Detention document of Jan. 6 attacker uncovers 'sleeper conspiracies': legal analyst

A detention memo is revealing startling details about those linked to Capitol attacker Marshall Neefe that include "a mix of fascist-curious, QAnon and guns," said legal analyst Marcy Wheeler.

The court documents outline Neefe's "history of extremist views and violent rhetoric," which led the court to consider making a “forward-looking determination about the serious risk."

Neefe expressed a desire for "civil war to settle political differences" and made statements about "committing violence against those he feels are pitted against him."

In a Nov. 4, 2020, conversation with someone named Brad Smith, Neefe expressed his heartbreak over Donald Trump's election loss.

“We all deep down knew this was how the election was going to go. Now if Trump wins the riots will be 50 times worse," said Smith.

Neefe replied, “Hope it burns either way.”

"Me to (sic)," Smith said. "This country needs to split up immediately."

“Why shouldnt we be the ones to kick it off?” Neefe replied.

The court documents note that on Nov. 6, 2020, a friend messaged Neefe asking, “Is Biden really going to win? How is the only question.”

Neefe told the person, “at this point it doesn’t matter who wins to me. Brad and I predict this goes go supreme (sic) court and trump (sic) gets the win, then the country goes to war. All jokes aside damned if we do damned if we don’t. This place is about to burn and we are getting a survival/escape plan together. Hence the maps.”

On Dec. 1, 2020, Smith told Neffe, “This wouldn't be happening if Germany won. I’m real close to liking full blown fascism. Fascism is one of the most lied about political ideologies ever and if you look it up it'll give you like 6 completely different definitions but we all know what it is. Its culture, heritage, family history, tradition. And Nobody hates a Communist more than a fascist lol.”

Neefe replied, “Id (sic) rather be a racist, fascist hate monger than a liar .”

Smith told him, “If this is what winning the war means then I’m a fascist.”

Neefe replied, “Hell id (sic)rather be a ni**er than a commie . . . These sick fucks really do need to start getting turned into mist.”

On Dec. 12, 2020, he posted a photo of an outdoor setting saying, "Out here lynchin that ni**er uncle ben as we speak."

Another user responded: "What tree you using?"

Neefe replied, "Rope on my bumper works wonders."

In another conversation about Sen. Mitch McConnell, Neffe claimed the Kentucky Republican needed "a bullet in the head."

"As reported in the FBI’s summary of that interview, Neefe said he was heavily influenced by QAnon conspiracy theories and that he and Smith discussed plans to travel to Washington within a month of Jan. 6, 2021," the document continues. "He admitted making a wooden club with an American flag stapled to it to take Washington to serve as a barrier between himself and 'possible Antifa.'"

Multnomah County prosecutor charges suspected park shooter with murder

The Multnomah County District Attorney’s Office filed murder and attempted murder charges Tuesday for the man suspected of shooting five people at a park in Northeast Portland on Saturday night.

Benjamin Jeffrey Smith, 43, allegedly confronted participants at a racial justice demonstration Saturday night before pulling out a handgun and shooting multiple people in the crowd, according to witnesses and prosecutors. Brandy “June” Knightly, 60, was killed and four others were injured.

A member of the crowd shot Smith, who remains hospitalized and in critical care.

In seeking an arrest warrant, prosecutors have charged Smith with one count of second degree murder, four counts of attempted first degree murder with a firearm, as well as four counts of assault with a firearm.

Court records filed Tuesday also state that one victim was “paralyzed from the neck down.” Three other victims were also shot in multiple places. One remains hospitalized. Two others have been treated and released.


Prosecutors say video of the incident shows Smith approaching a group of demonstrators who had gathered that night near Normandale Park to protest police violence.

“(Smith) approached the demonstration and confronted several of its participants, yelling at them and demanding they leave the area,” prosecutors wrote.

Video then allegedly shows the group telling Smith to “leave them alone and return home.”

“(Smith) responds by demanding they ‘make’ him leave and he approaches a participant aggressively, who pushes him back. (Smith) continues to yell at participants and a few moments later, (Smith) draws a handgun and fires at multiple people, striking five,” the prosecutors stated.

The shooting ended when a person with the group of demonstrators shot Smith in the “hip area,” critically wounding him. Law enforcement originally charged that person with first degree assault and unlawful use of a weapon, both felonies. The Multnomah County District Attorney’s Office ultimately decided to bring “no complaint” against the person “based upon our review of facts and evidence.”

OPB has chosen not to name the person because they have not been charged with a crime, and they did not respond to multiple requests for comment. Court records show the person is licensed to conceal carry a firearm.

Portland Police Officers have remained at the hospital with Smith since the shooting and subsequent surgery, court records state.

Three white supremacists plead guilty in plot to attack US power grid -- and spark a 'race war'

The United States Department of Justice announced on Wednesday that three avowed white supremacists have pleaded guilty to plotting to attack the United States power grid.

According to the DOJ, Christopher Brenner Cook, 20, of Columbus, Ohio; Jonathan Allen Frost, 24, of West Lafayette, Indiana, and of Katy, Texas; and Jackson Matthew Sawall, 22, of Oshkosh, Wisconsin, all pleaded guilty this week to one count of conspiring to provide material support to terrorists.

The DOJ alleges that the plot was first hatched in 2019, when Cook and Frost began discussing it after meeting in an online chat forum. Sawall was recruited to join them shortly afterward, the DOJ alleges.

"As part of the conspiracy, each defendant was assigned a substation in a different region of the United States," DOJ claims. "The plan was to attack the substations, or power grids, with powerful rifles. The defendants believed their plan would cost the government millions of dollars and cause unrest for Americans in the region. They had conversations about how the possibility of the power being out for many months could cause war, even a race war, and induce the next Great Depression."

Assistant Director Timothy Langan of the FBI’s Counterterrorism Division said in a prepared statement that the three men "wanted to carry out such a plot because of their adherence to racially or ethnically motivated violent extremist views."

A leader of the far-right group Proud Boys was charged with assault on Sunday after he was caught on video shouting racial slurs at a Black woman and then punching her in the face, HuffPost reports.

Andrew Walls, 26, was reportedly drunk outside of an Ohio bar and was seen scuffling with other patrons while spewing racial slurs. At one point, his victim, 23-year-old Cameron Morgan, passed by with a friend when she heard Walls and others around him screaming “Fucking n*****s.”

“We were like ... ‘You can’t say that. That’s not OK,’” she told her dad, local teacher and former sportswriter David Lee Morgan Jr., who recorded the conversation and provided a transcript to HuffPost.

In the video, Walls points his finger at Morgan, calls her the N-word and then says, “B****, shut your mouth,” and punches her directly in the face. According to Morgan's father, Walls also dragged her into the street by her hair.

As the video circulated online, it was discovered that Walls is the vice president of the Akron-Canton chapter of the Proud Boys.

Walls was charged with possessing a firearm while intoxicated and assault. A warrant was issued for his arrest. Morgan's injuries may lead to his assault charge being upgraded to a felony, the Akron Beacon Journal reports. He could also be charged with ethnic intimidation charge.

A newly released video shows at least two men accosting Nevada Gov. Steve Sisolak and his wife at a Las Vegas restaurant.

The confrontation appears to have taken place at the Lindo Michoacan restaurant, although the date is unclear, and the video shows a man with a shaved head and a beard approach the governor and put his left arm around him, reported the Las Vegas Review-Journal.

“I can’t tell you what a piece of f*cking sh*t you are,” the man says, as Sisolak says he's sorry to hear that and steps away. “You New World Order traitor piece of sh*t b*tch. You’re in here without security?”

The man continues ranting profanity at the governor as he exits the restaurant with his wife Kathy, and a second man joins the harangue.

“I want to second that,” the second man says. “You’re a traitor. You should go down for treason, and I hope you hang.”

The two men keep taunting Sisolak and making references to hydroxychloroquine, an anti-malarial drug that some conservatives believe is a cure for COVID-19, and China.

“I’m surprised you have the balls to be out here in public, punk,” the first man says. “Out here without a cop. Out here without security. Wooo. You got balls on you, boy. I’m not moving.”

Another man is then shown outside the restaurant ranting about treason, but it's not clear whether he's the second man or a third, and the first man continues to threaten the governor with hanging.

“We should string you up by a lamp post right now, pussy boy," he says. “You running into a patriot now. Huh? Huh? Where’s your security at?”

And I seen the video, on the local news station, which is very much out of context which is the way they want it.

Walls says he was jumped and they ran, which is very believable to me, Walls had what looked to me like a bloody mouth before he hit the girl.

Now, I have never hit a woman in my life...even when they deserved it.

Walls certainly had some cold ones, and he certainly was angered by something...prior to the girl, who didn't have much bruising afterwards...something provoked this long before the released out of context video.

That area is known for College kids and heavy drug use/sales, it's a great place to visit while the sun is still up, but when the sun goes down...one should expect some shenanigans.

Oath Keeper says Stewart Rhodes told him to be ready to use 'lethal force' to stop Trump from being removed

On Wednesday, Josh James, one of the 11 Oath Keepers charged with seditious conspiracy in connection with the January 6 Capitol insurrection, accepted a plea agreement in a major turning point for the criminal proceedings relating to the event.

But according to CBS News' Scott MacFarlane, the key reporter covering the January 6 cases, James' plea deal involves giving deeply incriminating evidence against Oath Keepers leader Stewart Rhodes, also charged in the conspiracy — including an allegation that he instructed his followers to be ready to kill anyone, even members of the Armed Forces, who sought to remove President Donald Trump from office.

"In the weeks leading up to January 6, 2021, Rhodes instructed James and other coconspirators to be prepared, if called upon, to report to the White House grounds to secure the perimeter and use lethal force if necessary against anyone who tried to remove President Trump from the White House, including the National Guard or other government actors who might be sent to remove President Trump as a result of the Presidential Election," said the plea deal signed by James.

The Oath Keepers are a far-right paramilitary group consisting mainly of current and retired military and police officers, who swear to refuse to enforce any law or directive that conflicts with the group's extremist interpretation of the Constitution.

The group was active on the Capitol grounds during the January 6 attack, where they formed military "stacks" that charged into the building. They have claimed that the stacks were only activated in response to the shooting death of rioter Ashli Babbitt by Capitol Police, although time stamps prove they began their assault before the shooting occurred. A separate video shows Oath Keepers escorting Trump ally Roger Stone in D.C. earlier in the day, raising questions about how linked they are to members of the former president's inner circle.

Rhodes himself, who maintains his actions were not criminal, has been denied pretrial release after a judge determined he was a "clear danger." His estranged wife has testified against him, noting that he built "elaborate escape tunnels" in his backyard.

Woman pulls gun on motorist after she became angry over his pro-vaccination bumper sticker

A New Mexico woman is accused to pulling a gun after she was apparently upset my a motorist's pro-vaccination bumper sticker, WFLA reports.

Police say Christina Blair, 33, also threw water bottles at the other driver, but things escalated when he accidentally backed into her car while trying to avoid her. She then allegedly followed him to a Walgreens and pulled a gun on him.

Blair admitted to police that she initiated the incident over the bumper sticker, but claims that she only pulled a gun because she was in fear for her life.

Prominent New Mexico lawmaker arrested, charged with drunken driving (yahoo.com)

SANTA FE – Prominent Democratic state Rep. Georgene Louis of Albuquerque has been arrested and charged with drunken driving, the Santa Fe police department said Monday.

Louis, an attorney and rising figure among Indigenous legislators, was arrested shortly after midnight on charges of aggravated drunken driving and driving without proof of registration and insurance, police said.

Santa Fe police spokesman Ben Valdez said that Louis was driving on a main street in the state capital city of Santa Fe when a police officer pulled her over for speeding late Sunday night.

A field sobriety test and breath test “supported the suspicion of impaired driving,” Valdez wrote in an email.

Louis did not immediately respond to text and voice messages Monday. It’s unclear if she has legal representation.

The arrest took place during the frenetic final days of a 30-day annual legislative session.

A legislative committee chaired by Louis canceled a Monday morning hearing just hours after Louis was booked at a local jail.
