    In a November 27 legal filing submitted to the Colorado Supreme Court, attorneys representing former President Donald Trump made a unique argument in justifying that the US Constitution's insurrection clause doesn't apply to their client.

    The clause, which is in Section Three of the 14th Amendment, states that "No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof." Trump's legal team argued that as president, their client is exempt from that language.

    "The framers excluded the office of President from Section Three purposefully. Section Three does not apply, because the presidency is not an office 'under the United States,' and President Trump did not take an oath 'to support the Constitution of the United States,'" the filing read.



    The filing also argues that the events of January 6, 2021 did not constitute an insurrection, even though Trump supporters attacked the US Capitol in an attempt to disrupt Congress' official certification of the 2020 presidential election in an hours-long riot that left several dead and hundreds more injured.

    "Wow in a legal proceeding trump is now arguing he didn’t violate the 14th Amendment by inciting the Jan 6 insurrection because he 'never took an oath to support the Constitution of the United States,'" Rep. Bill Pascrell (D-New Jersey) tweeted. "This treacherous criminal is head of the republican party."

    Trump did in fact take such an oath. The presidential oath of office — which all presidents take on Inauguration Day — explicitly mentions the Constitution.

    "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States," the oath reads.

    The matter before the Colorado Supreme Court concerns an attempt to remove the former president from the 2024 ballot on the grounds that he is ineligible under the insurrection clause due to Trump's involvement in the January 6 riot. While a judge ruled in Trump's favor, that decision has been appealed by watchdog group Citizens for Responsibility and Ethics in Washington.

    But brain damage apparently prevented some Leftards who cited this oath, from actually understanding that the Presidential oath implicitly impies the word 'support.'

    In their appeal against the Colorado lawsuit, Trump's lawyers reiterated that the wording of Section Three does not apply to people running for president and that Trump technically did not swear an oath to "support" the Constitution. Instead, during his January 2017 inauguration, Trump swore to "preserve, protect and defend" the Constitution during his role as president.

    Donald Trump on Tuesday evening suggested MSNBC should be hit with government force for its "illegal political activity" in the course of reporting news related to the ex-president.

    Without citing which interview or report caught his attention, the former president took to social media to slam the news network and its CEO.

    "MSNBC (MSDNC) uses FREE government approved airwaves, and yet it is nothing but a 24 hour hit job on Donald J. Trump and the Republican Party for purposes of ELECTION INTERFERENCE," Trump wrote on Truth Social. "Brian Robert’s, its Chairman and CEO, is a slimeball who has been able to get away with these constant attacks for years."

    Trump further alleged that the network "is the world’s biggest political contribution to the Radical Left Democrats who, by the way, are destroying our Country."

    He then added.

    Overnight, amid a flurry of social media posts, Donald Trump demanded President Joe Biden weaponize the federal government to "come down hard" on a news media outlet to benefit the indicted ex-president's 2024 political campaign. While attacking the press is part of Trump's regular tactics, this time he's getting widely criticized for his thinly-veiled threat he will do what he's demanding of Biden if he retakes the White House.

    The First Amendment is clear, and numerous rulings have shown the federal government cannot censor or dictate how or what the free press reports. It can, and has, asked for coverage of a story, and can direct a news outlet's attention to an issue, but it cannot stop the media from reporting on a presidential candidate.

    And yet, that's exactly what Donald Trump demanded President Joe Biden do.

    "MSNBC (MSDNC) uses FREE government approved airwaves, and yet it is nothing but a 24 hour hit job on Donald J. Trump and the Republican Party for purposes of ELECTION INTERFERENCE," Trump claimed very late Tuesday night. "Brian Roberts, its Chairman and CEO, is a slimeball who has been able to get away with these constant attacks for years. It is the world’s biggest political contribution to the Radical Left Democrats who, by the way, are destroying our Country."

    "Our so-called 'government' should come down hard on them and make them pay for their illegal political activity. Much more to come, watch!" Trump wrote.

    Critics immediate focused on the fact that MSNBC is a cable news outlet that does not use what Trump called the "free government approved airwaves" (which are not free, broadcasters pay licensing fees.)

    Pulitzer Prize-winning investigative reporter David Cay Johnston, who has written several books on Trump, called it "a perfect example of Donald's appalling ignorance."

    Also pointing to Trump's false claim of MSNBC using "free government approved airwaves," former New York Times media reporter Bill Carter noted Trump's "ignorance is worse than the puerile name-calling."

    "He’s ranting mindlessly," Carter observed, noting Trump "has several cable nets that are full-time propaganda channels for him."

    But the larger concern expressed was not that Trump does not understand the difference between broadcast and cable TV, but that he does not understand the U.S. Constitution.


    "Thank goodness for the First Amendment, which gives the American people, the private sector and the free press the right to tell the former President to shove it," wrote U.S. Rep. Ted Lieu (D-CA). "If Trump is going to say or do stupid stuff, or authoritarian crazy stuff, the press has the right to expose it."

    Former Obama Administration senior advisor and campaign chief strategist David Axelrod wrote, "I think we owe it to Trump to take his words seriously. He would use the power of government to punish media outlets who do critical reporting about him. Where are those who speak reflexively about fidelity to the Constitution but apparently have not read it?"

    Former CNN chief media correspondent Brian Stelter responded to Axelrod's post, writing: "Slight revise: Trump repeatedly did use the power of government to punish media outlets, and he can't wait to do it again."

    Politico White House Bureau Chief Jonathan Lemire, who is also an MSNBC host, wrote: "Trump again threatening to use the power of the government against media he believes is being critical of him: 'More to come, watch!'"

    Gen Z speaker, writer, podcaster, and organizer Victor Shi noted Trump is calling for "MSNBC — which does NOT use free government-approved airwaves — to be dismantled by the government. Joe Biden does not say this about Fox, because he values democracy. Trump does NOT."

    Shi, adding other Trump overnight posts to his commentary, observed: "So, over the span of one night, Donald Trump called for the government to shutdown MSNBC because they don’t cover him 'favorably' & called for Obamacare to be gutted AGAIN. This isn’t how leaders [in a] democracy behave. This is how fascists act—& we must be alarmed."

    “We should be very concerned about the real threat, again, to democracy…if we elect him into office again,” says Markus Batchelor, political director at People For the American Way.

    Political experts say Black and brown communities should have serious concerns after former President Donald Trump renewed calls to send military troops to Democratic-controlled cities to address crime if he were to return to the White House.

    “There’s no dog whistle…it’s full-on dog barking,” warned political scientist Christina M. Greer.

    While on the campaign trail in Iowa this year, Trump said he was prevented as president from using his executive powers to use military units to combat crimes and violence in cities led by Democrats.

    In a hypothetical second term, the leading Republican presidential candidate suggested he would not again fold to pushback from within his administration or military leadership.

    “The next time, I’m not waiting,” he said, as reported by the Associated Press. He added, “We don’t have to wait any longer.”

    Trump has long called out cities such as New York, Washington, and Chicago for being “crime dens” where city leaders are unable to address the violence and crime occurring under their watch.

    Greer, a Moynihan Center Public Scholars fellow at CUNY, said it should be no surprise that Trump has a particular vendetta against so-called liberal cities.

    “We know that many of these cities are run by Black people, people of color or women,” she told theGrio.

    Greer added, “He and Republican Party members and, sadly now, conservative slash moderate Democrats are using the same dog whistle to say danger in urban centers means dangerous Black people and Latinos.”

    While serving as president during the Black Lives Matter uprisings in 2020, Trump deployed the National Guard to use tear gas and rubber bullets on protesters in Washington, just feet away from the White House.

    Markus Batchelor, national political director at People For the American Way, said Trump’s actions and rhetoric should be enough to show the American public what he is capable of doing if elected back in office in 2024.

    “At this stage, he’s telling us what he will do if he’s in the White House again,” Batchelor told theGrio. “I don’t think he’s being coy about it at all.”

    The political organizer said that in addition to the threat of militarization in Black communities, Trump poses a broader and very real threat to America’s democracy as we know it.

    “We should be very concerned about the real threat, again, to democracy, to the rule of law, and whether we’ll lose democracy if we elect him into office again,” said Batchelor.

    Though presidents have legal authority under the Insurrection Act to call on reserve or active-duty military to respond to unrest in states, political experts and historians have warned against the type of deployment suggested by Trump.

    “To deploy the military, especially without local authority or local request, is a huge threat to democracy and to liberty,” said Batchelor.

    “He’s doing what sort of dictators do in various countries where the military and the police force essentially work for you personally at your beck and call,” explained Greer, “which is the antithesis of what our military is supposed to do.”

    The political scientist warned that, if elected, Trump would likely change the military structure by appointing leadership positions to “sycophants and loyalists.”

    “Then we actually are in the scenario that he just laid out, which is the military then acts directly on behalf of the president and his whims – and not for the good of the country,” said Greer.

    She said Trump’s strategy if he can’t win at the ballot box is to “take the country by force,” which he almost succeeded in doing with the insurrection attack on the U.S. Capitol on Jan. 6, 2021.

    She added, “I don’t think enough citizens or media outlets believe in the capacity of Donald Trump or his followers.”

    The threat of Trump’s undemocratic norms aside, Batchelor noted that when People For the American Way engages with communities in urban cities, they often raise concerns about public safety.

    “The fact is there’s a real anxiety in cities,” said Batchelor, who fears those concerns could feed into the rhetoric of Trump and Republican politicians.

    “We just have to make sure people don’t turn to those extreme messages because they don’t find solutions and kind of the principled leadership that we’re trying to offer on our side,” he explained.

    Batchelor urged President Joe Biden and Democrats to pay attention to concerns about public safety, particularly Black communities that are “frustrated” by crime and economic insecurity.

    “These communities need results,” he said.

    Batchelor noted that Republicans have managed to pivot away from criticisms about the GOP’s refusal to work with Democrats to enact stricter gun control legislation. Instead, he said they are trying to steer the national conversation toward broader crime.

    “They need to see the president and the Congress fighting more forcefully for an assault weapons ban,” he argued. “The Democrats have to get their message together so that this kind of hyperbolic rhetoric about crime doesn’t hurt their chances of being able to deliver.”

    However, Greer noted that the data doesn’t necessarily back up Republicans’ claims that crime is on the rise.

    “The data shows that crime is going down in most places, but the perception that it’s going up hasn’t changed,” she said.

    Greer acknowledged that crime data is “complicated.” For example, while recently released FBI data shows that some crimes like property crimes and car thefts have increased, violent crimes and murder have decreased and returned to pre-pandemic levels.

    “People just believe crime is up, and they see the quality-of-life issues around them,” said Greer, “and so they believe that the country is going in that direction, but the data does not bear that out.”

    She added, “It doesn’t really matter sometimes where reality is if the perception is something that’s the opposite.”

    Two months after a prominent conservative activist and fundraiser was caught hosting white supremacist Nick Fuentes, leaders of the Republican Party of Texas voted against barring the party from associating with Nazi sympathizers and Holocaust deniers.

    In a 32-29 vote on Saturday, members of the Texas GOP’s executive committee stripped a pro-Israel resolution of a clause that would have included the ban— delivering a major blow to a faction that has called for the party to confront its ties to groups that have recently employed, elevated or associated with outspoken white supremacists or antisemitic figures.

    In October, The Texas Tribune published photos of Fuentes, an avowed admirer of Adolf Hitler who has called for a “holy war” against Jews, entering and leaving the offices of Pale Horse Strategies, a consulting firm for far-right candidates and movements. Pale Horse Strategies is owned by Jonathan Stickland, a former state representative and at the time the leader of a political action committee, Defend Texas Liberty, that two West Texas oil billionaires have used to fund right-wing movements, candidates and politicians in the state — including Lt. Gov. Dan Patrick and Attorney General Ken Paxton.

    Matt Rinaldi, chairman of the Texas GOP, was also seen entering the Pale Horse offices while Fuentes was inside for nearly 7 hours He denied participating, however, saying he was visiting with someone else at the time and didn’t know Fuentes was there.

    Defend Texas Liberty has not publicly commented on the scandal, save for a two-sentence statement condemning Fuentes’ “incendiary” views. Nor has it made clear what role Stickland has at Defend Texas Liberty, which quietly updated its website to reflect that he was no longer its president in October.

    Tim Dunn, one of the two West Texas oil billionaires who funds Defend Texas Liberty, confirmed the meeting between Fuentes and Stickland and called it a “serious blunder,” according to a statement from Patrick.

    In response to the scandal — as well as subsequent reporting from the Tribune that detailed other links between Defend Texas Liberty and white supremacists — nearly half of the Texas GOP’s executive committee had called for the party to cut ties with Defend Texas Liberty and groups it funds until Stickland was removed from any position of power, and a full explanation for the Fuentes meeting was given.

    The proposed demands were significantly watered down ahead of the party’s quarterly meeting this weekend. Rather than calling for a break from Defend Texas Liberty, the faction proposed general language that would have barred associations with individuals or groups “known to espouse or tolerate antisemitism, pro-Nazi sympathies or Holocaust denial.”

    But even that general statement was not enough to sway a majority of the executive committee. In at-times tense debate on Saturday, members argued that words like “tolerate” or “antisemitism” were too vague or subjective, and could create future problems for the party, its leaders and candidates.

    “It could put you on a slippery slope,” said committee member Dan Tully.

    Supporters of the language disagreed. They noted that the language was already a compromise, didn’t specifically name any group or individual and would lend credence to the Texas GOP’s stances in support of Israel.

    “To take it out sends a very disturbing message,” said Rolando Garcia, a Houston-based committee member who drafted the language. “We’re not specifying any individual or association. This is simply a statement of principle."

    Other committee members questioned how their colleagues could find words like “antisemitism” too vague, despite frequently lobbing it and other terms at their political opponents.

    “I just don’t understand how people who routinely refer to others as leftists, liberals, communists, socialists and RINOs (‘Republicans in Name Only’) don’t have the discernment to define what a Nazi is,” committee member Morgan Cisneros Graham told the Tribune after the vote.
