed against transgender and gender-nonconforming people over the same period.

Robinson on Monday condemned recent acts of violence against the community and said legislation seeking to ban gender-affirming health care, prevent transgender people from using restrooms or locker rooms consistent with their gender identity and restrict talk of gender and sexuality at school has worsened stigma and created “a hostile environment that endangers the lives” of LGBTQ people.

More than 500 anti-LGBTQ bills were introduced this year in more than 40 states, according to the American Civil Liberties Union, and at least 84 became law.

The LGBTQ media advocacy organization GLAAD last week linked more than 700 incidents of violence and threats against LGBTQ people this year to anti-LGBTQ legislation and “lies and disinformation” about the community spread online.

All five major social media platforms received low or failing scores on an annual assessment of LGBTQ user safety released by GLAAD in June. The group’s report deemed X, formerly known as Twitter, “the most dangerous platform for LGBTQ people.”

“We must imagine a better future for transgender and gender-nonconforming people,” Robinson said Monday. “Not just surviving, but truly living as free and equal members of our society.”

‘I Will Come For You’: Court Filing Reveals Judge in Trump Case Received ‘Hundreds’ of Threats

A new court filing has revealed “hundreds of threatening, harassing, disparaging and antisemitic” threats made to Judge Arthur Engoron, who is currently presiding over the civil fraud trial of former President Donald Trump in New York and trying to get the gag order he imposed against Trump reinstated.

Trump already violated Engoron’s gag order twice, costing him $15,000. An appeals court paused the order last week, citing Trump’s “constitutional and statutory rights.” But the threats have caused serious security concerns for Engoron and his staff, especially his principal law clerk Allison Greenfield.

One voicemail, according to an affidavit filed by court officer Captain Charles Hollon, stated: “Trust me. Trust me when I say this. I will come for you. I don’t care. Ain’t nobody gonna stop me either.” Another said: “Resign now, you dirty, treasonous piece of trash snake. We are going to get you and anyone of you dirty, backstabbing, lying, cheating American. You are nothing but a bunch of communists. We are coming to remove you permanently.”

Hollon also wrote in his affidavit that Greenfield has been repeatedly doxed, resulting in, “on a daily basis, harassing, disparaging comments and antisemitic tropes. I have been informed by Ms. Greenfield that she has been receiving approximately 20-30 calls per day to her personal cell phone and approximately 30-50 messages per day.”

In asking for the gag order to be reinstated, attorney Lisa Evans said:

t is unquestionable that the conduct engaged in by Petitioners [Trump and his legal team] — the deluge of the court’s chambers phone and the law clerk’s personal cell phone, personal emails and social media accounts with hundreds of threatening, harassing, disparaging and antisemitic messages — which threatens the safety of court staff is the type of countervailing interest being served that warrants the imposition of the limited gag orders imposed by the Court.

Evans further argued, “The First Amendment does not prohibit courts from limiting speech that threatens the safety of the court’s staff. Courts have broad discretion to control the conduct of litigants and attorneys in ongoing proceedings.”

Trump has continued to lambast Engoron, Greenfield, and New York Attorney General Letitia James on Truth Social, as recently as Thursday, calling Engoron a “Psycho” and Greenfield a “Politically Biased & Corrupt Campaign Finance Violator.”

A Florida man’s social media posts threatening a mass shooting on the New York City subway landed him in jail, authorities said Friday.

Pinellas Park resident Robert Trout III, 19, posted a video of himself brandishing guns, and wrote: “If you’re from New York City do not take the train on Thursday evening,” said a report on WFLA, a Tampa TV station.

According to a police report, the video depicted Trout “handling firearms in a reckless manner,” WFLA said.

The firearms allegedly included two Glock .40 caliber pistols. Trout also claimed on the video to have 60 rounds of ammunition, the TV report said.

An anonymous tipster flagged the video to Pinellas Park cops. Trout’s mother was among those who identified him as being the person in the video, the TV report said.

Trout remained jailed Friday on an “FBI courtesy hold” after police charged him with threatening a mass shooting and unlawful use of a communications device, according to Pinellas County Sheriff’s Office records.

MTA officials referred questions about the arrest to the New York Police Department and Florida law enforcement authorities, who did not immediately respond to a request for comment.

Nov. 26 (UPI) -- Three students from Palestine who are studying at universities in the United States were shot in Vermont, including one shot in the back, Saturday night.

"Ramallah Friends School board, administration, staff and community are deeply distressed by the recent incident involving three of our graduates -- Hisham Awartani, Kinnan Abdel Hamid and Tahseen Ahmed," their alma mater in the West Bank said on Facebook.

"While we are relieved to know that they are alive, we remain uncertain about their condition and hold them in the light."

The school said that Awartani was shot in the back and Ahmed was shot in the chest, with Hamid suffering minor injuries. Awartani is an Ivy League student at Brown University. Hamid studies at Haverford University and Ahmed studies at Trinity College.

"My cousin Hisham has been shot in the back while walking with his friends in Burlington for simply wearing kuffiyehs and speaking Arabic," Basil Awartani posted on Twitter. "Dangerous performative rhetoric from U.S. pundits and politicians as well as constant dehumanization of Palestinians has a real-life cost."

The Council on American-Islamic Relations, the nation's largest Muslim civil rights and advocacy organization, said Sunday it was offering a $10,000 reward for information leading to the arrest and conviction of the person or people behind the shooting.

"CAIR also called on state and federal law enforcement authorities in Vermont to investigate a possible bias motive for the shooting," the civil rights organization said.

The shootings were confirmed by police to local news stations WCAX and WPTZ. It was not immediately clear if the attack is being investigated as a hate crime.

Police said officers received reports of multiple people shot around 6:35 p.m. on North Prospect Street and were taken to UVM Medical Center where they're being treated for non-fatal injuries.

The shooting comes amid a rise in hate crimes against Muslims across the United States, a phenomenon often categorized as Islamophobia -- though some say the label is not descript or critical enough to describe crimes against Muslims and people of Arab descent.

Tim Alberta, an evangelical Christian journalist who got his start at the conservative National Review, thinks something has gone seriously off the rails for many of his fellow evangelicals in the age of Donald Trump.

In an excerpt of his new book published in The Atlantic, Alberta details how he was accosted by MAGA fans at his own father's funeral over a recent book he'd written containing "unflattering revelations" about former President Donald Trump that had been criticized by the late Rush Limbaugh on his radio show in 2019.

Although some of the remarks people made to Alberta were done in jest, he said that others were overtly hostile in a way that left him shaken.

"One man questioned whether I was truly a Christian," Alberta writes. "Another asked if I was still on 'the right side.' All while Dad was in a box a hundred feet away. It got to the point where I had to take a walk. Here, in our house of worship, people were taunting me about politics as I tried to mourn my father."

Alberta brought this incident up briefly while delivering his father's eulogy and suggested to the audience that they would have been better off listening to sermons delivered by his father, who had been a priest, instead of listening to "garbage" spewed by Rush Limbaugh.

While Alberta at first questioned whether he'd gone too far in making this mention at the eulogy, he was further shaken when he was handed a note written by one of his father's longtime friends that accused him of "part of an evil plot... to undermine God’s ordained leader of the United States."
